I sent out my I-129F packet today...  I over looked my fiancees  G-325A form.. 

 

there is a part where she would have to put the dates for employment.. it said       Month/ Year    but she reversed.. put in year for month and month for year....

also when she signed at the end where she needed to put the date she put  year first then month...

 

will this cause a problem ? or will they be smart enough to figure it out ?

 

I guess in her country they write the year first... then month.  should I have her prepare another  G-325A form again....

 

I will actually have her prepare it again.  and resend it to me.

 

LOL, I like your attitude when you have to face a problem. It will make easier all the process if you take it light and be positive.

 

Anyhow, I do not think it would be a problem. Different countries have different style when come to write these things. But, if you they send you an RFE at least you'll have another one to send. Good luck and keep us posted!

First, you can't apply SSN card with your married name if you came here under K-1 visa. According to some knowledgable member here (Darnel), the name won't match on the system since you will bring your passport with I-194 to apply SSN. You can change your maiden name into married name at least after you get an EAD. About dropping one of your first names, let others chime in about that.

First, fill your time line in since each consulate has their own requirement. Secondly, are you sure that he was received RFE? Most of times that if people don't respond in timely manner the petition is consider to abandoned.

Thirdly, unless you have checked regularly on USCIS website, only petitioner received the NOA-2 via email and mail. How come you yourself received it? The last but not least, based on my experience, the consulate will send email to the petitioner and ask the beneficiary info before send the instruction. Remember, regarding petition, the petitioner should have known the correspondence like receiving mail from USCIS and NVC before the case fly out to the embassy.

On the side note, it is not K-1 visa approval you have received via email. It is the petition approval. You have long way to go if you are going to complete the process and again you have to involve your former fiancé to handle papers about financial support. Your case is the first time ever I read on VJ that without responded to RFE and still get approved for I-129F.

List him as his son but when comes to names just put whatever it says on birth certificate. The US embassy might be ask you to do DNA test to prove he is his son.

It is not your fault at all, really. Blame to those people who have committed fraud or scam marriage as an easier way go to the US. The more people do that, the more difficult it is. Ironically that when the US government is very strict about the rule there is a time when others slipped into the country and then why Ebola is in now and scared all Americans and others including me as an immigrant.

I never heard a K-1 visa holder gets denied when is trying to enter the US. Though A K-1 visa is under non-immigrant visa but also is bear an immigrant visa. Which means no reason the holder gets denied while entering the US because that's one of the purpose of K-1 visa, gets married in the US within 90 days.

It is nothing compared to many couples here who have gap between 30-40 years age of difference. Age does not matter as long as your relationship is genuine. My husband is 13 years older than me. Im 24 and my USC husband is 33. I don't think there will be a problem. I see in your case you are the younger one but still I don't think is a crazy age difference.

So many issues and switchbacks and hiccups and runarounds, starting to get a headache....
 
K1 and K2 just arrived 3 days ago, however I've been trying to lay down the groundwork before their arrival.
 
 
Called school and of course they need health clearance/physical exam
I called HMSA health insurance, they told me they won't cover them unless US Citizens/married to mother
Called a clinic and they told me they can't accept the only form of ID they possess, which are Japanese passports (and DL for mother), so the K2 can't get an appointment  
  
Not sure what I'm supposed to do next.
 
 
Does this look right for the k1 flow?:
Get SSN > Get Married > Change name on SS card > Apply for AOS
 
Thank you for any advice. Getting burnt out doing all the legwork all these months and especially now that all these snags are coming up all at once.















They can't get any benefit unless you married the mother. Married first then taking care of insurance and school thing. That was happened to me. The military won't let me enroll to TRICARE unless we presented married certificate and any other docs.

You can't changed name on SSN before or at least have an EAD on hands.

 I appreciate the input. I am just trying to navigate this like everybody else. Interestingly, reading through the reviews of the consulate in Bogota, it seems like a pretty reasonable and straight forward process there, and not much of an  issue navigating through there.. yes i am probably making it too hard. I work for the feds, and we get bogged down in stuff sometimes, until somebody speaks up and says, "if its not a material issue, don't worry about it." and then we define material, such as what form, and the completeness of information requested .. So, yes, the bureaucracy, looking at it from a different angle, is a bit overwhelming.. I am sure, as information starts to flow, it will smooth out in my mind.

My husband is in the military - as far as I remember it is a federal government as well-. I believe the military is more strict than any other federal agencies. I know how strict they are and even my husband needs a permission to travel to my country just to attend my interview. Let alone he had to do many trainings including the security training just for one visit. I know how complicated to deal with the military. Guess what? My husband and I am now are happy together. Have you heard some people said, "Sometimes it is only worst in your mind rather than in reality"?. It is.

You wanted to well-prepared which is understandable. I have been on VJ over 3 years and my husband filed I-129F more than a year ago. I spent almost everyday on VJ to learn the whole process because I knew it won't be easy. But if you take light this and enjoy the process you will be happy and free-stress for this matter that already stressful.

not concerned... curious of this process.. i help support her, when she needs it and into the future while we navigate this journey together, and understanding the process helps plan for the future.. Colombia isn't the USA.. here, information is pretty much standardized and readily available, like where to get birth records, background information... etc.. In developing countries, its not quite that easy, like all long form birth certificates are kept with the local notary that has greater authority than US notaries, and that needs to be tracked down, from 25 years ago, if you can even find the notary, (thanks be to God, its listed on the Birth cert. and they still exist).. Rules change depending  on the department, (state) in which a person lives, and even from municipality to municipality, for record keeping and a lot of other  civil processes. So, what would be quite simple here, in the States, can become quite burdensome and bureaucratic in other countries. A lot of that burden is the US Govt. is quite process oriented and driven by standardized rules (administrative law), that dictate how they operate. Even though consulate staff operate in host countries, its doesn't relieve them of these rules and law, since their authority in which they operate is granted by congress, and regulations that interprets said laws. We have rules of due process, which isn't granted to visa applicants, but they are entitled to have a consulate operate under the authority that was granted to them, not the consulate staff ride roughshod over the whole process, how they want, in a host country. It is doubtful that Bankok's consulate operates much differently than another consulate, except where there was higher risk of violating immigration law, but it is doubtful that they deviate much, through local standard operating procedures. That is why I made the comment who cares if something is listed as a bar or restaurant, when working in either is legal in the USA?. What is more important, would be dates of employment and job description verified through an official call to the business.   That is why I  asked about a letter from her employer stating dates of employment, and a simple job description, would help, given  remoteness, in relation to Bogota? If its a data base check, then why go through the trouble and have an employer write up a letter? However, if its more investigatory, it would seem beneficial. If an agency has a back log of files, anything to move the process along would be helpful.   Since a lot of the migration issues, and visitor visa issues came up was after 911, it would be quite logical to consider that is what they would be focused on, but not being through this whole K-1 process before  911 (navigated the CR-1process without problems), I figure the more information the better.  When something here can take hours or a couple of days, it can tack on months in developing nations, simply not knowing where to get it. ... out of curiosity, we were interested so we can plan for the long haul through an AP, or if its a quick and dirty data base check for criminal and terrorist ties? Even prostitution is hard to prove, unless its a legal business in the host country and records are kept, but in countries where it is illegal, then it becomes illicit and a negative response on an application would be hard to prove. Silence would become the beneficiary's best friend. However, as the beneficiary, it would be an issue if they listed unemployed for 5 years, because the first thought would be, " how does this person support them self?" It is doubtful that a host country would allow the US government to access its tax records for employment checks, or any other domestic and civil matter, for that matter, if there is no criminal complaint, just to satisfy its application process for visa issuance. That is why countries have Sovereignty laws, where they don't subjugate its citizens to another country's rule of law; that view of thinking left with the waning dominance of a colonization. If the host country has mutual need for information, then it is granted, If it is beneficial to the host country, as is  the case of terrorism, they would disclose it right away.  if not  Then one has to look at treaties, like tax treaties,  for specific issues. If there is no specific treaty, then you wait for consulate staff to visit the employer. The employer chooses to disclose or not disclose.I
 
That is the long winded answer, why ask this question.  

Then, may i ask, why do we have to go to Primera Notary to get a copy of her long form birth certificate? Its because that is the notary which it was recorded. The Notaries have shelves of books with these records. Mexico is not Colombia, which is not the USA.




Honestly, you make things are seem difficult than they actually are. There are specific questions on DS-160 ask they ask to a beneficiary. Some of them are," do you involve communist party?", do you engage prostitution or human trafficking?", " do you have communicable disease?". These information are needed and if the immigration found out someone lied about this I am absolutely sure the US government will remove and banned this person come to the US.

If your fiancée does not involved in any such activities, if I were you, I wouldn't sweat over small things. I know you are nervous about this whole process. But remember, you are not the only person have been through this so far and definitely it is not the last one. I have seen many Colombians here got approved. My advise is try to ask them about this whole things since they knew the right way for the process in Colombia. Just my two cents.

A consulate would spend thousands of dollars,and man hours employing the NSA, to investigate a shop assistant, in a small town? Seems like a quick phone call to an employer verifying employment would be enough...and hold up a k-1 visa? I think I wouldn't call my senator or congressman about processing as much as i would complain about spending our fiscal budget on investigating a shop assistant in a remote city.. Seems like cross matching name with data bases to see affiliation to any known illegal activity or terror groups... (Colombia has the Narco-trafficking, Human Trafficking, and terror groups like FARC). Those things sound more relevant in a beneficiary background check of an address or employer (i.e. cleaning lady at a bar versus a restaurant?


Based on my experience I never get noticed from any of my friends or my family members regarding someone called them and asked about me. But again, they would easily find me on Internet because I have been worked over 10 years on journalism field and I even attended many functions of the US Embassy in Jakarta regarding my job as a journalist when my husband filed I-129F for me. You can read my interview review regarding what they were thinking about how wonderful Internet it was.

I think you are worried for nothing. If the beneficiary lied on immigration docs and found out after she/he moved to the US then the government can kick them out from the country.

I am simply wondering - is that really possible? USCIS doesn't have any databases except the US ones. So, I believe, there is no actual background check for the beneficiary. Probably, just the documents info verification, to make sure all the data in the application is the same as in the IDs and certificates provided.


NSA is a living proof that the US government can get any sensitive information from other countries regarding the national security concerns.

Agreed.  My wife and I never went through secondary questioning either, the immigration officer just asked us a few questions at the counter and we were on our way.  Our POE was LAX.

 

My husband was with me as well and in fact we went through the immigration via USC-Alien Resident Line. Our PoE was Detroit.

they would be pulled in to secondary questioning by immigration. It happens to everyone entering with a k1 or cr1. They asked my husband a few questions  and let him through in less than 5 minutes. Some people are questioned much more extensively and have to wait much longer. Not sure why you are putting such an emphasis on customs, that;s the easy part


I did not go through secondary inspection or secondary questioning or whatever they call it at immigration line and I was entered the U.S. with K-1 visa. So, it is not happens to everyone to get pulled out.

They will allow you. I went to USC-Alien Resident Line because I came with my then-fiancé ( my now husband) and the officer told us go to the USC- Alien Resident Line. It was shorter rather than Non-USC Line.

Though it says on many posts that most of times the embassy did not ask but I still was prepared all chats and print screen of video calls for my interview. But they did not ask those conversations even pictures that I brought with me. From my observation usually the COs would asked these proof of courtship if they suspect the relationship is not genuine.

Unless it stated that you need to notarized it do not over do. Just send the letter intent of marry in English signed by him. English is not my mother tongue as well and I wrote in English language, signed it and had no problem whatsoever. His name in different letter won't be a problem because that how it is.

Yes you can travel. Why wouldn't you be able to?

Question is, will you be allowed to go through border control together.

That I have seen can vary from airport to airport.

Some have managed to go through the citizen line together, some haven't.

If you can't do not worry, your fiancée will be taken to secondary and asked a few questions just to make sure everything is in order, it's how they check us in and send off the packet for AOS.







 

It is vary actually and I am here to give a second opinion. My husband  ( my then-fiance) and I did not go through the secondary inspection or whatever we called for it. We went together through USC-Alien Resident line as you have already mentioned above that can vary from some airports. There are many members here also traveled alone without their petitioner and did not have to go to the secondary inspection.

 

To OP:

 

Ask an officer there about whether you and your fiance can go together through USC-Alien Resident line. When my husband and I was in Detroit - my PoE-, some officer looked at us and asked whether we came together or not. After he knew we were together then he told us go to USC-Alien Resident line. The good thing about USC-Alien Resident line that it was very short compared to non-USC Line. Good luck!

My same-sex fiance and I have just started the K-1 fiance process. Although our marriage is still several months in the future, it is something we would like to have some definite plans for before he goes to his embassy interview. Since neither of us have been married before, we need some ideas on how to proceed. We will be living in upstate New York after he gets his K-1 visa. My fiance is Catholic, so getting married in church is pretty much ruled out. We both have researched on the internet for answers on where to get married, but we are no further ahead than when we started. Where we have the ceremony is not important to us - we love each other, that's all that counts to us. Can we get married at the courthouse?  We would love some insight from some of you who have been through this before.


Yes, sure. You can get married in the courthouse. Many people did including my husband and I. We did not believe in big fat wedding ceremony though we still have a plan near in the future to have one but more smaller and intimate with close friends and family.

Just a small note, make sure you both are apply a marriage license in the state that allow same sex couple. I heard NY is allow to do. Guess, I don't think you would've problem at all. Good luck!

No, it's in Spanish.  He went to a Spanish doctor to get his vaccines.

You should get one in English language version. For safe way, I have no any other option but suggested you to get I-693 done by designated USCIS doctors here in the US. You don't need to redo whole medical but just to transcribe the vaccination records onto I-693 form. And just a reminder, better shop around because some of the doctors have charged their services beyond your imagination.

My then-fiance (now husband) had his vaccines done in Spain before he entered the U.S. on a K1 Visa.  However, he didn't have a Civil Surgeon complete Form I-693 when he got vaccinated.  Can he just submit his vaccine records with Form I-485 (Adjustment of Status)?

As long as his DS-3025 is marked completed or ticked "eligible for waiver", he should be just fine.The  I-693 can only be done in the US not in the beneficiary's home country.

Getting married in the US with a tourist visa and having had plans to do so is NOT fraud.

Getting married in the US with a tourist visa and STAYING in the US afterwards, and having planned to do so IS fraud.

Your legal options are thus, djgirl: 

Option 1) You can apply for a K-1 Visa and adjust his status to CR-1 after the wedding.  You must get married within 90 days of activating a K-1.

Option 2) Get married in the US on his tourist visa.  He RETURNS TO HIS COUNTRY and you file for a CR-1.  He must wait IN HIS COUNTRY for the CR-1 (or in another country that is NOT the United States).

Those are your only two options.  Marrying on a tourist visa and him staying in the US is not an option if you plan to do it.  You cannot plan that and do it legally.  And they check for ANY trace that you might have planned it.  So don't commit fraud.
