Well heres an update:

I called USCIS on the first petition and I was told that the case is closed and that I have done nothing wrong. The man I spoke to said he doesnt see why my case would be in AP seeing that I have done everything correctly and gave them the divorce decree. He did say I should call NVC and let them know that I am divorced. The only thing that the embassy can say is about the age difference - but then basing my petition based on age difference could be discriminating. Gave them over 4 years of evidence so I will be on the lookout for the next month to see if things change and if not then I will contact them to see what is going on and perhaps attempt to talk to the CO himself.

I will not give in cause I feel that if there is a will there is a way and I do know how to talk to superiors and supervisors if I have to.

I want to thank everyone for their advice, support, suggestions and experience. It TRULY means a lot to me and Faycel. I will be keeping that candle of hope lit, cause it aint over yet. I have just begun to fight.

Yes I did file on behalf of my now ex husband (he was a lawyer in his country) and now here I am filing again on behalf of my fiance. Sure that will raise some questions and concerns and it should. I understand why its in AP. I work in law and I even have some homeland security/ICE agents as clients. I'm ok with them taking the extra step on reviewing my case. I have nothing to hide. When I got in law I took an oath to report any wrongdoing and/or crimes.

I see the red flags and am aware of what they are thinking, but all I can say is bring it on. There is no fraudulent activity in my petitioning my fiance and I will fight to the bitter end on getting him home. I do hope that they grant his his visa cause I refuse to go thru any more then I should.

I have heard that if they take his passport its a good thing, but is it?

Inshallah I hope to hear good things soon.

Let me throw this out - my ex was given his 10 year green card when he arrived because we were married 2+ years he was no longer considered a CR1 but a IR1

My ex was given his green card 1 week after he got here because at the time of his interview we had been married 2+ years already. He arrived in the states in 2011 and 2 months after he arrived I saw that the relationship was not the same and I filed for divorce.

Ok not sure where to post this topic but Im hearing mixed things and maybe someone can give me an idea.

We had our appointment with the embassy and my fiance answered all the questions without batting an eye. The CO took his passport but has place us in AP because they want to see the previous petition I did.

The first petition was done in 09 and it was a I-130. I ended up divorcing and now filed a K1 petition.

I have submitted the documents that they requested and will wait 30 days before contacting them to see what is the status (CEAC site still says its in AP).

Any thoughts, experience or suggestions from others that had their passports taken or have been in a similar situation.

Summary: we had our interview and was given a 221 (g) because they wanted information on my previous petition for my ex husband. I have them what they wanted and last night I got an email for the embassy indicating that they have received my documents and that it was forwarded to the consulate for review and that my fiancé would be notified so this morning I checked the CEAC site and got the above status.

Does this mean that they are processing is application and that he is approved?

Dont stress. Give them the information they require ASAP. Keeping the passport is a good thing at this time. Just give them the info,,,,,,,,,,Hurry

Well just a quick update: NVC got our file and now I have a case number WOOO HOOO!

I asked if we were still going to keep our appt with the embassy and she said that they should be sending our file in the next couple of days and that the embassy would have the file before our appt date

Keeping my fingers crossed and praying for a great outcome.

yep i got that email, Faycel filled out the DS160 online and we got confirmation of the appt with the embassy and a receipt for Online Non-immigrant Visa Application (DS-160).

Now I got an email from the NVC that stated that they have not received our file and to scan and email the I797 which I did last night. I spoke with a guy there and he indicated that they have NOT received our file but I got an appointment with the embassy then to just go forward with the appointment. He indicated that it take 6-8 weeks for NVC to get a file. He said he doesn't know how we got an appointment with the embassy without a case number (good question)

Luckily I made another package to take to the interview so hopefully all will work out for us.

Hoping your day goes well. I'll be waiting to hear the word APPROVED! Thanks for your input

Yes the interview is set for Dec 16 th. I submitted the AOS and tax docs at the time if filing the petition, in fact all the needed docs were filed with the petition. The embassy did send an email indicating what to bring at the time of interview. When I traveled to Tunisia a couple of weeks ago I brought a copy of the file plus additional docs for him to take to the interview. The only thing I think I need to do is the DS 156 & DS 156k.

I will see if there is anything else but I'm sure I got it all. Thanks for your input.

Yes our case was processed quickly that I will admit, but I filed everything in with the petition. You name it, it was sent. I was not going to have to have a bunch of RFE's sent to me, so I played it smart and I think that is why we got thru this fast.

The only thing I did forget was 2 passport pics of me which I sent out immediately.

So I quess I shouldnt have to worry about NVC since we already have our appt with the embassy?

Hello VJ Family!

I really need some clarification. When Faycel was approved by USCIS I began contacting the embassy in Algiers to schedule an appointment, as well as the NVC. I was under the impression that I had to pay the 240 for the visa, but the embassy sent us a response that at the time of the appointment the visa fee is to be paid.

Ok before I get ahead of things, let me give you the scoop: Faycel made his appointment with the Algiers embassy for his K1visa appt, which is set for December 16, 2013. At the same time I was writing all these places, NVC responded with this (after we got the appointment in Algiers)

Dear Sir/Madam:

Thank you for your inquiry. The National Visa Center has not received your petition from U.S. Citizenship and Immigration Services (USCIS). Please scan and email your I-797 or I-171 Notice of Action to

nvcresearch@state.gov. Type the receipt number in the subject line of your email. We will contact USCIS on your behalf to find your petition.

K1 interview jitters

Ok so heres the deal once again............

Our file is now at the embassy in Algiers (YAY). The hubby to be made an appointment before we knew the file was at the embassy. He filled at the DS160 and proceeded to make the appointment (which is December 16th).

Now about a week ago I got the confirmation (finally) that they got the file via email and they attached a list of doctors to the email (which is set for December 8th). When writing them I also attached the embassy appointment confirmation to the email.

There has been no word of them changing the appointment. We are thinking that since they did not give us the appointment that they may change it. I called the embassy and talked to a very nice lady there but kinda forgot to ask her about this and I want to call them again, but I dont want them to find me as a nuisance.

Has anyone made an appointment before their file was actually at the embassy?????

Are we freaking out for no reason?

Getting social help affect citizenship?

Hello Henia,

Ive been told that if someone is on section 8 that getting an approval is hard because how can you show or provide proof that you are capable of caring for someone else.

The idea is to prove that the beneficiary can be taken care of and if someone is on welfare or receiving section 8 already says hey I cant take care of myself and the government is helping me. It also says that I depend on the government and so will my spouse. Its a government burden.

The one thing I hear is that they want that the beneficiary be NOT DEPENDENT on the government.

Just called NVC, Now its taking 8 weeks for a case #?

Just called tonight, and the rep told me the 8 week deal too. What was different was he asked me to read the first 2 sentences of my approval letter, and he then ask for the approval date. I After giving him the information, I told him I was originally told 15 business days, and that this is the 15th day. He then went on to tell me that they are now saying up to 8 weeks for a more realisitic timeframe. Kind of disappointing but he did encourage me to call daily.
