My suggestion is: Check the guides and see what is usually requested and what is just suggested. Get your fiancee to write her letter of intent and mail it to you, write your own. Keep them safe where you can send them off quickly if you receive an RFE. Won't hurt to be prepared and won't delay your process more than necessary. If there's anything else you might have forgotten just gather it up as well in case it's asked for in the RFE (if you ever get one).

Folks, this is VERY clear, the 90 day period is not that long so the couple can know each other, is so the couple have enough time to plan their wedding, settle into the new house, some places have different requisites for a wedding license (here we had to have blood work and all that) and some courtrooms are so busy it may take 30-40 days to get an open date for the judge to marry you, THAT's what the 90 days are for.

If you don't know your fiance/e well enough that you need the 90 day period to do so, then you shouldn't have petitioned AT ALL.

It's a waiting game and basically there's nothing you can do to get ahead on the very long line. Just be patient and hang in there. The USC can visit the beneficiary in the meantime so lessen the burden of being apart.

With a straightforward case and having all the proper documentation your fiancee shouldn't have problems in the interview. That being said, if you're comfortable with flying there (time and budget) it certainly won't hurt it. Some consulates allow for the USC to be present at the interview and some don't.

I'd also call the embassy once enough time for them to receive the process is passed and confirm the address change. I changed my address in between NOA2 and embassy myself and although we did call USCIS to change the address on file I also called the embassy and confirmed it with them (they had the old address since they receive the hard copy of the petition).

And btw, using a tourist visa with the intention of getting married AND staying in the US is fraud, and VJ does not give advice on how to commit fraud.

That being said there's no issue in getting married on a tourist visa then returning to their country to apply for a family based visa.

A non-legally binding ceremony does not jeopardize the K1. Some countries have the religious ceremony function as a legally binding contract (eyes of government, not of God), so you gotta look into that. Usually at the end of a "church" wedding you sign a contract that makes it a legal marriage, so it's a case by case issue.

You can say attending a wedding is the reason for traveling, you could even show up with the invitation to prove that's really what you'll be doing (as opposed to working illegally or staying illegally beyond the visa). There's no need to go overboard with K1 copies, etc.

But most importantly, to be approved for the visa you must prove strong bonds with your country to show you WILL indeed return and also to show that you can afford the trip and the stay in the US and that you won't become a burden to the US. Those two are more important than the reason to go. So that's what you need to work on to have a successful interview.

Do not write "none" for "father" and only write "unknown" if it's true. If you know the name and nothing else, write the name and "unknown" only for what is unknown. Never lie and ALWAYS be accurate when filling out immigration forms.



Yep, if you know his name write it down, if it comes up in the interview why his name is not on birth certificate then explain. Simple.

Some people use the receipts for the engagement ring as proof of the relationship and intent to marry to show at the interview, but it's not necessary or mandatory. The letter of intent must be what they were referring to.

The only proof you need is that the relationship is valid and ongoing.

Your evidence looks good, but don't forget the letters of intent to marry from each other. Unless the requirements changed we sent those signed by hand.

The question of how we met, we elaborated a little bit just in the sense that what we wrote in the letter followed the rest of the evidence (photos, etc) we had, to create a chronological sequence of events, up to where he asked my hand in marriage to my father. We decided to do things that way 'cus we thought it helped show the slow development of our relationship and also that we both knew each others families. The idea was to clearly show the depth of our relationship.

Yep, if you read the guides and the I-129F forms's guide you'll see there's a space there for children to be included.

Once you get to the consulate stage you'll then have another form where you'll write down any children that will be traveling with the beneficiary or following the beneficiary later, and those children will have the K2 visa status.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).



So you can take those with you when you visit her.

I think that at any time we talk of our SOs as objects something is wrong. IMO there are no such things as his or her tasks, his or her problems, his or her culture as the issue. Each person is different, and there are all types of people no matter what country you're in. So I wouldn't go as far as saying never to people of a certain nation, or generalizing everyone.

Of course some cultural behavior will always influence one's relationships but then it's YOUR or HIS problem with that particular trait of a culture, and not to be put in general ways (i.e. DON'T marry a woman/man from this or that country).

And yes, the question is there, last address outside of US, it doesn't say last address in past 5 years, it doesn't last address after your turned 18/21, it doesn't say last address if you naturalized. It's a simple question of "none" if you never lived outside the US or "xxxxx st, #xx" if you did.

Yeah, mine was about 2 paragraphs, mostly because what I wrote in the letter was a chronological sequence of our meetings that was supporting the evidence of ongoing relationship sent. I painted a picture for USCIS.

(i.e. sent a picture of us at my graduation ceremony + a copy of my ceremony invitation, and wrote on the reply to Q18 that trip #4 dated XX was for attending my ceremony. So that along with the boarding passes for such a trip was to show that we did meet during said trip with factual evidence. The same way somebody else might send in receipts of hotel stays etc on both names, etc, which I didn't have since he stayed at my house on all but 2 trips, and in those we didn't save receipts from the hotel)

The timeline for processing the AOS is unpredictable, it goes from a couple of months to over a year, some cases take even longer. Average is around 6 months perhaps? But like others said, I wouldn't make any plans with fixed date or that you put non-refundable payment down.

Please read the guides and get familiar with the options, and be aware that in order to petition for her as a fiancee you'll have to have met her in person in the past 2 years and prove it. I dunno if there's more to the story that you're not telling us as far as her need to "escape" but as others said if it's simply due to cultural issues in Ukraine this is the 21st century.

About marrying in a country neither of you is a national of you'd have to research the rules that apply to that country.
