OMG... all the while we thought that our paperworks has been neglected but its not. My husband recieved a call last monday (26 Sep 2011) requiring him to send his income tax for the past 3 years. They asked for my contact number and they informed him also that in a moth or two I will be schedule for an interview. God is great as he is listening to my prayers. Nothing to worry now. Just preparing all the supporting documents that I will be needing for my interview. Thanx for all your replies :)

When you say no updates, what exactly do you mean? Did you get a notification his petition was received (commonly called NOA1)? Was his check cashed?


yup, no NOA1... :(

Have your spouse call USCIS to see what the status is.


yes.. every week to check and see if there is any progress.... but all they say is pending.... is it normal for us to wait this long??? :(

hello everyone... hope all is well out here. hmmmm, i dunno how to start this topic. to anyone who can relate with my question, pls do reply.. my hubby filed I-130 last feb 2011 but up to this moment we do not have any updates yet. how long does it ususally take before a petitioner gets a notification. we got married in PI. he is now in NJ and I am here in middle east. thank you. If you married out of the country. Which means he has a passport. U need your original birth certificate to get a passport. So that fake birth certificate sounds fishy to me. Just sayin!



yup... we got married in philippines and i have seen his original BC, and have a copy of it also :)

seems like your husband is playing games with u :bonk: anyways if he really file a petition you should get a receipt # kinda similar to this #WAC0000000000

ask him to give you that receipt #. go on USCIS web and check your case. MABUHAY!!!!

Did you, as the beneficiary, ever have an interview? If so, what reason(s) did they give at interview and later by letter; they nearly always send a NOIR (Notice of Intent to Revoke) and it is the petitioner's responsibility to attempt to address the issues raised on the NOIR - that's my understanding of the process at least?



no interview, hubby received an email notification saying that our cr-1 application was denied as we are only married less than 2 years.. hmmmm... cr-1 is meant for less than 2-yr marriage but why denied? :(:crying: :help:

Not sure on the first time, but the second time, you either missunderstood something or your hubby is not telling the truth. There is a spousal visa for less than two years, the CR-1, and for more than 2 years, the IR-1; the process is exactly the same, the only difference is the one letter in your visa in your passport.

When was your visa supposedly denied? Ie at interview, or by letter? There is no such thing as denial by phone call.



Im sorry, through e-mail notification... That is why we applied CR-1 visa coz we are married less than 2-yr. Now, evrything is in doubt why such result happened :(

Hello everyone... I hope to find some enlightenment to clear my doubts why it happened.

Hubby & I got married on 18 April 2010 in Philippines. Hubby applied our 1st CR-1 on Aug. 2010. By December, we got the result. Denied.... They said his birth certificate was fake. Though he was born and raised in NJ, USA. So we applied again after a few months. We decided to apply CR-1 visa again by Feb. 2011. End of Sep. 2011, my husband received a phone call saying that my interview will take place in a month or two. Just got upset coz 2011 ends without receiving any phone call. My husband received an e-mail notification 1st week of March 2012 (gosh, it took a year to find out the result) saying that our CR-1 visa was denied again coz we are married less than 2 years.



And now we are planning to hire an immigration lawyer to process my papers. Just to make sure that everything will be handled accordingly.



Seeking for an advice for any VJ'ers who had experienced the same OR any opinion with our case why it was denied is highly appreciated. And any idea how much it will cost to take a lawyer?

Hope members could help me more to enlighten my confused mind.

So to start our application. We need fo file i-130, g-325A for both of us, g-1145 which is optional. Including our passport size photos, copy of our marriage certificate, my husband's passport and birth certificate copy, affidavit of two disintersted person.
Is there anything else?

Photocopies are ok for accompanying documents for I-130 and AOS.

For IV package, ORIGINAL or CERTIFIED COPIES of the civil documents are required.

I sent in all originals and didn't have any problems. I would suggest sending them in, and having another original copy for the interview.

· A cover letter asking for to file a petition for me
· A completed and signed I-130 form
· A check for the filing fee: $$$
· G-325A Biographic info (Petitioner)
· G-325A Biographic info (Beneficiary)
· Copy of US Birth Certificate to prove US Citizenship
· Copy of marriage certificate
· Copies of pictures of Petitioner & Beneficiary on different occasions (Proof)
· Passport copy with stamp of entrance in Philippines? (replacement if ever Plane tickets can't produce?)

Im just wondering and if anyone could pls advice. My husband and i got married in philippines last year. Are we still considered fiance/e in the eye of US law even if we got married in PI already?
