Part B – Question 18

In August 2005, I came to know Joan through a Yahoo internet chat room. Since then, we have communicated via e-mail, instant messenger and by phone. On January 12, 2007, I went to the Philippines to meet her in person. After three weeks together, we mutually decided to become married upon her entry into the US.

dappollo,

If you really mean married, no. If you mean have wedding ceremonies, it will depend on which if either creates a marriage.

Yodrak

Can you get married outside of the USA and then again inside the USA once the K1 VISA has been issued without breaking any laws/regulations.

TimDaisy - I have nothing to add to this. I just wanted to say I always appreciate your replies on VJ.

We didn't use a lawyer.
If you read the guides here and follow the directions, you should be fine.

Let's change the question now. Has anyone completed the process with a lawyer and in retrospect see it as a waste of money??

K-1 Fiance(e) Visa Process & ProceduresOff to Turkey in June !!

Hi Everyone,

 I am so excited I'm ready to burst! My boss agreed to give me me ten days off in June and I'm going to visit MS!! I haven't seen him since October and cannot wait to see him !!!!!!!!!!

I bought the airplane ticket today! And he's really excited, too - already planning our week. It's only an 8-day trip, but I'll take it! I cannot wait to see him!!! We've got lots to do while I'm there, but I really want to sit quietly with him each day and make time stand still ... if I can.

(L) (L) (L) (L) :star: (L) :star: (L) :star: (L) :star: (L) :star: (L) :star: (L) (L) (L)

I'm also thinking about the NOA2 which I hope to receive in June. Since I'm flying to Istanbul, perhaps I should prepare/type all the NOA2 forms in advance - those that I can - based on what the embassy website indicates. MS doesn't have a well functioning laptop or printer. If I can prepare these forms and bring them with me, then he'll just have to sign them and make copies. At least, we'll save costly FedEx delivery charges.

This will be the last time I see him before his interview in Ankara. Any suggestions or thoughts about what I should bring or prepare in advance??

Thanks so much!
MM

Aloha,
When we get our NOA2 in May, that is exactly what I intend to do. I'll get to see Joan and I'll also have the peace of mind in knowing the paperwork 'got there'.

K-1 Fiance(e) Visa Process & ProceduresNOA2!! Need some advice!!

I need some advice!!!! I am at CSC, Moscow Embassy, recieved NOA1 March 9, they recieved petition 3/01. Looking at the immigration timelimes(CSC and Moscow embassy, 3 month and 6 month) I am HOPING for NOA2 email around May 28. (I know, dont hope too much!!) I am leaving for Russia May 31 -Aug 31 for 3 months and (hoping) that she will come home with me. (dont laugh). Anyway, do I need the NOA2 or copy for interview?? Or any other documents from CSC or NVC??? Ideally I would like to leave about a week or so after approval but tickects jump from 1150.00 May 31 to 2050.00 June 1st, plus I miss her dearly!!! Do I need to stay until approval???? I have prepared all documents(FED EX) for any RFE scenarios. I need some advice!!!!

Visit May- Help!!!

I am in an identical dilemma. I want to go visit Joan soon, and our NOA2 should be coming due sometime during May. I want to see her now as I view this as "halftime" of our VJ. But at the same time, the delivery service I trust the most is that backpack sitting by my feet on a flight to Manila. In the end, I will probably wait till I get our NOA2. That way I will have the peace of mind knowing she has everything.

K-1 Fiance(e) Visa Process & ProceduresOn Chat logs as proof of ongoing relationship

There really is no reason for them to read your entire conversations. What is important is who is chatting, when, and how often.

What I do is take a screen shot of the chat archive for every day we chat. The archive shows the date, time, who is chatting, and the first part of the conversation. I paste this in a word document with our names, date of chat, and case number in the header. I format the document landscape for printing.

This gives 1 page for each chat rather than tons of pages for each chat. If I provided entire chats, I would seriously be killing an entire forest ;)

I use a free program called Gadwin Printscreen for capturing a screen shot, you can select any part of your screen to either copy to clipboard or save as an image...I use the copy to clipboard option as I am pasting into a word document.

I also use the same program to take screen shots of us a few of times a week while we are on Windows Live Messenger video conference. I include this with the chat archive for that day.

Once a month I gather all of our chat proof and burn it to CD in the even something happens to my PC, and also print our chats for the previous month and file it in a cabinet I have set up for all of the proof we have compiled for the last 2 years.

I'm sure you will have other members suggest different things, and you may find something else works better for you. I have found this to be the easiest to do, and maintain in the long term.

Good luck to you

(F) ~Kiyah~ (F)

That's what I call dedication! :D THANKS TO ALL for the really useful advice!

Aloha,
I think you're making this more complicated than it has to be. Joan and I use Yahoo messenger, and when the conversation is over, I save the chat as a text file naming it JoanIM-YYYYMMDD - Y being year, M being month and D being day - ie JoanIM-20070420 . Then when you print the conversation, the 1st line will be the name of the file - thus documenting the date.

As far as editing with a black marker, I won't go to that trouble. If we say anything risque, to me that is a futher indication of a real relationship. For god's sake, we're not a bunch of monks and nuns - and I seriously doubt that the interviewer would expect that - even if he took the time to read every word of every transcript.

K-1 Fiance(e) Visa Process & ProceduresImmigrant vs Nonimmgrant Visa
Aloha kakou.

Why is the K-1 considered a non-immigrant visa when in fact the beneficiary intends to move here?? I have always wondered that. And besides that, a fellow poster had questions about the DS-230 which is an immigrant application.

K-1 Fiance(e) Visa Process & ProceduresCalling USCIS as the beneficiary?

Is there a way to check directly with the NVC?

Answering my own question...yes, there is, I called them, and I found out that we've been approved!

Like some others here, our file was touched 2 days in a row, and the first touch was the day that it was approved. The NVC wouldn't have that information until they received the file, but they received it 2 days ago and sent it to the foreign consulate today. The person I talked with didn't have a problem giving me, the beneficiary, the information after I gave her our names and DOBs.

Did NVC know what date you were approved?? I am in the same situation. I called USCIS and lied (I know I'll burn in hell) - and they didn't have a clue what was going on. So I called NVC Thursday and they said they sent out our packet the day before. I was so dumbfounded I didn't think to ask what our approval date was.

K-1 Fiance(e) Visa Process & ProceduresCalling USCIS as the beneficiary?

Not only should you probably not be calling because you're the beneficiary, you shouldn't be getting into ANY habit like lying! Just like you're not supposed to be filling out papers, or saying anything during your interview that is in anyway a lie, why would you think it's okay to phone the information line and lie?

You have no idea whether you've received an RFE, or any NOA. You were touched. Period.

I know you're anxious, but patience is a virtue!

Good luck during the rest of your journey.

Carla (F)

Good god Carla.. Take a pill... If I wouldn't have 'lied' I would have never of fully appreciated how screwed up USCIS is now.

K-1 Fiance(e) Visa Process & ProceduresWhat is a fair price?

I agree with most here that if your case is straight forward I would do it myself. The papers are not very difficult to fill out. Even if you use a lawyer, you still have to provide him/her with your and your SO's information, pics. etc. Send me $500, your information and I'll type the papers for you. "just kidding". If i did not find and utilize this website I am sure I would have made some mistakes. The guides here and personal experiences are invaluable. Good Luck.

I'll do it for $495

K-1 Fiance(e) Visa Process & ProceduresWhat is a fair price?

You all are great! Thank you, for taking the time to respond. :energetic:

Yes, our case is very straight forward no little things hiding out in the proverbial closet BUT I did have another idea today and wondered if it would be speedier than a K1 Visa. Tell me what you think 'cause I'll ask the lawyer too on Monday when I go for my initial meeting. Here goes:

What if I went to London (where my Polish fiance has been living for 25 years) and we got married there and applied for a K3 Visa instead? Would that be a faster process you think? We have been a commited couple for 3 1/2 years (this is no whirlwind kinda thing :clock: ) and I just want to get this horse outta the barn, lol :hehe:

If you think this will only complicate the situation let me know and tell me how it would. I'll be throwing all this at the lawyer (get my moneys worth, heh ^_^ ) so anything you can think of would be appreciated.

Again, thanks for the terrific responses you all are super and give me hope.

P.S. Use the money for a party instead that's a good one! :jest:

I have heard a K3 takes longer. I hope your meeting is a free initial consultation. You asked for opinions - if your case is straightforward, do not waste the money. All the information you need is on this site. I knew nothing when I started - now Joan is awaiting her interview notice. All the info I needed was here. As someone said before, this process ain't rocket science. Another consideration is that a lawyer will not be giving your case the same timely attention that you would.
JoanBillMalePhilippines2007-06-10 03:12:00
K-1 Fiance(e) Visa Process & ProceduresWhat is a fair price?

I have thought long and hard about this and I need the help a lawyer can give. First of all, I need the help to organise because I admit I'm a nervous wreak and I feel a lawyer will prevent the little mistakes that turn into disasters. It just seems that you get a little peace of mind is all.

My question to those who have "recently" used a lawyer can you give me a round figure of what you paid, please? I know it's a very personal question but it would help me tremendously when I go on Monday to see this lawyer and he asks for an amount. I would like to know if it falls in with what others are paying.

Thank you. :)

In the beginning, I thought about hiring one. But the more I read here, the more I realized - hey-- we can do this ourselves. In retrospect, if I would have spent money that way, I woulda been soooooooo pissed at myself.

K-1 Fiance(e) Visa Process & ProceduresQuestion about dates on NOA2

First want to say, it's nice to see another person from Hawaii. Best of luck to you both. I am glad that I checked this post out. I checked out the above link about the explanation of an NOA 2. When reading your post about dates, I was a little confused. Let me explain.
A couple of weeks ago, I received a letter. It says " the state department's NVC has received an approved I-129f ..etc. This letter is to let you know that within a week the petition will be forwarded to the issuing post where the interview will take place.."
They have the original INS Receipt # and they gave us a case number.
On the bottom " Your fiance will soon receive a packet with instructions..etc...
Sincerely, Bureau of Consular Affairs

For a couple of weeks I assumed that this was a NOA2. Now from reading this post, I guess I was wrong.
So the NOA 2 looks like the NOA 1? I understand that we will need this later, after she gets here. Correct?
Is it common for a person to receive the above described letter first? If not, is there a website I can contact to try and get a NOA2. I have a Ph# on the NOA1, but during the week I don't have the time to sit on hold. By the way it is CSC. I will look around for a web address, but if anyone knows it off-hand. let me know.
Thanks, (Mahalo)

Eh brah... Where you stay??

K-1 Fiance(e) Visa Process & ProceduresQuestion about dates on NOA2

The "validity dates" of the petition approval, a 4 month period of time during which the fiance(e) must complete the requirements for the visa. (May not be on every approval notice, but that doesn't mean there is time to waste). Note: This validity period may be extended at the consulate if needed.

http://www.visajourn...-I129f.html#3.7

The K-1 approval is only for 4 months, the embassy routinely extends them beyound the 4 months, the consular officers have the authority to extend the validity.

Example US Consulate Guangzhou:

What if my petition expires?

Consular officers have the authority to extend the validity of petitions that have expired. Because many petitions often expire before an applicant can be interviewed, officers at the Consulate routinely extend the validity of K-1 petitions.

http://guangzhou.usc....gov/kvfaq.html

Manila does do this also.

I was wondering how accurate the predictions for adjudication for a k-1 here on VJ are. They are constantly in flux (and I know it's based on the timeline of those who are in the process of approval), but I'm wondering if those of you who've received adjudication on your k-1's found the VJ estimated date of adjudication accurate.
Thanks!

K-1 Fiance(e) Visa Process & ProceduresStarting a K1 advisory business

JoanBill,

If you are serious about this venture, I would highly recommend that you make and appt with a lawyer and discuss the legal ethics of what you wish to do. The ABA may take the stance that even preparing some documentation would constitute practicing law if you provide analysis in how to answer or fill in the form. The drafting of legal documents requires a law license.

Please do an extensive search on the "unauthorized practice of law" (UPL) as it is prohibited in every state. Is this something that you were considering for the US or in your spouse's homeland? If in your spouse's homeland, I would consult with an international lawyer.

Yeah, I know. I am thinking of some type of waiver/agreement signed by the client in the very beginning stating to the effect "I recognize Joan and Bill aren't lawyers and they are acting in a non-legal advisory manner. If unforeseen problems arise, then actual legal services may be needed above and beyond what Bill and Joan provide". I would think a good pre-screening could alert us of any potential legal issues. And if we sensed that, we could reject the client.

Yes, I intend on talking to a lawyer about this. The question arises - what in the I-129F process constitutes being a legal document?? And if providing analysis on answering question is UPL, then is VJ.com acting in an illegal manner??

K-1 Fiance(e) Visa Process & ProceduresStarting a K1 advisory business

Aloha kakou,

With Joan and I 99.9% thru with our (pretty much problem free) K1 process, I am seriously considering the possibility of Joan and I starting a K1 advisory business. Note the word "advisory". The appearance of practicing law concerns me, but I am sure there are protections we can take.

With Maui's proximity to the Philippines, the abundance of Filipinos already here, Joan being filipina and $1800 legal fees - I see a possible market.

Has anyone else contemplated this???

Mahalo,
Bill and Joan

a suggestion is to shift away from being an advisory service as it implies legal knowledge but there is definitely money to be made as a document preparer. plenty of agencies exist in other countries where non-attorney types provide notarised translations etc. think of how many people (me included who are just too scared to fill out the forms even though they are really simple if you just take your time and read them)

good luck! :)

That is an excellent angle.

now im confused..me and my fiance read the I-129F instructions and it NEVER mentioned in there that the benefciary will also need to submit a Copy of BC. wacko.gif and some of here says it should be submitted others says i dont have to,but only my fiance(the USC) is required to submit it...

anyways it wont hurt if i'll send a copy ,correct?? or it may just result into an RFE if i'll send something unrequired.

hope i can get a definite sure ball answer with regards to my question about the BC helpsmilie.gif

If I were in your shoes I would feel betrayed and devastated. That being said, are you sure this is the end of your relationship? Some would say, of course it is! Yet others would say people in stressful situations, such as a life changing event like immigration, sometimes make mistakes like lapses in judgment. And even a fewer number might say, who care? let her have a wild fling with some old flame she is never going to see again when she leave her country.

My point is, you have a lot invested here. Is this something you can get past? Do you love her enough to build a life together regardless of the past? If she is indeed pregnant, can you be a parent to that child not of your loins? If you can not, then there is no shame in it. No one would expect you to. But if you can, then take the steps to put it back on track. Dont let emotion or public opinion make the ultimaten decision for you on this.

Yeah, right. If that were me, I wouldn't even put her on a plane. I'd just say "you're on your own".

Bill and Joan,

She can go anytime to have her 2-day medical as long as she has her Appointment Letter with her which she will be needing upon entry at the St. Luke's. She can also have her CFO certificate and PRISM seminar anytime. Bring the necessary papers when she goes to both appointments respectively.
I had my medical examination done 1 month ahead of my scheduled time. Also I did my CFO and PRISM seminar earlier so i will just have the seal when i get my visa.

You don't have to let the St. Luke's know before you go there, you can go ANYTIME. Also its best to go there in the afternoon at 1pm, i did mine both days in the afternoon. Hope that helps.

Aloha kakou,
Long ago I saw this mentioned, but now I cannot find it - so your help is appreciated. I remember reading it is possible to go in to St. Lukes earlier than your assigned date for the two medical days. My questions are -

What conditions have to be fulfilled before this can happen??

Do you have to let St. Lukes know beforehand??

Can anything else be done early while in Manila - such as attending the CFO seminar??

Here's the short story - it is somewhat of a burden for Joan to get to Manila from Pampanga. Once I receive our NOA2, I am gonna go visit Joan again and hand-deliver the NOA2, financial documents and myself. She will be traveling to the airport to greet me, and I was thinking it would be nice if she could take care of other things while she is there.

US Embassy and Consulate DiscussionQuestions re: Manila CFO Guidance Counseling

That "visa summary" they are talking about is probably the form outside the sealed envelope...just make copy of that. I don't know how it looks like but I was told by my fiancee that some of her aquaintances during the seminar with the visa on-hand already bring those. And of course bring the passport with the visa on it since they affix the sticker/stamp on the passport.

Good Luck!

Coco Puff

Hi everyone, thanks for the advise. Coco Puff - I'm looking at the package of her visa that came through the Delbros delivery. All that's in the package was her Passport, the Brown Envelope that's NOT TO BE OPENED, a receipt from Delbros for the delivery, the Appointment Letter from the Embassy originally sent to her with her interview date, the pre-departure yellow paper giving instructions on the seminars to take, and the big WARNING DO NOT OPEN piece of paper. I don't really see anything that would pass as a "Visa Summary". Anyone else know what this is?

I don't really want to bring the entire package specially the Brown Envelope for fear of breaking that seal. Thanks again everyone.

Well I guess it is just the passport that you need to bring. That is considered to me as a Visa Summary if nothing else is inside the package except for the confidential brown envelope and miscellaneous papers. No name nor the case number in the envelope? You can just copy the exterior of the envelope if there is any information printed in there.

Tell you more when we get ours next week  ...Wish us Good Luck! But for now that is all I can share with you

US Embassy and Consulate DiscussionPost NOA2 questions
Aloha kakou,

Hopefully within 2-3 weeks, we'll be running with the post-NOA2 crowd. That said, we've started researching the next step. I had surgery a month ago and was taking some pretty funky pain pills. When I was reading the forums during that time, I was in a haze, so I don't remember alot. I do however vaguely remember a few things that I would appreciate elaboration on -

1. I remember someone talking alot about a bar code on one of the DS forms. It seemed pretty important.

2. I also remember someone mentioning that some documentation was incorrect in that Form B - not Form A was to be used as a (receipt??) for the (visa??) payment.

3. I started filling out the I-134 within Adobe. The form seems to have some fields linked as in a couple instances data was incorrectly duplicated into fields other than the one I was filling in. Has anyone else experienced that and has come of with a work-around (other than doing it by hand)?

US Embassy and Consulate Discussioni-134 pdf problem with date fields

I resorted to opening it up in Photoshop and pasting the text in.

STOOPID ADOBE!!! That's a real bug.

It's not Adobe - it's a poorly designed form.

US Embassy and Consulate DiscussionLetter from Bank with Affidavit of Support

I should be receiving my NOA2 in the next few weeks and want to prepared for all of the additional documentation that I need to prepare. One of the things that I will need is the letter from various banks stating how much funds I have. I am concerned that if I get them too early then they will be no good when presented to the Embassy at the interview because they will be dated several months in the past. What are people's opinions on when I should get this letter.

Thanks for your help.

I have read here that up to 6 months before the interview is acceptable.

I want to repeat the OP's question about which form acts as a receipt for the application fee - for we have the same question. We have seen two different answers from different sources.

Normally you simply show your appointment letter and the bank gives you a receipt to take to your interview to prove you have paid. Check your consulate's website - perhaps they clarify.

I explicitly remember reading that the bank annotates one of the DS forms upon receiving the application payment. Unfortunately when I read this, I was recovering from surgery and was on some pretty ###-kicking pain meds - thus the memory deficiency.

I am filling out FORM SD-156 online and for some reason it wont go through and says "Internal server error" Is it mandatory that we need to fill out this SD-156 form online? and generate the barcode from there?

Another question, What form should I bring when I go to the bank to pay for Applicaiton fee?
