The co-sponsor needs to meet the requirements to support their household + you. If they don't, they can't be a sponsor, so usually it's just the fiancee, which must fill out a form meeting the requirement or not, and one more person that meets the requirements.

I'm just saying that before there were computers, we had papers. In Brasil to this date you can't simply order a Birth Certificate official copy and have it printed out for you. We have one official document that we keep for ourselves and if we ever lose that one the court where it was registered will go through mounds and mounds of books of records to find your birth record and then issue a new official paper. It's the same for marriage and we brazilians know not to ever lose such papers.

So I figured that there would be something similar back when you first married, a book, a file cabinet somewhere that has all those old marriage records signed by the judge of said court, etc.

Shouldn't your marriage certificate show by your SSN? Even if your name is common it should show up in the county you married. Even if she can have disappeared completely your marriage record shouldn't, and with that you'll get her name, her parent's name and maybe her SSN and might be able to locate her or the divorce certificate, if she ever did file for one. If you two aren't in fact divorced you're in bigger trouble by having remarried without being legally able to do so.

Short answer is no.

You can file for the K1 again, with the same steps and waiting time. You can get married in her country and file for a CR-1 as well. But you can't reissue that already approved petition, she left without ever getting married, that visa and the petition that originated it is are no longer valid.

As far as weight allowance and number of suitcases allowed, contact the airline that you're flying with.

As for checked in luggage, usually the airline will check your luggage to the point where your immigration will be. So for example, when I fly from Brasil, let's say a smaller town into São Paulo, then to Miami, then home to San Juan (Puerto Rico), I check my luggage in my depature town and only need to pick it up in Miami, which is where I'll do my customs/immigration in the US, then I check it in again for San Juan (in São Paulo the airline will move my luggage from one plane to the other for me). So if your first flight is already your POE, you get your bags there, and then check them in for the rest of the trip.

Yes, the checks are necessary for security reasons, and it's really not scary (unless either party does have a record that would prevent them from being issued a visa).

You won't be interviewed at all. After approval your case will be sent to your fiancee's consulate where she'll be interviewed (in some consulates you can attend, in others you can be there but not in the room, not sure for China).

I'd suggest your read the guides, there's a flowchart that shows the steps of the case and you can have an idea of what's next and be prepared for it.

Yes, background checks are done on both parties.

The process takes a long time due to the number of cases they receive everyday, for all different types of visas.

There isn't really a slow or slower month really, it all depends on cases received, whether they are focusing on a type of petition that's getting behind, the actual person analyzing your petition (some work faster than others), your evidence, your particular case, etc. It's a lot of factors, really.

You can research the number of petitions they receive to have an idea of how much they have to work to keep these going as fast as possible.

Copies are fine. We never sent any originals of any IRS stuff at all. Originals were only from documents I had to bring (foreign beneficiary) during this part of the process. Only originals that can be sent is the tax transcript that comes certified when you order a copy (at least it's this way here in PR), but the W2's can be copies.

The letter from bank was original, but pay stubs were regular copies as well. You should be just fine.

Since finances are an issue at this step of your process, I'd also point out that once you are approved, and have those 6 months to enter the US and 90 days to get married, you must take into consideration the AOS fees that come right after marriage, which are a little over US$ 1.000 so prepare for that as well.

I believe you can reschedule the interview but it's not recommended to do so. And I never heard of needing US$100 on the day of the interview, it's just the medical and the visa fee. In Brasil if you want the visa mailed instead of FEDExed you won't pay anything, but you do pay if you want the visa delivered.

I think you're doing what you can. Send the documents by Fedex (resend originals of what you can), tell your fiance to print out all the scans, and if the FEDEX doesn't arrive (or the documents you sent), have your fiance take the copies to the interview, and explain the documents were held in customs longer than expected, that way if there are any originals they need, they can probably ask for the documents before approving the petition.

Your only other option is to call the consulate, explain the situation and ask if you should cancel the interview and re-schedule it. I'd e-mail them asking about it.

So I'd advise you to hire a competent immigration attorney and go over your case carefully before proceeding to any interview, especially revising what you've already stated in your file as the overlapping marriages will probably pose a problem at the consulate interview.

1- Back in 2006 I got mine from Rio (the one on the other side of where we get passaports done). It came notarized already. Maybe that's what he meant when he said you wouldn't need to get it notarized.

The one from the IFP was handed back to me with a little paper with the directions to the Cartório where I needed to get it notarized at. I had no problems getting it notarized.

2- I never went the internet route, so not sure if and how it can get validated.

Two options, if the info is too big to fill on the comp you can write "see attachment" or manually write it in smaller handwriting after printing.

As far as address and employment history goes, try to be as accurate as possible, but most likely you won't have any problems if the dates aren't perfect, just don't leave unexplained gaps in either of them.

If you file your taxes as such just go ahead and write self employed instead of unemployed, they'll be looking at your tax returns in order to verify if you can support your fiancee.
