so basically, my fiance in the U.S. files an I-129F. then within 90 days we need to get married in the USA. the problem is, whenever i choose to go back to the USA within the 90 days to get married, if i tell the border that is why i am going into the USA, they are not going to allow me in.
If i lie, i will get in, but once i get married, they will know i lied. i am supposed to go across the border to visit my friends and this just happened to be the weekend we went to the court house to do it? doesnt having filed the I-129F show premeditation to get married, and if so, then i am a liar at the border because of my intent.
and, all this aside, once we do get married, i have no problem going back to canada and continuing to visit every other month or am i allowed to stay and then get a job?

Hi There, you file the I-129f to start the process, once you have the visa which will take on average 6-12 months , you make your permanent move to the usa and then you have 90 days to get married.

I'm sorry for adding this, but.... If he is currently married (legally he is mind you), is this going to be a red flag when he goes to file and shows he met someone within past 2 years and started a relation? In some states, even if you are legally separated, you can still be charged with adultery should your significant other wish to pursue.And this will be a sworn direct admission of engaging in a relationship with the intent to marry prior to being legally divorced.. ? I would get some really solid advice on this issue before proceeding with filing. And you have a little time before that can happen anyhow. Good Luck......

My fiance is from England! We filed for our k1 back in October, 2010. Needless to say, this process is taking FOREVER for us. We've been very unlucky. But that aside, he had his medical today and it went really well! It did get me to thinking about other people in England having their medical and then going off to the interview. We've not heard back from the Embassy yet.

I've heard most people are told whether or not they will be approved or denied at the interview and usually 2 weeks later have their visa in hand. I hope this is true for us!

Hi there good luck to you, your nearly at the end of the K1 so thats great, I had problems with my medical so I was approved pending the medical, but once all that was resolved I had my visa within 5 days.

Just look forward now to being together and all the waiting will fade away.

Me too. The blog post was from 2008. She didn't give the lady a date to come to the US so the lady wrote 8/15. She came on 9/20 and got taken into the room at immigration and asked questions.


Hard to say but I imagine she used the visa after the expiration date. who knows lol.

My fiance has her interview tomorrow morning in Taiwan and she saw on someone's website tha said the embassy wrote a date for that to enter the US (she wasn't asked when. When she arrived a month later after that date, immigration said her visa expired. So my fiance is telling me the date you enter is important.

To me that doesn't make sense. I thought you had six months to enter and can come at anytime.

Does this make sense? Will the embassy ask for a specific date she wants to enter the US?

I have never heard of that before, other when they tell them they have to enter before the expiration of the visa.

I'm new here on Visa Journey. I went indicated by a Brazilian friend, I received many compliments on this site.
And then I came to confer with my own eyes, and really this is the most complete site I've ever seen!
People really interested in helping - That's what I (and my fiancee) needed!

Well, first I want to say congratulations to everyone who got the visa! I think it should be a lot of happiness. And those who are in the process: I wish all the luck and all the dreams will come true!

I have many questions... (Millions of Questions ) And then I'd rather ask people who have done this and could not be any problem. I would like to hear stories. I think this strengthens the confidence to go forward.
I'd like to read these stories, I would like to receive tips on what to do, the best way possible and fast.

What we're doing now is read and read and gather our documents and evidence of our relationship.

I want to know: What is necessary to send it to start the process K-1 visa?

I read that there are three forms to start the process - right? (if I'm wrong, please correct me!)

I-129F (Petition for Alien Fiancé)
I-134 (Affidavit of Support) <- Is necessary to send this too? It is also necessary to send the first time together?
G-325A (Biographic Information) <- We must fill this out? It is necessary also send together the first time?

I read that these are the forms that we should send - may be wrong, but you all explain to me the right way.

Is there anything else we should send to start the process? How: Photos, Letters, plane tickets etc?
or it is not necessary now?


I wonder what is necessary to send and not get errors later.


Another question: This process takes a long time to be ready? (I think so... that's why I'm afraid)

I will explain the situation a little better ... She's pregnant (I'll be a father!) And she is 9 weeks pregnant. I think our baby will be born in late February, so we're running out of time.

She has medical documents showing that she is pregnant, we should send it?

I'm afraid not be ready until February and missing the birth of our child, That would be cruel and very sad.
I'll have lost the entire pregnancy that is a fantastic time then I cannot even think of that possibility..

Anyway, I'd like help about how to proceed in the best way possible,

To be honest the best answer I can give you is to click the guides tab at the top of the site and follow the k1 guide, If you follow what it says you will be fine.

Im Kenyan and its difficult to judge someone from where they come from.

I would suggest to you to take time to know her. Arrange for more visit, dont show her that you are in a hurry to settle down , take your time to know her really well since this is someone you would wish to spend your life with. Avoid sending her money in early stages. I think you should take more time to know her and the rest will fall into place

kenya is not a high fraud country but you have to have good evidence to show on your relationship. I used western union receipts on my interview and they didnt ask anything. For the last one year, those i know of through visa journey, there has been just 2 APs , . So its not too tough to go through nairobi Embassy.

If the Western Union receipts are for money sent, and if your country is a high fraud country, then I would strongly advise AGAINST sending those. A consular officer may interpret that as buying a fiance.

Since I want to be frugal, my calling card also does not have summary listings, but what I did send is summaries from my phone bill showing the access code phone number being called and then copied the page from the website that shows the access code. I think that ties the two together.

Dawarig they will require proof that you communicated frequently.
In my case they chaecked emails, snail mail, photos, Fedex/ hl receipts. Anything that could show we were in contact.
I showed my western union receipts but just a few. That is good if u signed up in that should work well. I use rebtel to call my parents and it keeps all the records.

I have been self employed for the past 7 years and have made below the poverty line (less than 10,000 dollars).  But in January, I got a teaching job making 20,000 a year.  But I am still also still self employed, which puts me at about 28,000 a year.  In my I-134 form, I have put pay stubs, letter from my employer, assets (401k), and bank statements and a statement from my bank .  My biggest worry is that I have only had a bank account for 3 months.  All of my previous checks, I have cashed using check cashing.  Will this hurt me?  I make more than the poverty now, and have also written a letter to go with it.

Hello!   My first advice to you is file as soon as you can.  My fiance and I filed our I-129f in late august.  We thought we would have everything would be done in 10 months....but he has just gotten approved today.  Visa time varies, so it could take 6 months or over a year.  It's best to be prepared, because the US never does anything on the time you'd like it to be.

 

Also, send your evidence of a relationship (photos, chat logs, etc etc) along with affidavits from yourself, your fiance, and 1-2 other people of proof of relationship.  Also put in affidavits from yourself and your fiance of your intent to marry within 90 days of him entering under the k1 visa.  I find this best to send with the i129f so that they don't have to request more evidence (which adds more time).  

 

MAKE 3 copies of EVERYTHING!!!

 

They actually lost my fiance's paperwork when he went for his interview this morning, but luckily he had a copy of his original to hand in.  It's best to be organized and keep a binder of everything.

 

 

As for the support, you need to make above the poverty line.
