if you have been married for 2 or more years, it's an IR1, otherwise it's a CR1 and you will adjust to the IR1 eventually

You got confused bunzarelli, the wifes birthday is correct, her mom's birthday is not. I don't think you'll have a problem because of that, i think they barely look at that stuff. On my co-sponsor form I mistakenly put the year as 2099, and i got approved no problem.

We messed up question 22 also.
I'm not completely sure what we answered there, but because we failed, CSC never send our papers to NVC after the approval. We had to file An I-824 to get it forwarded. We filed in January and never heard back of them. I hope they will do anything soon, because I'm sick of waiting any longer.
So I Guess worst case would be for you that you approved I130 doesn't get forwarded and you have to file an I924 and pay the fee for having them "release" and sent to NVC.

All I did was email and ask then to look into the status. I told them "I see others getting there now that are the same time frame as mine on VisaJourney getting theirs approved". She call back and said it was sitting on a desk as of 7/31 to be check and it should be less then 1 month to get approved.

I guess it does help to just have a congressman ask about it. Try emailing your congressman and see what happens. your in the time frame now.

They could see the details of the petition in their system (such as an overseas address) but they can't physically send the petition to NVC.
According to a USCIS rep (800 number) they shipped my application in a crate with thousands of others to some sort of facility. In order to send it to NVC they will have to receive it there and pull it out. This is why nothing can be done at this point until the file physically gets out of that crate.
And yes the explanation was that since my daughter's address is abroad and she's not in the US she is not going to adjust status and this should have been captured by USCIS before deciding about the adjustment of status.
The form is poorly designed and it should have a separte field to select what you want to do and not lump the adjustment of status and consular processing together in one question.
The attorney should have known better which is why I'm firing him.

It has just happened to my daughter's approved petition. They said her I-130 indicated adjustment of status which is not true because she's outside of the US and we didn't specify adjustment of status elsewhere. In any case the petition is now in limbo and USCIS is saying they will change it to NVC on their own but who knows if they will. Obviously a foreign address should be a good enough indication of consular processing. I'm supposed to call them again in 2 weeks.
