hi everyone, i have my k1 visa approved,issued on feb 13,2013 and will expire on july 21,2013. but i dont have plans of moving til last week of june to settle some more things here..

question is, will it be okay? and im kinda confused with the visa that states:
PET FILED: 29Feb2012/REVALID TO 03JUN2013.......
will it have an impact on my plan of POE-ing on the last week of June?thanking all in advance.
one more thing, anybody who brought their dogs with them? what documents will i be needing?

Have you, or have you not met in person in the last two years? If you have not, you will be denied.

A waiver is only effective if you have solid proof that meeting in person is absolutely impossible. It's very rare to say the least.

Reply to the RFE, with the evidence/information that's requested in the notice.

I'm not sure if a waiver is necessary in your case, but it's my understanding that 'mishka1' (previous post) submitted it due to their circumstances. (read below)

Thank you, it is for some reason comforting knowing that other people are experiencing the same excruciating wait. I just called and the employee told me that I could only file a service request after the 60 day wait. You must have lucked out and gotten through to a very generous person!


Also waiting, here in Vancouver, CANADA.

California Service Center just received our "1.5 lbs" RFE package today. Hopefully it won't be a long wait.

You need to send in:
-the letter of intent to marry, from both of you, a template is available on this site under the K-1 guides.
-proof you have met in the past two years. Either receipts, boarding passes, stamps in passports, photos of the two of you together. The more the better.
-Send them a page of the story how you met and proposal.
-Reason for the customs violation, whatever that might be, and the outcome.
-proof the prior marriages were terminated, either by death or divorce BEFORE the K-1 was filed.

Someone didn't read the guides before they sent in their package.

know what we need to send . Pretty easy instructions, once you get the letter. Whatever applies to our situation.


With our 1st package we did send a letters of intent & a time stamped photo of us (proof that we've met over the last 2 years).
Obviously that wasn't enough, and we'll read over guides on the RFE a little better. Not a huge deal, just more work.

You need to provide everything they ask for. A letter of intent to marry from both of you, I think a sample is in the guides, proof of having met in the last two years, and certified copies of divorce decrees. You would be best overloading rather than skimping on the evidence as they will not give you a second chance to answer to this RFE.



Yes I understand, and will overload them with information. However, RFE's can be sent at anytime during the process. Some cases never get them, some get more then one. Every case is different. But yes, MORE information is better then none. Even though I've already given them some information that I will be resubmitting.

I put the example notice I received for others to view. Pretty easy to follow their instructions, if they apply to your situation. (Neither of us has been married before so divorce 'decrees' don't apply to our situation).

I understand that my fiance (the petitioner) will get this letter, and he's also 'signed-up' to receive 'email notifications' with the USCIS, regarding the 'status of our case'. Then what will I get? A notice from the US Consulate,? (in my case, Vancouver) Is that correct?


I know it'll be coming soon (end of April, beginning of May 2012)

Anyone care to share? (maybe scan a copy of this letter?)

It'll look like NOA1, just with something different written on it. Don't lose it becayse you need it to adjust status. After USCIS approves your case it makes a short stop at NVC and after NVC goes to Montreal. When it's approved at Montreal they will send out packet 3 which is a letter telling you to fill out some forms and mail them back. When they approve packet 3 they send out packet 4 which is a letter telling you to book an interview. However Montreal is known for dropping the ball and failing to send out pkt3 and pkt4 so a couple weeks after your petition is sent to NVC you should start calling department of state to inquire about your case, specifically asking if pkt3 has been "logged." As soon as it's logged you can mail off pkt3, you don't have to physically receive it in the mail, just know that you've been approved. Check out the K1 guide pinned at the top of the forums for more help with pkt3, and be sure to read the newer posts in it as some things were updated.

CanadaQuick question about when to book wedding stuff..

When you get your Visa, do you have to enter the USA right away? Or could you stay in your home country for a few months to book your wedding venue, etc.
I know you have 3 months once you enter the states to get married, but 3 months doesn't seem long enough to make solid wedding plans.





What others & you have said: K1/Fiance VISA is valid for 6 months, from the date of issue.
Once you enter the USA on that VISA, you must get married within 3 months or 90 days.

Do what's best for you.

We were trying to plan a wedding, but have since changed our minds. When the time comes, we just want to make it legal, and have a celebration ceremony another time. Listen to your heart, and do what's best for you.

Anyway, we didnt have anymore than what we had ALREADY sent, so we re-sent what we gave orgianlly and extra reciepts of credit card transactions of the visit. They also asked us to send letter of how we met. So USC wrote a 1 page letter of our journey and had it notorized. (was only 5$ to have it done)
We got our NOA2 10 days after mailing RFE in.

My I-129F got approved. 6 days for the USCIS decision.

Have the 'circumstances of meeting' & both 'letters of intent' notarized gave us piece of mind. Although it's not mandatory, we felt better seeing the Notary Public, to get things notarized. And she even included copies for us. Cost us $50 for 3 in Vancouver. ($35 for 1).

The office we went to was the closest, & we got an appointment last minute. The timing critical because my fiance was only in Vancouver for a 2 week period, and wouldn't be back until July, past our RFE deadline.

They do prefer the boarding passes, since you can technically purchase a ticket and then not travel, but if you can match the reciept up with the passport stamp then that will solidify the evidence a bit.

Checked my case status on the USCIS site today, the update read, "On April 11, 2012, we mailed "a notice requesting additional evidence or information in this case..." That notice goes to Hawaii, my fiances address. He's working on a ship, out in the Gulf of Mexico until April 25th. (He's got family there that can scan the notice, and mail it to Canada if need be, so no problem there).

So, what's your experience been? Hoping to hear from people that have recently been through this.

If you purchased airline tickets on-line through some place like priceline that you have an account with, you should be able to go back and at least get the itinerary/reciept that you purchased those tickets. I know sometimes when I flew from Canada, US customs did stamp my passport so you could inculde copies of those passport pages if you have the stamp.


I was just wondering about on-line airline tickets, which I've been doing for years... I've got some of those. I'll see my fiance in a few days, and how many stamps he has. Actually, we both have Nexus cards, I'm sure that'll be helpful somehow.

yeah just make sure to put the date in of when you met.

We met in Hawaii in January of 2010 - for example. Just make sure you include a date within the last 2 years (since you met originally in 08). Ie.

"we met in hawaii in january of 2008. We have since started a long distance relationship where we visited back and forth. Our most recent trip was when XXXX visited me in Vancouver in February 2010"

- I saw you mention something about the olympics so I'm just assuming :P

Hey girlie. Here's what we did for the following things you've been asked for:

Part B. Question 18 – Describe the circumstances under which you met.

Holly and I first met while playing an online video game. Originally we were just friends who occasionally played together. However, over time we spent more time with one another. In late 2008 we became close friends. In January of 2009 I made a joke that I should come up to Vancouver and we could spend a weekend together, eventually this joke turned into an actual plan. My first trip to meet Holly began in June of 2009 after my classes had ended for the semester. I drove my car up the west coast. It took three days of driving to reach the border and soon I made it to her apartment. From the moment we first met one another in person I knew this girl was special. I had originally planned to stay there for only two weeks, but two weeks quickly turned into five. We went camping in Tofino, visited her cousin in Victoria, and I met her father, brother, and grandmother in Salmon Arm. Since that first trip we have regularly visited one another every three to four months. Holly agreed to marry me when I proposed to her in July 2010.

*It just needs to be a very simple statement. Always best to go with the 5 W's (who, what, when, where, why!). Our "how we met" statement is probably more elaborate than even they want it to be!

Intent to marry letter:

*We just copied the example on Visajourney's website. Not sure where I found it but probably somewhere in the guide.

Have met in person:

*Sounds like they want primary evidence ie: boarding passes, passport stamps, receipts etc. I believe you can get a record of your trips if your passport hasn't been stamped but I can't remember how. You should try to look back into your visa credit card statements or something and see if you can find any charges at that time.

We did do letters of intent, and intend to send the same as they've requested it. Along with 'primary evidence', (from Nov-'09-Nov-'11).
So far I have 9 pages of primary evidence. My honey will be here for a visit in a few days. We'll see what he can add to that.

Got the notice/letter via scan/email. Sounds similar to the one you got.

* We both have to provide 'Intent to Marry' letters (which we already submitted with the I-129F package).


*..."Have Met in Person" have met in person and/ or have been in each others physical presence at any time during the two years (2009-2011) immediately preceding the filing of the petition. (I did submit one time stamped photo with the I-129F. Oh well, do it again).

Under Have Met in Person: Circumstances of meeting:.... to establish the relationship & Last Personal Meeting (2009-2011)

Circumstances of meeting: We will both do letters. As advised above, have them notarized.

Last Personal Meeting (2009-2011)... whatever evidence we have, we'll provide. Thank goodness my fiance, (the petitioner) has credit card receipts with his name & year/mm/dd. Unfortunately, we don't have airline stubs during the time period they're asking. Everything is done on the internet these days, we print, travel, and toss. Oops. My favorite receipt is the one for my ring which he purchased in Vancouver/Canada 2010. Other favorites items to submit are time stamped photos. One from Disneyland, California 2009, and another from the 2010 Winter Olympics CAN vs USA game.

My fiance will be here for a visit in less than a week. Haven't seen him since Valentine's Day!

or for omitting a check in a box. our lawyer did not check off box 18 i think it was..it caused us a 3 month delay.Bascially you got an RFE. go over what you sent them to see if you missed anything.


OUch on the 3 month delay..

I did review what we sent, but we'll just have to wait for the notice, to see what they want.
Can't really do much until then.

I'm constantly hearing, 'Oh, well I'll need to know the date, so I can book time off" Really? YOU need to know the date?

Or this one, from acquaintances...'I've always wanted to go to Hawaii. I'd love to go to your wedding." GEEZ!

Truthfully, my FAVORITE thing to say is the truth.
We don't have a date. We're just going to make it legal and have a ceremony another time.
My family and closest friends get it. Once we decided that was our plan, it has made everything SO easy.

That felt REALLY good to vent.

I've been searching the forums for an answer, but haven't gotten an answer to my question. Please forgive me if this has been answered already and I just couldn't find it. :)

Is it possible for the Vancouver Embassy to email (rather than snail mail) Packet 3 to the beneficiary? If that is possible, how does one go about having that happen? My fiance will be moving shortly, and will not have as timely of access to his mail as we would have hoped. Email would be our preferred method of communication, and I have heard that Vancouver is stellar with email communication. ANy helpful advice would be appreciated!

Friday June 1: 15 business days later.... from NOA2. Nothing in the mail.

Saturday June 2: Sent emails to the US Consulate in Vancouver & the NVC.

Monday June 3: Email reply from Vancouver Consulate; "Nothing received from NVC".
Evening time, called the NVC: Asked for status of file. Case # given.
Advised NVC sent petition to US consulate in Vancouver, Friday May 31st.


So... now I have my Case # and no letter. Now what?

I decided to call the NVC after all. ( 4 min call .Posted Image ) *11pm EST* less wait time...

Gave the NVC lady my petition info....t
hen she asked me to read her the first paragraph of my notice...
( "The above petition has been approved, and forwarded to the listed consulate". ) She said, "Looks like your petition was sent directly to the consulate from here. Contact the consulate (in Vancouver for me) 15 days from the notice date."

So, according to my NOA2 & NVC lady, I should follow up by calling the (Vancouver ) Consulate regarding my VISA.

(15 days from the notice date =Friday June 1st.)

The notice also says,,, "Please contact the consulate with any question about visa issuance".

(I didn't read her that part. I kind of felt silly for calling at that point, but she was nice).



Well see what the mailman has for me in a few weeks...

Before you answer, understand that I DO search this site (every forum, portal, etc...) before I post, but sometimes I just can't find the answers I'm looking for.

Hoping to hear from K1-CANADIANS in Vancouver. People in the exact same boat. Don't be offended if this isn't you, and I do appreciate all that share. It can be a little overwhelming when information is filtered in from all over the world, and you just want to hear from people that have been there done that. Walked in your shoes.

I've messaged a few "peeps" regarding this questions. Now I'm putting it out there for the rest.
