Hi all,

In anticipation of an approval and preparation of our interview packet, I need to get my fiancee's immunization records from Dubai translated into English. She's in Edmonton, so I'm hoping for something close. I do have a couple questions.

Is it generally recommended that I get a certified translation from a company? I don't know if it's a requirement for Woking Medical, but would hate for an RFE for that minor thing. I know that any translator could write a certification note, but would using a company bolster the accuracy?

If I'm using a company, do you have a recommendation as to whom? Are we allowed to list some on the boards? I found Cilfo Translations - who work via email - that will do the translation for $150 (their flat fee), but wondered if anyone has had a good experience otherwise? This would obviously be from Arabic to English.

Save yourself $150 and have your fiancee go to her doctor and get titre tests done for the required vaccinations. They will draw a few vials of blood and test the immunity levels to see if she has had that vaccine. She will have to ask her dr for a copy of the results to take to her medical.

Getting the titre tests done is free (at least it was in Ontario). And with the titre tests you are 100% certain that the proper vaccinations were recieved.

Canadaclaiming ei for 2010 tax return?

Greetings all-

I know it's early but this came up at the breakfast table this a/m - and feed back would be great.
I poe'd in Dec of 2010 - I filed income tax in Canada (exit return) and jointly with my husband in the us as we were married dec of 2010 Year filing 2009). I am collecting ei from Canada and that will be my total income for 2010 - Question: Do i have to file in both countries? 2. What amount - as the exchange re4ally makes a huge difference...depending on the rate of course it has been as low as $50.00 less then what the check is actually written out for...Just wondering if theres a % we can use to get a more 'realisitic' amount...Any ideas?

If you have already filed an exit return in Canada, you will only have to file in the US (Canada takes a 25% withholding to cover the taxes).

As for the exchange, you will have to convert you EI into US dollars. You do this by using the 'yearly average exchange rate.' Here is the chart from the IRS site http://www.irs.gov/b...=206089,00.html

CanadaDid you have to go through ROC?

Reading over the steps to AOS and getting a GC, I saw that some people had to go through Removal of Conditions and some don't. I noted that the majority of people who had to ROC were those from countries like the UK and Canada. Just wondering if you had to ROC or not.

I would say 95%+ of people have to go through ROC. The only time that you don't have to do ROC is if you wait more than 2 years to file your AOS. Since you remove conditions after 2 years, if you have already waited out that period (by delaying AOS) they will issue your 10yr green card instead of your 2yr conditional one.

If as a K1 you get married within the 90 days and file AOS right after your marriage, you will need to file for ROC within 90 days of your conditional CG expiring.

I am so sorry Kim, this really sucks. Why does buying a home have to be so stressful and filled with disappointmet????? I hope that it somehow all works out for you, but sometimes these things happen for a reason. When I was house hunting a few years ago in Canada, I found a place that I absolutely wanted...it was the perfect location, and price. It needed a bit of work, but nothing I couldn't handle. I was out bid, and was beyond disappointed, but a week later I looked at another place and realized it was 100 times better and I ended up loving absolutely everything about it. I loved all the colors they had and didn't have to do a single thing when I moved in. Hopefully this will be the same situation for you!

We are hoping to be able to look at buying soon...I am getting so sick of living in a tiny apartment.

Canadaomg i can't believe it!!

So its been 2 months since they auctioned off the house we loved and put an offer on. And its been 3 months that we have been with inlaws and i've been slowly going crazy.



Last night we are on the phone with my new realtor, and she tells me about a house that is more expensive than we want but she can get the guy to drop the price (same realty company). Anyway we agree to go see them today, they are in the same area as the house we wanted. So i go on Redfin to see her colleagues house, and OMFG, what do i see at the bottom of the page for other similar homes....thats rightOUR ORIGINAL HOUSE!!!!



It was there for less money to boot! So my last realtor, and the lawers for the auction and the old bank all lied etc etc...it never got sold it never got given to the bank..i dont even know where it went or what happend. but my realtor (shes the foreclosure specialist that was originally trying to sell it to us) was freaking out saying unreal this is unreal.. and now we are going to see it again and buy it for even less!!!



some of the appliances are gone from what i see in the new pictures, some minor dmgs in walls like from banging furniture into them but other than that..i'm so happy i could cry. its 8k less than it was originally, and i'll bloody pay 8k more if i have to to get it!!! we might just have a home before winter finally, cuz as it stands, i was about to kill my mother in law!!!!

No one had anything but papers at the embassy in Montreal. They are extremely strict and anything electronic is not allowed inside the embassy. They wouldn't even let this person bring their car key remote inside. They had to leave it in a locker down the street.

I had one of those greeting cards that play the little song in my folder of evidence and I had to leave that at security. I would be confident in saying that no, kindles are not allowed!

I did my medical mid-november and then didn't have my interview until the end of March. I was laid off from my job while waiting for my interview to be scheduled, so I decided to head to the US and wait it out with my fiance. I did my medical before I left so I wouldn't have to worry about scheduling it to work with my interview and have to spend extra nights in Montreal.

They held the results for me at the office and I just called them a week or 2 before my interview so they would have my package ready to pick up. I did my medical with Dr. Seiden in Mtl.

You may want to speak to someone from the health unit because I know there are certain viruses that you can't test immunity for. I had this problem trying to get my vaccines done for my K1 medical and they needed my immunization record to prove Measles/Mumps/Rubella (I think there's only one of those they can't test for but again, not sure which one).

I had to get my 2nd shot for MMR which was free (covered by my MSP so I don't know how much that cost) and the TDap was $40 at a Travel Clinic.

As long as you haven't had a TDap shot within the last 10 years they should give it to you but make sure you ask for TDap specifically because they will try to just give you part of it...

Where did you get your titre tests done? I didn't have my immunization records so I had to get the titre tests and they were able to test for everything.

I started talking to my boss while we were still waiting for the I-129 to be approved. They were beginning to work on another round of layoffs, so I was able to work it out that I got laid off and recieved a nice 6 month severance package. They actually outsourced my job to a LCC (low cost country) so I had to train my successor. It worked out well for me!

I got my PCC also in Quebec (some local agency in Montreal). It was both in English and French, so hopefully it's the same for yours. If it is only in French, you should still be okay since your interview is taking place in Canada, where one of the official languages is French.

One of the official languages of Canada is french however it is not an official language of the US, and you are interviewing at a US consulate. I would play it safe and get it translated. If you did not get it done and they wanted it translated and you had to send it back to the consulate it could add a few months onto you getting your visa since Montreal is soooooo slow at dealing with their mail.

My AOS/EAD was abnormally long (due to lack of biometric appt availabilty at my local ASC) so although my EAD was approved about 60ish days after I applied...I did not get an appt for my biometrics until almost 5 months later (you need the biometrics before they can issue your EAD card). When doing an EI claim they go from the date on the card, so I could have got close to 3 months of back payments from EI had I started a basic job search (posting resume on Monster, sending a few applications etc) when I assumed that my EAD would be approved.

I would suggest starting a basic job search around 45-60 days from applying just in case you run into a situation like mine. The $3500 that I could have recieved in back payments from EI would have come in very handy when I finally was able to recieve it!!

CanadaImmigrating to Canada under spousal sponsorship

I was wondering if anyone could give me some advice before I get married in Canada as to what I will need to do before leaving the U.S.I beleieve Ill need a police back ground check but as Iam applying for a sponsorship with in Canada I am under the impression that I can do most of my work there including a medical check.

From the little bit of research I have done on it (as we are considering moving back to Canada) you will need a FBI background check (which can take 16-20wks I think) as well as background checks for any country that you may have lived in for more than 6 months. You will need to send a copy of your passport page with all of the biographical information, your medical exam, proof of your relationship to your sponsor and immigration photos (these are not the same size as passport photos, so you will have to get the info off the CIC site for the proper size specifications and take them with you to the photographer. This is on top of all the application forms, proof of identification and marriage/divorce documents.

CanadaPregnant and hoping to travel home to Canada for Christmas
I would be leary of traveling at that point in my pregnancy. Also I know when I wanted to travel back to Canada after I had my LO I needed to have a passport for her. This meant I had to wait to get her birth certificate and her SSN. This took about 6 weeks, then I had to get her passport which was another couple of weeks. So I am assuming that you would have to do the same if your baby was born in Canada. I think it takes a lot longer to get a birth certificate in Canada (I have had friends who waited months).

As previous posters said that the baby will be a dual citizen, but you need to have the documents to prove that at the border!! Both times I have traveled with my LO they have asked me at the borders (both going and coming back) for the notarized letter from my husband acknowledging that he was aware and approved of me taking our child out of the country. Even though your husband is deployed you might require something like that from him.

We ended up getting pregnant just before I got my visa and moved to the US (I had been visiting my fiance for 4 months while I waited for my visa interview, and when I came back from Canada 2 weeks after my interview....surprise!!). I was able to be added onto my husbands insurance and they covered my pregnancy. If you were getting your own personal insurance you would still be covered under the HIPPA laws (since you come from a country with national health insurance it is like having health insurance here and you are just moving to a different policy so they can not reject you for pre-existing conditions). However when I got a quote on insurance (since my husband wasn't able to add me for almost 3 months, it was going to cost me $2450.00 per month (no that is NOT a typo) for maternity coverage. So if you are already pregnant when you move to the US it could be costly for insurance for those first few months. We ended up paying out of pocket for my first few months of prenatal care, and it didn't cost too much. They charge you significantly less when you are uninsured.

As for EI, not only can you claim EI ,but if you are able to time your pregnancy correctly (easier said then done) you can get your full years worth of mat leave. I am not exactly sure on all the rules but I was fortunate enough to have it work out for me (although I only got 6 months since I had received a severance package from my employer when I left Canada). It may be worth a trip to a Service Canada office and speak to an unemployment officer and find out exactly how it all works. It was sooooo nice to be able to have that time with my baby after she was born. Standard Mat leave here in the US is 12 weeks....UNPAID.

Right now, with the unemployment issue in the US, it is VERY difficult to get a TN visa unless you have some very specific skills. And unfortunately there is no sort of 'get to know you visa". You can try to go down and visit and use the 6 months of time alloted for Canadians to have physical presence in the US, but it is very unlikely that you will be admitted for that time period without strong ties back to Canada (a lease agreement, letter from employer stating return to work or documents showing return to school and definitely a return ticket). You can try to get in for the 6 months, but be fully prepared to be either turned back or only allowed in for a shorter time period. It is totally up to the individual CBP officer as to whether you get admitted or not. Ensure that you are clear that you are only visiting, not trying to live together (as this alludes to immigration intent) only give information they request when they ask you questions and do not, for any reason, lie.

There are 2 types of 'relationship' visa's that you can apply for. The first is a fiance(e) visa (K-1). This takes around 9 months to process and allows you to enter into the US, get married, and then you have to apply for AOS to get your green card. You have 90 days once you enter the US on your visa to get married. It is a relatively short period, but it would give you some time to live together and get to know each others annoying little habits..lol

The spousal visa (CR-1) requires that you are married, then you apply. It takes about a year to process, but you get your green card (and thus work authorization) when you enter the US. It takes a bit longer initially, but ends up being faster (as AOS with the K-1 visa can take another 3-6 months) and it ends up being cheaper.

CanadaFrustrated with trying to get money to the US!

Ok, I think I have read every post on using Custom House (which is now owned by Western Union) and banking with RBC. I have no idea what to do! I NEED to get some money here, and hopefully my EI cheques (a whole other disaster story) are going to finally start coming soon, and I could really use access to this money. I contacted Custom House and tried to open an account, but they needed me to get a form filled out by a guarantor, and I haven't been able to do this. Is it worth my while to try and open an RBC account in Canada? I currently bank with PC Financial (I still have my parents address as my mailing address so that I don't have to close my accounts) and have several accounts with them, including my RRSP. At this point I just really need some good advice on the best way to get money here (and the cheapest :D ). Any advice will be greatly appreciated!

Open RBC Canada and RBC USA accounts and link the 2 online. Have your EI cheques direct deposited into your RBC canada account, transfer the money to your RBC USA account online and you are good to go. I think I pay a $4 monthly fee for each of my accounts, but there is not charge for transfers. If you have Weigels stores where you live, they have no fee ATM's so you can withdrawl money without it costing you anything (or do cash back when you are shopping).

The only downside is if you don't live near a RBC USA branch it there could be some issues if you ever need a branch. I have been here for 2 years and have yet needed to go to a branch.

Not only can I not afford the center ice package, I work a 4pm to 2:30 am shift so I rarely get to see any games. I do get the NHL network and Versus so we do get some games...I am just never home to watch them, and rarely is it my team playing.

As for the Hockey Night in Canada Theme and CBC.....did Hockey Night in Canada not move to CTV a few years ago and CBC had to do a new theme song?

On the weekend I went to our storage unit to pull out some bins of my clothes that I can finally fit back into since having my baby and I found this T-Shirt that I got at walmart a few years ago. It says "I (L) Hockey Night in Canada" and I just happened to wear it today!!

If you are lucky enough to "time" your pregnancy there is a chance that you can claim your maternity benefits from Canada. I had my baby nearly a year ago and I was able to recieve my benefits (although I only got 6 months because of a severance package from my last employer in Canada). If you are considering trying to get pregnant soon I would either call or go into a service Canada office and find out how you would have to "time" your pregnancy to recieve your benefits. We were just lucky that it worked out for us since we were not really trying at the time we got pregnant.

The way it works in Canada is you get 15 weeks of maternity leave then 35 weeks of parental leave making 50 weeks. In the US you generally get 6 weeks to 3 months and most often it is unpaid. It is also dependant on the size of the company that you work for. I think if it is less than 50 employees they do not have to provide FMLA benefits, so that is something to look into as well.

I had no problems getting titre tests done in ON, I just went to my family Dr and asked for them. If your doctor does not know what a titre test is, I would be worried about the level of care that I am getting from them!!

What about shipping with Greyhound? I have shipped some stuff across Canada with greyhound and it was fairly reasonable (mind you this was several years ago). I am not sure how they would handle the customs end...I would assume that it would be similar to shipping with a moving company.

I had a 3bedroom house to move and I used ABF. It was fairly reasonable.

You would definitely have to look into your medical insurance to see if they will cover a out of country birth. If not I am sure it would be a similar cost as having a baby in the US without insurance (so ~ 10k for an uncomplicated birth).

I had thought that I might have gotten a confirmation email from EI or something, but I guess I'll wait till Tuesday and see when I can expect the cards to start arriving. As to the EAD thing, wow, that long? I was really hoping that I would get something sooner, hopefully I won't have to wait so long.

I am pretty sure I recieved a letter in the mail, but I can't remember how long it took, sorry I can't be or more help there. But again my EI case was a bit different since I was laid off from my job and recieved a 6 month severance package, so I didn't qualify for EI until the end of that 6 months. My case for EAD was not typical, so I doubt that you will have such a long wait. There are a handful of ASC's that tend to get backed up and it takes FOREVER to get an appt for biometrics, and that was my issue. I had to contact our congressman for help getting an appt since I was about 7.5 months pregnant, so if I ended up having to have in interview I couldn't have done the 6hr drive to the local USCIS office!! They did waive my requirement for an appt...I guess having a baby was sufficient proof of a bona fide marriage :)

My husband has been in the states a few weeks and we recently got married. Is he eligible for EI? Canada or U.S.? We are about to send in out AOS paperwork as well. If there money available we want it too..lol.

If he is from Canada and has met the criteria for qualifying for EI he can claim it. He had to have applied within 4 weeks of his last day of work, and he won't be able to recieve payments until he has his EAD, but it would give a bit of income while he is looking for employement in the US.

I had expected to be getting cards to return to them saying that I was unable to work, and yes, I was aware that I would't be getting payments till later, but what my question actually was is will I not get any kind of a confirmation at all that they have received my application??

And again, I know that I can't work until I get my EAD, but when I file for the AOS with the EAD, I know some people wait 3 months or longer before they get a card saying they can work but EI tells them that they should have been looking because they were approved for work, so what I was actually asking is, when do I know that I have EAD confirmation if I don't get my card till later down the line??

Yes you should still be recieving cards eventhough you are still awaiting your EAD. You would answer the questions on the back, but when it comes to the one that asks about work you would slelct "no" and put something like "unable to work, awaiting employment authorization".

I can't remember how long it took me to start recieving the cards, but you can call the out of country office and ask them about it. I did have a card with the phone # on it, but have just recently thrown it away. If you call Service Canada you can ask them for the out of country #. I always had to leave a message on the answering machine and they usually got back to me later that day or the next (it might take longer if you call today due to the holidays).

As for looking for work early, I would suggest that you start a very preliminary search (posting a resume on monster, contacting an employment agency registering with them, but explain your situation). It took me close to 7 months to get my EAD. I applied in May and the paperwork was approved in Aug, but due to a backlog at the ASC it took forever for me to get a biometrics appt (I needed to get the congressman involved to get one). When I recieved my EAD card at the end of Oct, the date on it was Aug, and that is the date that EI uses for when you become eligable, so had I started a job search back then (and not waited until I had my card) I would have got 8 weeks of back payments from EI. But you have to be able to prove you were looking for a job.

Unfortunately there is no way to know when your paperwork has been approved. And even if you knew it was approved, you would have to supply your EAD card to your employer prior to starting work.

We came here for me and the kids to return with the plan for him to go back and apply. We decided once we got back that he would stay. So we applied from here and it was slow. Almost a year for an open work permit, almost impossible to find an employer willing to hire so you can get a work permit. Then it seemed to go ok but we had a mess up with his eldest son who was not coming. Got denied, lost the work permit. Got a lawyer, that sucked cuz nothing went faster, then the lawyer got disbarred. So that is where we are at. We either had to reapply for him or go back to the US.
I will tell you from all I have heard it is tough to immigrate to Canada, not imposible just harder than the US was. I would just say be prepared for a long wait until both of you can work/get healt insurance/drive. Not fun for us at all.

Thanks!! We are going to apply outbound and from what I hear it is a lot faster. We would not move until he got his PR so that he would be able to start work right away. And since our daughter has dual citizenship we won't have any issues with her. There are 2 things that I am worried about tho. I am sure that you will have to provide some sort of domicile (which I can do no problem...my sister has a 2nd home that they will let us live in)but I am not sure if they expect that I have work lined up for when we move, and how I would possibly time that with getting the visa. I guess I would just have to move back ahead of time and get a job. Also, my husband had a brush with the law nearly a year ago, but his record will be expunged in April, so that is why we have to wait. I am just a bit worried that somehow that is going to be an issue...his record will be cleared and he was never ever charged or had to appear before a judge, but the way our luck has gone since I have moved here......I worry about every little thing now.

CanadaHave green card but want to stay in Canada

Hi,

I got my Green Card in Sep 2010. I am originally from Montreal and married my wife from Michigan. Soon after obtaining my Green Card, I was offered a job in Toronto and have accepted the job. I have tried looking for a job in the US but didnt have any luck.

Over the past few months, since Sep, i have travelled from Toronto to Michigan to visit my wife and in-laws and each time i have crossed the border i show my Canadian Passport and Green card and explain to the immigration officer that i have not moved to the US yet. When i say this, he says that if i dont move, they will take the Green Card away...or i can file paperwork to ask for an extension. Does anyone know what form is required?

Also, my wife is a Canadian Citizen (dual) and is going to move to Toronto as well. Does she need to file paperwork as a Canadian returning to live in Canada and will this affect my CR-1 visa?

As a Canadian Citizen you wife will just have to tell them that she is a returning resident at the border. As for your CR-1 visa and green card, you will lose it if you move to Canada. To be a resident and maintain residency (and your green card) you have to live in the US.

As the previous poster said, you can file for a re-entry permit, but I am not 100% how those work and the conditions that apply with them, you would need to do some more research.

No, This is where you ask yourself is it really worth it or not. You have already spent thousands of dollars on getting your loved one here. This 200$ charge is really the straw that broke the camels back. If it was me, I would let the 1996 Truck be deported. I mean how much love can you really give. Makes me wonder now is Chevy truely American, or did we help bail out a foregin entity.

If I was you I would write to Daniel Ammann (CEO of Chevy), for his support or send him your bill. If that did does nto work, I would appeal to the US goverments on the how much of the truck was built and assembled here. If it is more than 65% , I would say its American.

Lastly, Shouldnt we as America just annex Canadato be part of the US. It should be very easy since there is not real army. I know we will have to do something with the French speakers, maybe resettle them in New Orleans.

But lastly and truely, I would just spend the 200$ for the letter and chauk it up another expense for my loved one being here.

You can use assets but you need to have something like 5x the poverty limit instead of the 125% with income, so you would need to have a pretty significant amount in assets. If your in-laws were to co-sponsor you ( I think that only one person can do it) they would have to make 125% of the poverty limit based on the household size including your spouse, and I would be willing to be that their benefits do not pay that much.

I would suggest that your husband registers with several temp agencies and actually goes in to speak with someone about jobs. I was recently laid off and I had registered with a few agencies and applied for some jobs via their websites and I did not get a call. I went in and spoke to some recruiters yesterday and I had 2 job offers this morning. I made sure that I dressed up and looked very professional (even though the jobs I was applying for were not professional) and I think that made an impression as a lot of people were coming in in torn jeans and baggy sweatshirts. It also gave me a chance for the recruiters to see a bit of my personality and I think that makes a huge difference. I find it so frustrating when you can not go into a place and talk to someone about empolyment and it is solely done through a computer.

You will get a form (NR-1 I think...it is similar to a T-4 but reports your investment income) from your investment company. I know when I left Canada I had to update all of my accounts and since I am not a US resident I am subject to a 25% withholding tax to the Canadian Govt. The amount of your investment and the amount of tax paid will be reflected on that NR-1statement. You will claim the income as foregin income and the tax you paid as a tax credit. This is the way H&R block handled my investments that I cashed in last year.

When Simon lost his job and we had to get private insurance it was costing us $370 per month for very basic medical coverage. The deductibles were pretty high, we had a $35 copay for a PCP and a $50 copay for a specalist. They wouldn't cover the medication that he has to take for his reflux eventhough it is a generic. That price also did not include vision or dental.

My aunt said FL is pretty easy to get a license if your Canadian because so many Canadians winter there. FL is one of the few states you do not have to prove you are a LPR or citizen to get a license.

I take that last statement back, they changed the laws last year. :)

Yes, and I got one before I left Canada, but I came here as a visitor for 4 months while I waited for my interview so my abstract was over 30 days old when I finally got to change my licence over. So when I went it they told me I needed a new one. So I went on-line and was able to get a copy of it from there. So I went back to the DMV and tried again. But because it did not look the same as the older one, they were not going to give me my license. I eventually convinced them, but it was a hassle.

They will exchange it.
One because you are an immigrant and they know it takes a while to get all your documents.

Two because they really don't care, as long as your previous driver's license is valid. They make the law for people that move from state to state and never bother to get a new license. Because they can't track one down for jury duty and other civil matters.

The only time waiting over the 30 days is and issue, is if you get pulled over and the cop is having a bad day, and you can't prove why you had to wait over the 30 days.

It may not be as simple as just exchanging it as you say. I know to get my TN licence I needed to have a copy of my drivers abstract from where I was moving from that was issued within the last 30 days (so make sure your hubby gets one of these!!)

my fiance and I want to marry he is American and I am Canadian....he has 2 children he has custody of and cant move to Canada....we want to marry in Canada and then when the paperwork is taken care of me to move to the States...what steps do we need to take for him to be able to come for a visit so we can marry

As the previous posters have said, just make sure your fiance has proof of ties to the US when he crosses. It takes a significant amount of time to recieve your marriage certificate in most provinces (usually between 1-3 months) and that is a definite requirement for your petition. Most states issue a marriage certificate that day or the next (we got ours right at our ceremony). So you may want to consider this if you are trying to get to the US in the quickest route.

A CR-1 visa (what you will be applying for to allow you to move to the US) will take around a year to process without the wait for the marriage certificate!

He should have no issues with being on disability when moving to the US.

As for adding him onto your insurance you will have to call your company to find out what it will cost. I know that some companies will not cover a pre-existing condition. But since he is coming from a country that has a national health plan he is covered by the HIPPA laws. So based on that he can not be refused.

I was in a similar situation when I moved to the US (I had a pre-existing condition....pregnancy!!!) and I found a company that would cover me, but for individual insurance for me only with the maternity rider, it was going to cost me $2450.00 a month!!! I hope that yours is nothing like that!!

Do you have any links on HIPPA?.Was the 2450 for a month? As expensive as it is it may work for us...We were going to pay midwife out of pocket but if im close to delivery this may be an option...

I don't have the links, it was just what I found out from Blue Cross Blue Sheild when I was searching for insurance. BCBS quoted me $2450/month for basic medical with the maternity rider. This was almost 2yrs ago now, so I am sure prices have increased. And like all insurance the prices are based on your age, smoking/drinking habits and general health.
