Hi,

In addition to the archiving features...you can print out copies as you chat. On yahoo, which we use, if you print while your chatting you should be able to get the whole window. If you archive you will only be able to print out words and times and dates that you chat. Another idea which we used is to take a few photos of you on the comp chatting...we use the cams and voice chat through yahoo...so we took a few pics of me on the comp talking with my wife, showing both cams ect. A few print outs of different chat sessions from the archives should be sufficient though.

Hi Robee,

When you receive your NOA#1's from the I-130 petitions they will have a receipt number on them. You can use this receipt number to set up an account and check the status of your petition on the USCIS web site. When you view your account theere will be a "last updated" column, each time this date changes it is concidered a "touch"...meaning they have done something with your case.

K-3 Spouse Visa Process & Proceduresgetting K3 status

I filed the K1 for my wife back in May. Received the NOA1 with receipt number. I am able to login at the ucis website and check the status on that.

Since then I filed the K3 to CSC and received NOA1 with receipt number on that - MSC-XX-XXX-XXXXX

How do you check the status of the K3? I attempted to add this to my USCIS online portfolio but it does not accept this NOA receipt number. I tried calling and using the automated system and it does not recognize this receipt number that I received back on July 19.

I went through the FAQ's and Guides and even searched for K3 status updates and can't seem to find how how people are doing this? I see a lot of folks posting touches and so on, how do you know?

Would appreciate some guidance on this.

Hi Stephen,

Hey we were married in Cebu on april 26th!!! Anyway...you should be able to enter the receipt number the same way you did for the I-130 and add to your portfolio and check status...we had no problem with that....you can try calling back using your I-130 receipt number and then talk to an service person about the I-129f not being on the system.

After our I-129f has sat under some stack of papers, lost in the shuffle for over 2 months now, with no touches or imbra rfe, we are finally getting somewhere. My congressmans office was able to get the NBC to locate the file and they sent the rfe out today...of course they didnt give a reason why our rfe had not been sent...only that they "located" our case file and were sending the rfe today. At this point it doesnt matter much what happened only that its moving again finally. In the mean time our I-130 had been approved quickly and we are just waiting our nvc case number to be assigned, so we can continue with that process.

I AM FROM CEBU CITY AND AT FIRST I DID AMMEND MY PASSPORT BUT WHILE READING SOME POST OF HOW MUCH HASSLE I WILL HAVE IF I WILL OPT TO HAVE A NEW PASSPORT IN THE STATES NOT TO MENTION THE HIGH FEE, I WENT BACK TO DFA CEBU CITY, FOLLOWED THE RULES....PAID 500 PESOS, SHOWED CFO CERTIFICATE THEN GOT MY NEW PASSPORT AFTER 4DAYS.
P.S. ONE HAS THE OPTION TO HAVE A NEW PASSPORT ESP, WHEN YOU HAVE NEW NAME.
P.S. MY OLD ONE WAS STILL VALID TILL 2007, AND YES I NEVER ASKED ANY FIXER TO DO IT.....

I don't know how long ago you got this done, but as of april of 2006 when we attempted to get new passport they are not giving you that option...we tried and so did my wife's friend...they just won't do it...we had cfo cert., and all other req. documents.

You know it amazes me how the Philippines handles things in different parts of the country...even the cfo seminar is different in cebu than in manila. The Cebu office will not renew a passport until it is time to renew (close to expire date) and will only issue the official stamp in passport....believe me we tried...i wanted my wife to have the passport with her new last name...but they just wont do it. Now her passport was only 1 year old and not even close to expiring, but her friends passport was only 10 months till expire date and still they wouldn't give a new one.
Thats why i asked about fixers....coz thats about the only way to get it done in cebu...and we weren't about to go that route...thats just asking for trouble.

Am I missing something? or is their new rules about changing/renewing your passport to your married name? ok, I have passport which is still valid but soon as I got our marriage cert. from NSO, I went to DFA to change my passport and yes they did issue me a new passport on my married name and they cut the front page of my old passport to make it invalid. so I think it is not unusual to get new passport on your married name.

My wife went to Cebu DFA office to get this done and they will not issue a new passport unless its lost or being renewed. To change a name on a current passport they will only put an official stamp in the passport indicating the name change.
Perhaps the office in manila does things different, but the Cebu office wont do it. My wife's friend just had the same experience a few weeks ago.

ok, i did misunderstand my wife on 1 thing, correct, no need to go to the auth ofc, but my wife has heard that sometimes the embassy will ask 4 auth copies, so she got them authenticated now just 2 b sure there would be no delay later. as far as the passport however, my wife did not use a fixer, she did it herself, she has her old passport which was punched by dfa, making it invalid, and will recieve her new passport with her married name on tuesday. now, i guess it might be possible to have a passport amended with and official stamp, don't know for sure, i guess if jazzy wife had hers amended then it's possible, but, personally, i wouldn't want the old passport with a stamp in it, just 1 more thing 4 immigration officer to question at poe. i much prefer to have all names on all documents matching.

I don't know quite how your wife was able to get a new passport....thats very unusual....the rules you showed the link to are for new and renewal passports, it says nothing in that link that refers to a name change on a current passport....the usual way for current passports is the stamp in the passport indicating the name change......by the way what copies did your wife get authenticated?...the civil registry copies?....there is no need to authenticate the nso copies if they are on security paper....that IS the authentication.......as far as the poe....as long as you have a copy of your marraige certificate with you there is nothing to question.

u can send the copy of marriage cert u got from the local civil registrar with the petition. as far as the passport and other info my wife posted to you, it is all correct. jazzy, my wife just did this whole process, will pick up her new passport on tuesday from dfa. you don't get a stamp in current passport to show new name, u get a new passport. she will have to go to the authentication ofc to have the marrriage contract authenticated,after getting it from the nso ofc.
A. For married women who chose to adopt surname of husband
Marriage Contract (MC) in Security Paper issued by the National Statistics Office (NSO) or CTC issued by the Local Civil Registrar duly authenticated by NSO."
note the "duly authenticated", u do that at the auth ofc.
also, ur wife will need to attend a cfo seminar, which she can schedule anytime she wants.

Once you have the certificate from NSO on security paper thats all you need.....that IS your authenticated certificate....and my wife and I just did this process as well and you DO get a stamp in the current passport.....they would not allow for a new passport......be careful how she got that passport....did she use a "fixer"?

Hi,

OK....first as far as filing the petition, all you need is a copy of the original marraige certificate. Later in the process if you are going with the cr-1 you will need to file a certified copy of marraige certificate with the ds-230 and at that time also provide an original nso cert. of marraige (they will return originals at the interview).

Your wife needs to get certified copies at the civil registry of your marraige cert. Bring the cert. marraige cert. to nso office and they will process it....its taking a while right now to process.....once you get the nso copies back (and get at least 3 as already suggested above) you can get her name change stamped into the passport. We were told if you have a current passport they wont give a new passport...they make an offical stamp indicating the name change in the current passport. If she doesnt have one now...then she will get a passport showing the married name....but you must have the nso copy for the passport stuff. For everything else you can use the civil registry copy.

Don't know what soulm is talking about with the red ribbon and such...none of that is needed...the civil registry certifies it and then the nso....thats it and all that is needed as proof of marraige.

You do NOT need the nso copy for filing either the I-130 or the I-129f...just copy of the original marraige cert. from civil registry.

Do I check "Other" and specify: "I-130 Petition for Alien Relative"

Or do I just check "Status as Permanent Resident", since, that is, in fact, the ultimate goal...

I checked the example forms, but there isn't a G-325-A example given for what you send in with the I-130.

We had a heck of a time getting ours from Manila directly. Finally my wife just got it from her local NSO same day. It seemed like before you had to get it directly from Manila but either that was incorrect or it's changed and you can get it from your local office.
Also you can order copies online.

Which local office did you use? You can only get the security paper copy through manila. Where online can get order copies? We thought you could only order BC's online?

I got married in the Philippines and we were issued a marriage license by the local civil registrar. My wife has been waiting for the official NSO issue of our marriage license since October 05 and it has not yet come (despite going back back there many times). I want to begin filing the K3 and send in the I130.

Question: Do I need to wait for the NSO marriage license or can I send in the locally issued license? My wife thinks I should wait for the NSO license since she cannot get a passport (etc) with the local license. Thanks!

You do NOT have to wait for the nso mc. The copy from the civil regitry is fine to use for both the I-130 and the I-129f. You will want to have the NSO MC later for your interview and for the original doc's required with ds-230 later in your cr-1 process. And tell your wife not to hold her breath waiting for the nso...they are taking a while right now (backlogged)...we are still waiting for that also.

You may certainly use your married name if you wish. We were married in cebu this year and are using the married name.
She has already her id's changed, like drivers licience, work id ect.....she already has a passport in her maiden name...but as soon as the NSO cert. of marraige comes in this week she will have the passport changed...they dont actually change the name on a current passport they place a stamp in it indicating the name change....if your wife does not have a passport yet then she can get one using her married name.

As far as the marraige certificate in the Philippines it doesnt say on there if you are using a married name or not....it just has maiden name on the certificate....once you are married you are free to use the husbands name. Just get your id's changed...some of which you can use the civil registry marraige certifate as proof of marraige to change.....however to change passpport name they require the nso certificate. You can file your I-130 and I-129f petitions using just the civil registry copy, getting the nso certificate can take a while....just have that on hand for your interview.

I forgot to mention the CENOMAR thing. This is the CErtificate of NO MARriage that "may" be requested by the LCRO when you apply for the license. It's called a singleness statement there, proving that the bride (or Filipino groom) is indeed single has never been married. My bride did not have one, but she applied for it thru the LCRO. It finally arrived last week for her, but since her town was very small, everyone knew she was single so our marriage went on without the CENOMAR. I guess the LCRO wanted it to complete their files. She mailed a copy to me last week, along with a copy of the NSO marriage certificate she finally received. I believe that's all I can think of now. Good luck!!!

Since you brought up the cenomar thing.....in Cebu we were required to get cenomar....not only for my wife....but for me as well...even thought i had my divorce papers and had never married in the Philippines before they still had to do it...I thought this to be odd....but its just another way to for them to make money....lol It only took a couple days and didnt affect our wait time at all as they did it during the 10 day wait period.

I was wondering ......if one decides to go with the K-3, for whatever reason, and you have already paid fees on the cr-1 (aos fee bill and IV bill)...do the aos and fees you have paid tranfer or rather "count" toward adjustment of status if you choose to use the k-3 and not return for cr-1 interview. Or do you have pay new fees when adjusting status? Aussie any thoughts?

My question was simply what to do about the I-130 if we choose to go with the k-3. ..as there is no guarantee that the I-130 will be complete in 2 to 3 months. You seem to be more worried about money, in the end you are going to be spending it anyway on AOS. She will not be able to work, you will then be feeding two additonal mouths, etc which could cause more "money" problems than just filing for the CR-1 and letting her get a part time job when she gets here to catch you up for that dreaded $900 you spent.

"dreaded $900"....maybe 900 dollars is nothing to you but to us its alot. You are correct that we will be spending it anyway on the AOS when she gets here...however I don't want to have to spend it twice!! She'll be able to work soon enough when she arrives and she will be able to help immediately when she gets here careing for my son, saving money on daycare expenses till she gets her ead.

I noticed that the I-129F has not been approved yet. Have you considered that the NVC process for the I-130 can feasibly get through and completed in 2-3 months and beat the I-129F. Just something to consider. I would hate to see the I-129F get held up at service center and you have halted the I-130 process for the CR-1 immigrant visa.

If you are content to wait for the I-129F, you can let NVC know that you will be interviewing for the K-3 and they will return the approved I-130 to USCIS to await the adjustment of status process in the US from the K-3.

We are anticipating an approval shortly on the I-129f with the help of our congressman, who got our imbra rfe sent out right away after being held up for no reason. That aside my concern is not to waist money.

We have 2 petitions, wife and step daughter, with the I-130 ..so thats 70 each for the aos fee bill and 380 each for the IV bill...thats 900 dollars. my concern is that the I-130 would not be complete by the time she gets an interview in manila. Manila is operating on an approvimately 3 to 4 month delay right now. So if an interview is scheduled for the k-3 and the I-130's are complete before the interview, will that interview automatically become interview for I-130? on the other hand if its not complete by the interview date we can't afford to go back to manila for that interview, finances are tight.

what is the basis that made you sure to put her Maiden name? My opinion is going with what is official, certified, etc, like official change of name, after marriage...and consequently the changed name on other official papers, cards, etc...if not, and until the official married name change is not done, i won't put it...because i can not use it just because i decided it myself...in my opinion i can not do that...If it's something else than official, i would explain it on an attached sheet (i.e., nickname, etc)...just in case to make very sure, they have all the infos they need...in the official sens and not official...!!!

I didnt say I was sure. I said I was almost sure :unsure: . On what basis? - on the basis that whenever "other names used" has been asked for so far, it has meant to include "Maiden Name" and even states so, but in this case it did not say "including maiden" which is why I asked. I also have an opinion- My opinion is Maries name was changed at the very moment her and I were married August 15th (L) . She is in the process right now of making that change on her documents. As for being official-Her married name is on one of those papers I looked at after our wedding. Maybe it was something sent to the NSO or maybe it was in the cival registry files-I cant remember-I gave up on trying to understand what papers went where in the Philippines. I just let Marie handle all of that. I just remember seeing my wifes married name on one of the papers after we got married which I would imagine make her married name "official"

Gary you are correct, when you got married her name changed officially if thats what you guys chose. In the Philippines there is no "official" name change paper. The civil registry MC and the nso MC just have the madien name on it certifying that you are married...then its your choice what name to use, by having her id's changed to reflect the married name shows which name you chose. So again you are correct, however i would be interested to know what paper you saw that had your wifes married name on it? If she is now using your last name....then her maiden name should be put down on all papers that ask for "other names used".

hi there, my k3 visa was already at the manila embassy last aug. 31 2006. now im waiting for the packet to come. i tried to call the embassy to ask the status and they told me to wait for 6 months before they send the packet. :( my k3 wil be valid until december only, how come i have to wait another 6 months for that?! im really dying to be with my husband, but the visa process really frustrate me. please help me what the best way to do. thanks

Your its not the visa thats at the embassy, its the petition that is there. The embassy in Manila tells everyone its going to be 6 months.....the way things look right now you should get your packet in a month or two and an interview between 3 and 4 months. Don't worry about the petition being valid for only 4 months....the embassy knows they are behind and automaticly extend the time. Check the recent timelines here on VJ to get a better idea on how long of a wait Manila is right now. Good luck...and try hard to be patient.

Dear friends,
I have filed I-130 for my husband and now I'm going to prepare I-130 for my stepson (16 years old). I have following questions. (my I-126F's NOA1 dated 10/27)
Besides his birth certificate and my marriage certificate(to his father),
1. Do I need to submit G325A for both of us?
2. Do I need to submit passport style photos?
3. Do I need certificate that shows his relationship to my husband(his father)?
What else do I need?

To answer your question more clearly.....NO you don't send any G325A's with a stepchild petition....NO you do not have send any photos.....you need a copy of your marraige certificate and copies of any divorce decrees as well s BC for both petitoner and child.

There is no rhyme or reason to it...we are still waiting for our K-3/k-4 to be approved...its been 3 months now since they recieved our imbra rfe...i called them yesterday...and of course they could tell me nothing, we even had help from our congressman..but tere it sits. In the mean time our cr-1/cr-2 was approved and is now in the queue at the embassy for an interview...so for us the k-3 is a dad issue...i'd still like to know wats up with the wait.

If you can wait a few additional months to be with your spouse it more advantageous to wait for the I-130...if the I-130 is approved already you should only have a couple months extra of processing....the benifits of coming to the states on a cr-1 are great.....especially if it was approved, my opinion would be to go ahead with the I-130/cr-1. The k-3 is usually quicker...but you have to adjust status in the states, cant work right away, need to go and get ssn, and many apptionments to go to.....with the cr-1....your spouse has green card, ssn, ead, upon entry and nothing to do for 2 years until you need to apply for lifting of conditions....its a much better way to go if you just wait a few extra months.....you'll be happy you did.

Since your I-130 is approved you may find it advantageous to go with the cr-1/cr-2. Your wife and daughter would enter as immigrants with all the benifits that brings. Otherwise yodrak is correct you will need your daughters I-130 for adjustment of status.

My case of r I-130 is complete so more then likely I am going the route of IR-1/CR-1 my question is when exactly should I cancel my I-29 F process and how? Should I do it now or just before my interview for I-130 and should I fax them or write to them? And should I also include my I-130 case number or is that not necessary?

Hi,

Theres no need to do anything with the I-129..most likely they will stop any further processing now that you are procedeing with the I-130/cr-1...that what they did with ours.

Hi Kiyah,

We had our K-1 denied at interview because my fiance's previous marraige was not annuled properly. We got the problem corrected and married after it was finalized and are now in the K-3 process. I guess it all depends on your specific situation and reason for denial.

Hello guys, I am a newbie here. But I read this site long before.
My husband and I are planning to apply for a K3 visa.
And from what I have read, CR1 Visa is better and faster than the K3 visa nowadays.
And that's what makes me confused about stuff.

Im thinking to just apply for the CR1, but then my husband like the K3 better.
Anyone here would like to comment please, about of which visa is right for me?

And how much is it cost?

CR1 is better than any other visa its an immigrant visa, though you need to be patient like 1 or 2 months for your interview dates compared to k3 but its worthy...no more paper works when you get here and its more expensive than k3 too....

i'm suscribed at the USCIS Case Status online, so as to receive emails or see the process of
our I-129F and I-130 = case "touched" !! :unsure:

but whenever i log on, i ONLY find the NOA1 dates !!

is it normal that i haven't received any "touched" confirmation in our process yet??
Am I missing something? should i be suscribed somewhere else??

Hi najia,

After you log in the site will take you to your "portfolio page....there you will see a heading that says "last updated"....the date below is the last time your petition was "touched"...you won't neccesarily recieve an email each time this date changes. So to answer your question...yes it is very normal....just hang in there....our I129f was touched 4 times in a week but we never got an email.

when i was with my interview at u.s embassy, u.s citizen accompanied with there filipino fiancee's and spouses are allowed to get inside the building but as i observed filipino companion are not allowed inside the building i saw the guard trying to keep those filipino away from the building they just wait outside.
