I completed some paper work using my laptop and emailed it to her, her MacBook removed some of the check marks I put in boxes and therefore we sent our paperwork off with some boxes unchecked!

Quick question;

 

We sent off our K-1 fiancée visa paperwork just before Christmas and we have had it returned stating that the classification sought was not completed.

 

My fiancée is the applier, so I have not actually seen the response.

 

Could someone please shed some light onto this so I can contact her with some reassuring feedback?

We'd like to resend the application in the next few days if possible.

It looks like I'm OK.


My Sponsor has told me that everything that was on my original DS-2019 stands because it was signed by immigration, and my extension wasn't because it states in the 'purpose of this form' box 'to extend an existing program' and because my original DS-2019 also states TRAINEE UPTO 18 MONTHS.


I hope that makes sense!

There is a box that says 'is not subject to the two year residence requirement', but it is not checked.


Ok, it just got confusing.

 

My first one had it checked?

 

Let me explain, I had a 12 month visa, that was then extended to 18 months, so I have 2 different forms?

The statement on the back also doesn't mention K visa.
It does state Marriage does not remove this requirement, but I'm not married, I'm applying to, which has been accepted?

I've managed to find it.

It doesn't appear to say anything, but on the back it does state the 2 year rule.

 

I never bothered to check it over as I didn't plan on meeting someone when I landed in the USA!

From what I'm reading it is only for work visas?

 

Surely we wouldn't have just had it accepted if they were going to refuse it later down the line?

 

I met her 3 months into my 18 month visa, so it's not just a summer romance.

 

What exactly am I looking for in regards to this HRR you mentioned?

Just wondering if someone can help and advise on this:

 

I left the USA to come back to the UK in October 2012 after completing an 18 month internship on a J1 visa.

During that time I met my wonderful Fiancee and we are now applying for the K-1 visa.

 

We're upto the point where all paperwork and been accepted and sent to the UK so I am completing my DS-160 application.

I have just come across this; Are you a former exchange visitor (J) who has not yet fulfilled the two-year foreign residence requirement?

 

As you can see, I have not been back in the UK for 2 years since completing my J1 visa.

 

I'm now panicking that we won't be allowed to obtain a K-1 visa now.

Has anyone ever gone through the same thing so quickly after returning, or have any knowledge on the subject?

my petiton was approved on last october 21 and it was said that as soon as my petiton approved they will sent it to NVC..but until now it hasnt written in my case if they sent it already or not...

i was just wondering because as my friend case, she received notification that her papers were sent to NVC 3 days after her papers were approved!

Hey guys. I'm Jason.

 

My question is probably a common one, but I just can't seem to find a very clear answer.

 

We are at the stage of waiting for my interview appointment. I sent my DS-230 pt 1 and 2 in two weeks ago now. But that's all I sent in....was I meant to send in evidence to support this form? Or do I wait to take said evidence to my interview when appointed?

 

Also....once I receive my police report in the post (I have everything else ready to go, i'm very eager to just get back to my fiancé as we've been waiting for what seems forever to just be together). do I then send in the DS-2001? I have read today that this form is obsolete now?

 

Am I just to believe that all I have to do it wait for my letter instructing me of my medical booking location and my interview date?

 

Any help to clear this up would be greatly appreciated! I just want some relief from this stress...thinking that I've missed sending something in or that I could be doing something else they require of me.

The lady on the line said "hang on a second and let me pull up your file. What do you mean nothing has happened on your file, it was sent to the NVC last month?"

Husband says "ummmmm, our case status says pending, and I haven't had a letter or anything. Does that mean we're approved?"

USCIS says "Yes, your file was approved on February 15. We sent it over to NVC already. You should be getting a letter from them shortly."

Husband says "thanks for your time."

What a seriously messed up system. I have been like RainMan for the past two months on the case status online - checking everyday for something/anything.

But happy happy all the same! We celebrated with a plane tour of the volcano and a little body boarding.

So to all you July/August Filers patiently waiting who haven't heard anything for USCIS - give them a call and see what they've managed to mismanage.

Somewhere on this site is the RFE trick with the proper prompts to speak with a human being quickly.

Hi there and congrats, IR6 is the category under which you were granted permanent residence. IR6 generally means you adjusted here in the US from a visa other than a K1, although some offices use IR6 for K1 adjustees as well.

since i am now based in and working in my home country of Pakistan, i will be more than happy to present the pakistani police certificate. my concern is what do i do about the british police certificates. can i submit copies of my degrees to show that i graduated successfully and had no problems with the law. the other alternative is to get standardised letters from my universities indicating that i was a student at their respective universities and graduated successfully.

i currently have a valid visitor visa for the UK and the worst case scenario will be that i visit England and get some sort of a police clearance certificate from both cities. This will be extremely expensive and a very hectic option to undertake.

your valuable help or opinions regarding this matter would be highly appreciated.

You will definately require a police certifcate from the UK, your degrees do not prove that you have a clean police record.

  • Divorce Decree of Death Certificate of previous marraige if applicable
  • Police Certificate
  • Court Record
  • Military Record
  • Two American Passport sized Photographs
  • Evidence of support
  • Proof of relationship

Usually you sent copies with your application, I hope for your sake they forward them on otherwise you will have to get them again for the interview.

Ok , I will ask my lawyer , if USCIS incompetance is anything to go by they will DEFINATELY lose it all , one thing i have found over the last 7 years is that the only surety is there incompetance and total disregard to even look at facts etc . thanks sal and jay .

I got an email this morning at 4:45 am... from CRIS!!!!!!!!!!!!

that our i130 was approved. we had no touches.. last touch was 2/24/08 and now it is 4/21/08

i was sleeping.. i got a TEXT MESSAGE on my phone from yahoo sayin i have an email from CRIS .. my heart started beating. i almost fell off my BED!! i ran to the compute and checkhed our email acct and WALA!!!!! an email from CRIS.. i checked the case status online and our i130 was apprvoed but NO ACTION on the i129f.. same date 2/24/08...

im s thankful to GOD! im sure eveyrone wil be getin their apprvoals soon!! i have no words.. to explain this..

i caled myhusband right away! and told him the good news.. hes so happy..i talked to my inlaws too they were EXCITED!!

im so excited i got to work and the first thing i did was wanted to inform yal! i wil post more later...
