   I don't see why not it's just a payment and why can't you pay it if they are away?  I think either one is fine but someone correct me if I'm wrong.

 

We've actually given the lawyers their fees as well as money for the AOS and IV fees when we hired them. So they have all our money!!! :ranting:

 

If we go ahead and pay it now, we may never get back the money we've already paid them... Dont you just hate it when lawyers take their own sweet time!

I was getting the same message until I got an email from NVC telling me that the AoS fees are ready.

It takes up to a week from the day they assign a case #.

It is ok, don't panic!!!

 

One week to the dot for me! I had my case number assigned 15 April and AOS and IV fees became available for payment today! It's 22nd already where I am :)

Do you mean IV fee? Your signature says your AOS fees were paid on 17th of April.

Hi Guys ,
I am realy stressed out right now, just finish speaking to NVC regarding the checklist i recieved on that it says that my joint sponser does not meet the requirement to file the i-864 form. He is retired since 2011 and he made 39000$ last year on his social security and he has wife , his income is way over the poverty guidelines for household size 3 but since he is retired NVC represntative says that he does not meet the requirement...

just wanna know if this is true that retired person cannot sponsor anyone even though his social security income is well over the povery guidelines

Any help on this would be really helpfull




 

I'm pretty much in the same boat. Is there an age limit for the co-sponsor?

He usually beats me! hah, it is a fun way to spend time together. :) Of course not as fun as actually being in same place! Almost there though, we are sure hoping we get him over for our 1 year anniversary July 7th.

 

Twice a day? For hours?? I'm so jealous!!! My husband and I can only make Saturday morning (Malaysian Time) which is Friday night in the US where he is. And that too only for a couple of hours. Our schedules never line up :cry: Being on opposite ends of the earth totally sucks!!

Your assumption about "we're ok" is incorrect.  You may NOT legally file as "single" if you are legally married.

 

This fact is correct:  You cannot e-file MFS or MFJ or married at all when your spouse is a non-resident alien without an SSN.  You must print out your return and file it manually until the NRA spouse gets an SSN.

 

While the IRS may accept the return filed as single, because the IRS does not share information with the USCIS or NVC about your marital status, it may cause the NRA spouse serious grief at the interview, and, in subsequent years, cause the couple great grief with the IRS.

 

Your husband will need to amend his tax return.  You may get through your interview just fine - or you may not.  Just get him to go ahead and amend his return now so you can demonstrate that he understands his mistake and is trying to correct it.

 

Remember, it would be VERY rare to find an accountant that is fully versed in immigration law, just as it would be very rare to find an immigration attorney that is fully versed in tax law.

 

I happen to be a petitioner who is retired from an accounting firm.

We will refile manually as Married Filing Separately but I hope we can make do and send the one filed 'Single' to NVC first with a letter explaining the situation and informing them that we are in the process of getting it corrected. We're due for our case number any time now and don't want to delay with the AOS package. I'm sure we'd have the corrected one in time for my interview in Kuala Lumpur.

 

You think that ought to work?

Based on your timeline, you should be getting your Case # and IIN any day now. Things will start rolling faster after that. In fact, you should be ready to send your AOS package in a couple of days after Case #. So I don't think you have time to amend your tax return with the NVC AOS package. Just send a copy of what was submitted to IRS (2013 return). For the interview, you can (and probably you should) carry an amended return showing MFS.

 

That sounds like a reasonable and good idea. Anyway my husband is seeing his tax consultant in the morning and should be able tell roughly how long it would take to refile or amend. But I think I'll let our lawyer send in the stuff we have now in the AOS package just as it is. Really don't want to be waiting longer than necessary!

Okay I'm quoting myself but I just found this link on VJ about someone else in a similar situation and apparently you cannot file MFS or MFJ or married at all if you're doing e-filing when your spouse is a non resident without a SSN. So I'm assuming we're ok with my husband having filed Single.

Just called NVC and I have finally have a case number!!! So excited!! I already filled out the form to be updated on the spreadsheet, but for those of you keeping track so that you know if you are close to getting a case number, NVC received my case on March 27th.

 

What a sense of relief... there might actually be a light at the end of the tunnel  :idea:  :joy:

So I hope I'm not the only one facing this issue with vaccinations. I know I got a bunch of vaccinations as a baby (which is mandatory in Malaysia) as well as in primary school (also mandatory). I think they include polio that we all get at intervals of a couple of months as a baby. I have a record of a couple on my birth certificate. But that's it! I don't have any record of the vaccinations I got in school. Has anyone managed to get their hands on these records? How do we do that? Go back to school? Or do we just forget about it and just get the vaccinations at the medical?

 

Another thing, did anyone get vaccinations prior to the medical and find it worth it in terms of cost? Or should I just get it done at the medical and get a whole cocktail of medicine injected into me?

Now I'm freakin highly annoyed. Nothing yet. Amanda said they're getting a high influx of mail right now.

Sometimes I wonder if doing things the illegal way would have just been better. I know people who came here illegally, got married and became residents within 2 months of their marriage. Clearly doing the right thing is the wrong way to go about it.

 

I sooo feel you! I have wondered that every single day since filing the i-130! To think that the ones who do it by the books are the ones suffering is so sad!! :cry:

For all those looking for flights (now or for the future), I find the "google flights" has really good fares... the best I've found, at least for us from the Caribbean to the US west coast. At the top of your search results, it will even give you suggestions on how to get a cheaper flight (i.e. leave a day later or leave from another airport nearby). It also has a really awesome calendar that has a graph at the bottom showing which days have the lowest fares for the selected route, which is good for us because we won't have to leave on any specific day after we get the visa, just which ever day has the cheapest flight!

Well, my AOS was submitted electronic April 29.  I called NVC and is not yet review and I have to count 30 business  $%^& days! blah , blah , blah.  From yesterday I have to count another 30 business days (IV submitted).  I can say good bye to July interview. :cry:  :cry:  :cry:

Arghhh I hate my lawyer and her paralegal!  :ranting:  They screw up the I-864 by rounding up the figures causing us to get a checklist (on 5/21). And now the paralegal goes off on holiday and the lawyer doesn't have a slot on her calendar until June 2! That's a total of 10 days wasted doing absolutely nothing! :clock:  I so regret using a lawyer. I could have done it myself with the help from you good people :cry:

Oh no!  :( What did they checklist you for?
 

 

I had a checklist for 2 parts. On my joint, sponsor's I-864, it was:

1. In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.
 

I know it was covered like a million times here, but since it's all being done by a lawyer in the US, I dont have any control over what they fill out. Besides, they probably think I'm an idiot anyway!

 

2. You must submit the following financial evidence:
[x] ___2013____________________________ IRS tax schedules.
[x] _______2013________________________ Federal income tax returns, IRS printout, or Letter 1722 issued by the IRS.
 


 

I'm positive my husband handed them copies of all his 2013 tax stuff, so I really dont know what's happening :( My husband will be calling the lawyer in the morning and possibly be going over to see them. I just hate the fact that because of this we're gonna be delayed another month! I hope they don't take 30 days to review corrected documents as well...

I had mentioned earlier that I was gonna take a hiatus from my frequent NVC phone calls. So I broke the streak today. I made the phone call and had the longest wait ever, before one of the operators came on and told me that it will not be long before my case is complete. Why? I calmly asked, and she said its because they were revewing April 26th mails (It was a Saturday) and she noted that my I864W was received on May1. I wonder how many days they take to review an average day's mail. Time will tell..... crossed fingers and toes.

 

This is the most exciting news I've heard for a while!! (besides all you good people with case completes of course and case numbers being assigned of course) :)

The wait had been long and tormenting but we like many have passed the test..
Luckily dint have any checklists but they did confirm june interviews are filled.
