First, relax. Now that you received your NOA1, you can wait about 4-6 months before hearing from the USCIS again. Take your time to read how the whole process works, especially at the Mumbai consulate, if that's the consulate your case will be transferred to (Indian members will be able to help you).

You're right, the affidavit of support form I-134 (the I-864 is needed at the Adjustment of Status stage, not for the K-1 process) and supporting documents should have not been sent with the I-129F petition package. It is needed at the interview stage. I would say, don't worry, as it is not required with the petition, I assume the USCIS won't look at it. You will send correct and more recent documents to your fiancé before his interview.

For the interview, you fiancé will have to gather birth certificate, police record, and so on... I don't know exactly which documents his consulate will ask for, look at the "Embassy Info" tab and look for your consulate. Browse the Guides tab on VJ, check the I-129F petition package checklist to see if your lawyer send all the good documents. If it misses something, you will receive a "Request for Evidence" (RFE as we say on VJ), be prepared in that case. There is definitely a lot of useful informations on VJ! :)

So my fiance and I sent in our i-129f petition in December but I just realized we may have a big problem though. I know that if one has ever lied or misrepresented himself to an immigration officer then he is inadmissible for immigration benefits. My fiance applied for a tourist visa a few years back in order to visit his father's friend who said that he could come see his father's friend's business and then if he wanted he could get the appropriate visa to stay and take over the business. I don't know exactly what was said in the interview except that my fiance claimed to be going to visit a friend and they determined that was false because my fiance did not know the last time his "friend" (who, in this culture really was his friend because it was his dad's friend) had visited Jordan (country of origin). I know when they asked when he last had visited my fiance just threw out a number that turned out to be incorrect. I don't know how much he lied or told the truth but I want to know what factors of this previous visa denial might be considered in our current fiance petition. If you have any direct knowledge of this please let me know. I got terrified when I realized he could be inadmissible.


Don't worry about what you don't know. You've already sent out your petition, and it will take months before you hear anything.

We have mailed off our petition for the fiance visa. I was just wondering if it is possible to start getting the next documents ready for the next stage while waiting for the NOA2. I have been reading that sometimes it takes a couple months or so to get the police records that are needed. I am making another trip up to see my fiance in July and I am sure we wont have the NOA2 by then, but thought maybe we could work on getting things ready together while I am there. Any tips would be greatly appreciated. Thanks :)




Congrats on your new beginning!

Research, research, research. That's my best advice, and what I did between my NOA-1 and now.
(I'm in the middle of collecting evidence because we received a 'Request For Evidence/RFE)

VJ site is really helpful. Look at posting from people in your area to get an idea of what your next step is. Different forms for different parts of the country.

Black Ink.

This information is stated in the VJ GUIDES section, instructions for K1 VISA,

as well as Department ofHomeland Security/USCIS "Instructions"
(see link)---------->USCIS... Instructions for form... "in black ink"



Regarding having the "Letter of Intent" notarized. We did not have them notarized the first time we sent them in with our I-129F package. We just signed them in black ink. He did his, I did mine.

HOWEVER, we recently got a Request For Evidence/RFE notice. (Please note: not everyone get these). We were required to send "Letters of Intent" (just like we did with our I-129F) & "Circumstances of Meeting" evidence. THIS time, we had both "Letters of Intent" notarized, and the "Circumstances of Meeting" letter notarized. This was suggested by a fellow Vj user.

In our case, It's not required by the USC or the CANADIAN. It's piece of mind. At a price of course.




Follow your heart & the advice of people in the beneficiaries country. That's my advice.

A lot of people have. The I-134 was not created with K-1 visas in mind. Its purpose was really for those that would be temporarily in the US. Not for those that would be staying, adjusting status and becoming permanent residents. Question 11 makes more sense for those being sponsored on a temporary basis. That is why N/A - "K-1 visa process for permanent residence" makes sense in the case of a K-1 applicant. If it makes you feel better, check 'Intend' and then put "K-1 visa process for permanent residence" on the line.

The I-134 is not a binding contract. It is basically kind of like a 'cover-letter' for organizing and listing your income and/or assets that you are providing documented evidence of.

On form I-134, Question 11, I intend, do not intend to make specific contributions to the support of the persons named in item 3.

Should we choose intend or not intend? My US citizen fiance, he's confused about this, we're gonna get married, we're gonna share everything, There's not the exact amount and duration of contribution, Should we choose "not intend"?

Question 7: My US citizen fiance, he's unemployed for years, but he has sufficent cash and assets to support the family, How do we answer question 7?

Thanks again everyone, you guys are so kind and helpful.

I will take to attorney tomorrow and insist on having the I-129F package filed without fiancee's birth certificate. We do have copy of her passport, my US naturalization certificate, US passport, and everything else on step by step guide for I-129 F package from Visa Journey.com.

If they do require it, I assume they will send us "Request for Evidence". Fiancee is still trying to get the birth certificate, I believe we will get it in a few weeks.




Beneficiary's Birth Certificate not required to file I-129F. Just the USC/petitioner submits their copy.

I'm a Canadian beneficiary. We filed our package without a lawyer, and without my birth certificate.
Like others have said, it's not needed at this point. I have since sent away, and received a copy of the required version of my birth certificate, that's needed for my interview in CANADA: Vancouver BC location, US consulate.

As recommended, send your package off. Then work on getting a copy of your fiances birth certificate ASAP.
Check under the forum of her birth country, and folks on that forum should be helpful.

Ideally you'd have ticket stubs of you going to Canada, or perhaps ticket stubs of her coming here as far as primary evidence. Credit card statements of you in Canada would also be helpful. It would be even better if you both had statements showing transactions at the same place and the same time (like if you split dinner and could come up with statements showing transactions at the same restaurant).


We sent 1 1/2 lbs of evidence. Mostly credit card statements showing transactions my fiance, the USC made while he was visiting me in CANADA. And he rarely uses cash, so LOTS of transactions over the 2 year period 2009-2011. A few 'ticket stubs', but mostly 'ticket' receipts from him, the USC, traveling to Vancouver/CANADA. I included my visits to the USA of course, but he comes here more often.

Everything is now in the hands of someone else. Good thing both of us are patient.Posted Image

Yes, I submitted every airfare receipt from every time we ever met (from the first time in 2007 through the most recent before filing). I think there was only 1 we didn't have still. It was a ton of them. The problem was all the receipts were emails. Nothing in the original instructions says emails aren't acceptable proof.

Yes we submitted the letters of intent. They just felt the need to ask for them again I guess?

You're welcome for the detailed list. Don't think everything on there was necessarily needed but at the point we were RFE'd I wasn't taking chances and went right into overkill mode. I took the keep it short and simple, bare minimum approach in the first place and when we got the RFE went a full 180. Wasn't going to risk a denial or further delay.



TOTAL felt the same way.

The California Service Center received our evidence Friday May 4th. Looking forward to hearing something 'within 60 days'... Posted Image

Heather drove for her most recent trip to Canada for Christmas in 2011 so there's no record of it

Heather stayed with Jay and his family at his parents' house however we told Jay's family we were going shopping for Boxing Day and got a hotel room for one night so we could have some privacy. The room is in Heather's name and was paid for on Jay's credit card.

Here is my situation:

I live in Michigan and my fiance in Ontario. Its a 7 hour drive for me to get to him. I don't have an actual passport, I have an enhanced ID that provides me the same access to and from Canada by car as a passport would.

My fiance has a passport, but because its only a short trip, the times we've met, I've driven or he has taken a bus.

I sent in pictures of us and also his bus ticket stubs, but what other evidence would they want? Based on what I've read here, is that those are all secondary. We really have no primary! I also sent a copy of text messages we've sent to each other.

We also don't have any telephone records because we Skype every night and text during the day. So its very rare that we actually call each other on the phone. Maybe 3-4 times a week.

Oh! And also, we both have Blackberry cell phones so we normally talk on Blackberry Messenger because its free. So therefore actual texts that some cell phones list on your bill showing who you texted, doesn't apply to us either really.

Anyone have any advice? I sent that all in, but have a feeling they are going to want more evidence.

Honestly, and truthfully, you sent what you had.
Now it's wait time... months... Either you'll get a RFE (request for evidence)
or they'll be happy with the evidence you sent and you'll get NOA2
(2nd Notice of Action / i-797).


We just got the NOA2... however we did get an RFE.
*Please note, this does not happen to everyone, and every case is different.*

Not a big deal, just more work.
By the time we sent our stuff off, our i-129F was approved in 6 days.
And now we have our NOA2.

My attorney that I met with before I sent in my paperwork said its all about the "intent". I think their systems do show the names of people involved with immigration. Because K1 is an immigration process. The intent is for marriage and eventually permanent residency/citizenship. So I guess if they can prove that they are going to be going back to their countries after visiting, then they may or may not let them in. For me as the USC it doesn't make a difference on my trips to Canada and back because they know I don't want to move to Canada based on my filing of the K1.

Get your VISA, get married, and plan the 'BIG' day later. Why stress yourself out with all of this and planning a wedding.
I was trying to do that in the beginning, and decided to wait.

This whole process, is all about waiting. Patience will always brings peace.

Hi there, (CANADIAN beneficiary from VANCOUVER).

I'm not a dual citizen, but hopefully I can be of some help with the Birth Certificate question.

I would think since they'll be asking for your Birth Certificate, it means the Spanish one. Where you where born.
You where not born in Canada, so you only have 1 Birth Certificate to present them.

I'm sure you're going to have to bring along your Canadian Citizen information too, so no problem there.

That's not correct. You only have to prove that you've met within the two years prior to filing the petition. So, if you meet on June 25, 2012 and file the petition on June 27, 2012, you're fine.

I think you're suppose to have known each other, for more than 2 years, before you apply.

Just saying, you might want to think about that before you start anything.

Exact wording from USCIS site:
  • You have met each other in person within 2 years before you file this petition.
It hasn't been 2 years for you guys yet. (late January 2013 will be 2 years)
But you have met each other is person which is great.


I'm no lawyer, just trying to help.

Thanks for all the input.

I've read over the flowchart several times, and while it's helpful, it doesn't really explain how things progress as far as "now you'll wait to receive a letter from NVC", etc. There is a lot of useful info, but things get a little vague after the NOA2, at least in my opinion. Maybe I'm missing something, I'm not sure. I tend to work better with lists, etc to work from, though.

Hello from a CANADIAN beneficiary in Vancouver. (K1-VISA Approved last week).

In our case, after the NOA 2 (May 10th) USC received a letter from the NVC dated June 1st. Basically it was just an FYI , ..."your Canadian fiance will receive a letter from the US consulate/embassy where they will have their interview, it will instruct them what to do". The letter I received,from the US Consulate here in Vancouver was dated June 7th, and it was literally just instructions; a link for 'packet 3' (more forms). *We actually got our letters on the same day: June 10th . Coincidence? *

(Months ago, between the NOA 1 & NOA 2, I had read what 'packet-3' was, (Vancouver version) and did a lot of the required tasks. Vaccinations & such. Whatever I could do, that didn't require having a case number)


For my interview, my fiance only gave me copies of his past 3 years taxes to go along with the 1-134 'Evidence of Support'.
That's my Vancouver Consulate experience. (Not sure if Montreal is any different).

And my K1 was approved..

I think the Montreal Guide will be most helpful in your case.

True & true... Validity date will be on the VISA page of your passport. (approx. 6 months).


Calculate mine out, and it's actually 5 months + 18 days..

As mentioned previously, 1 entry into the USA when you 'activate the VISA'.
Whenever you 'activate the VISA', upon entry to the USA, you then will have 90 days to get married.


Re: Extending you interview.... you can reschedule your interview date.

Once the applicant logs in, they may select cancel or reschedule from the options on the Applicant Summary page.


How many times can an applicant change the appointment date? The applicant may change the appointment date as many times as needed before the reschedule/cancel deadline in the confirmation email.

Hi to my fellow Canadians. I will be flying out of Vancouver International and I know I read "somewhere" that they process our POE there instead of on the USA side. I can't seem to find that infomation again and wanted to know about the procedure there.

I would just be honest. Not so hard to put more than one address. It's were you lived, resided. (Not were you got your mail). Were you lived. You can state it was college dorm... no big deal. They just want to know where you were.

2. Applicant's last address (outside of the U.S ) for more than 5 years.

Answer the question as stated. It's kind of like the first one.




3. Applicant's employment for last 5 years.

State employment dates, last 5 years.


I had to put an extra sheet for that, also had a new job, with several different employers. I typed in what I could then when I ran out of room I typed in ( See attached continuation sheet). If you wanted it put everything on the cont. sheet, I'm sure that's fine.

Best way to label it correctly? This is what I did...

Area's where I put "N/A" : If your native alphabet is in other Roman letters.

A: Correct... As long as you both answer truthful, that's all that matters... if you put N/A instead of none... or vice-versa.. it's okay... just be honest :)

I filed my Fiance K1-Visa from Vancouver, BC Canada. And just filed my AOS (Adjustment of Status), from here in Maui, HAWAII.

As 'LeftCoastLady' previously stated, have a look at the VISA Journey Guides. This will 'guide' you through the K1 process.
The K1-Guide-Vancouver/ is another guide to follow, since your fiance will be filing from Vancouver.


You two can totally visit each other. Do a search on this site regarding "Visiting during the K1 process". You'll read lots of stories about couples that have gone through this.

Totally agree with both previous postings.

I understand your way of thinking, and they DO ask for the I-134, (they did for my interview) so it's best to have it filled out with 'supporting evidence'. We submitted/ had the last 3 years taxes as evidence, and that's all. But whatever is easiest for the USC I guess.

Later on, down the 'Visa Journey' road, you'll be filling out a similar form for your AOS (Adjustment Of Status); Form I-864/Affidavit of Support. On Part 7, of Form I-864, there are 'optional' questions, where you can put your financial information. As this was 'optional', I choose not to provide any of my information. After all , it's not required. (personal choice).

Any who, I hope this helps to shed some light on Form I-134. Better safe, then sorry.
