You have to met within the last two years whern filing the petition. So you should be okay from that point of view.

However, as you haven't met in some time, I would think that you will need to provide plenty of evidence that your relationship is continuing - e.g. e-mails, text chats, Skype logs, etc.

Yes it has happened.

For that reason it would not be a good idea to use any copy of communications with that reference as it can (and has been in the past) assumed that you are already married and therefore not eligible for a K1.


Is this particular embassys that are concerned about this? We have been referring to each other as husband and wife for the last 8 or 9 months. There is no communication between us that doesn't refer to us as husband and wife! Every e-mail we've sent each other. Every card we've sent each other. Every video we've made and sent each other.

Oh well. There's nothing we can do now. Our history can't be re-written.

Yes... it is highly possible since one of the requirements is to have met in person... :blush:


I think they have met in person - it's just that it is more than two years ago. So, yes it will be denied as they must have met in person during the two years immediately before filing the petition. There will need to be proof of that - airline ticket receipts, passport entry and exit stamps, etc.

And just another point for you, your member name is all cute and stuff but DO NOT refer to your FIANCE as your "hubby" lest someone believe you are already married and deny your FIANCEE visa, and YES that has happened.


What?! My fiancé and I refer to each other as husband and wife all the time - in e-mails and in cards we send each other whilst apart. And I've used his surname for requesting travel brochures and the like. We feel like we are husband and wife but we aren't legally.

Are you saying that someone was denied the K1 visa because someone in authority thought they were married rather than engaged because they called each other husband and wife?

We've been waiting 8 months with CSC and still no NOA2.

The petitioner is the one who will receive the NOA2. You can set yourself up to get alerts from the USCIS website about when anything changes with you case. You can set up a text and e-mail alert so my fiancé, as he is in the US, gets texts and I get e-mails. Well, hopefully we will at some time.

Igor's list here tells you the most recent NOA2s from CSC. It's still a bit disheartening at the moment but it doesn't depend on people completing their timeline.

The only thing you are risking is the money you spent on your plane ticket ( one round trip ticket purchased before the trip and a one way ticket bought on the spot in case you get sent back ) plus the time spent traveling. If you can afford that , give it a shot. In the end it is at the discretion of the IO if he believes you will return to your country or if you will stay in the US and adjust status from there. What country are you from?


You don't generally have to buy a one way ticket to come back. The airline usually use the return portion of your round trip ticket to send you back.

Hello everybody! I'm a newbie and I need help. Last year my childhood sweetheart found me on Facebook after 20 years of no contact and got engaged when I went to visit him in the Philippines for the first time after 20 long years. I sent out our K1 file on January 16, 2013 and were hoping to get approved before June and have my fiance with me for my Graduation and have our wedding on June 25 but reading everybody's comments it seems like it is not going to happen. My question is would it be faster to go get married in the Philippines, cancel the K1 and apply for the spousal visa or to just wait. Any opinions and information will be greatly appreciated for we are so eager to be together.

Good news. London is not going to want to see one shred of evidence of an ongoing relationship. Throw the emails in the bin. About your visits. There is no written law or rule that says how long you can visit in a years's time that would make you ineligible for a visa. If CBP let's you in and you leave by 90 days so not to overstay the visit, then you have done nothing wrong.

Thank you for your advice - it is always, always welcome. I thought I had done nothing wrong with my visits - it's within the VWP guidelines - but I expected not to be let in last time. I imagine it would be hard for US immigration to track how long you were out of the country, because when my fiancee travels back to the UK, she just scans her passport, so there is no stamp ever showing her return. Only stamps in her passport are all US entry stamps. She's always returned WELL within the 90 days and never spent more than 12 weeks in any year here, but I don't see how they'd be able to know that from looking at her passport with the VWP


They do know. When I entered this time, the officer at passport control said 'I see you stayed the whole 90 days last time'.


I think I will err on the side of caution and use other evidence.

8 months? I think the limit is 6 months within a one-year period, isn't it? Hope that doesn't get you into trouble.


The UK is part of the VWP - visits of up to 90 days at a time are allowed and re-entry is allowed (no guarantee you get in!)

If anyone can give me a recent experience of how long it took them to get from medical exam to interview I'd be grateful. Also if anyone can tell me what the story is if I have to beg them to give me an earlier interview date, that would be great too.. Everything is sent in to the embassy and ready to go, other than my medical results at this point. I think I'll be ok! October is still over 3 months away. Surely it wouldn't take that long?

 

My medical was 30 May and my interview was 18 June (notice of it was posted out on 4 June) .  However, in my covering letter (I sent all the paperwork in advance of my medical)  I had included the date of my wedding (July 12) and attached proof of my booking.  Whether this made a difference, I don't know.  other people around my time who put later dates or no date at all, seem to get dates about 2 weeks later than mine.

 

Before I had received notification of my interview, I had phoned the extortion line and begged for the code to e-mail the Embassy.  I got the code and it is valid for one week.  I didn't use it to ask for an early interview date but I did use it to e-mail the Embassy to ask permission for my fiancé to accompany me to the interview.  The responded to my email in about 2 hours!

OK.  Now something that came up with the clerk checking the paperwork this morning was my name.  I was married at 19 - changed my name to my husband - divorced at 22 - changed my name back to my maiden name, which is what my name has been for the last 28 years.

 

He said 'Were you <married surname> for a while?' I said 'Yes, whilst i was married but I reverted back to my maiden name on my divorce.'  He asked 'How did you do that?  By deed pole?'  I said 'No.  I just reverted back.'  'OK', he said. 

 

Now my US fiance says that it's different in the US.  When you marry, you 'tcik' to say you're going to take your husband's name and then 'tick' to say whether you're going to continue with his name on divorce or revert.

 

Has anyone had this as an issue?  It seems it wasn't a problem today but it did throw me a bit.  Did I miss doing something when I divorced?  I thought, in the UK, you could be called by any name you choose as long as it's not for fraudelent reasons?

Just to let everyone know, I had my interview at the US Embassy this morning - my fiance came with me as he is still in the UK.

We were approved!!!!  Woo hoo!  A clerk spent 10 minutes checking our paperwork and then 15 minute 'interview' that was more like a chat about our relationship.  I should have my visa by early next week and will probably fly back to the US late next week.

I can't begin to tell you how happy we are - woo hoo!!!!



 

I will post more in the London review thread when I get a chance.

My receipt was e-mailed to me pretty much instantly after I paid.  It will be a PDF attachment which you need to print off for the interview.

I have decided to use LondonConsular@state.gov to e-mail them.  It seems to be the most widely used e-mail address.  I have received an automated repsonse to say:

 Your message has been received by the Consular Information Unit. We are currently averaging four to five days to answer routine email correspondence and ten to twelve days for all other email correspondence.      There is no mechanism for "status checks" while a visa application is being processed.  Inquiries concerning cases which require administrative processing or background checks, and which have been pending less than 90 days, will not be answered.     Please do not, under any circumstances, send a duplicate or follow-on e-mail.  Repeat messages slow down our response time, and we reserve the right to permanently delete all e-mails from senders who transmit repeat messages or status checks.   Sincerely, Consular Information Unit

The daft thing is that the letter says that your US citizen fiance can accompany you as long as you let them know in advace his/her full name but them doesn't tell you how to tell them!  Still - I am still 11 days away from the interview.

I need to e-mail the Embassy direct as I would like to ask permission for my fiance to accompany me to the interview.

 

I got the all important code from the extortion line but..... he said to e-mail LondonConsulate@state.gov.  Checking, it seems more likely to be LondonConsular@state.gov.  But I've also found londoniv@state.gov which 'Sunshine', who was in exactly the same positon as me last August, e-mailed and got a response.

 

Any thoughts on which is the best e-mail address to use?  The code will only be valid until the end of today, i think.

Thanks, that's helpful smile.png Kind of wish I'd put a 'date of travel' on mine as well, but seeing as we're not planning on celebrating our wedding till October I'm not sure how much it would have helped.. 

 

So I just put something along the lines of 'I do not yet have a specific date of travel or marriage as of yet, but I hope that you schedule my interview as soon as possible, since I'm available to travel to the interview at any given time'.

 

I'm just really scared right now that I'm going to be away from my guys for ages and ages and ages. It's giving me the fear!

 

It has been known for people to make up a wedding date  innocent.gif   If the Embassy staff are allocating interview dates, then they may give preference to someone who has stated that their wedding is in a month over someone who says they haven't booked their wedding.

 

Although we all know that the offical advice is not to book your wedding until your visa is in your hand.....
 

I wonder if there's a way of saying now that you're scheduling a wedding for late July or something?  I don't know if you can send another covering letter or beg the extortion line for the code to e-mail the Embassy direct.

Hi guys - Finally got all my stuff sent in to the embassy and have my medical scheduled for June 12th, fee paid and everything.

 

Anyone have any recent estimates about how long it will take to hear about my interview? And roughly how long away my interview is in general?


I realise there is probably a timeline for this somewhere, but I've literally filled in so much paper work and stared at so much information today that I think my brain has stopped working..


 

All I can tell is my recent experience.

 

Medical on Thu 30 May.

 

Results sent to Embassy on Mon 3 June

 

File updated on Tue 4 June (CEAC website).  Called DOS who confirmed that I had been allocated an interview date of 18 June.

 

Still not received the actual interview letter.

 

In my covering letter, I said that we were getting married on 12 July and included confirmation of the wedding booking as evidence of that.  I don't know if this helped in getting a date relatively soon.

Well find out a cost to rebook your trip so you can evaluate.
I think they are pretty nice humans at the embassy with a heart and won't try to punish you. Ask if they have anything on June 11-14 because your fiancé will be over and would like to travel with you to London. I wouldn't leave it too open, so specific dates are good. You also have a very important date to get to the US so you don't won't to push it too far back, unless that is also flexible.

Talking of 'human beings', am I able to actually talk to someone at the Embassy rather than e-mail?  If I were to actually speak to someone and say 'can it be brought forward but if it can't, I will keep the18th?'  It is so much easier to have that conversaton with a person than try it via e-mail.

 

I am trying to reschedule the trip to Devon (my fiance wants to see where I lived as a child - sweet!) but there are a number of ducks that I need to get in a row there.

I phoned Knightsbridge Doctors yesterday and they sent my medical results to the Embassy yesterday.  I phoned up the extortion line and paid the MRV fee and managed to persuade them to give me the all important code so I could e-mail the Embassy direct (are wedding is booked for 12 July in the US).  I have been crafting an e-mail to send them but I checked our status on CEAC and it was updated today.  I phoned DOS to check what the update was, expecting that it was just that my medical results had been added to my file.  The 'Packet 4' letter has been sent out today!  I asked her if she was able to see what the date of the interview was and it's 18 June.

 

However.....

 

It is the most inconvenient date they could have chosen for me.  My fiance is coming over on 10 June for 2 weeks and we are due to be in Devon on 18 June (17 to 19 June) - advance train tickets are booked and paid for.  Car hired.  Visit to Dartmouth Steam Railway paid for (fiance is railway nut).  I may be able to change these things to another date at a cost.  Before I do that, do you think there is any chance (using my valuable code) that they might reschedule my interview to 2 or 3 days earlier or 2 days later?  I know that this interview is the most important one of my entire life but I thought I would ask.  I don't want to e-mail the Embassy and they think 'Well, this interview is obviously not that important to her - let's give her a date in July!'

Compiling my documentation for the interview and just printed off the checklist for documents.  I know I have everything but, you know, I just like lists....

 

Under the UK Police Certificates it says:

 

'If the police certifiate states "No Trace" or "No Live Trace", please be prepared to discuss your arrests/cautions/convictions with the consular officer on the day of the interview.'

 

My certificate (as opposed to certifiate whistling.gif ) says 'No Trace' which the ACRO covering letter says means 'You do not have any convictions, cautions, final warnings or reprimands.'

 

Surely this is an error on the US Embassy website?  I have no 'arrests/cautions/convictions' to discuss with them.

I'll give a couple of my experiences to help you decide. I went to the interview so observed this. My financial folder was stuffed with 3 tax returns, two letters of income, and enough financial statements to support a family size of 100. The document lady sifted through and pulled out one tax return and one letter showing a small regular source of income and handed all the rest back. The interviewer never saw the other, nor even mentioned the Affidavit of Support. I learned enough is enough, more is not better, London is not picky if you make enough, and you don't get a better visa with gold stars if you can show a lot of investments. Other people have said similar ---she only took my employer letter and gave the rest back.

 

Thanks again Nich-Nick.  I think I will put the last year's tax transcripts at the front of the folder and offer them that, together with the pay stubs.  I'll keep the other 3 years' tax transcripts at the back of the folder as back-up, just in case.

 

It's useful to know that your older tax returns were joint ones - I can't be the only person who's marrying someone who has divorced in the last couple of years!

I'm afraid I have yet another question.

 

I know that Nich-Nick said in her first post in this thread that only the most recent tax transcript is required.  I have the last 4 years but I have just realized that the first 3 years (2009-2011) are joint returns for my fiance and his then wife.  Is it going to be best if I don't include those at all?  I have my fiance's first sole tax transcript for 2012 and his last 6 pay stubs.  Should that be sufficient?

 

I have a statement of his investments but it's 14 pages long.  For photocopying for the interview, I take it that I only need to photocopy the front page which gives the total amount of his investements not the whole 14 pages?

Soooooo... the 156k says it needs evidence attached (like Birth Cert, marriage cert.. evidence of engagement etc) and everyone on here says don't send it but take it to the interview???

 

Which is it?? And when are they gonna re-write these forms in plain english LOL

 

The 'packet 3' letter supercedes this form as the letter says:

 

'Under no circumstances send any documents to the office until you are specifically requested to do so.'

 

Unfortunately, there was someone at the medical yesterday that thought that meant he shouldn't send his forms in!

 

I agree.  The forms and everything involved with this process would not win a 'Plain English' campaign award.

I know that you've said Nich-Nick that London are not interested in seeing loads of Skype logs, e-mails and stuff.  However, do they need evidence that the relationship is ongoing?  It's not mentioned on the US London website in the documents required by the Embassy.  We have done updated Letters of Intent - is that sufficient or should I be bringing more stuff?  I can't print off our e-mails because we have been calling each other 'husband; and 'wife' for over a year!

Back again.

 

On the London US Embassy website it says:

 

You are required to obtain the original documents or certified copies, and one photocopy (with the exception of your passport and photographs) for yourself and each family member applying for a visa.

 

Does that mean I do not need to take along my fiance (the petitioner's) original documents?  It's just that I'm not absolutely certain that I have my fiance's original divorce document.  I may only have a copy of it.  I can't be certain as I am in the US and my file is in the UK!  My fiance doesn't have the original.

I've been completing the forms for the Embassy and gave done the DS-156 and printed it with the bar code on it.

 

Looking at the completed form again, I realize that I should probably have put NONE for some of the answers e.g. 'Other First and Middle Names Used'.

 

Do I have to complete the form again and get another bar code or can I write NONE in the answers on the form?

Thanks for that Nich-Nick.  Lots of useful information there.  But just to say that NVC are open Monday through Friday from 7:00 AM to 12:00 AM (Eastern Time).  Someone got confused in another thread and thought that NVC were only open for 5 hours a day - they're not, they're open for 17 hours!  You no longer need to press 5 to get a human - the only option now is to speak to a human, which is why you often end up hanging on for some time.

I'm back again.

 

Thankfully, our file has come out of AP at NVC and should be winging its way to London shortly.

 

I have my fiance's 3 years of tax receipts and some recent pay stubs - I can't get an employer's letter as he owns his own company and would be writing the letter himself!  As he has plenty of income to support me, do I really need recent current (checking)  account bank statements?  It's just that, in a gesture of commitment last year, he closed his checking account and we opened one together.  It means that any statement has both our names on it - I just wonder whether that will look strange?  Co-mingling of finances usually happens after marriage, not before!  He has a statement of his investments which is in his sole name.  Would that be better (or needed)?
