K-1 Fiance(e) Visa Case Filing and Progress ReportsAny Feb. filers still NOA2less?

If so, call NVC. If asked, they will tell you when your case was received and left their jurisdiction. They can also tell you when USCIS approved you.

Once you have this information, contact your Senator. The most expedient way to this is to go to his/her website, fill out a "Right To Privacy Act Release Form". On there, tell your story, give pertinent dates, sign and fax.

My last touch was May 5th and I went through several useless conversations with USCIS. 36 hours after sending my fax to Senator Akaka, I finally received an email saying we were approved.

I recommend anyone else having a similar difficulty to pursue this course of action.

Aloha no,
Bill

Do you actually need the noa2 document for something> I havent found it to be required in any of the guides.

Highly advisable to have for the interview and definitely needed at AOS time.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2 on May 3rd, but no

Still haven't seen the hard copy yet, but just checked the online portfolio again and the date changed to 6/6 - which would be when I had my conversation with the friendly guy at CSC. We'll see if the hard copy turns up.

Next step will be to contact a congressional office.

btw: if you click "printer friendly version" of either the portfolio list or the case status page, you get a pdf of the status. I have saved copies of those and printed out - figure that, in-case, I can see if they really are accepted at the AOS stage. I hope not to test that CSC-operator's theory, however.

Personally, I wouldn't have a lot of faith in what anyone from that agency told me. Every time I spoke with them, they seemed like a nice - albeit clueless bunch. Getting the real thing in the mail two days ago was an enormous relief. I wouldn't settle for anything less.

Sounds Like not receiving an NOA 2 hard copy is common. My last and only touch after NOA1 was on 5/09. No email, nothing. I received a NVC letter dated 21 may, still no NOA2. So I guess the touch on 5/09 was the approval..?? Another "Hawaii" member just received his in the mail, this past Saturday. So I'm hoping to get it this week. It's basically been over 1 month after approval and no hard copy. I'll give it another week. then if I still get nothing I'll try to track it down.

He also didnt hear anything until he contacted his senator. They probably wont just send it out, so you should really start calling either Cali or your representatives.

I agree 100%. Call Akaka.

Well I call one time to the USCIS and am told I'll receive my NOA1 within 45 days of my submission. I call back after the 45 days and am told that not only will I not receive it within that time frame, but it won't even be mailed out until after 60 days. That means I could very well receive it by 75 days or more. And of course they could give me no reason for this delay. Anyone else going through this bull right now. I have the receipt number (made sure to call and get that after 4 weeks) and check my status on the USCIS website daily. This is just maddening.

Chill man... You got bigger battles ahead.

Hello All,

I'm wondering if anyone else had their interview scheduled on the day that the I-129F actually expires. What happens if my fiance doesn't get approved on his interview date?

Thanks

K-1 Fiance(e) Visa Case Filing and Progress ReportsDepressed..

Visajourney friends,

Congratulations to all of you who have gotten approvals this week eiher through mail or email. This will be my last post for now, but don't worry I'll be still checking everyday and see and read all the good news. I'll post here again once I get my NOA2. I've gotten so many touches last week and this week (everyday) and yet no NOA2. I've called a few times before, but I don't want to do it anymore..just tired of hearing the same sad news over and over. I wish you all the best guys. Lately I see that some of you are getting approvals and it looks like CSC is moving, but slowly. I'll talk to you guys soon to bring the good news, and I hope someday I will. God bless and if I may claim to be the one who got touched several days in a row.. hehehe.. :( thanks for your support. :crying:

I would call NVC and see if they have your petition yet. In our case, that's how we found out we were approved (see timeline below).

hi mike, the US Embassy here in Manila will schedule our interview and medical, but according to some of the members, we can go ahead to St. Lukes even before the medical schedule but the interview set up should be followed..

rea

Looks like we are right behind you Rea...

I guess I need to get out my check list and make sure she will have everything she needs for her interview!

Did you receive any notice from the USE yet?

hi novelyn & gragg, i haven't received any notice from USE yet and i also tried the website but it is still not accessible, according to some of the vj members from PH the site of USE is sometimes down when they do updating of the interview & medical schedules...let's just all pray we all have our schedules or notice from USE within the week or sooner... :innocent:

I still don't have a hard copy of the NOA2, even though I have my notice letter from the NVC saying they received the packet...

I wonder if I should use the RFE trick to get a live person on the phone and ask them nicely to send it out and to update our status on their website???

Good luck on that.. I talked to them three times and wasted my time. We were approved 5-2 (according to NVC) but USCIS said we were still pending. I got my Senator involved last week, and got the NOA2 today. I advise you to do the same.

I may have to do that...

What did you say to your senator to get them to intervene on your behalf?

But seriously, other than the satisfaction of having the hard copy in hand, do we really need the NOA2 for anything?

I already have the receipt notice from NVC that they received it and a verbal notice that they sent it on to the USE in Manila. I plan on contacting the Embassy on Tuesday, Philippines time to see if it has arrived yet.

I said "duuuuuuuuuuuuude".......... Seriously, go to his/her website and find the "Right to Privacy Act Release Form". Fill one out telling your story, list significant dates and fax 'em in. 36 hrs after I did that, I got my approval email and 2 days after that - the paper.

It is a good thing to have for the interview and a necessity for AOS.

got our NVC letter last friday June 8, as per the letter , our application was forwarded to the US Embassy in Manila on June 5

now we are just waiting for the US embassy in Manila to nofity my fiance' and go from there, i am ready with my affidavit of support and other docs, just need it to be notarized and then fedex it to her in Manila

what is all that DS forms, i am not aware u can jump the gun and send docs to the embassy ahead of time, we pretty much just leave it at it and just let time and the US govt take its course with regards to the application, so far so good, no snafu or fubar along the way yet :)

we are hoping this will be all done in the next 5 months

cheers to all,

I just spoke with the agency who helped me prepare the initial forms we submitted with the application and they said interview dates in Manila are on average 90 - 120 days after the date it was sent from the NVC to the embassy.... :crying:

That seems like a REALLY long time to me, is there that many applications to process?

I wouldn't trust an agency. It may be a canned response. I hope so for both of us. I am hoping for a late July/early August interview.

When I called for the RFE trick I first had to enter my case # (including WAC) before I could talk with a person. If you aren;t having to do that, you might be in the wrong part of the automated system. When I did get through, I said I was concerned about an RFE blah blah blah and was told "actually it looks like your petition was approved on the 3rd" I didnt have to press them thankfully. After a week or two if you havent heard anything then also try NVC, but make sure you talk to a real person, NOT the automated system. Good luck to everyone still waiting! One more week till I can call and bug them for the paper copy...

K-1 Fiance(e) Visa Process & ProceduresAny problems with attorneys?

I work full time and am quite busy, so I thought that it would be easier for me if I hired an immigration attorney. I wanted to do everything right the first time taking as little time as possible, so I was willing to pay the rather hefty amount. I contacted an attorney that I had found on the internet, but they never returned my call. So, my father's attorney suggested an immigration attorney that he knows who was supposed to be "one of the best." His fee was even higher than I had expected, but it seemed worth it to me if I got the best possible attention to our case. Well, I'm just not sure that I have. First off, I have learned 1,000 times more about this process from this website than from my attorney. Whenever I ask him questions, he makes everything sound like i'm worrying too much and there was nothing I needed to do but wait. For instance, he told me nothing about needing to get together documents from my banks, etc. for the I134; things that I could be doing ahead of time. Secondly, there were multiple mistakes in the paperwork and we had to get them re-done like 3 times. They even had Germany spelled incorrectly! The way his system worked is that we entered all of the information on a website. I'm very particular so I proofread everything about 10 times. So, it when they were transferring the information to the forms, they did so wrong, in numerous places on the forms. It was quite frustrating because every time they had to make corrections it took a few more days. Also, when I received my first receipt after paying half of the fee, it was a blank letterhead with only my address at the top, like they forgot to actually type the pertinent information that should have been on the receipt.

My father's attorney is great and I am really surprised that he referred me to somebody who isn't also excellent, but it feels like I could have done this much better myself and possibly even in the same amount of time. I've only paid half of the fee, and I have considered letting him know that I no longer need his services and outline the reasons why and then not pay the second half which should be due when my fiance arrives in the US. However, I'm afraid to do that because he is supposed to also take care of the work authorization (the invoice also says travel permission?) once my fiance arrives. I don't want to fire him and then when it comes time to getting those done, I'll realize that I need him.

So, I am looking for advice. Anybody in a similar situation? Should I keep the attorney? Or am I just throwing away thousands of dollars?

This was my short experience with a lawyer. I talked to one and told him I was going to visit Joan in a few weeks. I asked him if I should get as much paperwork done before leaving so that I could have her sign everything when I was there and then file immediately after I returned. His answer was 'no' which I thought was shortsighted and stupid. I never looked back. Joan and I will pull this off ourselves. And next fall when we're sitting on the beach reflecting on what we accomplished, it's gonna feel pretty damn good knowing 'we' did it.

We have just about completed our I-129 form and we saw mention of an I134 Affidavit of support form. We realize that this does not have to be sent in with the I-129 form, but we want to start getting ready for it. It says that we should start getting the required information ahead of time. JoanBillMalePhilippines2007-02-27 00:24:00
K-1 Fiance(e) Visa Process & ProceduresNeed HELP with your opinions!!!!!!

I think you need to realize that she is likely giving up a job and disrupting her life a lot. A prenup can be good for both of you. I know one Ukarainian gal who came her on a K-1, married, divorced a year later and they each spent $ 20,000 in legal fees including about $ 5,000 each argueing about who owned an $ 8.00 snow shovel. With a good prenup you can save the arguements and the legal fees.

She got to stay in the USA and came out with about $ 30,000 in her divorce settlement and a lawyer bill for $ 20,000. He lost his house over it and a lot more in addition. The only winners in a divorce are the lawyers.

I totally agree with your comments. I was to meet with the attorney tomorrow, Friday, to draw up the agreement but decided to call her through an interpreter to see how serious she really was. She told me about some concerns she had and we had a very nice discussion. I called the attorney to say i was going to make some changes in the agreement that i hope will help her feel more comfortable, yet she is definitely not going to get much from me because i don't have much for her to get. I believe her concerns are valid and I believe the relationship is going to work out, maybe even stronger than i had hoped for. Language has certainly been a problem but i believe things are headed up hill again and will be stronger because of our problems.

To be blunt, I think you are either nuts, self-abusive or both. And now you say you can't even communicate with her on your own. Man-o-man-o-man-o-man.
