12/3 email recieved for case being transfered

12/4 email recieved stating a new office now has jurisdiction of my I 130 case

12/5 email recieved saying my case is now being processed at a USCIS office

Hopefully soon we will all get that approval we've been waiting for.. :)

Does anyone know what's next after we receive the transfer?

Do we as petitioners need to do something?

or how do we know what "local office" it went to?

I live 2 hours south of Fresno in Kern County. My local office, as advised by USCIS, would be Fresno if I was transferred. So I would guess that Fresno would be your local office as well. You can call USCIS and ask a Tier 2 to look it up for you if your transferred. I haven't been transferred yet but I wanted to know just in case.

If you need to know your local office just call and ask a Tier 2. The operator will transfer you because they dont even know that lol. I havent gotten a transfer notice so I guess my file is still at MSC. But at least if I do I know my local office is Fresno.

Hi everyone - so I finally tried the Tier 2 operator call, and got pretty much the same response as everyone else.  Both operators were perfectly nice, but can't say anything other than, "You haven't been transferred to a local office" (which is actually useful information) and the same "They're working on October 2012" that everyone else has gotten.

 

Obviously we all know that October 2012 aren't the only files getting approved right now, so my theory is that in order to avoid complaints, they are basing their standard processing times off of the OLDEST files that are currently being processed and not the AVERAGE age of the files being approved.  That gives the MSC the largest window of time before people can start complaining about being outside "standard processing times".  

 

Not that it makes it okay - and I'm just guessing - but I suspect that's the reasoning behind it.

 

It does start to make me really nervous that he won't get here before next summer - even though we are legally married, we are planning a family wedding ceremony for next June, and we had thought initially that there was no way this process would take longer than that.  Now it looks like our worst-case scenario might come true - and we have to start planning for it just in case.  Luckily, I am in a position to possibly take a month off in the summer (skype in for work meetings and such) and go be with him in Germany, which we might have to do if it comes to that.

 

Let's hope that it doesn't, and we all start to hear more April approvals soon.  And let's send some good thoughts to those poor people from October 2012 who might still be waiting for approvals!

I talked to a Tier 2 as well. The first operator I spoke with gave me the standard paper reading answers and told me to wait a year to get approved. LOL. So I asked and was transferred to a Tier 2 who helped me to confirm what I was already thinking. He said they were telling customers that they are currently processing October 2012 because that's what shows on the NBC website and because of slight delays with files that were transferred. Obviously we can all see that there have been approvals after October 2012. I took it as USCIS is telling petitioners that to cover their own asses. Just wanted to share the info in case anyone was interested and because the info I got kinda makes sense with the info on the post I quoted. Hopefully we will start seeing more approvals for everyone soon. :)

When did you file? You think it will get approved first?

I filed in early August. IDK if it will get approved first but i saw 130's were starting to slow down and the K3 were still at 5 months. Not to metion it was free to file for. Thats why I did it. If our 130 gets approved great, if not at least we have something else working. All it cost me was postage and a little time.

I filed for my K3 as well..and to think all of all those people here that told me it was a waste of my time. Maybe not in the long run.

Personally I could care less about legals or illegals. While I dont agree with immigration laws here in the USA Im only really interested in one thing. Getting that approval and getting to be with my wife again. Its sad to see people trash talking over the internet and such...actually pathetic would be a good word for it. Thank god for skype and the internet. While I cant be with my wife I can at least see and talk to her. For the letters to the news station, I totally agree with that. I think its a good idea to bring this situation to someones attention. Personally I think that there should be a maximum time limit set. But it would be kind of hard for us all to come together and accomplish something with all this bickering about being illegal or not and knowing the situations of others. Regardless I hope within the next few months we all start to see at least a few approvals if not all approved. A little hope is better than none, right?

According to the directions it says you must enclose a copy of the 797 as proof. I would call again and request it. Make sure to get the persons name and agent ID that way you can hold them accountable if you dont get it. Here is the link for the K3 info

Yeah K3 is a viable option. The way I figured is it didnt cost me anything to file it since I already filed a 130. If my K3 does get approved before my 130 then it will cost me a little more money and paperwork in the long run. Which personally I have no issues with. I also figured that at least this by filing a K3 I have at least a different avenue to get my wife here. The K3 is not an obsolete visa, it is only deemed obsolete once your 130 petition is approved. For me personally it was worth it to file. My suggestion would be to do some research and see if it is worth it to you. If you decide it is then you should file..pretty easy to do. Good luck!

I filed my K3 about 4.5 months in roughly. Personally I dont think it will affect your processing time at all. I can say that Ive had more activity on my K3 in the month Ive filed it than I have on my I130. We filed because it was free, K3 is a valid visa, and it wont take your 130 out of line like others here have stated. In the end the K3, if approved, will cost a little more money and create more paperwork...but to us it was worth it.

It would be great if you keep us updated on how the K-3/I-130 work out for you....Maybe I was just too hopeful going into the process and didn't want to create the back-up plan of the K-3? At the time it just seemed like more money....but given how much we are spending visiting and so on and so forth, I can now see the cost really would not be any worse than travel costs to see each other over a longer period of time.

 

 

 

My timeline is updated but I will be sure to post any changes as well. We already have an alien number assigned as well.I figured the K3 was worth it. In the long run if that does get approved before the I130 it will mean spending a little more cash and extra paperwork. But to me whichever way works faster is what Im cool with. Hopefully we will start seeing approvals at the end of this month or sometime next month. Sooner the better!

The more I read about the K3 I think it is still an option.  Only on VJ do a few members say that USCIS takes it and puts both back to the bottom of the pile.  I have asked how they know this but I get no reply to that question.  Logically it  would not make any sense to send someone asking for an early entry into a longer process.  The statement is something like "when the NVC gets both at the same time they cancel the K3".  I think all I-129f get processed the same  (faster), just VJ is not set up to track the K3's  If someone would post the USCIS policy about returning the I-129f and the I-130 to the back of the pile it would let people make up their minds about what to do.  Otherwise its like they are joined together but maybe not when sent to NVC?  or two different things? 

I agree, if you go to the USCIS official site the K3 is still a valid visa to pursue. I also think that it sounds ridiculous to say that if you file a K3 your I-130 gets pulled and put at the bottom of the pile. I personally think thats a rumor that has spread here on VJ as well as other places. Can anyone link something official stating that? Personally after doing my research I filed for the K3 as well as the I-130. Even if it does end up costing me more money and paperwork in the long run I dont care. My goal is like everyone else, to be with my spouse ASAP. Even though the waiting does suck I can at least say that I pursued every avenue I could visa wise to get her here with me. Did you get a notice of Alien Number Change with the NOA1 for your I-129f ?  I did but i dont know if its good or bad. 

I haven't gotten my NOA yet. My file was just signed for in TX earlier this week. If you got an alien number that means someone is working on your case. Id say its a good thing. Hopefully your approval will soon follow.

I filed the I-129f before I found the VJ website.  After reading some of the posts here I was very upset that maybe that put our I-130 at the bottom of the pile with the I-129f now attached to it. 

 

I did see that the California Service Center was proccessing the I-129f faster than the I-130 at that time by about 100 days. 

 

But I'm not saying anyone should do both.  But I did so we'll see.  Maybe I'll get two letters saying USICS is adding 6 months to both. 

 

I wonder if the K1 filers are getting the 6 more month letters too now.

I filed the I-129F as well. Figured we might as well have both running because either way it seems like a slow process. Not to mention all it cost us was a little time and paperwork so we figured why not. Hopefully things will pick up and we wont recieve any extension letters.

When I originally called and asked if my file had been transferred they said "no, we only do that if we need an interview".  Then when I finally got my address changed to my foreign address I called again to see if they will transfer.  The Tier 2 told me "no, your address is foreign it will be processed at NBC.  Only people with national addresses are transferred."

 

That's the issue.  Two people will tell you two different things.

I had a foreign address when we filed in April, an APO box. Now I have a California address. The tier 2 I spoke with told me my file would not be transferred and would be processed at NBC. She also told me I could expect it to be approved sometime around the end of August. Either way hopefully us April folks will start getting approvals and NOA 2's soon.

Finally my wife got her interview today at Tokyo embassy and was approved. Within 5 days she will have her passport and visa. Then a few days later she will finally be home. After almost a year and a half of waiting I can say its about time. Now it seems like the time apart was worth it? LOL. To those still waiting your day of good news is coming. Our I-130 was approved on Dec 10th. Today we got this e-mail saying the application has been shipped to the Dept of State. Anyone know why they didn't say NVC, or does it mean the same thing? Thanks and good luck with all your applications.

Hi all, my wife in the US called NVC several times last week to try to get our case number and received a 'busy' signal instead of getting through to the automated answer service. Anyone had the same or knows why this is?

The ds230 is obsolete. They no longer use this form. You must go online and fill out the ds260. The only thing you need to send with your IV documents is the bar coded cover sheet that comes available when you pay the IV fee. As far as the AOS packet, you need to fill out the I 864 and send the bar coded cover sheet that became available when you paid the AOS fee. Nice to see you! I was wondering what happened to you. I had the same issue and Saylin clarified that the NVC have not updated their instructions and everyone does the online DS-260.

Help needed please.

 

Received AOS payment receipt on March 9th with a letter stating that only those whose NVC case numbers begin with certain three letters need to file the on-line ds260 and send scanned copies of their supporting documents, and that everyone else should file a paper ds230 and send physical copies of their supporting documents.

 

As my NVC case does not begin with the three letters mentioned I filled out a ds230 and have assembled my physical documents to send to NVC.

 

However, yesterday my IV payments cleared and I am now instructed by the CEAC website to fill out an on-line ds260.

 

Would really appreciate it if someone is able to clarify what to do with certainty.

It is only good for one year. So as long as you get a interview before May you should be good to go.

Hi all. Could anyone tell me categorically how long a uk police certificate is valid for please?

 

I am a uk citizen with an American spouse so my interview will be at the US embassy in the UK sometime this spring.

 

My police certificate was issued in May 2013 so I am needing to know if it will still be valid for my interview.
