I am filing for a K-1 Fiance visa and I need to send in a G-325A form for my fiance. I am wondering about the signature that is required at the bottom of the form. Can I use a photocopy? Or do they want the original copy?

This is straight from the VJ guide, Id follow it to a T. See number 6.
 
What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)
 












Some of guides on VJ are not really apply. For instance, an entire copy of I-129F package. You don't need this one. The reason why VJ put here in case you had bad luck and lost your package and you are still have a copy of it. The US embassy already has the package including the approved petition. I did not bring any of these and they did not ask me either during my interview.

For OP:

Please just follow what the consulate ask from your fiancée. It would be sufficient since each consulates has their own requirement. Good luck!

Hi,

 

Our petition was approved by USCIS on June 25th.  But we still haven't received a hard copy of the NOA2.  However, the process is still moving along and the next step will be receiving notice of our interview date.

 

It seems like I've read somewhere that you have to take a hard copy of the NOA2 with you to the interview.  Does anyone know if that's true?  (If true, it doesn't make sense to me since there would be no interview if USCIS hadn't approved it)! 

 

I contacted USCIS about not receiving it a couple of weeks ago and they said we have to fill out some form and pay a fee to get them to send another copy.  They say they sent it back in June, but we haven't received it.

They did not ask my NOA-2 during my interview. If the US embassy already have received the approved petition then It should be sufficient, no need NOA-2. Keep us updated!

We are about to submit our K-1 Visa, still waiting on a few things to settle before we send everything. My fiancé currently lives in Ohio, which if we file now would assign us to CSC, but he will most probably be moving to Florida in the next few weeks so that would send us to TSC. My question is at what point in the process do they assign the service center? And what happens if during the process there is a change of address?

If yours already sent to CSC unlikely they will going send to TSC because you moved. When you moved, call USCIS to inform about your new address because the petitioner will received NOA-1, NOA-2, and a letter from NVC.

Hi Vj family 

 

For the DS 160 form , is it ok if I explain that I will be taking the required vaccinations during the medicals and have the documents during the Interview? Or is it better to wait till the medicals are over and write it as YES ?

 

Wouldn't it be wrong to put down as YES since technically we don't have the vaccinations records at hand while we are filling the form even though we intend on having them later on at the medicals ? 

 

So confused guys . any input would be so helpful.

I'm confused about this too. I thought we just needed to show proof of meeting in past 2 years. However, I saw so many posts about front loading so I did send my cell phone log.
I thought u sent proof ongoing in with the stuff for the consular but now I keep hearing "the embassy never looked at it". I've heard of denials and people saying they didn't want to see proof of ongoing. We really mostly talk on ohone. I have FB chats but don't know how to print it. So other than phone logs we really don't have any other "proof".
His mother just received her visitors visa so she can come to our wedding....is that any proof??


For high fraud countries, petitioner needs to front-load the petition. My husband and I only submitted Skype screen shots when we did video calls, emails spanned from 2008-2013 we chose wisely about 20 emails, unlimited Skype subscription records taken from May 2013 to August 2013, 10 pictures, and that's all. We were approved for I-129F without any RFE.

For the embassy's stage, the CO did not look at evidence of ongoing relationship I brought. He only asked I-134 original, W-2, and recent tax return. I received my visa 3 days after my interview and the embassy had returned all photos that we submitted for I-129F.

We've known each other for 4 years and have met physically twice each for one month to 3 months. I recently graduated from UCD and currently seeking employment.

Don't worry. Little mistake like that won't hurt. My husband misspelled my address on I-129F and we did not encounter any problem. We were approved in 38 days without RFE. You should be just fine.

Yes, of course you can as long as you have all documents are needed. Also it is much easier since she does not have to send G-325A, letter intent of marry, and photo passport through snail mail. Good luck!

This may be a silly newbie question but it seems that most of the K-1 visa people had their first meeting in a foreign country. Can your first meeting take place here in the US? Originally we were going to just meet in the Philippines in January but I came into some extra money from the sale of a car and am paying for her to come here for two months. Can we file with this meeting or should we wait to file when I go this January?

 

Most important both of you have met in person within 2 years regardless which country you have chosen. The reason why not many people did in the US because too difficult to get B-2 visa especially from the third world countries. I applied B-2 visa back in 2010 and denied. We did not meet in my country due restriction of military and chose Singapore as a neutral country to meet in 2011.

I know this may sound crazy to those who have waited 6-8 months for NOA2, but recently I've seen a few people (especially from the UK) with only 2 months or less between NOA1 and NOA2. 

 

We are sending the petition off in 1-2 weeks (before my fiance moves to France until April and therefore bypass a few logistical problems). However, I can't move to the US until next October (2015)

 

If the NOA2 came back in November-January time, would I be able to delay an interview  until April - either by not submitting my readiness for interview or requesting a later date -  as from my understanding, I must move to the US within 6 months of the issuance of the K1 visa. Or would I be able to apply for an extension to this?

Anyhow, if you are worried about you can't move until October next year, why you just delay to file the petition?

Well Last year I did not work, and I will have to file at the end of the year for 2014... i will make way less than $97,600.

My mom will help me with a co-sponsor application. We will be living with her once we get to U.S.

I was confuse because a i had a friend that filled papers for his wife and he got denied because they were outside the U.S for too long, and I didnt know if that affected my case.

 

For petition, all you need is to proof that you have met within 2 years and seems like you have overcome the rule. I believe you have tons of proof of relationship. After approval, your file will going to NVC and then the US embassy. This step that you have to provided a proof that you can support your fiancee financially. $97,600 a year for annually income is a lot for 2 persons in household (http://www.uscis.gov...form/i-864p.pdf).

 

I don't think lived outside the US was main reason your friend's denial. Many people did it and got approved for the visa. Probably he could not provided financial support for her. Someone can't stand corrected me wrong about this though.

I have been staying in Chile since Dec 26th of 2012, on April I submitted a for a K-1 visa for my Fiancee (We are same sex couple) , we are still waiting for final approval on her visa.  After that we are planning on moving to U.S.
I was born in Chile but I have been an American citizen for many years.
My question is would it affect the process and her change of staus later on, the fact that I stayed in Chile all this time?


As long as you can provide affidavit of support for her, then there is no problem at all. Have you still filed US taxes during your residency in your Chile?

Yet another question, =)

Just like the topic title says, will I have to pay a second time? My French sister-in-law told me I have one shot and if it gets sent back I have to pay twice but I have hard time believing it.

Anyone got any clarification about this or any other fee during the visa process?

No, if they rejected it because improper documents, USCIS won't cashed the check. It will returned back to you.

 

NOTE: You don't pay $340 for fiance visa fee. It is the fee for I-129F. Those things are different.

No wedding planned is needed. All you have to do is get married within 90 days to fulfill K-1 visa requirement.

My fiance has her documentation from her country as FirstName MiddleName PaternalLastName MaternalLastName, passport, country id. Do I need to use the same format when filling out the letter of intent or other documents?
 
Also, she signs only with her first name in both these documents, can she sign the same way or does she has to sign like a standard signature FirstName Lastname?

I just read this as a lawyer who is trying to cover his ### and put blame on others, all while risking your application and making you think you need the lawyer for his/her special inside knowledge.  USCIS doesn't give out "wacky" RFEs.  They give them when stuff is missing.

 

The lawyer just delayed your case for no reason because s/he wouldn't wait for the RFE letter to see what it is.  Now it is coming again,  you could have been in this position weeks ago.

 

Furthermore, had you replied to the first RFE then you would be approved by now.  The RFE stage is also the adjudication stage - they went to approve you, but something was missing.  

 

Oh no!  Not about incompetent lawyer again.

Write a letter to the US embassy explaining you are as the petitioner withdraw the petition. Include all information are needed from both of you. Sorry to hear that and wish both of you all the best.

No, financial situation has nothing to do with an approval. I still have several credit cards from my country and did not pay full prior my interview to approval date. And nothing was happened. I flew to the US safely and still using my credit cards now for online transactions.

Hello All,

 

I am new to this forum. I just got engaged overseas to my girlfriend of a year and half. We got engaged while vacationing in Turkey towards the end of last month. I am trying to get my papers ready for the K1 petition. I have a bunch of questions that I have not seen answered anywhere else. Any help with these questions would be supremely helpful.

 

a.       The I-129F asks for an address that the two of us will live at once she moves here. I currently have a room mate and plan to move to a new apartment right before she arrives. Since I do not know when that will be, can I just use my current address or will this be problematic in the future?

 

b.      Page 5 of I-129F asks about a waiver. None of those scenarios apply to me. Does that mean I can ignore that section?

 

c.       My fiancée and I have met over three vacations in the last year and a half. Will printouts of electronic reservations (flight reservations with both our names on it etc.) suffice or does the USCIS need actual hard copies of boarding passes etc? What is a safe number of pieces of evidence of this sort?

 

d.      The visajourney website has a sample G-235A form filled out. It says there should be no gaps for the home addresses and employment addresses. In the last five years, I spent two years as a full-time business school student. Do I need to include this on the employment section? Furthermore, for the bits that I was on vacation, do I need to state explicitly that I was unemployed?

 

e.      I also have gaps in a permanent address since I was traveling overseas for a while. Hence, I did not have an actual address in the US for a few months in some of the years in the last 5 years. Is this typically problematic? Will a statement explaining the gap be helpful?

 

f.        I have lived in a bunch of places in the last 5 years. Hence, I am unable to fit all the addresses that I have lived at in the last 5 years on the G-235A form. Do I need to add another signed and dated page listing the additional address(es)?

 

g.       I am asked to submit a ?front and back? copy of my birth certificate. I do not have anything on the back of my birth certificate to photo-copy. Could this present an issue?

 

h.      For proof of an ongoing relationship, would printouts of e-mails work?

 

i. In the event that my fiancee wants to visit the US on a tourist visa while the K1 visa is being processed, is that an option?

 

I realize I have quite a barrage of questions but any input on the above would be supremely helpful. Thank you in advance.

  • Just use your current address. You can change your address later on.
  • Yes.
  • Send them copies of biographical passport along with passport stamp pages. If you met in another country, send those from both of you as a proof you have met in person at same place and date within 2 years. Reservation or itinerary is not strong proof since people can buy ticket without use it. Copy of boarding passes are sufficient.
  • No, you don't have to explain that.
  • Yes, you can add additional sheet attached to your G-325A.
  • No, my husband doesn't have back of his birth certificate and we did not encounter any issue for I-129F. We were approved in 38 days without RFE.
  • Yes, print any emails but you don't have to get all hundred of pages. My husband and I only sent 20 emails spanned from 2008-2013.
  • Yes, your fiance(e) can visit you while the I-129F in the process.

Hi all, 

 

I am new to this site but so far have found it an invaluable resource (the K1 visa timelines and example forms are great). I got engaged about a month ago to an American man and I was just wondering what people's thoughts were on getting a lawyer? I would really appreciate advice from those who didn't go though the lawyer route to see how they found it. 

 

Ours should be a straight forward case, no criminal records or anything. I have had a couple of J1 visas in the past but I don't think that would affect anything. 

 

Was this site enough to do your K1 visa journey without a lawyer? 

 

I'm a little worried that things might get confusing when it comes to preparing the affidavit of support and AOS.. 

 

Advice is welcome!!!

If you don't have any problem subject breaking the US immigration prior filing I-129F, you should not be worried too much. My husband and I did not use lawyer or agency, we were approved for I-129F in 38 days without RFE. Sometimes lawyers - as many VJ members had experience- could slow down your process. Follow the guide on VJ, feel free to post any questions that you hesitate about the process, and you are good to go! There are many valuable information you can dig here through members who already have been through the process. Good luck!

The embassy should have a copy of the NOA2 (but I wouldn't take any chances and keep looking). You will also need the NOA2 for the AOS once the K-1 visa has been approved.

 

It coast a little over $400 to have the NOA2 replaced.

Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

 

 

 










 

No need to send the entire copy of I-129F. The beneficiary just follow the instruction from the US embassy since each consulate/embassy has their own requirement. The US embassy already received the copy of I-129F package from NVC - based on my experience, they attached my petition on my packet 3-.

Okay so my interview is coming up and I'm putting my paperwork in order this afternoon. It doesn't ask for me to bring the NOA papers but I've read that it's a good idea to bring them as evidence...the problem is that, in the process of starting to pack my belongings, I think I've lost them. Is it going to be a big issue if I can't find them? I have an email from the USCIS stating that we'd been moved to post-decision activity and that our petition was accepted - can I use that in place of the NOA papers? I'm panicking and tearing my room apart to find them.

 

No, you don't need NOA-2 for your interview. Your I-129F package sent to the US embassy as evidence your petition has been approved. But you need it though for adjustment of status. If you can't find it, here the link will be helpful.

Are actual photos required or can you send a color print from a computer printed on regular paper for the I-129 petition?

My fiancée and I are getting ready to just start the process. Our attorney said that we will need photos of us together and affidavits from friends as proof that it is not a sham marriage. Would it make sense to also setup a wedding website too?

 

We looked at http://weddingbeacon.com. They have Facebook and Twitter comments. I am thinking the comments can be used to verify that the wedding is real and that our friends and family are involved. What do you think?
