K-1 Fiance(e) Visa Process & ProceduresWrong Embassy on the I-129F?!

do you have any updates on what happened with this? I am in the same situation as my fiancé lives in Scotland. Our immigration attorney told us to put Belfast down as the consulate to use and we just received our NOA2 this week so its on the way to the NVC. However when I called the NVC they said all petitions for the UK go to London and any in Ireland go to Dublin. Is Belfast not an option for I 129f petitions? I know the office in Belfast processes things much quicker than London so we really don't want it heading to London.

Oh god. What did I do? I just sent the I-129F packet yesterday, and now that im reading the K-1 timeline, I think I made a big mistake. On the Embassy&Consulate portion of the form, I used the Edinburgh consulate (My fiance lives in Scotland) and I think I should have put London?? Does anyone know which is correct? And if its wrong, how do I fix it? Im freaking out!

"The Consulate General in Edinburgh does NOT process visas and cannot answer any questions concerning visa services.  Visa processing takes place at the Embassy in London and the Consulate General in Belfast.  "

Omg what did I do cray5ol.gif How do I fix this??

Du calme.

Once the petition is approved, it will go to London as that's the only place in the UK that processes K-1.

On her forms asking where she's lived past 10 years does she list school? She never stayed there 6 months exactly but did leave hukou there. My uncle in homeland security told me not to put it on her petition because its more of a secondary address should we keep it the same?

She got everything from her hukou except the unmarried certificate she has to go back to Wuxi for it and she called Huai'an notary they do the translations. Thanks for all your help!

ya, in the white book link I posted - there's some chinese characters about notarial documents.

OK I told her thats what it was I just confused her saying the words white book and she told people on phone white book instead. Well that clears that up!

hey - if Xuyi office can't do the birth certificate in chinese, then she needs to find out (from them) where it's obtainable.

I will let her know all this tonight. She said they're closed til Monday so we'll see what happens then. Thanks for the help!

Also is there Chinese for white book?

http://www.jiangsu.net/city/city.php?name=xuyi#Administration_Jurisdiction

Huai'an is the administrative city, Xuyi is the 'county' .
I dunno, maybe she needs to reach out to 'province' level for the notarial translation?

...Studying more - she can probably get the translation done in the big city of Huai’an City...

Alright I'll let her know. She's only been to the Xuyi offices should she try Huai'an office for hukou too? She said that last time she went without book to xuyi hukou they said even if had it they can't give her certificates. She's going to go and try again anyway Monday with hukou in hand.

no no no.
IN HER DISTRICT, there's a huge translation office.
Sure, not in her small town, but IN HER DISTRICT, no worries.

She'll have to scout a bit, find it.
400 RMB, maybe, but 400 USD? no, la.

Alright thanks. Sorry she's a little clueless about finding all this. So hukou can give certificates then find her districts notary to translate?

It was a company in Beijing and she said it converted to $400 USD they said doing it for USA visa will cost more.

Thanks both of you. Another city's notary can do the translations right? Her town is small and doesn't do translations. She saw a company that does it by emailing scanned pages from her hukou that has experience with embassies but its $400 is that a normal price?

Should she get multiple copies of birth certificate translated? I've seen some suggest have three; one for interview, one for AOS and one for things like bank account and ID.

is she in her hukuo city now?
if so, another member of her family, who's got her listed in their hukuo,
can get it done.

Sounds to me, without HER book, the registry office has been ignoring her.

Alright thank you. She's in her hukou city now. I'll let her know in the morning and see if her mom or dad can get it. If not she can try again when her book is back. Also where can she get her white book? And would white book have the police certificate and unmarried certificate or should she go elsewhere to get those?

Is this her only hukuo city, ever?

Did she transfer hukuo from one city to another?

what is her current hukuo city, and if there was a prior one, what was it, also ?

Her hukou was in her hometown in Xuyi, Huai'an. She took it to Wuxi for school but she moved back home in July she had left it there and its being sent back to Xuyi by today or tomorrow.

ChinaDS230 places lived
What should I do about not putting school on her list of places lived on the G-325a? we just went by what my uncle had said about school not being a permanent residence, i'm sure they didn't realize anything about a hukou and she didnt think of that until now when her certificate for unmarried is from wuxi and not xuyi her hometown. should we do another G325a and bring to interview or mail in? or just not put school again on her ds230, we have listed she attended the school but didn't list it as residence because she considers her home the permanent residence. Or put school on there and put a letter stating she didn't consider school her residence and put it this time because she had brought her hukou there?

Sorry just keep thinking of many options but not sure what would be best

no, it wouldn't cause problems.

All i'm saying is that for determining residency in china, hukou is the thing to go by.

OK she's been home over six months without returning and wont return to school but hukou has been there so it seems that would have conflict with home residence. Maybe she needs to write a note about her forgotten hukou.
mdglotzbachMaleChina2012-12-17 16:05:00
ChinaDS230 places lived

For China, it's definitely where her hukou is, it will be her residence. If understand correctly, when Chinese students go to college, they usually move their hukou to the city where the college is at, so her residence would be her college.

So it will cause problems she forgot her hukou in her school city months ago she's been back home for over six months her hukou was left there until last week.

Thanks. We understood it as her home is permanent residence and school was just class. All her mail still went home nothing to school. From what people in immigration services in the US said is just put home address school is more secondary so that's how we did the i129f. I just dont know how Guangzhou wants it.

for my wife's application, we put all the places she lived at on that form, including the time she spent at university dorms.

So she should put the 5 months in school then time home then other 5 months in school then time home and so on?

My fiancee isn't sure what to put on question 30 places lived. She has lived at home in Xuyi since born but when she was in college she stayed in the dorms there, in another Wuxi. She always came home on any holiday and breaks. so it wasn't a permanent residence. When filing for the i129f i asked my uncle that works in homeland security and he asked a friend he said don't put her school address, Which makes sense, but if we put Wuxi on her ds230 it will show up different than her petition. The confusion here is that she brought her hukou to the school and left it there for the years she had atteneded, and accidentaly left when moved back home meaning her unmarried certificate has came from there as well. Can she put lived at home Xuyi from birthdate (mm-yyyy) and then on the second line put Wuxi (only during school sessions) and put the dates she attended that school? Should she write a letter stating why her unmarried certificate shows wuxi because hukou was left? and should she get another unmarried certificate for the week her hukou has been back in her hometown?

Why not use the Skype records showing you calling her phone?

If Skype can't do that, then I suggest Dynasky.com for phone calls to China.

Skype can do that, I sent in every other month I had for the petition. This should be my last question for now, thanks for all the help hopefully I'm not too much of a bother. Do you think January is too late for a visit? I'm thinking either November or January. January works out better for my work schedule, just hope it's not too late for the interview time, i think it will be later though from how processing times are.

Yes, Dad will need to do the I-134 as well unless you have well over $3 in documented liquid assets for every dollar of income shortfall below 125%. Guangzhou requires the 125% as a MINIMUM, even for the K1 as does nearly any other Consulate.

Ok thanks! You've definitely eased my mind on alot of this. Is it ok that I use skype to call her phone? I pay $40 for three months of unlimited calls but it would show a chinese number on her phone records. Or should I get a international plan on my phone so my american number will show up on her phone records?

You heard wrong. The strongest evidence of a bona fide relationship is evidence of time spent together. Photos from one visit ARE evidence of time spent together but it's the time, not the photos that matter.

Thank you for all your help. I will be planning a visit for before her interview comes. She is very excited I will come again and so are her parents.
I do have one other question about the I-134 I do make over the 100% required for it but I'm a little shy of the 125% that I know will come later. My dad will be a cosponsor if needed when the i864 comes round when she moves here, but should he also fill out an i-134 to show that I do have the help for 125% when later needed? I also have a good amount in savings, some profit sharing and some assets. I'm up for a promotion by the end of the year and I'd make the 125% by then for sure, but if it doesn't come up in time I was wondering about how that would go?

For Guangzhou, you can expect the interview to be around three months after petition approval. All the timeline information is right here on VJ. Time to start your timeline.

Do you think visiting the week of the interview is good? I read I cant go in with her but she could bring my passport in as proof i came to support her. I'm thinking either go around November or right around the interview time.

Another visit obviously won't make the case any stronger to get NOA2 from USCIS, but it couldn't hurt to be able to claim two visits at the interview, when that time comes, as pushbrk mentions, (plus you will enjoy seeing your fiancee again!:D ). See most recent Guangzhou review by jregister (for K1 visa, BTW), question 4, she mentions, was about visits of fiance to China (she answered twice). Not saying it's necessary, but it couldn't hurt, and you would enjoy it obviously (if it's something your budget can handle). Best wishes on your journey.

I was refering to the interview for the visa not the NOA2. I saw that review and another website talking about it and it said one visit is no visa. But like said a lot of ky is luck they may not even ask her that question. But I want to be safe and do everything I can to get her here.

Great. I'm sure you'll enjoy your next visit. FYI, although Guangzhou requires two Chinese characters, it is only one word, so the Pinyin I'm using to spell it is correct including the capitalization.

Alright thank you, you've made me feel better about this process. I know through the Vermont service center it usually takes 5 months so I'm expecting the petition to go through in October. Do you know about how long it will take after that or know a site I could find out? I want to be able to plan when I can have the next visit. Thanks again.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa concerns

No matter what other evidence of relationship you have, the evidence of time spent together in person, is by far the strongest. By all means, go see your fiancee again, whether in the middle or at the end of the process. Whatever works for you. Minimum requirements for getting a petition filed and approved have been met but an approved petition is far from an approved visa.

How long was your first visit? Are there other concerns or red flags in your relationship? All this makes a difference.

First visit was 9 days, we stayed in a hotel together in the city she went to school. Her parents came to meet me for two days of the visit, they were happy about the engagement because their daughter was happy and in love with me. We talk online for around 10-12 hours a day, from when we wake up til one of us needs sleep and vice versa. We've known each other for over a year.

Since you have already started the application, the second visit before her interview won't help that much. if you have enough evidences to prove, there won't be a problem. But again, luck matters sometimes, so Good luck

Thanks!
I sent in pictures from the visit, several gift receipt copies, months worth of phone records through skype, all my purchase records in china, and all my flight and hotel records from the visit. I sent a pic with her parents too. I know when she has the interview she needs to bring in more things to prove that the relationship was still going, wouldn't a second visit help with that? She could bring pictures in from the second visit to show I was there since the petition. She will have a card from our anniversary to bring but what else could she bring to prove that the relationship is still ongoing?

K-1 Fiance(e) Visa Process & ProceduresK-1 visa concerns
I have recently seen that all k-1 visas will be sent to GuangZhou in China. So here's my concern. I've read that they seem very strict about the interview there. I have only met my fiance once in person and that seems to be a problem to get through the visa. Does this mean I should go visit again before she has and interview for the visa? I have no problem with doing so by the way, just concerned if I don't she can't come here. I've known her for over a year and I flew to China and we got engaged March 25th, I met her parents while there as well. Right now I'm awaiting the petition results, it was received on May 14th and sent to the Vermont service center. Seeing this has stressed me out so much, we just want to be together soon..
Thanks

Having the same intended address is not a requirement to have a I-129F petition approved.

If you want to feel better, write a letter saying that you both intend to live at your grandmother's address, and give it to your fiancee for her interview (in case the consular officer asks her about it). No hurry to do it now, her interview should be months away, and your plans may still change. :)

Thanks alot. I just happened to stumble on a website saying it's suspicious for the address' to be different, but you've definitely made me feel more comfortable about this. I'm still waiting on my NOA2, expected in November according to VJ timeline. :)

I would do two things;

You've done the right thing, change your address on the USCIS website.

I would call them the next day and confirm everything is in order (for your peace of mind), their number is 1-800-375-5283.

Good Luck to you Posted Image
