Although it's easy to think about how many months we've been waiting, I kinda found peace lately by thinking that it won't take more than a month now to get our NOA2.
I know that I'll be with my Kim in October/November and that all waiting will be over. I really like that prospect: in 3 months from now, we'll be together for e ver!!

Just finished the wedding registry the other day and my fiancee is gonna go view some houses this Friday. Also we've been lucky to have a very flexible venue that was willing to move our wedding to several other dates with a 30 days notice. Not getting married on October 6th is a bummer but the knowledge that we're way over half of the waiting time is really comforting. Also to think about all the blessings we've received from God last year... I think this goes for all of you. How big was the chance you met your soulmate? I mean, it's astronomically small!!!

My fiancee came to the Netherlands to work in a Christian Youth Hostel where my brother used to be one of the managers. Every now and then I would visit him there, because of the nice atmosphere in that hostel. When Kim and I met, there were no big sparks but we started to hang out on a friendly basis. I was planning a trip to the States when she said: 'If you're in the States anyway, you should come visit me and I'll show you Virginia'. Little did she know that I took her invitation serious. A couple of days before I flew over to her I got an abbess in my throat which kinda purged my wallet and so I didn't have the money to fly over to DC but a friend of mine heard it and paid my ticket. The moment I arrived the sparks of love flew around us and we knew that we wanted to be together forever.

If I think about how different this story could go! What if she never came to work in the Netherlands? What if I never visited my brother? What if she never jokingly invited me? What if my friend didn't pay for the ticket? Not to mention that the chances two people like each other at the same time is already a slim chance. I reckon all of you have similar love stories with slim chances of success, yet you are all engaged. Yes, I do believe God has something to do with our story. Even if you don't believe in God, finding our soulmate abroad is a spectacular miracle!

I just feel this rest over me now. Like the end is neigh and all of us feb filers will come back to this forum to hear about our wedding process.

You guys are still in our daily prayers and most of all we pray for a reduction of anxiety. I feel a special connection with all of you and I'm excited to see the first wedding photo posted!!

Also, congrats for the approvals!!



What an amazing story...thanks for sharing! It's very similar to my own so thought i'd share to encourage...

I had been spending time in Knoxville working with various ministries on and off since 2009 thru friends I had made that had been to Scotland on missions teams. Summer 2011 I was helping at a cowboy youth ministry and Jason, who happened to be back in his home town of Knoxville for only a year, came to a volunteer meeting...he doesn't even like horses!!! It was literally love at first sight and that was a year ago TODAY!!! Two days later we went on our first date and the relationship progressed from there. He is no longer back home in Knoxville. If he hadn't returned home for that time we would never have met! If the church he went to during that time didn't know about the cowboy ministry we would not have met! God has a reason for ALL things and His timing is wonderful and now we trust it for the visa. There was a reason we did not meet until last year and there is a reason for the wait for the NOA2...however frustrating it is!

WOW...what a difference a year makes! So thankful I met my soul mate a year ago today and can't wait to marry him and spend that lifetime together. We are all going to have so much appreciation for our spouses...possibly that couples who have been together thru their whole relationship could not experience. Our relationships are based on trust and communication and that's priceless!

Here's to August being THE month for all us fab Feb filers!!

Everyday I tried to encourage myself and my fiance that we are going to get NOA 2 soon, but every day is a disappointment for us, the only thing i can rely on the God now, this is not what i expected. There is a reason why God let us to wait, that's what i told myself, We will get it, maybe really 6-7 months


It's great to hear you say that sherylwu993...Jason and I were just discussing that last night and remembering the clear ways in which God brought us together and has guided us along the path toward marriage and how He confirmed our engagement with Scripture. We could have met before we did but for some reason August 2nd was the right date to meet and we now have to trust that God will approve the petition on the right day also...He sees the BIG picture :)

Just contacted CSC and the agent was able to open a service request due to the case been outside the normal processing times, will be in touch within 15 days, LOL. But at least the system did allow the agent to open the service request, something that was not allowing them to do. My paperwork was form Feb 6


What number did you contact to actually speak to someone? We called the central number today, our case is at VSC, but couldn't find an option that led us to a human!!

I completely accept if I have to make 2 trips down...you gotta do what you gotta do! However...IF the medical can be done the day before the interview it would be great!

Salaam and alhamdulillah you had your interview! My fiance had his on Nov. 1st but was temporarily denied pending some more information. Alhamdulillah they called him last week and told him to return Tuesday with his passport to get his visa, iA! We are so happy!

 

The problem with AP is you never really know how long it can take. From what I've read, if they keep your passport then it's generally is being processed quicker but Allahu alam. I hope someone with more info comments and I'll keep ya'll in my dua!

Salaam brother. At the top of this site is a "Guides" button. Click on it and then choose spousal visa or IR-1/CR-1. It will take you through all the steps.

 

I am doing the K-1 visa for my fiance so I do not have any personal recommendations for your type of visa. Just get all your paperwork ready. Medicals are only good for a year and must be done at specific locations, police reports are good for 6 months I believe so you should really wait until you get the notice to start those. You can make sure her passport has a good validity. You have to have at least 6 months from the date you go to the embassy/consulate so have her double-check her expiration date.

 

Make loads of dua and be sure you have enough income for the AOS (affidavit of support) or get a co-sponsor lined up. :) Insha'Allah khair!

My friend was having an issue for sponsorship for her husband (she is disabled) and a friend of mine offered to do it. They had no family ties but his income was sufficient and it was accepted. Her husband has his green card now. I don't know how they will view your lack of a job, though; perhaps someone else has some input.

We used photos, passport stamps (took copies) and lots and lots of phone records! The more the better so anything you have, put it all together nicely. :) The fact you are already married and met each other's family (and have picture proof) is really strong. They often ask if you have met/talked to family so I think that is a big indicator for immigration. Best of luck!

If you are asking if you can come to visit the US while your petition is pending the answer is "no". They will not approve a visitor visa while you have a petition with USCIS or NVC. My fiance tried to get a visitor visa when I was sick in the hospital and because they knew he was my fiance (we were honest) he was denied and this was before we had filed the I-129F. He even had proof I was hopsitalized, had a note from my doctor on hospital letter head. It was frustrating to say the least.

That was one concern of ours, having pictures that showed a time span. I cover my hair and I wear the same type so in every picture I look the exact same! As it was in Jamaica there aren't really distinguishable seasons either but I divided my pics up by trip, took a copy of each passport stamp and also attached each itinerary. Then we showed pages of call and text logs for several months as well. Thankfully they accepted it all but I was a bit worried. :) Best wishes for you and your husband!

Just be happy! Alhamdulillah. :) So many people LANGUISH in AP for months and years, even. I know it's been a long time but alhamdulillah it seems to be over now. You can send a letter later but NOBODY cares. :( It's a sad truth. People have complained for years but there seems to be little to no accountability. Our last go-round was pretty good but the first time it took them ten months just to deny our I-129F at USCIS, didn't even make it to the NVC or the embassy.

For something like this I could consult an attorney. Better to pay a $100 fee and be safe than to chance it. My gut would say no problem because you are working as a Canadian citizen for a Canadian company in the US but who knows how USCIS will view it? They rarely do what is logical. I would consult an attorney.

Just my experience; I was in the hospital with a failing kidney transplant and end stage renal failure and they guy at the Jamaican embassy would not grant my fiance a visitor's visa. :( He so helpfully told us to "apply for the fiance visa" because we had not yet applied.

Hey there. You need to contact the embassy you are going through. The embassy in Jamaica hasn't suffered any apparent shut-down because my fiance just received his packet and has an appointment on November 1st. Also for our embassy they said to do the DS-230 (non-immigrant type) and then the other supporting forms. The NVC told me to the DS-260 ONLINE for both fiance and his son. ???

 

So I contacted our embassy and they answered very promptly thankfully. They said we needed the DS230 still because when we applied the rule wasn't in effect. It's very confusing; either do both or, best bet, contact your embassy and ask them which one to clarify.

I have TMobile and there is a log of all calls. You can go to your account online and access it and print them out. You can also go in to your local TMobile and ask them to do it for you, possibly. I just did it myself. I think it was a great help for us. Our problem is, even though we met 3 times and I have photos, I wear a headcover and dress plainly so all my pics look the same! LOL And Jamaica doesn't have real seasons, per se, so even the surroundings were the same. Thankfully I will just copy my passport pages with the entrance stamps. :)

He didn't mention; we put it in his DS-260 paperwork, though; it asked if he had any previous refusals (or however it was worded) and we explained he had applied twice to see my family and once when I was in the hospital with end stage renal failure. He was denied bec we were truthful I was his fiancee and they thought he was a risk to overstay his visa. So we addressed it and I guess they were good with it; he didn't mention they brought it up again but so much is being thrown at you, you don't always think remember. :)

Well there are other forms of proof for a relationship. You need photos to prove you met, passport stamps. call logs, chat logs, etc. If you cannot get the Skype logs go ahead and print out what you have from June onwards; they don't even look at all the stuff! Then send your proof of meeting and it's really helpful if you have photos or proof you met his family or he met yours. We sent photos, itineraries, receipts, passport stamps, and phone and text logs. We spoke 3-5 times a day, and texted multiple times a day, for the past 2 years so we had no problem. I think the interviewer was a little surprised at how much we talk. :) The more the better when it comes to relationship proof!

The Philippines embassy requirements are different though from Jamaica.

 

Actually the Jamaican embassy paper does not say you can use a co-sponsor but since when you do the AOS you are allowed one I went ahead and included it. I took a chance and they accepted it but it stated I needed to make 100% of the poverty level myself.

We used a co-sponsor for the K-1 visa and it was approved. I got all of her transcripts for the past 3 years as well. I had some income myself and I included a letter from my (seasonal) employer. We were worried they wouldn't accept the co-sponsor but it was not a problem at all for us.

I'm a little confused: what were you intending to do to show support or were you unaware of the form? This was a big worry for me and I had everything in place ages before his interview because of my health issues and inability to work full-time. Do you have any income at all? I'm not trying to be nosey, just helpful. :)


For example, if you have a lot of assets (real estate, money in the bank, etc) they can also consider that; I believe that is on the second page of the I-134. You have the ability to list your assets but it has to be 3 times the amount needed.

They want the tax transcripts. Anyone could falsify a tax return and just print it out but the IRS copy is the official copy. :)  We gave transcripts as the paper asked. :) (I'm a registered tax preparer btw).

The police clearances are only good for 12 months so you need to gauge how long you think it will take before your interview against how long it will take to get the certificate from the HK police. I would go ahead and call/email now and ask for a timeline and then go from there. :)

In that instance (where they switch off tax dependency and exemptions) you should go with who truly spend the majority on her upkeep. If you are going to be using his 2012 tax return and she was not listed on it, I would go with partially dependent and explain he pays child support if asked.

When you first posted you said it was for affidavit of support but regardless it is the same issue. If he claimed his daughter on his taxes then he must claim her as wholly dependent on him. If he did not then he may claim her as partially dependent.

 

They want AGI which is ADJUSTED gross income or your gross income with a few changes (possibly). It is a line on his tax return and it's labelled AGI. Very easy to find, he should know it or be able to find it.

If he claims her on his taxes then he needs to count her as "wholly dependent" because he claimed her dependency for tax purpose and you cannot claim a benefit if you did not support the person more than 51%. Otherwise, if the mother claims the daughter, then he can claim "partially".

 

#9 is asking if your fiance has ever sponsored someone before for immigration so if he has never sponsored another immigrant he would answer "no". It has nothing to do with child support.

 

My understanding on the AOS is they want your AGI or adjusted gross income. Look on his tax return and find which line that is on and write that line down.

I would definitely put a note with it, reference which line on what form you are referring to, and give them a brief and impersonal account such as: "My parents and I have severed ties and have not had any contact for ___ number of years. I am unable to get their information" or whatever pertains to your case.

1. The IRS is indeed totally seperate.

 

2. Her sponsoring you does not require her to pay anything. She is basically a guarantor saying you will not become a public charge once in the US. So you will not apply for food stamps or other government benefits; if you do she could be responsible.

 

3. There is nothing illegal about her sponsoring you even if she owes the IRS money. Asking for her tax transcripts will NOT set off any alarms. (I am a registered tax preparer so I know how the IRS operates in this matter.)

 

Hope that clears it up for you and her! There are few things you can do in life to really help someone that really costs so little. :)

We were denied the first time after ten months (totally different issue tho) and then immediately reapplied. Like within 3 weeks. Thankfully his visa was just issued and we are waiting on the courier!

 

Others might have different advice but I sent in: pics, itineraries, and 5 months of phone logs showing repeated and lengthy calls from his phone to mine. You can try copies of emails, engagement ring receipt, etc.

 

Then save more stuff for your interview because you will have to show you have a CONTINUING relationship; new chat, call, and text logs, more pics in different situations, proof you met family and friends, actually went places together. This is what we did. :)
