Yep, it is unfair and we know they dont process in order and bear in mind also VJs are only 5% of the applications they recieve.

My other query is that I have noticed from other people's timelines that they have been filing their K-1 applications towards the end of January 2008 and in some cases have received their NOA2 and have had their interview already! I would not mind if it were a different processing centre but its not its Vermont and yes while we did have an RFE, it was stated that if we got the info back to them before the 1st of April there would not be a delay. Therefore as far as my Fiancée are concerned, if there have been any delays caused it has been as a result of uscis making a mistake.
Oh and one other question, does it make a difference where my Fiancée is from? because although the processing office is Vermont she lives in Albuquerque.

Sorry to go on but we need some advice and will be eternally grateful, thanks!

Yes you need to call them and speak to a person, as the K1s do not get entered into the automated system.

Me: No, that was before we met.
CO: Who do you work for?
Me: Comcast.

CO: How many times have you been to the Dominican Republic?
Me: For her specifically; four times.
CO: You visited before?
Me: Yes, once in 2006.
CO: What was the purpose?
Me: Vacation.

And that was it! He didn't ask her anything. After a few more minutes of looking over the documents, he turned to her and said in Spanish, "I'm going to approve the visa. You will receive it within a week to ten days." We thanked him and went to Domex to pay the courier fee.
The visas for her and her daughter arrived 10 days later, and she arrived in the US last night! It still seems unreal. She will go back to get her daughter in August.
Kudos to this website for the invaluable advise and information. Now we are just looking at the adjustment process. At least now we are together.

K1s dont go on the automated list, you will need to speak to an advisor, the reason is K1s go through NVC within a couple of days usually.

The interview itself went pretty smoothly. It wasn't very long either. Unfortunately I did have to wait for 2 hours for the 5 minute interview. But when I was told that I would be getting my visa, that definitely made the wait worth it. I will post a review of the interview shortly.

Well today is day 210 of our process of trying to get our K1 petition approved out of the California USCIS Office. My Congressman in the 16th district of Illinois has an office within about 4 miles. So, I downloaded the privacy form, filled it out and drove over to his office. A nice lady in the office with the title of District Representative asked my how she could be of assistance.
I informed her of my K1 petition that that it was received at the USCIS office on October 18, 2007. I asked that the Immigration Liaison from Congressman Manzullo's office call the USCIS and inquire about my case. She said she was not the Immigration Liaison but would definitely give my information to the appropriate individual and they would get back in touch with me. This was approximately 4pm yesterday afternoon.

This morning at 9:45 a woman from Congressman Manzullo's office called me and told me she had my request and asked about the background. I told her that each time I had called (using the RFE "trick") they told me the case was with an officer and would be approved soon. I was told in February that it went to an officer on February 22, I was told on March 24th that it was with an officer. I was told on April 24th that it just went to an officer and that the other people who had told me it was previously with an officer were lying to me. I called on May 2nd, the gentleman at USCSI told me it was with an officer. I told him I had been hearing this for 3 months. He said to be patient they are only processing cases from October 8th (lie). He said the case was with a good officer and this officer adjudicates petitions fairly quickly.
All of this was what I told the woman from the Congressman's Office. She said she had a direct contact at USCIS that usually gets things resolved fairly quickly and she had his direct line and would call him and get back to me at some point - maybe today, or tomorrow, depending on if she got a hold of him.

She called me back within 20 minutes and she said they she spoke with USCIS. They said they were sorry and this information should have been explained to me before. She said that USCIS told her that my petition WENT TO AN OFFICER on May 6th and to give it 30 days from today for approval. So, all along, the folks answering the phone line (using the RFE trick) were just playing me and lying.

So, it was very good to have such a very quick turnaround from the Congressman's office. For those of you waiting with times beyond 6 months, I strongly encourage you to go and visit the Congressman's or Senator's Office.
I emailed my two Senators - Obama and Durbin earlier to enlist their help, they have never replied. Go and personally visit the office if you can.

I did go to the USCIS and see that my file was touched today, so I am confident that she did in fact get in touch with USCIS.
Hopefully, we will receive approval soon.

She then gave the information to Noelle Obermeyer and from then on I have been talking to Noelle. Some time went buy after receiving my wac# and I started getting worried, When is NVC going to get the papers? I contacted Noelle and she contacted NVC and that same day I received and email back stating my NVC case number and that it was sent to HCM that same day, WOW this is great!. Some more waiting. All this time I was worrying about the address I put on the I-129f form, because when I filled it out I put Ho Chi Minh as the state and Binh Chanh as the City, which is wrong Ho Chi Minh is the City and Binh Chanh is a sub district. I was worrying if the Embassy would catch the mistake or if they would send the packet 3 to the wrong address. So I went out on a limb and sent the Embassy in Vietnam an email explaining the mistake and my case number and did not hear a response, so then I sent Noelle an email stating my concerns and the next day I received and email back from Noelle from the Embassy of Vietnam stating the Names and Address on my case number. In the letter from the Embassy they had her name spelled wrong I got worried again thinking I will need to send in a form or something about the misspelling of her name. I sent Noelle and email back stating my concerns and then the next day I received another email back from Noelle from the Embassy stating sorry for the misspelling it was just a typo on the email and the Names and Address on the case were spelled correctly. A couple of weeks go buy then Tham received the packet 3, she filled out the information and sent it back in. Then a few more weeks went buy then she received packet 4 with the interview date, YEAH May 28th 2008. I sent email to everyone I knew, I sent and email to Noelle. She sent me an email back saying congratulations and would you like Chuck Hagel to write letter of interest on Tham's behalf, I wrote her back YES, YES, YES. WOW A few days went buy and I wanted to read the letter that Chuck's office sent to the Embassy, so I sent Noelle an email and she sent me an email back with a copy of the letter.

I am writing on behalf of my constituent, Michael Allen Jennings. Mr Jennings fiancé, Tran Thi Hong Tham, will be interviewed for her visa on May 28th (HCM2008551010)

We respectfully request the she be granted every consideration within U.S. Immigration law during her interview.
