We were denied the first time after ten months (totally different issue tho) and then immediately reapplied. Like within 3 weeks. Thankfully his visa was just issued and we are waiting on the courier!

 

Others might have different advice but I sent in: pics, itineraries, and 5 months of phone logs showing repeated and lengthy calls from his phone to mine. You can try copies of emails, engagement ring receipt, etc.

 

Then save more stuff for your interview because you will have to show you have a CONTINUING relationship; new chat, call, and text logs, more pics in different situations, proof you met family and friends, actually went places together. This is what we did. :)

My fiance and I were denied our I-129F after ten months because, due to my serious illness, we were unable to meet in person. They have exemptions but even in my case where I was on dialysis they did not approve it. :(

 

Alhamdulillah we refiled in March 2013 and by then we had met 2 times and I went another time after that. So when we refiled we were approved and just had his interview at embassy and his visa is issued.

 

Its very important to follow all the rules and it's hard to get an exception even when you do qualify. If you lied, however, that is a totally different story.

What about phone logs? Even if historically an embassy does not require a lot, I always like to err on the side of caution. :) I'm an over-preparer. lol

 

Also, in Skype, you do not need to show actual conversations just that they occured. Does it show a log of convos like in a cell phone for calls? All incoming and outgoing with dates and possibly times? That would be sufficient. They do not need to see the substance of the conversations.

 

For example, I sent call and text logs for the 6 months preceding our application and the same for when we went to our visa appointment at the embassy. We were approved and I do feel they like seeing a lot of proof and seeing you took the time to do it. Just my opinion; I'm sure some one else will come along and be snarky about it. :D

It can be older than 10 days but they don't want it to be less. Which is crazy because in Kingston my fiance couldn't get an appointment til 1 week before and THEN had to go back for his vaccinations the day before! I was stressed but it was no big deal.

We didn't use an attorney for our first petition when we actually should have (because we had some extenuating circumstances). If I had paid the $100 for a consultation it would have saved us 10 months of waiting.

 

The second time we did not either because this time it was straight-forward and it was approved in a timely manner. Make sure you have all your paperwork, double and then triple check for signatures, fees, etc. I promise you are far more vested than any attorney.

1. I would print a few out of each that span a period of time. You want to show an abridged history of your relationship, not the whole thing. Too much paper looks like you're trying too hard for some reason!  Maybe 3-4 dated convos or emails for each year.

 

2. Make a list of all the times you've been to the U.S., if that's what you want to show. You'll be asked later in your DS-260 online form about visits to the U.S., and you might as well get that information together now so you'll have it.  They don't want a full copy of your passport. They just want the biometrics page with your photo on it.

 

3. Nope, they don't accept electronic media. You could print off a screen shot of the ceremony; that  might be something you could include. All you need is a couple of photos of that.

 

4. Having copies of the shared leases is a good thing.

 

5. I think it doesn't matter who pays the fees as long as they're drawn from a U.S. bank, but maybe another member can weigh in here with better advice on fees.

 

6. Unknown (to me)

 

7. Black and white is fine.

 

On all your submissions here: put a cover sheet on each explaining in a short sentence what it is they're going to be looking at, i.e., "Leases from 2010 and 2012"...."Photo of our wedding and honeymoon"...."Random Sample of Chats 2010 - 2012"  Anything you can do to help the reviewer understand quickly what they're seeing will help.

 

Wish I could help on the domicile and fees questions but it's not in my experience, so...  Good luck!

When you get your visa, immigration will tell you what to do to Adjust Status to the 10-year card. At your point of entry, the officer will help you with that. Try not to worry over it; they'll tell you what to do at POE, and if you still have questions, ask them then.

Sure it's okay to say "No." You won't get denied...You're just telling the truth, that you don't have these vaccinations.

 

You'll get the vaccinations you need at your medical interview, OR....you can look up the list of needed vaccinations for entry here: http://www.uscis.gov...on-requirements   and then go to your personal doctor to get the vaccinations; he or she can give you a paper that is a record of the vaccinations they've given you.  Then you can present that list to the doctor at the official medical exam.

I've been in your position, feeling horrible about the delay yet wanting so badly to help my spouse get through the time. It's very hard on you both, totally understandable.

 

There's nothing you can do to rush the NVC, but it's a matter of "mind over matter" at this point.  There will be things in your married life that will be way harder than waiting. See if you can encourage her to use this time to learn something new (improve her English, learn Spanish, maybe?) and maybe that'll help take up the time.

 

Just know: this WILL end. It WILL be over. Gotta hang in there!

Hi!

 

It is perfectly fine to marry her now and then file AOS without her having to go back to Mexico and wait there. I would do it all before her I-94 expires, otherwise she would be overstaying. You will need, however, to build up your case to prove you guys married "in the heat of the moment" and that she didn't entered the USA with intentions to marry you.

For it I would use for example:

- A copy of her ticket to fly back to Mexico as originally planned.

- If she has a job in Mexico, I would submit something like a copy of the contract, or a letter that says that she works there (I'm from Latin America myself and this is a standard document you can get from any employer). I guess it could help you show that she had stuff to go back to in Mexico and she had just come here to spend vacations. Makes sure it includes the date as of today, and how much money she was making.

- If you marry now make sure to do it simple, small and humble. Go to the courthouse, invite just a couple of closest family members and friends and have a normal dinner in a restaurant afterwards, or something like that. Document the whole thing. If it's a big, elaborated celebration, they won't believe you decided to get married overnight, but that you'd been planning this for a while and that can play against you. You can always have something bigger later. 

 

All you need to do is be ready to convince them that you indeed decided to get married while she was already there. My husband and I got married in the US. I entered the country with the intention of doing it so using my B1/B2. We didn't get a K-1 because we were not going to stay there but we were going to move to Germany instead, immediately after the wedding. 

When applying for my immigrant visa 2 months ago here in Frankfurt, they asked me how we got married in the US without me having a fiancee visa. We explained that we didn't considered it was necessary since we were not staying there after the wedding, but now we wanted to move. They said: it's fine, your visa is approve.

 

If you really didn't have plans in advance, just tell the truth when adjusting her status. I'm sure it happens often. Good luck! :)

I disagree with this part of the answer. If I am right, to be able to file abroad while together, the petitioner and the beneficiary must have both legal residence on the OP's home country (for at least 6 months prior to the filing). This is called DCF.

 

Unless the USC has a residency permit on the beneficiary's country, the only option they have is getting separated while he files for her in the US.

I don't think it's a requirement, but it wouldn't hurt. When we filed earlier this year, my husband wrote a short letter explaining how we met and describing the trips we took to see each other. At the end he included the names of 3 friends and 1 family member with their contacts, in case they wanted to talk to somebody and check. It all went pretty smoothly though, and they didn't called anybody.

In some cases, you must present to the IO what you have done to support her situation. How do I know? I have friends that work at that embassy.

If you have already applied, I would not change anything. When you go to your interview for your i485 you may give the immigration officer your new employment information and they will accept it. They only thing they care about is your tax returns/w-2's as far as income. Making changes while your case is pending could further delay your case because they might automatically send you a Request for Evidence letter. How do I know? It happened to me.

Your income tax returns are never optional. They are the only way to provide that you can truly support your spouse. Unless you have a secondary support affidavit. Being a student is insufficient for reason of no income. Remember you must maintain at least 125% above the national poverty level. I suggest i864 from a parent or guardian. As a note usually a school will send you a tuition W-2. Not all schools, but most schools do provide a student with a W-2. You should submit your parent or guardians income.

Hey Guys,

Well I'm Canadian with an American Fiance

As a Canadian I can visit the US for upto 6 months on just my passport.

Alot of canadians are snowbirds and got to the warmer states for the winter. And my parents actually have a winter home in Florida.

We filed the K1 in November 2012 but looking at these timelines is scary I see people on here waiting over a year when the USCIS site says 5 months.

I've been to the US since my fiancee filed the K1 and I've found as long as I dont mention him at all during border crossing there is no problem.
I just don't offer that information at all.

I'm actually debating on whether or not it might be feasible to just go there for 4 or 5 months and then just come back for my interview. And yes I realize I won't be able to work but hopefully I will have saved enough to live on during that time.

I'm also thinking that time together would be great for making sure we are compatible in a domestic setting rather than a exciting vacation setting.

Sounds a bit risky and I'm worried about it but honestly I dont think the border guard realized that he had filed a K1...perhaps because it wasnt and still isnt being processed? From what I understand they are only into July and August now...so if that is the case my case wouldnt be processed until July.

Yep, I agree :) Even now when I talk to people, I can see that they don't really grasp what I'm saying. Perhaps I'm just bad at explaining :P So many different stages of the process, the experiences and emotional whirlwind. I don't know about others, but where I am at the moment is strange. It's strange to be really happy to being close to being with Heather again, but still missing not being with her. At the same time, still being with family and friends, but starting to miss them. Even with the interview looming, the only thing I'm now focusing on is that super amazing hug that we have at the airport - the first hug that doesn't have a future goodbye hug, our first hug that signifies the start of our lives together :D


I totally feel the same!! I sometimes don't know what emotion to feel!!! No-one can truly understand how this all feels unless they've been thru it and that must be hard for them too as they want to. I'm trying to make the most of time with family but like you my thoughts are consumed with seeing Jason's crazy big smile as i walk thru that arrivals :)
