You are right, K1 is a Fiance visa. However I am not planning on registering my marriage when I get married in India. I will only prove that I got engaged. This should enable me to bring my fiance to the U.S. on a K1 visa.

This is with regards to filling for a K1 Visa for my Fiancé (Do note that I am a U.S. Citizen and my fiancé is an Indian Citizen). I met my fiancé online and have been conversing with her over the phone and e-mail (I know that I can use this evidence when filling for a K1 visa). I am planning on getting married to her in the month of Jan, 2009 in India itself, and then coming back to the U.S. and filling for the K1 visa.

There are a few questions I have with regards to the filling process -

Documents I need to collect and send over to the "California Service Center" are -

*Cover Letter that mentions the contents in the packet.
*Check made out to "U.S. Department of Homeland Security" in the amount of $455
*I-129F filled and signed by me (A typed page documenting how we met in person in last two years).
*Copy of front and back of "Certificate of Naturalization"
*Letter of intent filled by me and my fiancé' that we intend to marry within the 90 days of her admission in the U.S.
*Additional evidence (E-mails, phone logs, phone bills, photos, airline tickets etc) to prove we met in person.
*Completed and signed Form G-325A from me and my Fiancé.
*Passport-style color photograph of me and a passport-style color photograph of your fiancé (e), with both photos taken within 30 days of the date of filing this petition. (I have read on VisaJourney’s Step by Step guide to place this in a small plastic bag and attach it to a white sheet of paper, what's the purpose of doing that and if that is required?).

Now the waiting game starts, I should receive a confirmation from the office when my application gets touched and approved and when it is sent to the NVC and when the NVC sends the documents to the consulate (Do let me know if this is correct).

As I get the confirmation, I start preparing my I-134 (Affidavit of Support) and send it to my fiancé in India; moreover I will provide her with evidence of our ongoing relationship as proof of our relationship.

Some questions -

Documents she will need for an interview are -

*A passport valid for travel to the United States and with a validity date at least six months (Which she has at the moment).
*Birth certificate (If she does not have one, where can she get this document?)
*Medical examination (When is she required to take one, how will she know?)
*Form I-134, Affidavit of Support (Can I use my house as an Asset when filling the form?)
*Two Nonimmigrant Visa Applications, Form DS-156 (Both the forms need to be filled by the fiancé or does it need to be filled by me and my fiancé?)
*One Nonimmigrant Fiancé (e) Visa Application, Form DS-156K (Filled by my fiancé)
*Two nonimmigrant visa photos (Of my Fiancé)
*Evidence of a fiancé relationship
*Payment of fees (I believe you have to pay the fees before you can even schedule a date for the interview).

Do keep me posted, as this is my first time and any help or advice will be very helpful.

This is my situation, for which I would like to get some advise - I met this girl, whom I am planning to get engaged with in India during the December timeframe. At the present moment she is working for a multi national company in India as a Software Engineer. My plan is to get engaged come to the U.S. and file for a K1. However I have also asked my would be Fiance to ask her employer if she can come to the U.S. on a H1-B working Visa. Her employer has told her, that he may be able to do something for her (However getting a H1-B visa takes about 3 months time). Now after getting engaged with her and coming back to the U.S. and filling for a K1, if during this process her employer starts the H1-B process as well and she gets the H1-B visa. Can both the processes (K1 and H1-cool.gif go side by side? Also after her coming to the U.S. on a H1-B, can I get married to her and change her status?

Do provide your advise.

SabrinaFrance - Based upon my readings and findings, I cannot apply before the engagement, as I need proof to show to USCIS and Embassy that I have met my fiance in person (That is a requirement, makes the approval faster).

Otto und Karin - Thanks for your input, I am surprised the government does not allow for a change in status from K! to CR1 (Even though they are completely different). I will apply for a K1 nonetheless and see how things go.

There is definitely a wealth of information on this site; however I have been trying to find the following information that relates to my situation and am unable to find that. I am hoping someone can help me with the following situation –

I am a U.S. Citizen getting engaged to a girl in India during the month of November, 2009. Right after I get engaged, I am going to file for the K1 Visa for my fiancé. I understand and have seen that it has taken some individuals at least a year’s time before their fiancé could enter the U.S. However in some situations it has taken 5 to 6 months. This is fine. However in April of 2010, I will be getting married. During this time, my application will be in K1 status, how easy is it to change the status from K1 to CR1. Is this the best way to go? What are the steps to make the change from K1 to CR1?

Also I have started compiling all the documents relating to K1, I have a few questions regarding the following –

After my I-129F applications gets approved and forwarded to NVC, the following forms have to be filled –

• Two Nonimmigrant Visa Applications, Form DS-156 (A Form DS-156, prepared in duplicate.) Does the Petitioner have to fill this out as well?
• One Nonimmigrant Fiancé(e) Visa Application, Form DS-156K I am under the understanding this is filled out by the beneficiary.
• Two nonimmigrant visa photos (each two inches 50 X 50 mm square, showing full face, against a light background) – Photos must be of the beneficiary’s (My fiancé’s right!).

I am happy to say that I have mailed my I-129F Petition for my fiancée yesterday to the California Service Center. Now the waiting starts, moreover I am reading on the next steps after NOA2 gets approved. I have the following questions, I am hoping the Visa Journey community can help me out -

After the NOA2 gets approved, the following is what needs to be done -

• A complete copy of the I-129F packet that was sent to California Service Center be sent to my fiancée. These would consist of the original documents.
• Original letters certifying an intent to marry within the 90 day period (Date and Sign it).
• I-134 Affidavit of Support.
o Two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position.
• A copy of NOA2 that I received in the mail.
• Proof of on-going relationship.

However the consulate in India will send the following documents to my fiancée that she will have to fill out prior to the interview –

• Medical examination (vaccinations are optional, see below) – Can she get the vaccinations done right now, or does she need to wait till she gets the documents from the consulate. What vaccinations does she need to get, are there specific vaccinations that she should get!
• Two Nonimmigrant Visa Applications, Form DS-156 (Both filled out by my fiancée)
• One Nonimmigrant Fiancé(e) Visa Application, Form DS-156K (Filled out by my fiancée)
• Two nonimmigrant visa photos (My fiancée’s visa photos)
• Evidence of a fiancé relationship (Proof of on going relationship)

Hi All,

Can someone tell me if I am on the right track.

I will have a co-sponsor when filling out form I-134 form and sending the documents over to my Fiance (Based in India).

In terms of documents I have taken copies of my past 3 years tax returns and copies of W2's and 1099's for the past three years as well. I have also listed my house value on the I-134 document (Remaining mortgage amount).

For the Co-Sponsor - I will have them filling out a separate I-134 form. As well will include their tax returns. I know more information the better, however is it ok to have 1 years tax returns or show 3 years for the co-sponsor.

I will be taking going to the bank come Monday, and will be taking banking information. In terms of when I opened the accounts, the balance in my Checking and Savings. What form needs to be notarized? Is it the I-134?

One does not "apply" for a visa...the USC "petitions" for his/her fiance(e) to immigrate to the USA. By filling it out yourself, you eliminate any chances for error or misreading by the fiance(e). In the case of two people who speak perfect English, I would agree with you. But, a large percentage of VJ'ers do not speak a common language. Going over these forms by telephone would be a good way for you to "know all his details." :innocent:

On DS-156 one of the questions asks if this form was prepared on the behalf of the beneficiary by someone.

Hi All,

At the present moment, my fiance is gathering her Police Certificate and Passport verification forms. She is having a very tough time getting both the documents, the police folks in Hyderabad, India are not very friendly and are not giving the proper information even after repeated requests. My fiance has even given the police folks money to expedite the process and get the police certificate, however she is very nervous at this point and is not getting that form.

Moreover she also needs to bring the Passport Verification form, but those guys are giving her a hard time as well.

If in any case she is not able to bring these documents to the interview, would there be any issues?

Also is there any other documents she can bring to the interview other than these two documents?

Her interview is at the Chennai Consulate.

Thanks all for yours comments, however I have a few questions as I am going through the guide to AOS on VJ.com.

I-485 - Only one copy is required, I don't have to make multiple copies?

G-325A - Do I (Petitioner) have to fill this out as well? Can I use copies of the originals that I sent over to USCIS when I filed for the K-1 Peition? Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office.

I-693 - My fiancé has already had her medical done in Hyderabad, with that being said -

A). She is not required to have another medical examination as long as the form I-485 Application to Register Permanent Residence or Adjust Status,is filed within one year of your overseas medical examination.

B). We will, however, be required to complete Part 1,information about my fiancé,and submit the vaccination secton of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5 of the Civil Surgeon Certification.

There is also a mention that "Some people have submitted a DS-3025 with their AOS package and have NOT received RFE's. Some HAVE. If you want to be absolutely safe in terms of your medical documentation as a K-1 adjusting status, you should take your DS-3025 to a USCIS-certified civil surgeon and ask them to transfer the information from your DS-3025 to an I-693. They should do this for a nominal charge. If they try to tell you you need a full medical examination, DO NOT LISTEN. You ONLY need the vaccination part. The following memo from the USCIS documents that this completed form will remain valid beyond one year when submitted with most Adjustment of Status applications."

Question - How do I go about finding a USCIS-certified civil surgeon? Can I do this when I travel to India?

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate?

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same?

I know these are quite a bit of questions. But hoping someone can help answer these.

Now that her K-1 Visa has been approved, I want to know about the next steps in terms of "Adjustment of Status" and getting the Green Card. How do I go about that part of the process. How long is the K-1 Visa valid for?
