My fiancée and I are getting ready to just start the process. Our attorney said that we will need photos of us together and affidavits from friends as proof that it is not a sham marriage. Would it make sense to also setup a wedding website too?

 

We looked at http://weddingbeacon.com. They have Facebook and Twitter comments. I am thinking the comments can be used to verify that the wedding is real and that our friends and family are involved. What do you think?

I think I over did it on this lolol I sent 1040, W2's, copies of pay stubs, copies of all my deposits in the last  year at the bank and letters from my jobs. whew lol

 

I had everything too. My husband provided me bank account statements from 2 banks, his saving, insurance policy, and pay stubs. But the lady at Window 5 - who checked all documents- only asked form I-134 (original), W-2, and 2012 federal tax return.

Hello,
I have an engagement ring for my Korean fiancée that belonged to my Italian great-grandmother. In the U.S., I believe that items over 100 years old don't have duty fees. Does anyone know if South Korea has a similar exemption? I would like to send the ring with a friend who is travelling to South Korea so that my fiancée can have it as soon as possible.
 
I could just have a female friend bring it, claiming it as her own, buuuuuuuuut if I am not able to visit South Korea before my fiancée's eventual interview, is there a chance that the embassy would actually ask for proof that duty fees were paid?

The embassy wouldn't ask a proof like that. They only care whether your relationship is genuine or not. That's all matters.

How should I answer question 11 on I-34?  I assume I check the "intend" box?  I wrote: " I will cover living expenses until after our marriage until he is granted permission to work in the United States,."

I got my NOA2 approval via website on the 11th of June and the hardcopy of NOA2 on the 14th of June.
It has not yet been received at the NVC. Should I be concerned?



It is too early to worried about. It usually takes up to 8 weeks when your approved petition received at NVC. That's a normal time frame. I got my case number from DoS (not the NVC) 2 weeks from approval date on USCIS website. So better started to make a call and ask for case number after 2 weeks. Your fiancée will communicate with the embassy use the case number. Also, you will received mail from NVC contains all information including your case number.

Do I need to send additional information of our ongoing relationship? I provided when we first met until when we initially filed the petition in April with letters, skype chats, pics, etc.
 
Not much more letters have been made since the last 2 months since the NOA2 was so fast.. haha



Based on my experience, I still provided proof of ongoing relationship though the consular officer did not ask it during my interview. I got approval after I told him that my fiancé outside of the room and wait for me. But better be ready than sorry.

Hello so I received the NOA2 in the mail today.
 
So far my fiance' has the copy of the i129f packet. I just need to make her copies of the RFE I had to send in and the paperwork in the response.
 
I also have the fiance letter of continued support.
 
For the I134 and other paperworks I have my LES's since December. I have my 2012 and 2013 W2's. I have my 2012 and 2013 1040s. I have annual statements of TSP (retirement) for 2012 and 2013 and for the first quarter of this year 2014. I have a proof of service letter. I will be getting a letter with my employer soon.
 
So my main question is since I am the Military and I do make the 100% cutoff. Do I need to provide Bank officer statement of opening the account, past 12 month deposits and current balance?
 
If not, then should I answer the part on question number 7 on the i134 where it ask my deposit in my savings bank account? I do not want to get RFE if I write something in that blank but do not provide the bank letter. (I do make over 100%)

Also I will already add that I will be making a copy of the NOA2 also and she will provide the information since the petition was filed about our ongoing relationship.












My husband (then-fiancé) is in the military as well. He provided me everything and fill out all boxes on I-134 including bank statement for all of his saving, stock and bonds, insurance policy, pay stubs, but no employer letter. At my interview, the embassy only asked I-134, W-2, and federal tax return 2012.

No RFE at the embassy stage. But, if you are missing docs after interview, they will ask it and put your case under administrative review until you completed all missing docs. Also, no need to send a copy of I-129F package, the embassy already has it.

Usually 4 months. Did your fiancé receive the NOA-2 by mail? The validation is printed there.

My friend G from C please read and learn as I did. You will be able to help others rather than cause more concern. My case went thru all of this which is how my husband obtained the following info directly from officers at USCIS in person.
The O Ps case is not lost. Her problem is not what she or you think. The real problem is lack of info. That is caused by the system which is dysfunctional in this important area. This causes people a lot of anxiety and pain.
When a case is approved by USCIS the last step is a bar code that is placed on the case file. That code is for use at NVC. USCIS then bundled with others and finally shipped to NVC. That bar code placement means to USCIS that they no longer have the case so checking with them may produce the wrong answer and cause the appearance that they have lost the case.
Once a case is sent NVC it arrives at the mail center. Cases may simply sit there for a time. During that time the case may seem lost at NVC as well. Until the case is scanned into the NVC system they do not recognize that the case is there. It isn't lost; its in limbo.
If an inquiry is made during these times it may reveal a false sense that no one can find that case. This creates a situation where we see people trying desperately contact these politicians ect. Their efforts are so far behind by the time they actually do anything that what they say may be old news. I have no faith in these politicians at all when it comes to immigration matters. They are in fact the same people that haven't done anything about reform for the entire time they have been in office.
In my own case we never got any info from USCIS, NVC nor a U S Senators office even though my husband sent the 9 letters they asked for. They never responded to one. He had to return to the USA twice to sit down with USCIS in two different offices in two States to obtain the info I have given here. In the end my case took a long 408 days.





You have been through this before, so your solution is more useful for the OP. I read before similar situation to the OP and was trying to find the post regarding the situation. Thank you for such valuable information for all of us.

I didn't get this update on my USCIS status (I just checked it to make sure), and my fiance has his visa in hand already.   I would definitely contact the NVC AND USCIS again.  At this point, you need it remedied because your time on your approval is ticking away.  :(  I'm sorry this has happened.  :(
 


Yes, some people did not get an update regularly. When I got approved for my I-129F, I did not get any update via text or email. I found out the approval via USCIS website. This is really weird situation for the OP though I knew some member got her case number almost 2 months after approval. For me, I got my case number 2 weeks from approval date shown on USCIS website. I hope the OP can figure out how to solve her problem.

How can you tell it;s still in California? What else would this case thing show otherwise? i mean i know the nvc assings a brand new case number and thats how you track it further
 

I know sometimes UCIS website is not reliable but you should get this status after USCIS sent your approved petition to NVC. This is my last status regarding my approved petition.

Oh it seems, your approved petition is still sit at CSC. I don't think there is any other way, as far as my knowledge.

My last status says, " we sent the approved petition to National Visa Center for more processing". Do yours say that too?

guuys im really really worried.....we called all places possible. i contacted my embassy to see if somehow maybe they got it but no they didnt. we called the nvc and they told us to email them the scan of the noa2 so they can "investigate" but its been like a week and a half and still no reply. california service center told my fiance that it takes up to 90 days for the nvc to receive the noa2 from them...which everybody on here called bull, that isnt even what the k1 guide says, it clearly says 4-6 weeks. idk what to do. i mean if it got lost or watever and it wont be valid anymore, how would that be our fault? why would we need to apply and pay all thsi money again??



Have you tried asked your fiancé to contact his congressman or ombudsman? Probably they can help you because definitely it is not your fault if it is misplaced somewhere between USCIC and NVC. What is it say on USCIS website regarding your petition?

Hi all:

Not sure this is in the right place, but I hope the Vj mods will redirect to more fruitful areas.

I was fortunate enough to accompany my fiancé to his interview in London today where he was approved! That said, we were all flustered that when we got out I realized that, along with the originals of his birth certificate and polic certificate, the officer returned our I-134 form (original signature, tax returns, and letter from employer) as well.

At the first window, the guy didn't want our copies at all--he just took the originals of everything. Perhaps to make his own copies? But I am a bit worried that the second officer wasn't supposed to return our form?! Now people in my filing month said their CEAC statuses changed to AP same day as approval....but mine shows that, while updated today, it is still in th "Ready" status....I'm worried the delay may be caused by the form being accidentally returned.


Anyone have any experience with this? If this was a mistake on their part, would we be able to mail the papers in or would my fiancé have to go all the way back to London to hand them in?

I know we are celebrating and I should be grateful, but I can't help the residual nerves making me question some of this stuff.....










 

First of all, congrats for the approval. Secondly, it is hard to believe that the consular officer did not know which form is need to be return. The lady at Window 5 asked I-134 (original signed and dated), copy of W-2, and federal tax return 2012. One thing that the CO returned to me that proof of relationship such as pictures, emails, Skype chats, Skype video screen shots, after I came back to the embassy collected my passport with the visa, 3 days after the interview.

I know about the I-129. The OP was insisting on an I-29 form (not I-129 or I-129f). Anyhoo, it's all cleared up now I believe. 


I had friend who exactly told me about I-29. I told her that is I-129F but she kept repeating same time. After someone came to clear up, she finally accepted it. I guess, she would rather believe in someone else than me, lol. After all, the OP already cleared up the confusion.

My husband (then- fiancé) did not meet my big family as well. I lived in Jakarta for job commitment and my big family lived in small city in different island. But I did tell my family about my then-fiancé and our plan to get married in the US. The consular officer never asked about that during interview and I was approved. But I am not sure about how a consular officer will look at this based on the Philippines cultures and customs.

It means your fiancée has A# that will identified her when she finally comes to the US. A# will appears on NOA-2 hard copy that petitioner will received via mail. It written above the name of beneficiary.

So, my fiancee finally receives her letter from the US embassy telling her the interview date and where to pay visa fee, etc. We have 3 weeks until our interview ... but there are a few errors on the information they have listed on the letter.
 
1.) Her name has an extra "t" in it
2.) Two of her kids dates of birth are wrong (the birth years have an extra year added on to them)
 
Here is the issue: The misinformation is our fault because the information was submitted that way on the I129F form and DS-160 form.
 
Her name: I have been spelling her name one way ever since I met her and she never corrected me. When filling out the form, again, she did not correct me.
 
Children DOBs: Apparently, she had a friend of hers type the information to me in Facebook as she told the information to her friend. It looks like she did not look at the DOBs carefully. So for one child, the year of birth says 2008, when it should say 2009 - and other says 2001, when it should say 2002.
 
I think it is possible to correct her name at the interview, but I am unsure about the children's DOB. My DS-160 has already been submitted several weeks ago. Does anyone have any suggestions? Do you think I can make the corrections at the embassy when I go for the interview? What courses of action are at my disposal?











You can tell staffs at embassy when they checked all of your docs. Make sure you bring the birth certificates of your fiancée and her kids. She should show to the consulate that she doesn't change her name. I did mistake on my DS -160 form as well and never came up during my interview. There was member here from Indonesia that her name on passport misspelled and embassy asked her changed it according to her birth certificate. I think both of you should be just fine.

Wait until they send you letter intent to deny which is usually ask you to send missing docs including I-129F fee. There is a member here had similar situation with you and USCIS sent her letter intent to deny and asked her to send the payment of fee.

I received notification via website that I received NOA2 on June 11th. I got the hardcopy of NOA2 on June 14th.
 
I called the NVC this morning and they said they did not receive it yet.
 
What notifications will we get? Who will get them? The Petitioner or Beneficiary?






NVC will send a letter to the petitioner. You need to wait up to 2 weeks before started calling NVC. Or you can wait they send you the letter contains your case number. Normal time frame approved petition send to NVC about 8 weeks before they assigned you a case number and forwarded to the listed consulate.

The consulate here in Denmark. we thought that we will get the NOA2 before July, but because of the slow approval in TSC, I think that it is not possible anymore :(

You need to meet residency's requirement to apply a visa. NVC will forward your case file to your country based on your current address you put on your I-129F.

Hi guys, I am in a deep agony right now of whether to extend my stay here in a tourist visa or come home while waiting for my k1 visa.

I am currently staying in Denmark and my resident permit will end by the month of September, I can extend my stay while waiting here in a tourist visa but will not hold a residence permit anymore, is it still possible that while waiting for my visa interview in a consulate here I am in a tourist visa? or should I come home because they won't accept that I am not residing here anymore??? I wish that I could wait here and not come home in my country while waiting because it will help me reduce my expenditures. Thank you!

My petition was received on May 27th and my hardcopy NOA1 came in the mail early last week, but there is still no sign that the alien Registration has been changed. 

 

Should I be worried or does this type of thing take a varied amount of time? I know I am in for a long wait, being at TSC, but seeing other posts it seems like they are pretty quick about updating the number.

No need to worry. Alien registration can changed any days. Mine was processed at TSC back in 2013. I got approved 2 weeks after my alien registration number was changed. But, it does not mean anything.

If you have a proper work visa I do not think it should be a problem. There are many members here successfully entered the US with other visas and never encountered any problems.

Hello everyone,
 
My name is Ruben and my journey started on February 14th, when I sent the I-129F. It only took about a week for me to receive the first NOA in the mail; this made my fiancee and I very excited because the ball was finally rolling. After receiving the first NOA, we were looking at about 5 months for processing, which was great because she needed to stay and help her parents rebuild the family business, which was affected by the Typhoon in Tacloban; however, the second NOA arrived about three weeks after the first one. In normal circumstances, this would've been great but we were really counting on the extra time.
 
I read in different forums that we could ask for an extension but I did not know the proper way to do it. I contacted my local immigration office but they did not give me a real answer. Instead, they suggested that my fiancee could visit the embassy in manila and ask for the extension. I tried to save her a trip by calling the embassy in Manila and after explaining our situation, they said that I did not need an extension and that my NOA2 would automatically revalidate when it expires and my fiancee could schedule her interview appointment past the due date, which Is July 20th, as long as the two of us are still free to marry. This may sound like great news but I still have my doubts and I worry that the information they gave me may have not been accurate. Has any of you ever asked for an extension and if so, how did you go about it? Were there forms to fill out or any special procedure needed to be followed? Any assistance will be truly appreciated. Thanks!




The embassy will extended expiration of I-129F. For example, if your fiancée scheduled the interview July 20th and the petition expired, let's say July 1st, the embassy will extended the petition automatically. As long as you show your intention pursuing K-1 visa, you shouldn't have any problems at all.

That was I thought. But if I am not mistakenly remember there was a member here from Nigeria mentioned about that. The consular officer asked the beneficiary to bring his fiancée to the interview. They then had been interviewed in separate rooms. Last time I heard they were approved. I was trying to find the post but came no avail.

And if you look at the bottom it says it was updated June 16th (Monday) and that's when his interview was, but when we called yesterday they said it was denied. And when he talked to the interview guy he said we could resubmit to the embassy. I'm soooo confused!

 

There is a chance that he might be not denied. I read on VJ before the consular officer ask the beneficiary to bring his petitioner in order to come to second interview (stokes interview). She then finally came and last time I heard that they were approved. It might be saved up money not to come but highly slim chance he gets the approval. Better to take a risk rather than to start over again or choose the other path of immigration journey.

So, last December we applied for a K1 Visa, and we got approved like 2.5 months (really quickly) by the USCIS, and then they passed our case on to the American Embassy in Algers, Algeria. He had his interview last Monday. They told him that we didn't have enough evidence of a bona fide relationship and that I don't earn enough money or at least haven't been earning it for long enough. 

I just barely graduated college this past May. But meanwhile last October, I got a job while I was still in school and I make $28,000. I know it's not a ton, but we're not going to starve. Plus my fiance has a degree in Civil Engineering and I just graduated with a degree in Public Relations. It's not like we're not educated. It's going to be a little difficult when he can't work for the first part but we'll make do fine. The interview guy said that yes, I made enough to be considered above the poverty line, but I haven't been earning enough money for long enough. 

 

We thought we had enough evidence. There is nothing suspicious about either of us. Neither of us have broken the law (In algeria or in the US). We're around the same age (Me, 23 Him, 24). We submitted our lease from when we lived together for 2 years, photos of us together, references for them to call, a lot of our conversations on facebook, and phone records. 

 

They said we don't call enough but it's like .32 a minute and the time difference makes it difficult. When he's done with work, I'm at work and we can't skype often because the internet in Algeria is beyond crappy. We spend half the time trying to get the internet to cooperate. He said our lease didn't prove anything else either because it was a 2 bedroom place. We chose the place because the location was great and the apartment complex only offered 2 bedroom locations. 

 

And then originally, the interview guy said that my fiancee could bring back more evidence and they'd consider offering him another interview. So I called a lawyer, who said she'd help me put together more evidence. We we're going to submit affadavidts from friends, more photos, and all the wedding planning stuff we've already purchased (a down payment on a location, the dress, an actual wedding planner service).

 

So yesterday, I have my fiance call the embassy again, to confirm the status of our case and they say our case had been denied! But the interview guy said we could resubmit evidence to the embassy and they'd consider offering him another interview! 
 

I don't know what to do at this point. I'm so frustrated. I haven't seen my fiance since last May of 2013 and we've been planning this big wedding for August. 

 

 

 

I am sorry to hear that. What was your fiance's status on CEAC website? Administrative Processing or Denied?

No.  Beneficiary cannot. Is Petitioner's document.  Privacy Act o 1974 applies.


Hmmm. It is different from NVC then, isn't it? I was the one who called the NVC to get my case number.

Hi everybody, my fiancee is very busy nowadays and he doesnt have much patience as to being hold on the phone for a long time. I was wondering whether I, as the beneficiary, can call USCIS and inquire if everything is OK , or whether we have any RFE pending. We are approaching our 5 month, and I just want to be pro- active.
