Hi everyone! My husband called the us embassy about my concerns. They said that the consular officer did not ask for anymore domicile requirements and that I only need to submit my joint sponsor's ITR 2013. Once a the requirements are complete, they will mail my passport to me with the VIsA!!! What an amazing news after a day thinking that I got denied.

By the way, our joint sponsor does not have a 2013 ITR because she filed for an extension. We raised this concern too and they said we just submit the ITR and W2 2012. The W2 of 2013 that I submitted has proved that my joint sponsor has earned enough for 2012 to support me. So my advise to everyone out there who are having this problem-- call the US embassy to make sure. Also, if you NEED to say something during the interview with the CO pls say it even if he/she didnt ask. Because If I told her that my joint sponsor filed for an extension during the interview, she could have just accepted the ITR 2012 and my ViSA journey could been shorter.

The CO didnt ask for more proof of my husbands domicile. She read the letter detailing the steps that my husband took to prove domicile. She checked the documentary evidence as well. Then she gave the letter back to me. She then told me to go back to my seat and wait for my number to be called in another window for instructions on how to procure the ITR 2013 of my joint sponsor. By the way, April 15 was the date of my interview (Philippines time).

Hi guys!

I went to the US embassy for an interview today. I dont know if I will get a US VISA or not because the consular officer didnt tell me anything. After the interview she just told me to go back to my seat and wait until my number will be called again. I did what I was told. But when my number was called, it was in another window and I didnt see her again. The guy assigned there just instructed me to submit a 2013 ITR of my joint sponsor (because what I gave them was 2012) and mail it to them using TO GO courier. I asked the guy whats the next step, he then instructed me to give my mailing address to the courier in the next window. I also asked if I need to come for another interview, he said no. Lastly I asked about my passport because they didn't give it back, he said that they will mail it to the mailing address that I provided them.

Am I gonna get a VISA after I submit the ITR 2013 of the joint sponsor? Was my cr1 Visa application denied?

During the interview (15 mins):
After the pleasantries and confirmation of my identity, the consular officer just focused her questions on 1 thing- my husband's domicile! She told me that she is not convinced that my husband is domiciled in the US. She asked me a lot of questions about how long he stayed there, where he stays there, his stay in the Philippines, his work here etc. She also mentioned that the purpose of the spouse visa is for us to be reunited, but she thinks that we are united here in the Philippines already. So I showed her my husbands letter of good faith that stated the steps he made to establish domicile. She read it, but gave me back that letter and the other proof of domicile. She didnt ask for my 2x2 VISA pictures, didnt ask for any proof of relationship (she asked me how and when we met-thats it!). She kept the Birth certificate, marriage certificate, affidavit of support from husband and joint sponsor. She didnt give me back my passport. She neither told me that I will get a US VISA nor told me that my application is denied. She just told me to go back go my seat and wait for my number to be called. Thats how my interview went.

Please post your opinions... It will be highly appreciated.

We met online on a marriage portal. He's an Indian as well, same religion, we got married according to the Hindu marriage act and then got it registered. My family was present at the wedding and we have pictures to prove that.

Absolutely agree with Pushbrk. YOU need to know every tiny detail because with a total of three former spouses in the picture, you can be rest assured that there will be questions about it.

Both of us have our respective divorce decrees in hand, so that shouldn't be cause for concern. His dad is an immigration lawyer and they have a family-run business too in California which is now being handled by his brother. Both his dad and bro have assured me that there is nothing concerning, but despite all the reassurances, perhaps cos of my overactive mind, I do tend to worry about all this. We do have proper documentation regarding our relationship.

I do have a question. Should we also have sworn affidavits from family members (parents, siblings, etc.) about the relationship?

There would be no questions in the petition approval process, but particularly for Guangzhou, the foreign spouse should be prepared to answer any and all questions about current family members and former spouses. Be prepared. Petition approval is not a visa.

I guessed as much. I've already prepared a list of questions for my hubby and e-mailed it to him, and am awaiting his reply, so that I can be prepared with all kindsa info related to him, his previous marriages, as well as his parents and siblings.

I'm hoping you were meaning to say that you are not anticipating any questions regarding marriage history from the NVC (BTW, they won't ask any). However, a CO at the Consulate is very likely to ask about it and if she is not able to answer those questions satisfactorily, a visa denial could be the result.

Thanks much for that bit of info. I did read in one of the forums about an interviewee being questioned about her husband's ex-wife and what not. Which I guess means that you need to be prepared with all sorts of information about your husband's exes when u go for the interview, right?

First, you have no application for anything pending at this time. What was filed was a petition for alien relative. When the petition is approved, the foreign relative can apply for a visa. USCIS, (petition adjudication) doesn't care how many times anybody has been married as long as they were free to marry WHEN they married and are actually legally married.

It is later, at the Consulate where the totality of circumstances are considered prior to approving a visa application. Until YOU know the totality of the circumstances, (prior petitions etc.) it will be impossible to predict how the partial set of circumstances you provided would impact the ultimate decision.

He is a naturalized citizen, who moved to the US along with his parents and siblings 20 plus years ago. He works with the LA county sheriff's department. I think he did petition for one of his exes, though I need to confirm that.

Is your husband a naturalized citizen who obtained his GC through one of his ex-wives? Or is your husband a native born USC who previously petitioned for his ex-wives?

If the answer is No to the above questions, then you have no cause to be concerned.

We just received NAO2 (a little over 5 months wait). This is my third marriage and my wife's second. No one has asked any questions so far and we are not anticipating any.

Unfortunately, at the moment he can't really afford to travel to India due to many factors including his job as well as the cost of traveling up and down. He is a US government employee.

Did he ever sponsor anyone else for green card before you? If no, then no need to get worried.

Based on your timeline, you guys got married in July, and after that, applied for I-130. Most important is that how you guys make sure that your case is stronger enough. The good is that you guys should live together and spend alot of time. If he cant manage to live in India for his job/business, then he needs to make some good amount of visit to show it as bonafide relationship. Alot of factors.

Overall, it depends up to many factors.

I-130 may take up to 5 months to get approved.

Hi everyone. My husband has been married thrice, me being his third wife. He had been single for the past ten years before we got married. This is my second marriage as well. My concern is if his being married a third time should be cause for concern, as CSC or NVC might look at it as a ploy to bring me over to the US for a green card/citizenship. This really has gotten both of us very worried. It's been four months since our NOA1, and so far we haven't received any word on the status of the application. With him being in the US and me being in India, things are really tough for both of us. Do give us your feedback on this, both positive and negative, for it could help me with my interview (whenever that is). Thanks much in advance.

#1 - It is not passport clearance certificate but a police clearance certificate that you require.

#2 - Check the timeframe to get PCC in your location based on your case. Once you get NOA2, then apply for PCC right away. Because it takes around 3 to 4 weeks to get your NVC case number. Lets say if interview takes some time or whatever, but your PCC will remain valid.

#3 - yes, it is valid for 6 months.

#4 - If passport is same as your current address, you just require: Old passport in original with self-attested photocopy of its first two and last two pages including ECR/Non-ECR page and page of observation (if any).

to get PCC. Plus it solely depend up to your location officials. If they are ease, then things would be easier.

You know, in PSK, Counter A guy, who accepts all doc, fingerprint, etc, he told me that my PCC would take 10-15 days as my passport was issued from different state plus have different state address on passport. It really pissed me off to hear about 10-15 days delay. Then waited for Counter B, he just passed the file within 1 min, then waited for Counter C ( Granting Officer ), he was very nice, he granted me PCC within 10 min. It was totally amazing! :) It was totally God's micracle to get PCC same day, when esp counter A guy told me that it would take 10-15 days timeframe for my case.

If you want to apply for PCC in bangalore, you need to go the Commisioner's Office on Infantry road. There are 2 kinds of PCC one jus normal check & the other for job. You need to take 2/4 photographs & fill the forms and submit xerox copies of passport. You cannot pay the fees at the Commissioner's office and the same has to be paid at State bank of Mysore (Opp to Bowring Hospital, Shivajinagar) . The chalan has to be submitted at the Commissioner's office along with the forms. It may take about 2 weeks to get PCC.

So what you mean to say is that I can get a clearance certificate from Trivandrum itself. All I need to do is provide both my old and new passport numbers. Is that it?

Generally all records are checked online based on your passport name, number, dob, etc etc. Based on that, they can verify all records national-wide. I got my PCC within 4 hours from Passport Seva Kendra, Chennai, even though, my passport was originally issued from Lucknow, and I have lived couple of places in India for a year or more.

Just require for 1 PCC from your nearest Passport Office. It would be enough for embassy.

The fact is that if someone ever committed crime, then they dont need 6 months to live before they able to commit. That is why they have online system to check national-wide records.

I just received the hard copy of our NOA-2. It's the greatest christmas gift I have ever received so far, this year. I was advised by fellow VJs to start calling NVC after a week or two to check if they have received our case.

Now, my question is: Can I use MAGIC JACK in calling NVC?

Im the beneficiary and Im from the Philippines. My husband, the petitioner, cannot call NVC every single day as he is busy with work that's why he delegated it to me.

I know the wait is excruciating, and we're all in the same boat, but sooner or later, we'll all have our NOA2's in hand. All we need is a lot of patience. Let this not break any of us, let it only make us stronger. Just remember, this too shall pass. Also think of our spouse/fiance(e) at the other end. They're as much in pain as we are. Maybe I should have just remained silent on this subject.... cause this a subject that infuriates me :angry: my husband and I have been through alot to prove our marriage was bona-fide, his first interview was denied and his case got sent back to uscis for reasons stating :marriage not bona-fide.. we waited a whole year to finally get case reaffirmed and all the while I was pregnant with our daughter here in the states and my husband in china... I gave birth to our daughter without my husband here, my husband did not see our daughter until she was a year old I had to travel with her overseas 22 hour flight... Sorry I jus get emtional when it comes to this subject my husband missed a whole year out of our daughter's life... thank God we got a second chance to prove we are real about our marriage

Yes, the CSC certainly seems to be working on July cases too now, judging by the many July filers getting approvals now. I happened to talk to BIL yesterday, and he says they don't update their systems on a daily basis, happens every two or three months... So that probably is an indicator... The originals are to be submitted to NVC, and would be returned to the beneficiary at the time of interview.

I was wondering...

we were approved for the i-130 and my husb is in jordan so I need to know........will he need original documents??? I remember they asked for copies of originals when i filed the 1-130, now when will they need the originals? Will i be giving it to them with the next packet , or will they want him to bring the originals with him to the interview?? I have all of them with me.

Your husband (beneficiary) should email the DS 3032 form (choice of agent) to NVC once your NVC case number is generated. Then they will generate the bill and you pay the fees online. The next step after paying the fees is where your husband should be filling up the DS230 part I and II, with part one duly signed, and send in all original documents along with the DS 230 to you for submission to NVC.

I got a new passport too, as my earlier passport held my ex-husband's name. I'll be carrying both with me for the interview, just in case.

Have you gotten a response from the IV unit yet?
It's "out of season" to have passports done so it shouldn't take you that long from applying until receiving the passport. A side note is that it took a week for mine(in Gentofte county) so if you have a couple of weeks after you get back from your trip you can renew it by then. Might be a good idea to scan your passport before applying for a new one, only because of the stamps in it.

The unique number on each page of the passport has to match the one in your application, at least that was what I was told so I simply decided to renew it when the time comes.
