You can call the nvc to find out whether they have recieved your application and the current status the phone number is 603 334 0700.

I'm not sure where you read that K-1's are getting approved in a matter of weeks but for my case, and many of those around, we waited months and months also to get approved. I waited 11 months from time of filing to my interview date for my K-1. A lot of us are going through the same pain of waiting as you are.

As for the "shouldn't wives get approved before fiancees" comment, I do not understand how you feel you deserve to be approved faster. Some people who file for K3 simply get married, spend a week together and then file the paperwork. I don't see how that situation is any different than filing for a K-1, spending some time together and then getting married once they arrive in the USA. For those that get married and spend years together overseas and then have to go through this process, I can understand the level of frustration that would be attached in that situation.

No one visa type is better than the other and no one group deserves to get approved faster than another. Its unfortunate that the processes are not working on the same timeline, and I truly think they should.

However, I do not feel that the frustration should be taken out on K-1 visa filers and us told that our relationships aren't quite as important.



Totally agree, we discussed which option to take before we chose K1 and we didnt want to be seperated after marraige so chose K1, if you choose K3 you know the procedure. Neither is more important than the other.

Well, I started my journey around september of 2006, on 3/28/07 We had our appointment, we worried about the smallest details on paperwork and even handwriting! I explained that to him and told him that we always stayed in touch and after I got out we started the process so she can come home with me. He asked us if we were still married and we told him no. He asked me if I had an appartment or house, one or two bedrooms and if she would be staying with me. He asked if we had any children. He never asked for any pictures , my tax returns, NOTHING. He said congrats heres your green slip, just pay the 12$ for delivery fee and wait for the visa, its approved!! I was dumbfounded that all this wait and anticipation for so long as over so fast! My fiancee almost burst into tears and we gave eachother the biggest hug and sigh of relief. We paid our 12 bucks and were on our way! Now we are just hoping that we get the visa before our flight on saturday.

I would like to thank you guys here on these forums, I pretty much started this entire process and guided myself with the information you provided, you guys are life savers (and makers)

Hi there and congrats on your approval, you can contact the NVC to check if they have recieved your case and whether it has been forwarded to the Embassy, they will give you a new case number, you will need to provide the beneficiarys date of birth to the advisor.

On a K1 as long as you marry within the 90 days as far as i understand you can stay legally and no further visa is necessary while you wait for the aos.

I would just go ahead and provide them with the I-134 of my fiancee and her mom (since my fiancee does not make enough money), along with her mom's employer's letter and recent paystubs to back up her income.

In the original petition it just asks for divorce papers, which we sent and therefore got approved. But now I am reaching the interview stage they are asking for marraige certificate too. I am the beneficiary.

Im not sure how it works there but here you would apply in the courthouse where the divorce was served.

The police certificate is required to be taken to the interview, I didnt include it in my original package. Hope that helps.

Reguarly, it takes up to 1 month from the petition to go from USCS to NVC, so 22 days is still a normal time frame.

Do what Sal and Jay advised you to do. Your K-1 is not registered on the automated response system, that is why you need to talk to a person and ask about your petition. They will let you know if its already there and the new case number for the Embassy.

I have tried calling the NVC 3 times now and I emailed them, if the lines are busy they just send you back to the main menu again and advise to call after 6pm, I emailed them this morning so I will wait for a response, I agree its kind of tough to go through the application process and feel a level of excitement after getting the NOA 2, only to wait for this stage, the other thing that bothered me is that on the NOA 2 it has an application time of 3 months, I am not sure what that means? I hope its not some kind of deadline.

I have called the NVC over 10 times now and every single time I ask to speak to an operator I get the all agents are busy, you are being returned to the main menu, talk about annoying, plus I emailed them over 2 days ago and no response, I have done evetything, I don't know why I am having such trouble !!!!



Im not sure what time zone they are on but I used to call them when they open at 7.30 am and always managed to speak to a person, maybe you could try that hon.

I have my packet 3 from London and it just asks you to complete the forms, some are not to be signed but sent back, it also states not to send any documents like Birth Certificate etc but to bring them to the interview.

I think each embassy is different so I would wait till you get packet 3.

Yes, you can be denied entry on any visa.

Liam was denied entry because of consulate error. He had some charges on his police report that the UK consulate did not think required a waiver. When the CBP officer opened his brown envelope at Dublin POE, the officer looked at the report and was expecting to see a waiver in the envelope. There was none. He turned Liam around. After contacting the consulate, Liam was informed the consulate indeed should have denied his visa initially and he should have filed for a waiver. The waiver was filed, granted and Liam eventually entered the US.

The member Goldenheart's fiance was also turned around in Detroit due to statements made at POE which led the officers to believe he was already married and therefore not admissible under a K1 visa.

Lots of people visit from the UK while their K1 is pending. We did it and my husband actually had fewer questions going through saying he was visiting his fiance than when he was just "on vacation". Can you be turned away? Of course. Will it be likely to happen? Probably not. However, bring lots of evidence that you are returning home, copy of whatever paperwork you have to show you are doing things the "right way", have a return ticket, don't stay for extended periods of time, dont answer what they dont ask and dont pack everything you own.

Regarding the POE when you are entering on the K1, of course you can be turned away. However they are not going to deny entrance unless they have a very good reason. So like everything with the process, don't lie, don't answer anything they don't ask, pay attention and don't be stupid. When you have a K1 you must marry with in 3 month?



When you get issued your visa you have 6 months to enter usa, and you must marry within 90 days of entering the country.

Im not sure how you will get round this but they will want to see proof of name changes, either by marraige or deed poll.

Maybe a solicitor could provide you with an official document.

K1 applications do not go on the automated message at NVC, it is best to speak to a person who can confirm the position of your file.

I had the whole file returned to me also, so when we resent it I classed it as that date. So I would say April. Sorry tho. But hopefully now it will process quickly for you.

Applying for a spousal visa WILL get you permenant resdiency, NOT US citizenship. So it sounds like the I-130 petition is your best bet. It allows you to work immediatly upon entrance into the US and no need to give up your Kenyan citizenship!
