Are we turning in any 'Originals' during the NVC stage? I know we have to turn in the original police certificate. What about Beneficiary's Birth Certificate? I was planning to turn in a certified copy.

Poe is point of entry (as in... point of entry into the u.s.) london does not do us customs/poe/boarder patrol... the poe would be in raleigh. I think the only plaace that i know of that clears u.s. customs outside us territory is ireland (shannon and dublin airports do a pre clearance) that may be wrong.. others MIGHT do it too but im 100% that london does not. Any international airpot to the u.s. does their own poe though so im not sure who said tha raleigh doesnt but any airport with a flight from london would have a customs/poe/border patrol clearance to get into the u.s.


Not just Shannon and Dublin. Someone recently had a Bahamas POE. My POE will be Toronto. There are other ports too.
Oh, and POE is port of entry. London, as far as I know, wouldn't be a POE though.

when i called NVC..they said my case completed yesterday May 17th, and that there not setting any interviews until the second week of june for july interviews =( i really want one in june !!!..i hope this is just a speech they have to say, and maybe ill get an interview next month !!


It depends from country to country and consulate to consulate. From what I understand, Mexico has a huge number of people immigrating to the US every year, just like India, and so what they said might be a fact. Sorry 'bout that! But on the brighter side, you'll get there soon.

Well I know as of yet Nigeria is not on list to do the NVC forms online. So was wondering how others handled the DS-230 signature from Beneficiary and police report? i mean did you just wait until NOA2 came and they got that and sent all to you (but the DS-230 Part II). Or you had the DS-230 ahead of time or what?
It's just this unreliable mailing system in and out of Nigeria. I know the only way he can send would be DHL. But just wondering as I wait in the USCIS queue. Thanks


We did it well ahead of time. My I-130 petition was approved in Feb, but I'd already got my Police Clearance Certificate in Jan, filled out the DS-230, signed it, got all the other documents for the package ready, etc. Once my petition was approved, I immediately shipped out the package to my husband, so that he had it all with him by the time we received the case number, IIN, etc.

The current processing time for approval of an I-130 is about 6 to 6.5 months. Until then, it'll be in initial review. Once approved, it currently is taking almost a month to get a case number from NVC. After that, if all your documents are in order, you could sail thru NVC in a few weeks. It could take another month to two months to get an interview date. All in all, I'd say be prepared for around 10 months to a year.

You'll need an original or a certified copy. I don't think a notarized copy will work.
7. Payment Receipt for Police certificate/certificate of good conduct for Principal Applicant/Beneficiary

You don't need to send this.
11. Copy of petitioner's International Passport
You don't need to send a copy of the petitioner's passport. The DS-230 package is purely for the beneficiary.

14. Skype records between us
15. Some email messages
16. My flight itinerary to Malaysia
17. Copy of school IDs
Items 12 to 17 do not go with the DS-230 package. DS-230 package basically consists of the bar-coded cover sheet plus the following documents for the beneficiary.
1. Biographic page of passport.
2. Birth certificate (original or certified).
3. Marriage certificate (original or certified).
4. Divorce decree if applicable.
5. Police clearance certificate.
6. Two passport-sized photographs with the beneficiary's name, date of birth, and case number written at the back.
This is what goes with the DS-230 package.

I had read somewhere that if a spouse arrives in the US after two years from when they were married, the visa is unconditional. Meaning (?) I presume they have a right to ss#, work and basically they are finished entirely with USCIS. Next step would be citizenship. Could anyone clarify this please? Would this be from what date? They date we marry? The date of the application? I'd read if you were lucky you could delay the entry of the spouse to take advantage of this. It also saves you about US on fees.

What about the removal of condition of the sponsor and co-sponsor being financially responsible? I hear that is a good thing to get lifted as soon as possible especially for the co-sponsor.

It's not such a big deal, really. If your spouse arrives before two years, she gets a conditional green card, and you can get the conditions lifted when the two years are up. She can still work, get her ssn, driver's licence, etc etc. The only difference is if you've been married for over two years, she gets her PR at the time of entry into the US, if not, she gets a conditional GC and then you lift the conditions and get a PR. Not such a big deal, if you ask me.

I'm a college educated professional. My wife lives in Mexico.

I found a lawyer who will charge a reduced rate of $1000. Is that too high for filling out forms. Or is it money well spent knowing another person is looking and helping us out through the process?

You don't really need a lawyer to file your CR1. All you need to do is read up well on it and collect as much info as possible before you initiate the process. Before we started out, I hadn't even heard of the CR1.

I have searched through the forums and have found topics from 2011, so am reposting in hopes of getting current information for 2013.

 

How does a beneficiary residing in Mumbai apply for a Police Clearance Certificate (PCC)? The US Mumbai consulate web site says apply at local passport office, but no additional details are given.

 

My request to any VJ'ers with beneficiaries in Mumbai who have gone through the process recently: If you could post your advice/tips/experiences about how to get a PCC in Mumbai that would be greatly appreciated! How long does it take to get one and what is the cost?

If you google Passport Seva Kendra and go to their website, then go to the city of residence of the beneficiary, you'll get more info on this.  There's an online form that you'd fill out, then set up an appointment date and time, and turn up for the appointment with the printout and the documents required.

Your port of entry can be anywhere.  Mine was Toronto, of all places.  As for biometrics, it happens at your POE, when you go through immigration.

1.  The passport office that issued your passport.

For all you know, USCIS has not updated their website.  I did encounter this way back too, so I can assure you that it's just a matter of time before you'll be able to see the required info on the website.

 

This is one long-drawn process, so you need to have a lot of patience.

My spouse already went to local Passport Seva Kendra (PSK) and they asked for Interview letter to issue PCC. So I will most likely need to send IV package without PCC and defer PCC until Interview. Based on other ppl feedback on VJ, it appears that NVC will complete the file without PCC for Mumbai Consulate applicants.


This is not consulate specific. I'm from Kerala, and I did apply for PCC via PSK. On the day of the appointment, it took me just an hour to get the PCC in hand. I wasn't asked to provide any letter. That said, when you submit your DS-230 package, you can let them know that you haven't obtained the PCC yet and that it will be submitted to VFS prior to the interview. That should be okay.

You cannot sponsor yourself. Your fiance needs to find a co-sponsor.

The OP never specified that his relationship was an inter-religious one, only that she was a US citizen.
The 30 day waiting period is only applicable when marrying via the Special Marriage Act. If they both are Hindu, they do not have to wait 30 days and can marry via the Hindu Marriage Act.

If you're looking at a fiance visa, it'll be K1. Personally, unless you have a strong case, K1 could get denied.

Spouse visa will be the IR1/CR1. Where you get married does not really matter. How good a case you put together is what matters. If you're getting married in India, the US citizen will have to obtain a no objection certificate from the US consulate before you can get married. Also, keep in mind that there's a waiting period of 30 days from the date of registration before the marriage can take place. There's nothing like getting to the US at the earliest. It will take anywhere from 9 months to a year before you eventually get to the US.

Hi all,

I'm an American filing a K-1 for my fiancee in Brazil.

Considering that Brazil is definitely a "high fraud" country, I wanted to front load my application with proof of ongoing relationship.

But I have a question about that, namely, how do I differentiate between "proof of having met in the last two years" and "proof of ongoing relationship"?

I had thought that I would combine the two into something I could call "Proof of having met in the last two years and ongoing relationship".

In it, I basically wrote out a timeline of our relationship with various pieces of evidence supporting the different events I describe inserted throughout. I thought this would be the clearest way to explain the variety of different forms of evidence that we'll be presenting.

So I just was wondering what would be the best way to present it. Should I duplicate the evidence into the two specific divisions, or will putting it together into something that serves both purposes be okay? I suppose splitting it wouldn't be a problem, but I'd be duplicating a lot of the evidence, giving two copies of the same stuff in the same envelope.

I hope I made that clear...


For the proof of having met in the last two years, you could consider submitting boarding passes, hotel bills, and the likes, and everything else as proof of ongoing relationship.

Unfortunately from what I have seen and heard here and elsewhere it's not what "should" matter but what does matter that we're talking about. Everything I have seen indicates to me the the Delhi embassy where she will be applying is really hard on applicants. She already has a common (the most common) Muslim name in India, which I have heard will slow down her application by up to fours months. So I am worried that me having 2 part time jobs which I acquired in the last 6 months might not look good or might even merit denial on the application.


I agree that the New Delhi embassy is a little harder on applicants, especially K1's, as compared to the Mumbai consulate. That's cos the Delhi embassy is a high-fraud center. Adding to that is the fact that your gf has a common Muslim name, which will, without a doubt, place her in AP. You'll need to think this through before deciding on how to proceed further.

i thought so so even if you get through your poe you can still get pulled later on for it ???
i have also heard that you can go get married and file for the i130 so it makes you legal to stay there its being processed ????

It is NEVER OK to lie to immigration.
It is ALWAYS OK to enter the US on a valid visa (or the VWP, if you qualify) to marry, so long as you don't overstay.
It is NOT OK and is very risky to enter with the intention of staying and adjusting status, because it's ILLEGAL. Basically you're lying at entry and saying you don't intend to stay, even though you do intend to stay, and being caught in a lie can mean a permanent ban from the US. It is NOT SAFE and I don't care how many people tell you it is. Some people get away with it, but you don't want to be the person who doesn't.
The I-130 form eventually becomes an immigrant visa, and then a conditional green card valid for 2 years if you were married for less than 2 years when it is issued, or a regular green card valid for ten years if you were married for more than 2 years when it is issued.

Yeah you can marry on visa waiver as long as you dont have intent to stay if you do thats visa fraud no matter how you look at it and its illegal even though many people get away with it shame really it shouldnt be like that and should not be allowed 

there are many who marry on the vwp and get denied too lets make that clear 

so the honest thing to do is get married on the vwp and then come back home do all the proper paperwork and not become an illegal immigrant 

hope this clears up some things for you but if you feel like doing it the honest legal way you can apply for the k1 visa its one of the safest ways

i also needed my TDP as it was over the 10 year mark for tetanus
