have a medical 300 pound get your packet 3 forms done 

im sure more people will be able to help 

oh and pay the visa fee by phone its about 80 pound

your almost there 

you need affidavit of support too and proof of ongoing relationship to take

Ok...

after our case being denied, we were expecting that because we filed all wrong. We only sent the form and the payment. Only after discover VJ that I realise that we sent all wrong. I found out at the website that our case was denied and now we have to wait the letter saying the reasons of being denied which should take a while.

I was reading another forum and there was a question between appeal or refile 129f and everybody was saying that refile was a best option. But now something came to my mind, he is coming to London to visit me for 2 months. I would like your opinion...do you think that would be a good idea if we get married here and apply for spousal visa?

If you are missing the vaccinations required for someone of your age, then you'll need to have them (for AOS). Either have them done before the medical or at the medical (the latter is likely to be more expensive).  You have to have everything required for your age category.

Most adults require tetanus in the last 10 years and two doses of the MMR (combined measles, mumps and rubella, or suitable single-shot doses of each).  Chickenpox (varicella) is required where the vaccine is available (the UK doesn't provide varicella, we just have to say if we ever caught it as kids and are taken at our word, for example), and a flu shot in flu season.

 

Requirements will differ for children.

 

K1 applicants are not required to have their vaccinations up to date for the medical at that stage, as it's a non-immigrant visa, but they will be expected to have them up to date for their AOS.  As such, it's generally easier and cheaper to do it during the K1 stage, otherwise you have to find a certified doctor in the US to do them for you later at more expense.

i best go and have my tetanus shot again its been over the 10 year mark i thought you just had to have it done and mmr only has to be once right ???

Hello vjers 

one question is it a problem if the gross amount made was a few thousand over the poverty level 

But she had more deductions therefore not paying much taxes 

or do they go off the taxable amount ?????

she has already done her tax returns , letter of employment , letter from the bank ect

 

my fiance is self employed but rents from salon 

i have also heard its gross amount from so many people but on the paper it says net amount 

so what one do they go by so we have it right first time of asking

Theft can be considered a crime involving moral turpitude if it was committed with the intent of permanent taking. You would likely need to read the final disposition of the case, or consult with an immigration attorney, to see if this makes you inadmissible to the US as a result, though as you say the "petty offence" exception would probably save you here, even if it was considered a CIMT.

 

If it is considered as a crime involving moral turpitude then you also committed misrepresentation by not disclosing it on your ESTA application(s).

 

Since we're talking about theft of a traffic cone then I would imagine you are probably ok, but IANAL.

 

I'd strongly suggest you speak with an immigration attorney (and perhaps more than one) to have them review the situation.

Okay i have put this story on here before so please dont judge 

i am very worried and having many nights of not sleeping 

so please keep it nice and honest truth and good or bad news 

we recently got our noa2 was very excited were now starting to get everything ready for my medical and eventual interview 

my prob is this 

i have travelled on the vwp 3 times in the last year not knowing / forgetting about a potential cimt theft of a traffic cone back in 2007 it ended up in a warning for first time offenders as it was very minor ....... finding this out i now know i was not able to use the vwp 

im so worried that i will be denied my k1 at the interview because of the cimt (even though im in the exception rule) and missrep due to fraud of vwp and need a waiver

i have all the correct documentation and will be honest in every part of the interview 

im so worried but my fiance nicole is full of hope false hope i belive as im a man with very bad luck in life and feel i will be denied and have to do a waiver (i hope this isnt the case)

so could someone please tell me where i stand and but bluntly honest

yes my friend has just done it with his now wife 

they wanted to get things done the quickest way so he jumped over on the vwp got married it was planned vegas wedding her mother brothers and there kids were all there 

they done it after 60 days they have files for adjustment of status things look like its going smoothly for them 

myself personally did not want to go that route instead follow the k1 as immigration fraud is something id never do 

but he said he was there for 60 days and was coming back after visiting his partner was even asked if he was going to get married he said no 

yes i think its wrong but people people do it all the time 

you seem to get more respect doing things the right way 

i still might be denied my k1 and have to do a waiver yet there is a chance

but i did not want immigration fraud against me whilst already being married with the chance of deportation 

please dont go this route

my husband had unlawful presence in the us so he triggered a 10 year ban. i remember your previous posts regarding your "crime" lol, and i have seen much worse, hopefully your embassy will realize this too that this should not even be a crime. it was a once in a lifetime.... experience, not a crime, no harm done.

and yes it was very minor in nature and never done it with the thought of theft just wanted to put it on my head and walk around with it on 

but cautioned for theft so minor i had forgotten and who on this planet know's what a cimt is well i do now

trust me i understand i have been away from my husband since may of 2011 and was just able to file his waiver due to his denial. our youngest child, 5 is partially disabled with not that long of a life expectancy as others, it kills him everyday to be away but it is what it is, we were not granted any expedite, but we tried at least. my point is you are not denied yet, so try do everything you can, bug the doctor to get a letter, it's worth it if could help. if you get denied well then cross that bridge when you come to it, bite the bullet and file a waiver if you can. but be strong and good luck.

mine might come to having a 9 year old cimt of theft of a cone (no intentions to take perminatly) not that it helps i come under the petty offence rule 

i accidently ticked no on the esta about cimt's as i forgot plus never knew about my crime well more forgot it to be honest and nver knew what a cimt was till this day 

so they will prob see it as missrep even though i never wilfully lied on anything it was an honest mistake but they never listen to that

Sorry about the surgery, that must be very hard. 

Did you try contacting the embassy explaining the problem? If so, do it as soon as possible using this form : http://london.usemba...ntact_form.html

 

Tell them that you are desperate to go to the US to be with your fiancé who will have surgery. Provide them with the date of Surgery if it's been scheduled. Keep it simple and short.

Its funny i have just done that with dates ect and what the surgery is for after having it things will change alot for her and myself its just horrible and heart breaking being away from her at this time just need to be there to make sure she is okay and keep telling her all will be okay

my fiance / future wife has just come back from the doctors with heartbreaking news that she has to go have surgery to remove some cells C thats all im going to say were both sobbing and nervous im not looking for attention by posting this just need some vj friends right now 

its good the doc has caught it just in time but could lead to future impacts

im really not judging either a that is not my place too as i do not know your partner and i feel very sorry for you in this situation 

there is a possible chance i will be denied my k1 so feel your hurt mine not to do with drugs though

but did he not think as soon as he had the blood test he didnt clock on that illegals would be found its like any medical they check for things like that and also what did your fiance say when the doc asked if he ever took drugs ????

have a look at the ds 260 part 2 the one you take to the interview and there is a question that asks about arrest or criminal activity and just write down what happened else you could be done for trying to hide the incident <<<<< dont want to panic you have you got your subject access forms along with your acpo results  to show exactly what your crime was 

did your acpo say no live trace ????

just dont worry at the embassy its so easy when your there and rather relaxing 

i have a feeling you will be fine 

if not the most will happen is that you might get a 221g asking for subject access forms if you dont have them soon as you send them it you will be approved 

im sure it will be fine

oh and if its not a CIMT and i dont belive it is your flying through something this minor wont exclude you

what you did was very minor and what i mean by declaring it is this on your ds260 part 2 explain you have a minor crime 

then when it comes to the interview they will ask and you will sail through 

but you might need a subject access report to show exactly what you have done 

im very confident you will be fine

hey there let me try and calm your nerves my friend 

i recently had my K1 visa interview at the embassy and had whats called a minor cimt against my name THEFT of a orange traffic cone no intent to keep we were more wearing the thing not stealing it 

anyways i had forgotten about it too as it was so minor and minor things do get forgotten i was in panic mode for months after getting my records back 

anyway i went for my interview they asked it told them the honest truth and put all this on my ds forms what ever you do tell them about it dont try and hide it 

he told me i come under the petty exception rule and said i was approved if this is the only thing you have ever done make sure you declare it and im positive you will be approved with no issue as it doesnt sound like a cimt mine was on paper worse than yours and i was fine JUST MAKE SURE ITS ON YOUR FORMS AND YOU DECLARE IT AND TELL THEM dont lie as you could be caught up

Yes, that counts as income. But you need to have a documentary evidence for that. Im not sure the letter will serve as proof.

Immigration lawyers might give you clarification on this. If you want to get one, ask him during your first session about your chances of getting a VISA. If its low, dont pursue. They will give you flowery words that youll end up paying so much. If you want direct and sure answers, go to the US embassy and ask them. You'll know what im talking about. My advise is based on my friend's horrible and expensive experience.

You will not be allowed to immigrate to the US if you have past drug convictions. You will
not be able to enter the country anymore if the reason why you were denied a VISA previously was DRUGS. Even if that happened years ago, your name will still be in the list. You can quote me with this.

No consular officer will grant you a VISA if he wants to remain a US consular officer. He will be immediately kicked out of the position if he will let you in.

If your situation is tearing your family apart, then your wife and kid should be the one to immigrate to the country where you are-- thats the advise you will get from them.

Sorry for being direct. I dont want you to have false hopes. Drug conviction and US VISA cant be in one page. DRUG appears red in their computer monitor.

If your marriage took place on 2013 then your federal income tax return of 2013 should have a MARRIED status.
Going back to your question that if this will make them deny the VISA, the answer would be NO. But there is a possibility that they will make you acquire a valid tax return with the appropriate civil status. You have to declare that you are married because your civil status is One of the things that the consular checks first.

Check on the tax forum. There might be other members with the same problem.

Hi! If your marriage was on or before Decemeber 30, 2013 then you file SINGLE for the federal income tax return of 2013. See IRS form 1040 page6 (if I remember it right)

You have your marriage certificate during the interview. That will show them your marriage date and that will tell them if your civil status in your tax return is right.
