I think that the extra $200 would now make the option more expensive to return to Canada. My understanding - although I never added it up myself - was that AOS cost the same as pursuing CR1, so I thought that now it would cost an extra $200 + the trip back.

I'll try to figure out it all out so I know for later :) I'm glad we're just getting the CR1 through Montreal though, it makes the most sense for us!

Can you clarify what 200 dollars your talking about?...the aos cost is 70 dollars and the IV bill is 380 dollars...you dont pay anything for the I-130 to be send nvc...thats just part of the processing. If i remember properly the adjustment of status is actually more expensive not including the trip back, plus you have more appointments and interviews to go to here in the states on the adjustment of status...which probably exceeds transportation costs of going back once.

If you enter on K-3 you most assuredly CAN go back and interview for the CR-1!!! The choice is either go back and interview for cr-1 and recieve all the benifits that go with that....green card, ssn, ead, ect....coz you would be entering as an immigrant....or stay with k-3 ...entering as non-immigrant and have to go through the adjustment of status.....if they have already paid some fees...which it appears they have...the IV bill and aos fee...then the cr-1 is the better be......however....they CAN go back for cr-1 after coming on a k-3.



FORGIVE ME. Why would someone who wants to go the fastest way possible to be with their spouse go through the process/interview to enter on a K3 and then go back to their country and go through the whole thing again for a CR1? I realize a CR1 is much better in the end because there is no AOS, but once you are finally in the US, why do that? Seems rather counterintuitive to me.

Alot of people file for the k-3 and get an interview quickly only to find out that thier I-130 was approved....many people then go back for cr-1 interview so they dont have to adjust status...its much easier and less to worry about in the states if you have the cr-1, so for many people its advantageous to go back for the cr-1 interview...its not repeating the process...just the interview. Being that this couple is from canada...and it appears that they have already begun the cr-1 paper work and fees...it probably will be quicker for them on the cr-1 at this point....either way they have that choice.

Which ever route comes through faster, we'll jump on it. If I go back to the US and on the K3 and do have to still go to Montreal for the CR1, then that's the way it will have to be. If we can finish the process in the US, that would be great. At this point we will do whatever we have to do.



If you chose to go the K3 route, you will effectively be abandoning the CR1, meaning you cannot enter on a K3 and then go back to Montrea for the CR1. If you enter on the K3, you will finish you AOS in the US. If you chose to go the CR1, you will complete everything in Montreal and then enter the US.

:D :jest: did u laugh like this??? well, i guess u might be right... i forgot yeah it doesn't ask either biological mother and father is married or not, i was just thinking since the kid's biological parents wer not married, why bother mentioning him anyway? BUT IF u do want to have an EASIER and NOT complicated papers to process better not mention the father IF the mother has the sole custody of the kid. I believe if the biological father is mentioned, you need the paternal consent. What's the point of mentioning the biological father if it will only cause mess anyway?

Is the fathers nae on the childs BC?...If it is then you will probably need consent even if you have custody...if the fathers name is not on the BC...then its not an issue at all...either way there is NO G-325a filled out for a stepchild....so its not an issue at this point.

Thanks Riblet for the encouragement, I'm sure you can relate to how on edge a person can be waiting for paperwork :) I did check the phone system as you suggested and the message says it has sent my IV fee bill, but nothing about the AOS. I did make a late phone call last night (right before midnight, I got thru really fast!), I was told the AOS went out some time this week and expect it to take 2-4 weeks (more waiting). Makes me wonder though why does it take 2-4 weeks to get the paperwork if they sent it this week? I think I have given up making sense of it all because there's nothing anyone can do but be patient and wait. However, since I am a logical person a lot of this does not make any sense to me ha ha ha :lol:

Don't worry about the 2-4 weeks things...its a generic response...you will get it much sooner..usually within a week after it appears on the phone system...you can of course prepare the aos and iv ahead of time so when the paperwork arrives you can send it out same day...:)
As far as using quotes....just press the reply button at the bottom of any post you wish to quote...the quote will appear in your reply box...:)

YES..ths is correct...you do NOT fill up a G325a for children, no matter what age they are...only husband and wife fill out the G325a. We just went through all this recently.

Whem I was the agent, the packet along with the interview letter was sent to her by the US Embassy in Manila.

If the USC is the agent then the USC gets the initial appointment letter, my question was whether or not my wife and step daughter will recieve anything from the embassy. If you are the agent you get the first response from the NVC about the interview with the cr visa.

You should have the ORIGINALS of everything in your ds-230 and your aos. Even though you supplied the nvc with originals of some documents you should have them available at the embassy.

I have read these publications as well as talked to the IRS about them...as with everything else in this world...there are exceptions....the IRS was quoting me other rules that apply here...there were several publicatons they quoted..i don't remember them...as i said i will be going in to the office sometime soon to go over all this...however, it appears I CAN claim my stepchild....when you call the IRS it is not the same as calling the uscis....these are IRS professionals and tax experts, not just people answering the phones. In any case I said i would report back when i find out the publications/tax law.

Don't know why your being so arguementative. When you call the IRS they explain thier "chapter and verse" and how it applies to each situation...so you have your "evidence" and I have the IRS's say so on what that "evidence" means. It's not worthless if it gets me extra deductions and credits....:)

Again per the IRS publication 501:
You cannot claim as a dependent a child who lives in a foreign country other than Canada or Mexico, unless the child is a U.S. citizen, U.S. resident alien, or U.S. national for some part of the year. There is an exception for certain adopted children who lived with you all year.

I will...however I am VERY sure you can...again per the IRS...501 is not the only pub. they go by...lots of rules and exceptions with the IRS....you can claim the child as a dependant...just not according to pub 501 if thats all you go by.

You do realize that information given out over the phone is not a plausible defense in the event of an IRS audit or denial. You need chapter and verse out of an IRS publication or from the IRS code. What basis did they provide you as the source?

I suppose the basis was tax law...since thats what they were looking at when they gave me the info. I will be going down to the local IRS office after the first of the year to talk with them in person. I will post as to my findings and any publications or code that can be refereced.

I read this on the IRS web site also. This prompted me to call the IRS and spend alot of time inquiring. Normally you can not claim a child as a dependant if they are not a US citizen, resident alien..etc.....however if the US citizen spouse is providing the support for the step child and the wife is filing jointly and the child lives with the wife over seas this does not apply..and you CAN claim the child as a dependant. I reviewed this with the IRS people....and yes ...LOL ..yodrak i hope also its not the same kind of misinformaton as the uscis. In any case this is not a usual situation but I can claim my step daughter as a dependant.

Yes, my wife and daughter can be claimed..."claimed" simply meaning they will appear for tax purposes on my taxes. After talking with IRS (someone in advanced tax law) you are correct about ITIN/W-7; however my step daughter also needs an ITIN....she can be "claimed" as a dependant...even though she doesn't live with me, which is one of the requirements...she lives with my wife and if my wife is "claimed" on my taxes then my step daughter is concidered "living with us" for tax purposes...which is nice because then we get another child deduction and credit...it took almost 2 hours on the phone with the IRS but it was worth it for the info.

No, your wife and daughter cannot be "claimed". However, as the spouse of a US citizen, you and your wife can request that your wife be considered a resident alien for tax purposes. Submit this request along with Form W-7 application for an ITIN with your tax return. This makes your wife a US taxpayer and gives her a personal tax exemption.
File the tax return as married-joint. Include your wife's 2006 income along with yours on the appropriate lines 7-20 of the Form 1040. Fill out a Form 2555 or 2555-EZ for your wife, and show the result on line 21 of Form 1040, effectively negating all of her income that you included on the preceding lines.
This gives you the lower tax rate available to married couples and you collect both personal exemptions on your joint income. The bonus is that your joint income is equal to your income alone since her all of her income below $80,000 (the figure a few yeats back) is excludable since it was earned overseas.

You need to file form W7 to get an ITIN.

I'm almost certain that you will not be able to claim the daughter, from what I recall of tax law, dependents must reside with and receive more than half of their support from you.

NSO birthcertificates on NSO security paper are all you need as well as NSO marraige certificate (if applicable and I suspect it is)...nso papers are the "annotated by appropriate authority" as far as the police certificate...nothing special just normal police clearance....they wll need a police clearance from every country they stayed in for more than 6 months since age 14.

Hello Philippine applicants, (I'm petitioning my parents-IR5).

This question is for anyone (Philippine applicants) who's case has been completed/approved by NVC and forwarded to Manila. I would really be thankful.

For the NSO Birth Certificate, per NVC instructions, how did you get it "annotated by the appropriate authority indicating that it is an extract from the official records."? Or will NVC accept the NSO Birth certificate as it is?

For the Police Certificates, what should I tell my parents? Is there a special police certificate needed that is different out of the ordinary?

My parents need to get about 8 police certificates. Whoah. :blush:

Any help/advice would be appreciated........

Yes...you must send the entire 42 page decree with jugdes sig and all...but a copy is fine. Put your case number in the upper right corner of every page you send....name,dob and ss# are totally not necessary, just a waste of time. If papers get separated they use the case number.

My wife says she will need I-134 for interview. She got this info from this site. I don't think she needs since we submitted I-864EZ and NVC mailed DS-230 package a week ago. I think the I-134 is only required for K3 visa (USCIS switched us from K3 to CR-1 :unsure: ). Maybe I-134 is a Bangkok consulate requirement only :unsure: . Has anyone out there, classified as CR-1, had to submit/provide an I-134 for Thailand, or any other country for that matter?

If so; what is a safe amount/statement to enter on the I-134 where it asks "How much support" sponsor is going to provide? :wacko:

You are mistaken....for cr-1 you need...and appears you already filed...the I-864...no need for I-134...just have originals of all documents including your taxes, w-2 ect. for her to have at interview.

If both the I129 and the I130 are approved at around the same time is there a reason one would not go through with the I130 (other than if it's been held due to the new way of doing things)? I'm hearing that the CR-1, even though it's already been approved, would take longer at the embassy stage than the K-3. Why? What additional steps does the embassy have to take?

First of all....I love your picture....PATRIOTS RULE!!!!!!!!!!! Once the I-130 is approved you have seval steps at the NVC until it is "documentarily approved" and put in the queue for an interview. With the k-3...once that is approved it goes to the embassy. The cr-1 steps can take a few months to accomplish.....it doesnt take longer at the embassy stage as much as at the NVC.

Yes you need to have the police clearance as well as the NBI clearance. We only submited the police clearance from he present address/city. As far a the dates of residence you mentioned...just put the from date to "present".

So alright, I am having her print a new one and Fed Ex it . We sent the NBI Clearance as stated in the forms letter. I have never heard from anyone else saying the POLICE CERTIFICTES were needed as only the NBI Clearance is required in the Philippines. I had even posted that question, and was told no.
So now my question until I can call them in a few days is: Is the Police Certificate required then in the Phils as well as the NBI Clearance if she has never left the Phil's.

It sounds like by what the letter above says, that they want her to send Police Certifictes as well from the places she had lived in the Phils. She has lived in 3 Cities including present. :help: :help:

Hi,

You presented those papers to the consolar for the k-3 interview. For the ds-230 part II you are being asked to present the original documents to the NVC for the CR-1...you are not "re-sending" them as you have not sent them yet...the NVC has not seen the originals yet. Prepare the ds-230 part II...DO NOT SIGN IT....return it with the requested documents, all originals, or certified copies with exception to paasport...copy of bio page is all tats needed there. After the NVC reviews these documents, if they approve the petition you will be put in the queue at embassy for an interview, the NVC will notify the agent of choice of the interview and send packet. Hello Everybody,

It's been a couple of weeks that i didn't post in Visajourney, and here i am again need your help and suggestions again, my friends.

Well, my husband (a USC) and I (foreign spouse) are going thru both I-129F & I-130.
I took the I-129F interview in october 2006 and was issued 221(g). My case is still pending in Washington DC. :crying: ... We are keeping I-130 going.

A month ago, my husband received "part I" of DS 230... We sent it and we waited for their answer... Yesterday, he received "part II" and asking to enclose the following documents :
- my Police certificate
- a photocopy of my passport (biographical part)
- my birth certificate
- our marriage certificate
- part II

BUT... what we don't understand, is that, i already prepared these documents and I presented them to the consulate officer on the day of the interview !!!

Should we re-send them to NVC?? do you think that the "dates" of these papers (mainly police record, and birth certificate) expired?!!! should i prepare NEW ones & translate them again??

your answers will help us a lot

What i mean is does it matter if its for US visa or Travel Abroad. My wife already got the police and nbi clearance for travel abroad purposes. Do we have to get another one for US? It doesnt state on the requirements from ds230 packet.

No it doesnt matter...ours says both for travel abroad/immigrant visa on the police certificate and for travel abroad on the nbi clearance....you are fine with "travel abroad". What matters is that there is no criminal record...:)

WRONG!!!!!! There IS a bar code with the I-864..as devblt said...and you MUST send it with the I-864. I also agree with doug....stop listening to "fastk3" people.....besides...theres no such thing as "fast" k3...immigration is slow no matter how you look at it.

Greetings! My lawyer at fastk3.com (he he) just informed me I need to be sure and send the barcode with my I-864. I recently sent off the IV Fee bill and now sending off AOS. I had bar codes for the fee bills but not one for the I-864, I am pretty sure I am right when I say there is no barcode to put with the requested I-864's right?

Yes they are correct. You are filing for Philippines and o must file both the ds-230 part I and II along with very specific original/certified documents. Be very careful with that....if I were you I would rely more on other people here who are/have gone through the preocess than "fastk3" people who probably haven't...its also been my experience with some so called immigration lawyers, that they really don't know the specifics of each country and thier requirments....your better off doing it yourself and saving the money.

The other thing you want to make sure of is that you send the appropriate documents with the DS230.. depending on which consulate the DS230 will be going, they may require additional paper work to be submited with the DS230.. along with the bar code cover sheet

You are so right on this one. Our case is pretty much like what you described, we had to send in the barcode and additional paperwork along with part 1 and part 2 of the DS-230 to the NVC.

hello jazzy.. i have a question for you. I received the checklist response today and there is no forms included there only the barcode sheet. Does it mean that i will have to wait for the form (ds-230) from NVC or packet before i can send those papers and documents to them. I have already downloaded the form and i have completed my documents. Is it possible to send in all my papers even if without the packet yet?. i will be waiting for your reply..

Are you doing the K-3 or the cr-1? What checklist are you referring to? If you are doing the CR-1 have you already selected a choice of agent? or gone as far as paying for the IV bill? I need to know your info first...it would be helpful if you included these steps in your signature so others can hep you better....just pm me or post back...:)

Hi,

The benificiary should get back any originals at the time of the interview. However, you should bring original copies of EVERYTHING to the interview as they may ask to see them.

She is not eligable for a ssn until she arrives in the us...thats the whole purpose behind the ITIN. You can email the w-7 and the 1040 to her have her sign the forms and send them to you...couple of weeks at best...we just did this....then you dont wait until the itin is issued...you send the w-7 along with your 1040 and the IRS does the rest. You should call the IRS back and ask to speak to someone in advanced tax law...don't know who you spoke to but that info is wrong...can't believe he actually said you couldnt file for an itin....lol...the whole purpose of that is because she doesnt have a ssn yet.

OK, looks like I will just file an extension and wait until she gets here. By the time I send her the forms for the ITIN, I get them back, the IRS generates the ITIN, I send Kathlene a copy of the tax form for her to sign, she mails it back to me, it is looking a LOT like summertime!

Hey, maybe when she DOES get her and I file then, we can use the refund for a short honeymoon!

BTW, the IRS guy said I COULDN'T file for an ITIN since she was getting a SSN when she arrives here in the US, so he was wrong pretty much all the way around!
