You should be good to store the pics on your computer.  We sent a few pics in and we have the origionals on a memory card. But the ones we sent we dont expect to get back. Its ok though, it was less than $1 to print them out.

Thats it. We didnt use or include any affadavits and we used our address abroad on all forms. Except where it asks where we will live in the USA, we put our USA address there. We also kept a copy of everything we sent in as advised in other posts in the forum. We mailed it off and it was accepted about a week later. Good luck with your journey!

Hi VJ members, we are currently filling out i-864ez, and we are not sure what to put on #18:individual annual income. My husband filed as MFS for tax year 2013. He received wage increase since two months ago, and obviously, this increase has not been reflected on 2013 IRS tax return yet.
Im trying to help my hubby to fillout i-864ez but I'm not very familiar with the tax return forms in the US, I hope you can help me....

First question is:

1. Where do we get the answer for #18- are we going to refer to 2013 IRS tax transcript(total income), or do we refer to his recent paystubs which show the increase?

*I'm thinking he should get a letter from his employer stating his current annual income.

I have some other questions:

2. Btw, if we are including paystubs in the AOS package, do they need the originals or just photocopy?

3. I saw some posts saying the beneficiary's alien number can be found on NOA2 hardcopy? Is that true? Coz ours only showed my husband's (petitioner) A number. He is now a USC.

4. On 1-864ez #14: My husband has been a citizen since 1997, if he ticks the box for "I am a US citizen," does he still need to put his A-number parallel to the second option which says "I am an LPR"?

1. #18 I took my monthly pay x12. That was good enough for NVC.

* an employer letter is a good idea. I added a recent one to make my process go smooth. Your HR or boss should be able to hook you up.

2. Photocopy stubs will work. Keep originals for the interview just in case. OR just add in your federal tax return for the prior 3 years. NVC informed me that the Tokyo embassy would not give my wife an interview if my 2013 taxes hadn't been filed. Tokyo embassy confirmed that when I called them. Filed my taxes and submitted the most current 3 year federal returns. No issues and my appointment has been set. Might be worth looking into.

3. My wife's alien number was on our NOA2. However we put N/A and had no issues.

4. check US citizen

Hi all, 

 

Ok so my wife spoke to an immigration lawyer today for some advise, we have already filed form I-130 and received the notice/receipt. 

 

She did ask weather I would be able to come into the USA on a VWP (Visa waiver program / standard tourist visa which allows a a tourist up to to 90 days to remain in the USA) and he replied and was adamant to say that I should not do that as it could delay / mess up the I-130 process! I have however asked on the forum before and others have stated that they did do so and had no problems. 

 

So my question is has anybody had any problems with this? Of course having a return flight ticket already booked and ties that show your 'need' to return back home is a given.

I have the same case!! My PD is 9 jan 2014!! My lawyer told me not to apply for a tourist visa as it would mess the status. Mine one is too a reputed immigration lawyer. he said the process would take 10 months and hence i should wait and not rush for visitors visa. i even posted the same question on lawfaq.com and every single US lawyer asked me not to apply for visitors visa as it would delay the entire process.

 

My thoughts exactly! 

 

Because I've seen everyone say the same thing that it's ok to travel etc... however he does have a good reputation and he is a specific immigration lawyer. I have followed this question up with him and I'm yet to hear back from him (I just emailed him) but was very surprised when my wife told me!!

I had read about checks at airports when one parent travels alone with a child and so I was insistent that my husband change his ticket to travel on the same flight as me when we returned to China after my maternity leave was up. He managed to do it so I never found out if there was any truth to this. However, my sister's husband is Greek and she has been traveling alone with their son back and forth to Greece (where she lives) since his birth 5 years ago. She does it at least once a year. She didn't even know about this warning when I asked her. She has never been questioned.

I think the real issue is getting the passport. Since both parents have to know about this and agree to it, it really takes all responsibility away from the people at the POD, and since you are a USC taking your child out of the US rather than the foreign spouse taking the child out of the US, I don't think it would be a problem anyway.

I suppose you could bring proof of strong ties to the US with you just in case, and maybe even your NOA to show that you will be coming back to the US. I doubt you will need it.

Wow! Tough question. Initially it seems easy. My gut reaction is that I would be out of there faster than a cat with its tail on fire, but I think there might be situations where I wouldn't. It's hard to explain, but I think that some relationships could rise above this sort of thing. I hope I don't have to find out if mine is one of those because I have a feeling it isn't.

As for spying software, I suppose if I was already sure in my heart and only needed the evidence to feel justified in my decision to leave and never intended to cite my findings to anyone as the reason for my leaving, I might use it. I think I'd have to have one foot out the door already to use it because once I had betrayed the trust that way, I wouldn't be able to stay if I found out I was wrong.

I usually bring something typical from my area to my friends abroad. I am from Louisiana and we grow pecans there. It is hard to get pecans in Europe or asia, or they are ridiculously expensive. I don't know about Iran, but I would imagine pecans are not indigenous. If your in-laws have never tried pecans, they would probably love them and it might be unique.

Another really popular gift from my area is Cajun spice mix. I sort of doubt something like that would be an appropriate gift for in-laws in Iran, but who knows.

What about a coffee-table book with photos of your state or a national park?

I've never given any of this sort of stuff to my in-laws, but it's easy to buy for them. Shoes and cell phones, etc. I don't think that would do for your in-laws.

How does your employer do a 'check' to make sure someone is 'legal to work'.

I presume you are aware that any such checks cannot be performed until someone is actually hired.

In the case of the OP, her husband has not even been offered the job. Employers cannot ask for identifying documents until someone has been hired.

My understanding is the employee has to actually be hired before any identifying documents can be requested. I am unclear as to how a 'temporary OK' would be a 'hiring'. Perhaps it is.

At any rate, my understanding is that the husband in question was asked to produce these documents prior to his offer of employement. Perhaps I am wrong there.

If a person possesses a driver's license and a state ID then that satisfies the requirements of the I9. An employer cannot ask to see a greencard. I interpreted the post as he was required to produce a greencard before anything was mentioned about a background check.

I have had my background checked before for jobs. I have never been asked to provide ANY documentation other than signing a form that I consented to the check. My husband (the immigrant) had a background check for a prior job and there was no request for documents on that employer's part.

The extant question here would be (if the University requires a background check on employees) what documents does it request from employees?


I think we have to remember we are dealing with an educational institution. They require different types of checks on employees. Before I could be officially hired by my school district, I had to be fingerprinted and have a background check. It wasn't as extensive as it sounds like is being done here, but I had to give all my information before I was hired. I had been fingerprinted once before when I first started working in public schools here about 17 years ago, but I guess they wanted a digital fingerprint now that I was gettng back in the system. The same thing is done for janitors, secretaries, bus drivers, people who work in the main office nowhere near students. It's a state law. It's part a sincere effort to protect the students and part a CYA thing.

I asked this question and was also directed to the FAQ which doesn't really answer the question. Since then I have read your thread and a couple of others on the same topic. I've decided to wait until after my husband has entered on his visa to file our I-130, but it would be interesting to perhaps word the question in a different way. The responses I've read are of two types. The first type offers speculation about the answer. The other type offers first-hand experience. The only first-hand experience I've read is that while the beneficiary of an I-130/I-129f travelling on a B-1/B-2 has been questioned at the POE, no one has been turned back. It might be interesting to illicit only responses from people with first-hand experience who have been denied entry on their B-1/B-2s simply by virtue of their pending I-130 or I-129f.

Another question is that in one thread on this topic someone said that if you are in the US on a B-1/B-2 when your I-130 or I-129f is denied, you have to wait two years before you can reapply. I'm not sure there is any validity to this statement. I've asked for clarification and a source, but I haven't seen one yet. I'm still very new and ignorant about this whole thing, but it seems to me the two things are not related. The B-1/B-2 is a straightforward visa. It is legal and travelling on it is legal. It is not linked to the I-130 or the I-129f in any way. I can understand if you came on a non-immigrant visa of any sort and then applied for a change of status to an immigrant visa and were denied, then you might have a wait period before you could reapply, but if you do not overstay your B-1/B-2, I can't see how legally visiting the US with full knowledge of your embassy which granted the visa and immigration who let you into the country could in any way affect your application for an immigrant visa except in a positive way. Does anyone know about this?

Actually, I filed on turbo tax and my husband doesn't have an ssn or an itin. We tried several years ago to get the itin so he could open a bank account with my bank, but i don't remember what happened. For whatever reason, we dropped the ball on that one. For the space where it asks for his ssn, I put "Applying for". My friend's accountant told her to do that for her husband when they were living abroad and starting the process. Anyway, turbo tax kept telling me I was missing some information, but I kept saying file anyway. (I guess that is how Geitner got around his oversight as well.) I filed 4 years worth of returns with "applying for" in that spot. (I owed nothing for the first three of those years and got a big rebate for the last year due to foreign earned income exclusion all four years. But I don't think it would have made a difference if I had owed anything.)

My friend was married and living in her husband's country for 7 years before she ever filed, and then she only filed for the 3 years she needed to file to apply for his visa. That was her accountant's advice. No one ever asked about the tax returns. But she had no income. They were looking at her assets. I guess they will look more closely at returns when they are your AOS proof, but I don't think the alien spouse's ssn will become an issue.

additionally the date of your interview is totally beyond anyones ability to determine. my best advice would be to look at the consulate and check the average time line to get a better idea of how long it would take. hope this helps.

The K1 visa is for bringing a fiance(e) to the U.S. for the purpose of getting married in the USA



The CR1 visa is also for couples who marry in the US, but the foreign spouse returns back to their country of origin while the visa is being processed

You can use assets and savings on the I-864 also.

But I'm curious, why don't you go and get a job? It will make supporting your husband easier when he comes. What do you live on? I guess writing up and including reasons why you don't work in your I-864 would be good, and make sure he knows the reasons in case they ask him questions about it at his interview.
