Hi all,

Just venting a bit of frustration....I called the embassy yesterday and still no update...they just say its still waiting on consular review. Our first wedding aniversary is next month and I would love to have my bride here by then. They are delaying just enough that by the time the visas are issued airfare will be sky high due to peak seaon and holy week. We are just hoping this week the visas will be be released for processing.

We have been waiting 2 years now....every day on AR is like an eternity and very stressful...on one hand you wait for the visa to be released, calling the embassy every other day for updates....on the other hand you sit and wonder what foolishness the embassy will do next. Yes, Todd and I waited for 2years now like PW we we're here (START ALL OVER AGAIN)..lol. We we're on K-1 visa journey before but it was denied cos my marriage was not properly anulled. Though, I got a certificate from NSO that I'm single.
We we're not expecting that to happened! We we're so devastated! We decided to get married here in the Phillippines and now we we're in our CR-1 process but still on AR!...but atleast we're ready for this. He's been through a lot of this immigration procedure! All I want is that, to hand a visa so that he would be rewarded in all his effort. My little girl now, is very excited of her PINK ROOM, her Daddy Todd himself do the preparation, I'm so excited also to see personally of our PHILIPPINE design master's bedroom!

I think we will continue to Pray!

Oh, we went to Siquijor last October 2006 and we tour around the Island it was so nice there!. We enjoy a lot of our stay in KIWI. very nice place!

Hope everything 's still great with you both,I do pray that the sun shines so bright to your case..Ive been following you guys and in fact it makes me really prepared with my son's case..like your fiancee 's child ,my son is 6 years before i filed his B/C and upon reading/knowing that they make big deal(?) with pics and proofs im armed with many pics/souvenier of my son when I have my interview..and you know what..? they dont even care to look to all that proof!!
I just wondered what else they want and need..I hope they will tell and be specific to your case.

I'm thankful you got an idea from our case. Well, Cora really told me about those pics as support in claiming Gracey as my real daugther but its too late for me to go home and look for those pics. They we're weird sometimes!..lol...At first they we're thinking that Gracey is Todd's daughter cos she's MESTIZA (She's so pretty than MOM..haahahahhaha). The lady consul asked me some pics with her when she's still a baby though we have lots of documents to show! (like joint affidavit from friends, baptismal cert., school records and her i.d) but still she was not convince..she was so nice though! I told her MY GOD...MA'AM she's my daughter....and I have lots of pictures at home with her when she's still a baby!!! I'm armed with her pics with me and her Daddy Todd but she's already 4 and they want the baby pics....lol....
Anyway, this situation now that we are in is the hardest part. lol....We we're waiting and waiting....waiting 'till when?..huhuhuhuhhuhu. Our only weapon is to pray and have faith in HIM, and keep our LOVE alive as always! WE know its worth waiting for!

well we got an AR! i don't know what went wrong. the interview took only 3 minutes and he kept saying everything looks fine except they have to review something. he never told us what it was. it could be numerous things.
- my wife's grandfather was petitioning my mom-in-law a couple years ago. i guess since my wife was dependent on her mom at the time she automatically is included in the petition. it was an F3 petition i think. i dunno
- our marriage?
- if we have kids?
i dunno what it could've been. we got the "white AR document" with a check at the bottom that says "we will review your case... please wait for us to contact you and bring the following documents checked above...". the problem is there is no document checked above. he said it can take up to 3 weeks. we'll probably call the embassy on monday to get more details.

those who called the 1909 number, are you put on hold and the 6php starts to charge or it will just ring until someone answers and you won't get charged until someone starts to help you?

I called the embassy again today and the said....no update...case is referred to consular is al they could tell me...i'll call again on friday....you would think its such a simple thing to just look at the pics we sent and send the visa for processing....and so we wait ...and wait....and wait.

PW.....we have waited as long as you....24 months now....perhaps we should change name to "not so jazzed" lol...:)

The quote i referenced if for a filipino now married Period!! You see thats the problem with their rules...it does not state this is for a filipino marrying another...it just states married....then goes on to say as you have post additional rules....they contradict one another. I'm interested though to know how you come to understnad thier intent and meanng? I'm speaking from experience...we have done this already...the cfo seminar IS NOT REQUIRED. As you said...that is for FIRST time passport holders. We are talking about amending the passport to reflect married name. Now different offices through out the philippines seem to tell you different things...but again from experience if you go in and insist you most likely will get your way. Jasmin insisted on a NEW passport with married name...and got it...the cfo was NEVER asked for. This debate came up last year when we were going to get new passport. But odds are...that you WILL NOT have to attend the seminar to get amendment in passport....i can't comment on thier intent..as i dont think they even know what the intent is! I do agree that everyone should just go and get the seminar done ahead of time...one less thing to worry about later!

3. For fiancees of foreign nationals and spouses of foreign nationals who were married at least six months prior to their application for a passport:
a.) Original and photocopy of the Guidance and counseling Certificate from the Commission on
Filipinos Overseas

Under the DFA Department Orders No. 28-94 and 11-97, Filipino spouses and other partners of foreign nationals are required to attend guidance and counseling program as a pre-requisite of issuance of passports. The objective is to help the said clientele make informed decisions and prepare them for the realities of cross-cultural marriages.
After the receipt of the passport and visa, the Filipino spouses and other partners of foreign nationals will have to register with CFO prior to their departure. An emigrant registration sticker is affixed to the emigrant’s passport as proof of registration.

now true the dfa website has it listed under 1st time passport apps, but that is not the intent they had and philippine govt will follow intent much more readily than the us govt will. the quote you have from dfa sight is in reference to woman that married another filipino. the dfa wouldn't assume that just because a women had a passport prior to marrying a foreign national she meets the objective of the cfo guidance and counseling. if you already have a passport and will be using that passport to leave the philippines then np, just attend cfo before you leave. but if you don't have a passport yet you will be told to attend cfo 1st. if you do have a passport but want to change it to your married name then most likely you will be told to attend cfo 1st depending on how familiar the clerk is with these regs, how many cups of coffee they had already, how close it is to lunch time, etc etc. but the bottom line is that their intent is that if you are getting a passport in your married name and your spouse is a foreign national then, odds are, you will be told to attend cfo 1st because that was their intent.
easiest thing to do, attend cfo 1st so you'll be prepared either way

Hi,

Here is the "additonal requirements" from the PI gov site for passport amendments. As you can see the only requirement is the NSO marraige certificate. Jasmin walked in with the old passport and NSO marraige contract and was even able to get a brand new passport, not just an amendment...no cfo required.


ADDITIONAL REQUIREMENTS
A. For married women who chose to adopt surname of husband
Marriage Contract (MC) in Security Paper issued by the National Statistics Office (NSO) or CTC issued by the Local Civil Registrar duly authenticated by NSO.

That is NOT correct. You DO NOT need the cfo seminar to get an amendment to your passport for married name. I do know that the DFA in manila sometimes comes up wih weird things like this, The Cebu office is easy to deal with. The CFO seminar is only required to leave the country on the visa. Also you can take the seminar at any time and go back for your stamp in passport after the visa is delivered...you dont have to wait 6 months.

hi gary, what DFA told ur wife in regards to CFO is correct. my wife had to attend cfo before she could change her passport. My wife said that it will be listed on the back of the passport app what the requirements are to get a new passport due to name change. of course thats not to say that other people won't have different experiences with this procedure depending on who they talk to, but my wife specifically attended cfo to get the new passport and she remembers it being listed on the back of the app. take care, it gets easier as you get more along in the process and before you know it Fely will have her interview date! good luck!


Thanks soul. We're going ahead with Fely attending the CFO, but not until our 6-month anniversary which was also what they "suggested." Meanwhile Fely has been told by a friend whose daughter came to the US on a K-1 visa last December, that the cost of the CFO is 9000 PhP. I have no idea where she got this number from, as I know it's only 400 PhP. But I'm having trouble convincing Fely of the real cost. Does anyone reading this have any idea where the 9000 P amount came from? That's about $180, which is the fee for the original petition.

That's very odd...all you need for the name change on the passport is the NSO marraige certificate....the CFO seminar IS NOT NEEDED!! However, she can take the cfo seminar at any time...then just go back and get her stamp when you recieve the visa, thats what we did. Jasmin got a brand new passport with name change, of course that was in Cebu....but definately the cfo is not required.

that's interesting. my wife had her passport name changed months ago and she barely attended the PRISM. CFO would be after the interview and that's when they'll allow her to change her name? did she bring a copy of the marriage certificate?

Ouch, Fely now says they won't give her a new passport or change her name until she attends the CFO. So there's another wasted trip, 4 out of 4. I need to see what docs I need to send to her first. She's pretty much on her own here, doesn't really use the internet to find out about how to do things. This is suddenly so frustrating.



I'm not sure about the marriage cert. This is one of those cases where its hard to get a straight answer, plus she's very tired from the trip and hasn't answered my last two text messages. She knows the marriage certificate is required for a name change. The DFA website says that the CFO is required to get a passport for spouse or fiancée visas, but it does not say its required for a passport amendment. This is another example of govt. officials changing the rules as they see fit at any time. So Fely will have to go to Manila to attend the CFO, but the problem is I'm expecting the IV fee bill anytime and I don't have the money right now to send to Fely to go to Manila (she already used up the money I sent to her for her 4 unsuccessful trips to NSO and DFA). And so we'll probably have a delay while she obtains all the papers we need to send to NVC. Ugh!

You wont have to fill out any ds forms...you have already done that...she will just have to sign the ds-230 part II at the interview in front of consular.
She will not need any more passport photos at embassy either...I had Jasmin bring a couple anyway, but they were not needed.
Yes she will still need to get her finger prints scanned...they will instruct her for that.

1. What is the difference in the k-1 interview and the Cr-1 interview according to the step by step?
I don't think Lorna will have to fill up the ds forms and I think the Embassy already received all the forms from NVC. is that correct?
2. Lorna had to give St. Lukes 2 passport photos that they are supposed to forward to the Embassy along with medical and her passport.
So will she still need to bring passport photos to interview? How many?
3. Will she still need go to the finger scanning window?
I just want to make necessary corrections to the step by step for Lorna so it will work for her CR-1 interview....

The consular said she needed to be sure it was in fact Jasmins daughter. She even had Jasmin hold grace so thier faces were side by side to see if there is resemblence. Because she had late reg. BC. We had pics of grace for the last two years during my trips there...but did not think to bring pics ofher when she was a baby. The consular wanted pics from the time she was born to present with grace and Jasmin in pics together..lol...i suppose if we had a dna test available that may have done it! Sending the pics isnt a big deal i just wish we could have thought to bring them. PW actually mentioned that to Jasmin when they met in manila, but there was no way to get the pics there before interview. We had affidavits from family and friends, her bc, and baptismal as well as letter from school and school id. I guess that part was ok coz all they wanted was pics...not a document check. So now we wait..:)

She told me the pictures and passports finally made it out of the mail room and to a case workers desk feb 21 ( which ironicly is exactly 2 years ago Jasmin and I met). I asked when would be a good date to call back to check for update and she told me 2 weeks!!!!! I know I wont wait 2 weeks to call....i'll be calling by wed next week!! For gods sake all they need to do is look at the pics and process the visas already!!! I know...patience.
Congrats to all those who have thier visas and those on the way.....i don't wish this AR on anyone.

I remember reading your situation before, but what exactly was their reasoning for wanting to see pics of your stepdaughter and did they request pics of her from when she was a baby? Did your fiancee not bring any pics of her daughter to the interview? Sorry, I don't mean to rub your nose in it - but hopefully others here can learn from this and not get stuck in AR.

Good morning,

I called the embassy (loraine)..finally got through after 90 minutes of attempts. Loraine said that our pictures had not made it out of the mail room yet!!!!!!!! She took our tracking number from dhl (litexpress) and said to call back tomorrow she would check on it. I'm disappointed....a week to go through the mail room? Hopefully with loraine checking it will speed it along to a consular to review so we can get our visa processed already....:) Still waiting!!

We confirmed earlier this week that the embassy has the pics and passports...so now we are checking delbros daily to watch for changes. I hope they decide to review those quick and they are not going to sit on someones desk for weeks. Yes Cebu has International airport...it is nice ...i fly in there rather than deal with manila. We'll keep you posted on the AR...it "should" be a quick one!

You guys should check ORBITZ. I'm getting Jasmin and graceys ticket there its the cheapest i've found. She will flying from Cebu to newark with one stop....i checked for those of you flying into LAX...they have a manil to LAX with one stop in hawaii for 587...thats tax included...its even cheaper than the first time immigrant fare..its 468 plus 119 tax, of couse philippine taxes are extra...check it out...the date i checked was for march 15...they always have good fares...and they will fed ex the tickets to the philippines ( no e tickets available ).

Can you tell us the name of the agency. I assume the taxes was added on top of the $500? And how do you get a first time immigrant ticket? Thats a great price!

Yeah its a great price and I called several agencies and the price difference is around $70-150. My mother-in-law wants to buy my ticket in LA but it cost $780++, so she asked me to buy the ticket here right away. I just hope our visa will come on time :yes:

The agency is Manila International Travel and Tours, its along Bay View Hotel, exact address is Ground Floor Ermita Center Building, Roxas Boulevard. Look for Ms. Joanne at tel#5211312. I just asked her about the first time immigrant rate and thats the price she gave me $500+ $107(gov't tax) + 1620pesos(phil. tax). I asked her how much the difference is with the regular fare and she says its $80-100. Your wife needs to bring her passport and the US visa but since my passport is at st lukes already I just provided them with a colored photocopy of my passport and I will fax them the immigrant visa as soon as i get it. The fee is valid from March 16-31, it was cheaper between March 1-15 but no more seat available. Just give her the tentative date of her ticket cause their prices are still lower than others.

Thats not correct. Jasmin was issued a new passport and it was not expiring...she turned in the old one...they issued a new one and gave her back the old one also with an invalidation stamp on it....the embassy even asked her for the old passport at the interview. We had initially requested amendment but there was a posting here in VJ about it at the time so we got the ne passport.

Tell them you want a NEW passport...some offices will tell you you just need a stamp or something in the old passport, or try to convince you you dont need to change it to married name (i dont know why they do this...we pay for it). Anyway, you just get a new passport with married name. Not changing it will not present problems so long as you have your marraige papers. We had it changed so that the name would match across the board...and in my opinion...makes the marraige look more sincere.


Our Dept. of Foreign Affairs will only issue a new passport if the old one is expiring in 6 months or if the old one is lost or stolen. Having a new passport issued while an old one is still valid falls under "multiple possession", an offense that is punishable by fine and imprisonment. http://www.dfa.gov.ph/consular/faq.htm

If a married woman choses to adopt her married name, requesting an amendment to the passport is the way to go.

thx sheriff. looking for some more advice. my wifes passport is still in her married name. in order to get it amended, is it required to go to the cfo first? secondly, if it is not changed to her married name will that present problems later on at the cfo or consulate? third(if i may) if we are already married, the cfo can still ask for written parental advice? thx for any help, jeff

Hi soul,

On newer BC's like for my step daughter you can tell by the registry number in the regristry box at top of bc...the registry number starts with year theBC was issed. On older BC's its the date in box 25 a you refered to. A late registry is a bc that has been registered years afte rthe fact. Hope that helps.

hey folks, hope someone can clarify this for us, i think we are ok, but just want to be sure. with all the talk about late registered BC's, exactly how do you know if a BC is late registered? On my wifes BC, from the NSO, in block 25 date prepared is the date of her birth done by the midwife at the birth, then in block 20 Received in the office of the Local Civil Registrar there is no signature or anything, just the stamped date which is abt 1 month after my wifes birth. this would not be a late reg bc, would it? thx 4 the help!

Michael, if your filing a joint return your wife MUST sign the 1040 even if she has no reportable income...look at the signature line on the 1040...it says if filing a joint return both spouses must sign.

Star, I read all that also....the IRS people sid that as long as it was notarized its fine...I have sent mine off with my tax return after letting an accountant here look at it...we are not getting the ITIN abroad , it is being obtained in the US with the filing of my taxes. The w-7 is submited along wth your taxes to the TX address and they take it from there...it takes a little longer to get your return than normal. You don't get the ITIN then file taxes its done at the same time. I think you are referring to the process of obtaining an ITIN for say business purposes abroad. This is just getting an ITIN for spouse until they arrive and get thier ssn.

Given the choices listed for acceptable documents required, I figured the certified passport route made the most sense for us since she just happened to be staying at the provinical capital with a DFA office nearby and it was a very simple process for her. The color copy of her passport was not notarized. The DFA letter has their stamp and signature.
I had sent her a filled up W-7 to sign and return in December. She had no reportable income from 2006, so I did not have her sign the joint 1040 return. Figgers the IRS revised the W-7 in January 2007 and also has changed the mailing address to Austin TX. The previous form was to be sent to Bensalem PA, which is where I sent my return. I hope to H it gets to where it's supposed to go. So, I guess I'll wait until...hmmm, maybe June to see if what I did was acceptable.

Hi all,

Well Jasmin got safely back to Cebu after a 2 hour delay in manila. She immediatly got to work and assembled pictures of her and her daughter for the embassy. This was and easy AR to deal with...:) She mailed the photos, passports and cover letter to the embassy today dhl for delivery by monday. I hope they decide to review it right away and process our visas!!! This has been a verrrrrrry long journey!!

Star, yes i'm sure. You said that notaries are ot allowed to notarize US documents...you may be correct, however in this case they are not notarizing US documents...they are notarizing (authenticating) philippine documents....philipine passport and other form of philippine picture id.

Robor, the passport is mentioned in the list as you can see in the below quote taken from the instructions..its mentions VISA in the list...that is the passport (cant have a visa without passport...:) ) Don't know who told you dfz was only place that could notarize these things but that is not correct....we had a notary from Jasmins work do it. The instructions and the irs people i talked to just say to have it notarized....thats all...as you can see below.

Just trying to save you guysa lot of hassle and money....color copy is only a few pesos and regular notary just brato...no need to pay more!!

Individual Taxpayer Identification Number (ITIN)

What documents are acceptable as proof of identity and foreign status?
IRS has streamlined the number of documents the agency will accept as proof of identity to obtain an ITIN. There are now 13 acceptable documents.

You guys can save yourselves alot of time and aggrivation by just making a color photo copy of passport and a second picture id like drivers licience and just have it notarized...no need for special dfa certification ect....the w-7 and 1040 must be signed by the philippine spouse. You can have sign the forms and fill them out when they arrive in the mail. The w-7 along with notarized copy is sent along with 1040 to the address indicated in the w-7 instructions, not to the usual tax processing center.

Jazzy, are you sure about this? That is, have you filed your taxes with W-7, and your wife received her ITIN? The reason I ask is because what I have read says that the notaries in the Philippines are not authorized to notarize U.S. documents per the Hague Convention.

Besides getting the certified document from the DFA, you can also use obtain help from abroad using an Acceptance Agent, and the only one in the Philippines is in Angeles City.

No, the embassy will not notarize anything for you. Any notary in the PI will do, IRS isnt that picky. I just had my wife make a color copy of bio page of passport and her PI DL (they need two forms of picture id) and had it notarized, then for my step daugher her bio page and school id. Thats all you need...and original signature on w-7 and 1040.

Hi all,

Ok a little update here after my initial melt down of a reaction.

All the consul wants to see is some photos of Jasmin and Gracey from birth to present. Graceys paper work was fine...we had a couple affidavits, letter from school, school id and baptismal (but that was done at time of late reg. bc). They did give her a 221(g)....but all that was checked was the family photos line and the passport line.

Jasmin went back to embassy after we spoke and they explained that they are now handing the passports back when additional documents are required...we merely submit the passports along with supporting documents. Jasmin will be returning home friday and mailing off the photos and passports saturday ( they said mailing was fine). We will of course follow up to assure the safe arrival. They had us pay the delbros fee and the gir at the embassy told Jasmin she is fine if they made her pay that...just submit the photos. I am hoping because it is NOT a document check....consul said all was fine there...that once they see the photos the visa will be processed....I feel much now...a little relieved, though our journey is not over quite yet...there is the light at the end of the visa tunnel...:)

PW...Jasmin told me you had mentioned the pics to her....i figured with having the affidavits from family and friends it would be enough..but there was no real way to get the pics to manila in time. The embassy will have the pics by monday!!!! I am very excited!!

Hi everyone,

I just finished talking to Jasmin after interview.....she said the consul was nice and there was no problem with our papers, except that she wanted to see some pictures of my step daughter when she was a baby coz of her late registration BC. She told Jasmin to submit those or mail them...then told her to pay the delbros. Jasmin asked if it was approved or AR and the consul just smiled an had her go pay the delbros.

I had Jasmin go back to the embassy because they gave her the original docs back but they also gave her the passports back!!! How can they put the visas in there if they dont have the passports!!!! Anyone else on AR experience this?

PW i told Jasmin to call you to ask your advice....she did not recieve a 221.....i'm beside myself...coz it appears that the interview went well....but the whole passport thing has me concerned...any thoughts?

Well Jasmin and my stepdaughter are at the embassy right now waiting for thier names to be called.....its gonna be a long evening waiting for hr to call me with the results. I was anxious up till now....now im nervous!!

Dims, Jasmin booked a round trip ticket. She flew into manila last thursday early in the am..and took medical same day, came back the next for immunizations and the interview today, she will fly back tomorrow evening to Cebu. You can usually get better price on a round trip.

Well I'm glad to see my fellow cr-1's getting some good news!!! Have any of you, Soul, Michael, W1n, got your packet yet from the NVC? Or just an interview date from operator? Just curious...my god took them long enough, i was sure you guys would have heard last week.
Dims, saying a prayer for you to get a march date also....crossing those fingers!!!

So you know guys...with the cr-1 they don't set a st. lukes appointment...just have this done at least a week ahead. You will have to send your benificiary the appointment letter you get from the NVC. St. lukes will make a copy..of course bring passport and photos. Jasmin had no problems with that...her medical is now done and we are waiting till thursday for interview....we are kinda expectin AR do to her daughters late registration BC...so we are prepared...who knows maybe we'll get a nice surprise.

CR-1's.....you have to remember that the NVC sets the dates not the embassy as is the case with the K visas. The K interview dates come out the middle of the month....this rule doesnt apply to the CR-1. Now the trend seemed to have been a notification toward the last week of the month for an interview 5 to 7 weeks out. I think the november completions should expect thier notifications any day....don't rely too much on what the NVC says....I called them on dec 27 and they said to interview date yet....but the papers came dec. 30 and they had been generated dec 26th...so you can't rely on what the operator tells you...hopefully they in the mail as we speak.

Soul....my god if we were notified 2nd week of january wewould have just 3 weeks till interview....i think thy will give a bit more time than that.

My wife and step daughter will be leaving for Manila on thursday morning and taking her medical that day...anyone else in manila during this next week send her a pm and maybe you can get together...i'm sure she would appreciate the company and support.

yes, everytime i call nvc they always tell me the same thing also, that cr-1 is scheduled the 2nd week of the month for the following month. but i think they just say that so i won't call them so much (doesnt work, lol). but that is not the experience we see of juncel or jazzy. juncel had a jan appt, so according to nvc he should have been scheduled 2nd week of december, yet he found out late nov, and jazzy has feb appt so he should have been scheduled 2nd week of jan, but he was notified late dec, so no rhyme or reason to the system. we will certainly post when we have news of our interview. good luck to all!

Right now you are in the queue for interview, the NVC seems to be releasing the cr-1 interview dates the last week of each month. Our interview appointment notice (packet) was generated dec. 26, and we recieved dec. 30 for a feb interview date (we lucked out and got the beginning of feb.). With that in mind the last week of this month (Jan) they should generate packets with march interview dates...hopefully yours is among them....and no its not much notice. It will depend on how many applications are in the queue and your position in the queue in relation to the others. Its now the middle of january so k visa intervew dates should be being released this week by manila. It shouldn't take weeks to get the packet from NH to california....i live in NY and it took 4 days from when it was generated....so add 3 days frm there if that...just regular post. Hang in there....i would call the nvc the last couple days of january if you have not got packet to see if interview has been set yet.

Jazzy i was thinking about what you said regarding the packet may be delivered to me at the end of the month for a March interview. so far looks like many IR/CR's are getting their packets either end of the month or in JunCeL's case beginning of the month. but what i can't seem to figure out is if we are expecting a packet at the end of january for a march interview, why doesn't the NVC know we are scheduled yet? i'm sure it will take weeks to get the packet from new hampshire to california. but if we go by what NVC says about mid-month, it still won't give us the month advance for the interview which ends up as april. but it doesn't make sense since march interviews haven't been given out yet. aaaaah! so confused. sorry, i'm a computer programmer and my mind thinks in patterns. i MUST have a pattern to all this :lol: :blink: :wacko:

though i have my money on you than the NVC since you're ahead of us in the timeline :thumbs: so i hope and pray to hear something next week or the week after. getting an interview date would make things a little easier. i can't even plan for anything :huh:

The pattern we are seeing is that the cr/ir interviews which are scheduled by the NVC are coing at the end of the month. Your a month behind us on your completion date so i would expect the end of january you should be able to find out...it will most likely be in march sometime..:) The K interviews are scheduled by the embassy and come out the midde of each month...just hang in there...its coming soon!!

i called this morning and the CSR said that we didn't get in the february group. would the info they have at the end of the month be different? does it mean that we may still have a chance to be in the february group? i noticed you and jazzy got their info towards the end of the month, did you know prior to that or just when you got your packet in the mail?

K-Visas can know their scheduled date on the manila website on 2nd week every month. For IR/CR visas you need to call NVC at the last week of the month to verify if NVC scheduled you already. USembassy manila website is useless for checking CR/IR appointment it will only come out when your files from NVC has been ship out to USembassy Manila. Goodluck

And to put to rest "routine" and "automatic". Here's what the dictionary says:
ROUTINE ~ a regular course of procedure; habitual or mechanical performance of an established procedure
AUTOMATIC ~ largely or wholly involuntary, especially reflex; acting or done spontaneously or unconsciously
Since we are talking about a procedure here that requires conscious effort and not an involuntary action done spontaneously, "routine" would be the appropriate word to use. Plus of course, it's the word used by the embassy. The only requirement for NOA2 to be revalidated is for one to remain legally free to marry and that the intent is there. Request to revalidate is not a requirement.
Now, can we bury this issue already and start anew? Please? Pretty Pretty Woman Please?

I apologize in advance for this as I grow tired of this discussion as well. As everyone here seems to agree with me with a couple exceptions. I just wanted to point out that the dictionary also goes on to define AUTOMATIC: Having a mechanism by which certain operations are performed under predetermined conditions. The predetermined conditions here are that the embassy is backed up and they know they will run past the 4 month period. It is both routine and automatic.
Again I apologize for mentioning this yet again...its just that certain people here would unnecessarily worry others about this revalidation thing when it is totally unnecessary. Its the last i'll say on the matter.
We have our interview (for the second time) coming up in few weeks and thats enough to worry about. We are kind of expecting an AR as my step daughter has a late registratin BC...we'll hope for the best....but plan for the worst.

I read the article you posted. It kinda supports what i've said. He says that by the time the "interview" comes around the petiton has expired...blah blah blah....its up to the consular...blah blah blah. The thing is...everything is up to the consular, whether the petition is expired or not you still have prove to the consulars satisfaction that you have an ongoing relationship, and your intent is to marry. Also the date of this article is back in 2003, some things have changed since then. The fact still remains that the embassy does automaticly extend the time frame when its no fault of the petitioner or benificiary that the time frame has lapsed.

Just an FYI update with regard to shipping documents internationally.
On Monday, at about 9:30am California time, I mailed off 1.2 lbs of documents (Affidavit of Support, copy of I-129F, etc) to Jinky through the U.S. Postal Service using Global Express Guaranteed at the cost of $54. She received it, hand delivered by a FedEx agent today (her Thursday), my Wednesday evening at approximately 8pm...that was less than 3 days!
Had I gone directly through FedEx, the cost would have been $164...so I saved over $100.
I know some here in this thread said they've tried this service without reliable success, however, I would point out that you must make sure you are getting the 'Guaranteed' Global Express where the label has a FedEx logo on it. The U.S. Postal Service works with FedEx for this service, which is comparible to FedEx's speed but for a fraction of the cost.
Just wanted to pass that along and hopefully save other's here some money. :star:

Thats not a bad price....I use DHL for sending documents, I'll be sending a package out today (originals for Jasmins interview)...the cost for up to a 2 lb document envelope for my area (in new york) is 48 dollars going to cebu....it gets to her in 5 days...it may be longer in the provinces...they use third party once it gets to the PI...either way...much better than fed-ex prices!!

It is automatic...unless there is a problem in which case the embassy will notify you that you need to send them more info or something....you should never send the embassy anything they don't ask for.

Maybe you can help out here and point us to the source of your information that it's automatic. That might end the debate and keep us from sending useless faxes and letters.

As i stated early there is nothing written in stone...there is no chapter and verse for this...if you call the embassy or even the NVC they will tell you that it is extended...especially if you already have an interview scheduled outside of the 4 month period....its just the way its done.

Its not the immigration law or regulations i find arguementative....its you!! You are taking discussions past the point of being discussions...and they become arguements. You stated i'm mistaken....i am not....the embassy not only routinely extends the 4 months...they AUTOMATICLY do it whether you believe this or not. I have NEVER seen anyone have a problem here with that. And yes i do know that immigration law changes from time to time...but this has nothing to do with immigration law...it only has to do with how embassys handle this situation...they are very well aware that they get backed up and they extend the time frame....thats just how it is...its not written in stone anywhere for anyone to show "chapter and verse" but it IS true. Debating is fine Dean, however I feel you take it beyond debate with some of your commentary. Now i totally agree that if someone is posting something that is bad advice...someone should say something....if they know better...and in this case...you do not know better. Your not passing on part of the education you got here with that response; if you were to go back over the last couple years of posts this subject has come up time and time again....always with same response and outcme....its AUTOMATICLY extended.
Now lets let this one die and try not to be so arguementative in the future....we are uppose to be here helping each other...not starting fights.

"no offense" ? ASlmost everything you write is offensive and arguementative. For your information we already went through the K-1 process so I have a bit more experience than you here. Regardless of your quote from text below it IS routine for the embassy to extend the 4 months...thats just how its done....its not a written rule...its just how it is...I know tis from posts on this site for the last couple years, past experience from friends, and frm talking to embassy staff myself. You should try to listen to info from members here instead of inflicting your opinions as would be facts....draw from the experience of others.

Well no offense, but he is mistaken. We are talking about a K-1 petition here, not CR-1/IR-1. Here is the excerpt from the FAM regarding this issue:
41.81 N6.2 Validity of a K-1 Petition (TL:VISA-581; 09-03-2003)
An approved K-1 visa petition is valid for a period of four months from the date of Department of Homeland Security (DHS) action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States. However, the longer the period of time since the filing of the petition, the more the consular officer must be concerned about the intentions of the couple, particularly the intentions of the petitioner in the United States. If the officer is not convinced that the U.S. citizen petitioner continues to intend to marry the beneficiary, the petition should be returned to the approving office of DHS with an explanatory memorandum. [See 9 FAM 41.81 PN7 for revalidation procedure.)
The part I bolded is of concern for our case since we are looking at an interview almost a year from when we filed the petition.
It's just not good advice to tell someone to not send a simple letter or pick up the phone.

I'm sorry you find immigration law and FAM regulations offensive and argumentative. If you will take a look I was the one who stated it WAS routine. Your the one who used the word automatic. Sorry, but it is not automatic. I'm sorry you find that offensive. I love all of my fellow VJ'er's most of all on this thread. And with all your experience Jazzy you of all people should know that immigration law can change and routine embassy procedures can change at any time. I'm sorry to you and any other VJ'ers I might have offended. I hope we can have a debate here without everybody getting offended. I just don't believe everyone should assume that things at the Manila embassy will always stay the same and nothing will ever change. And if I see someone post what I think is bad advice I'm going to call them on it. That doesn't mean I don't still have respect for that person or don't like that person. I'm just passing on part of the education I've already gotten here on VJ. God bless all of you.

Hi,

There is no need to call or fax embassy about extentions of the noa2. They automaticly extend it past the 4 months. The manila embassy is the busiest in the world and this is routinely done, they realize it usually takes longer than 4 months and so automaticly extend it.

Well, for now my husband is on his DART night...We can give the information soon as he arrive. We'd been through a lot of this process and I know he knows, what he is talking about. He research everything...all information before he posted in every forum.
