She is not eligable for a ssn until she arrives in the us...thats the whole purpose behind the ITIN. You can email the w-7 and the 1040 to her have her sign the forms and send them to you...couple of weeks at best...we just did this....then you dont wait until the itin is issued...you send the w-7 along with your 1040 and the IRS does the rest. You should call the IRS back and ask to speak to someone in advanced tax law...don't know who you spoke to but that info is wrong...can't believe he actually said you couldnt file for an itin....lol...the whole purpose of that is because she doesnt have a ssn yet.

OK, looks like I will just file an extension and wait until she gets here. By the time I send her the forms for the ITIN, I get them back, the IRS generates the ITIN, I send Kathlene a copy of the tax form for her to sign, she mails it back to me, it is looking a LOT like summertime!

Hey, maybe when she DOES get her and I file then, we can use the refund for a short honeymoon!

BTW, the IRS guy said I COULDN'T file for an ITIN since she was getting a SSN when she arrives here in the US, so he was wrong pretty much all the way around!

In order for you to file as married you must submit a w-7 (form for obtaining a ITIN number) for your wife with your return.....she must sign the w-7 form and the tax return....i just went through this with the irs, tought i would pass it along to you.

Since I will be getting all my W-2s and 1099s next week I am going to go ahead and wait to file the I-864. 2006 will be my first full year as a salaried employee, so I will have a MUCH higher adjusted income then the past few years when I have been filing as self-employed on all my income. (my main company I have been contracting with put me on the payroll in late 2005) The IRS told me I can file as married filing separately now, then when Kathlene gets her SSN I can file an amended return.

As I understood it, no notary is required if it's you completing the forms based on your income. In our case we needed a joint sponsor so we had that notarized.
Everyone's free to their opinion. My main recommendation was that if you have questions on this sort of thing, ask the people who should certainly know (the NVC).

Should my name be included on the list since I am her husband?

Should my wife's name be listed as she is my wife?

If you make a mistake on a form a simple line through the mistake is what you need to do. Then write the correct response next to it, or, you can fill out a new form...downloaded copies are fine.

Not a dumb question at all. In my opinion color copies woud be prefered...we sent all color copies...with a good color copy you can see more detail and less question as to it authenticity. Color copies are fine!!

Robee....don't put IR-1....just stay with CR-1 on the papers. Since the 2 year mark has not been reached yet you are still filing for CR-1 not IR-1. They will change it automaticly if they feel the date is close enough. Oh..by the way....nice anniversary date (june 5)...thats my birthday...:)

I will be cutting it close on the 2 year mark. If I generate the coversheet (james shortcuts) with a IR1 code rather than a CR1 code will I create a problem? I am hoping that if my wife gets here before the 2 year mark (a month early)she still gets the 10 year green card.

Hi,

Yes you must submit all the supporting documents!! In your ds-230 packet you should full instructions as to what they are requesting for the Philippines. You must submit ORIGINALS or certified copies, except for the passport bio page (a copy is all thats needed). Your spouse must sign the ds-230 part 1 (do not sign part 2). The embassy will return all original documents at the interview.

Hi,

K-3's are scheduled by the embassy and are longer than month when scheduled. Cr-1's are scheduled by the NVC....once the interview is scheduled its usually 5 to 6 weeks, at least thats been the trend. Once you've been approved by the nvc you are put in the quue for an interview, its been aout 8 to 10 weeks from the time of approval till nterview scheduling.

I'm sure someone will sigh when reading this, but the flowcharts and numbers really are confusing to us. We know that the K3 visa interview (once scheduled) is pretty short, maybe a month. What about CR1's? Are they the same wait period when scheduled as K3's? I didn't see any info (like the K3 flowchart) here nore at the embassy site in Manila. Again only non immigrant visa info. Any insight would be appreciated. Thanks!

Orimai.....the ITR is an "Individual Tax Return"....this does NOT need to be certified or notorized...however if you are using a co-sponsor the co-sponsors needs to be notorized or certified. Co-sponsor can obtain a tax transcript from IRS or you can have any US norary notarize it.

Hi,

It means you have been "documentarily qualified" and will be put in the queue at the embassy for an interview. Call the NVC and talk to an operator to verify. You should be recieving a letter in the mail to same affect. It is taking approximately 8 to 10 weeks after thecase is concidered complete to get an interview scheduled...then approx. 5 to 6 weeks for actual interview. I mailed my ds-230 on oct. 2 and case complete was oct 17...so yes it doesnt take long.

i just open my e mail today and im so surprised that I got letter from the NVC which says:
Dear Sir or Madam,
All documentation necessary to complete the National Visa Center's
processing has been received. As soon as an interview date has been
scheduled, the designated representative of this case (petitioner) will
be notified. The US Embassy may require additional documentation at the
time of the interview.

its only been less than 2 weeks (10 days to be specific) since the day they received my ds-230...My question is..does it mean my case is complete @ the NVC and anytime they gonna forward it to the US embassy in manila? this might be a stupid question and i may be skeptical but i dont want to put my hopes high. im expecting a message like Your case has been forwarded to the US embassy of your country or the likes.....or maybe something like Your documents have been reviewed and appoved.i called the NVC but the automated system is not updated yet.i will only be able to talk to an operator on monday..im confused. :unsure:

does anyone of you got this kind of message?hope you guys can help me with this.

i'm not sure if you are in cr-1 route, first you need to present your valid i.d, then show your original appointment letter to the guard, get a priority number inside the embassy and get ready all original docs listed in your packet or go to foreign embassy and consular discussion (manila thread) you will learn a lot more info.

Our medical for K3 went without a hitch and was completed in 2 days. We are hoping to get the CR1 next week at the K3 interview (if at all possible). We noticed they stamp K3 on the medical receipt and we were wondering if a 2nd medical is needed for the CR1 part? Are they even different in anyway?

For me its better to get the CR-1 visa. I think no second medical is needed its all the same shot and procedures base in my experienced.

Hi everyone!

I just want to share the unexpected outcome of my interview this morning. I arrived at USEM around 430 am from Bayview Park Hotel. Everything went fine and the CO told me that my papers were organized and complete but they still need to verify some information in NSO regarding our status before we get married (if we have previous marriages) since we were both PINOY the time of our wedding coz my hubby wasn’t naturalize yet only last 2005 although he have been in the US for almost 15 years.

During my pre-screening (Filipino lady) only our pictures, emails, cards and snail mails were asked, I asked her if she needs to see my CENOMAR and my hubby’s 2006 ITR she said those are all fine…my money transfer receipts for the last 4 yrs were not even asked also the bank statement. Yeah, I pretty much covered everything that can served as a proof prior to our marriage but seems not enough knowing everything were organized and all originals and recent.

I feel wrecked after my moment wid the CO, I never expected it that I’ll be put on A/R. I answered all questions consistently & directly to the point with all my heart and gave some additional information like on the pictures (although it has captions already). Smiled even nerve wrecking. I don’t know where I came short. I saw some applicant weren’t even ready what to submit and present to them but end up having what they really wanted. I feel that my readings with all these visa things didn’t paid off …I still end up at the darker part of the journey. I was hoping to be reunited wid my honey in 2 weeks but I am disappointed. I strive harder but it didn’t work out. I insisted twice to present my CENOMAR to the Pre-screener and to the CO both refused to accept.

I am just wondering if I am just the only IR visa applicant here that went thru the same situation. Did I really screw up? How long am I going to be doomed?:roll:

I don’t wanna lose hope even I’ve been thru a lot of RFE’s (not our fault tho) coz I am almost there. Please..please enlighten me everyone. I don’t know when to cheer up now.

PS. They let me pay delbros and was given a paper wid “wait till u here from us” words. I brought a 3 kilos of proof but was't enough.

I am in total despair.


Just hang in there my friend. Be strong everything will be fine.. Thats life always uncertain. My prayers for you and for other people who is also taking this long journey..May God Bless us All.

There is a lot of help here on VJ to get you through it. We used a lawyer last year with the K-1 process, but in retrospect i feel i wasted my money, but thats just my feeling. I have a few questions. For the G-325A form, do I need to have my fiancée sign and return the form or can I have her fax it over? Same goes for the letter of intent to marry, do I need to include an original signed document or would a faxed document work? I don't need any other documents from her during this part of the process right? What documents should I have her begin collecting for later on in the process? To be safe, send an email asking them to ensure that they have extended the validity - not all consulates do it automatically and it's better to be safe.

With all due respect to your lawyer, the OSG cannot issue a Certificate of Finality since it is not the one deciding the case. Only the court has the power to do that. As a matter of fact, the OSG is a party to the case as they represent the government (thru the City Prosecutor/Fiscal's Office) in all annulment cases.

I can only assume that what you have is a Certification from the OSG. "Procedures require that an Order be issued by the court directing the OSG to issue a Certification briefly stating its reasons for its agreement or its objection to the petition within 30 days from the receipt of the order. This is in accordance with the decided case of the Supreme Court, Rep. Vs. Molina GR No. 108763 Feb. 13, 1997." http://philsprocedure.blogspot.com/

After which the Certificate of Finality together with the Decision, and a copy of the petition will be submitted to the Local Civil Registrar. Make sure that your annulment is not "half-cooked".

I suggest for you to double check the above facts with your lawyer. This may just be a simple misunderstanding as legal jargons can be really confusing. Let me know what your lawyer says.

My wife was not understanding the papers correctly. You are correct and the papers are all in order....the finality came from regional trial court where the case was heard after the OSG's 15 days were up. The only paper we are waiting on is from the NSO to be sure it is registered with them...but everything seems to be completed properly as you have outlined above....:)

Hi Jazzy,

The Certificate of Finality is not issued by the Office of the Solicitor General (OSG) but is issued by the same court that granted the petition. What the court does is to wait 15 days from the date the decision is rendered to give the OSG time to file any opposition. If the OSG does not oppose within the time frame, the Finality is issued. The communication is internal between the court and OSG.

When I told the court clerk that I was going straight to the embassy to submit the decision, she told me not to waste my time because the embassy would still require me to submit the finality. She told me of similar cases before me wherein the embassy sent the ladies back to court to wait for the finality. I just took my chance that the embassy might not require it from me since I had a finality for the 1st annulment. I hope I get lucky :yes:

Hiya all,

I have the court decision in my hands now so off to the embassy I go this afternoon. I don't have a Certificate of Finality yet but I'll take my chance and submit the decision just the same. Who knows, out of pity for poor little me who's been waiting forever and ever, the embassy might grant me the visa even without the finality document. I know that's wishful thinking but hey, I can always hope :yes: If not, then wait 15 more days for the finality thingy to be issued.

And so I have to patiently wait again... :clock: :cry:

by the way...patiently waiting when you went to your interview before did the consul ask about the anullment papers..like the (entry of judgement) and the letter from (solicitor general) or just the decision from the judge? and i am confused what happened to nakashima too... why they we're on AR?.....thanksssss....hope to hear from you both...thanks.....

hello everyone

I have a question..My step son is going to have the interview on June 1st. we had the packet sent to a friend that lives in Manila..

What forms are in the packet? I want to fill them out cause I have to send some other documents so I will send the filled out packet forms also when them

Also is their a Bank of the Philippines Islands close to the embasy or a citibank?

what about a hotel that is not too expenive so I can have my Mother in law and step son stay in.

any other suggestions cause my step son lives in Mindinao...

i can recommend a hotel near u.s embassy its southern cross hotel tel no. 025212013 i stayed there during my interview last december its a new hotel or jualiano hotel but sorry i dont have number its affordable and clean.

i am so sorry to hear that.....anyway...your not alone of starting all over again...now i realized that GOD has his own plan to all of us....just keep your love alive, that's the most important thing. soon my anullment would be final and we will get married by april and we will start our journey again. just be patient again...and again.... :D
