Wo she came to the US claiming to be visiting but with intent to immigrate.

An attorney told you, wrongly, that she needed an I-94 although she is from Canada and they don't give those.

Then she left the US and tried to return with the intent to immigrate again, and was caught.

She currently has a three year ban from entering the US. You need to file the K-1 and be totally honest on all the forms. One lie and she could get a life-time ban. After her visa is denied you can file  the I-601 waiver for her overstay.

While all you stand to lose is any immigration benefits you might gain if you obtain a visa he could, note I say could, be looking at criminal charges. He lied on official government papers and it looks like he might be bringing women here for immigration purposes.

Withdraw the petition ASAS. Have him file for divorce. If he doesn't know where the woman is he can have an attorney help him file by making an announcement in the newspaper and such. Since she was a friend of his step-fathers he probably knows how to reach her. There could be a problem is she is difficult granting the divorce as she would rock the boat and announce he married her for immigration purposes which might cause a lot of problems for him.

Allowing for cultural differences, remember he is allowed to have up to four wives in his country so being engaged and married at the same time, MIGHT, not be a thing he gave a second thought.

What bothers me is the: I just got my citizenship and now I want to divorce my wife and apply for my girlfriend to come to the US.

It does sound like premeditated fraud. Only he knows what his true intentions were.

Advice, wait a while before filing for your new woman because if we all think you are trying to scam the system you can bet USCIS will think the same thing.

You would count in your household yourself, your fiance, and anyone you support...ie.. anyone you claim on your taxes. If someone else claims you on their taxes this complicates things a little. So when you file taxes next month how many people will you claim?

If you are already married when you arrive with your K-1 visa you will not be permitted to enter as you are not a "fiance" but a "wife". You must have your marriage inside the US. Any marriage in any other country that is recognized as such by the government, which it sounds like yours would be, will void the fiance visa.

For various reasons Morocco is a difficult consulate to obtain approval for most people. A few bad apples make it hard for everyone. If you  feel you have enough evidence then proceed with the petition when both of you are legally free to marry. Expect him to be questioned about the non-child issue. Expect him to be questioned about only meeting one time for a short period. Don't be surprised if you are denied.

I am very curious what her response will be when she finds out she will have to return to the Philippines for the process and it might mean staying there for 8 or so months prior to the interview. It seems the OPs main concern is having her gone as short a time as possible (which I can understand from a love standpoint) but I wonder if she is the one expressing this. If she is presented with the fact that there is a good chance her visa will be denied what will her response be then, will she wish to remain in the US illegally or will she go home and take the time to establish proof of a real relationship? Perhaps the OP should present the intending immigrant with the facts...length of time to obtain the visa and good chance of it being denied....and see what her reaction is.

     Withdraw the prior visa. She could probably do it by writing a notarized letter explaining she arrived on a K-1 visa and decided to not marry the petitioner.

     Have her return to the Philippines prior to the 180 days so she has no ban. I would not cut this too close by waiting until day 179 as things happen.

     You can file a 129F petition for her anytime you wish.

     Law is only part of the immigration process. You can meet all the requirements of the law and still not obtain a visa. This is not a black and   white situation.

     Very unlikely you can obtain a hardship waiver as you lived just fine before you met her. What extreme need to you have that she must be with you in the US right now that did not exist prior to you meeting her?

     As to hypothetical: This is not hypothetical. She will be questioned very intensely about her prior relationship and why she chose not to marry the petitioner. She will then be questioned as to how she fell in love with someone weeks later. The Philippines is a high-fraud country.

For the K-1 you DO NOT submit an affidavit of support online nor do you pay the AOS fee. You send the beneficiary (intending immigrant) the I-134 with ALL supporting paperwork, tax returns, W-2s, form filled out completely with an original signature, employment letter, pay stubs. These will be submitted and reviewed during the interview.

When he is told to come in for the second interview, which may not really be an interview, if any documents are expired or about to expire he will be notified (hopefully) to bring new ones. Don't try to do a new medical until he is told his visa is ready. My now hubby was in AP for over a year and had to do a new medical and I sent a new I-134 with updated information even though they didn't request it as a just in case.

You need to start with reading the guides.

1. You will need US based income that meets or exceeds the requirements for your family size (2 if just you and the fiance). If you do not meet the requirements you will need to find a USC or LPR who has a US based income or US based assets to sponsor her (along with you).

2. I know with the CR-1 you have to prove a domicile in the US, not so sure if this is true with the K-1 but they probably want some proof of where you are going to live.

3. Once she enters with the K-1 you have 90 days to marry. After you marry you apply for the green card and can also apply for work authorization and advance parole. Advance parole is what permits her to leave the US and return prior to having the green card. If she leaves the US without AP she won't be returning and her AOS will be considered abandoned. It takes about 90 days to receive the AP.

4. As a resident she is expected to spend more time inside the US than outside. If a pattern is seen of her living somewhere else and just coming to the US for visits she could lose her green card.

If your family wants a court wedding have them pay all the K-1 fees and all the CR-1 fees plus your living expenses for the next year.

You cannot enter the US with a K-1 visa if you are married. End of story. You might not get caught then but you still have to adjust status, remove conditions, and apply for citizenship (if desired). Each step will involve scrutiny of your records.

At any time if it is discovered you misrepresented your status (fiance when you were married) you are subject to loss of LPR and sometimes citizenship status and immediate deportation with a life-time ban.

Your cousin might want to brush up on immigration current events. A K-3 is almost never given, usually it is closed at NVC and the CR-1 is processed. If you decide to marry you are looking at 12 months wait after you file the paperwork and possibly AP all over again. Getting married won't solve anything and will add at least 12 months to the process.

You need to meet 125% of the poverty levels.

Age difference will depend on whether you are the male or the female. Usually if the female is much older than the male, especially if she is beyond child-bearing years, it will make a difference.

Expect the process to take about 8 months from filing to the interview. With the person being Tunisian there will probably be Administrative Processing prior to the visa issuance so it will take longer, if approved.

Clogging the system with useless paperwork not only kills trees it slows down the process for everyone. Why shouldn't everyone request an expedite? Because it means more workers are pulled from processing the normal cases and put to work reviewing the request for expedites.

If you don't mind waiting two or three years for your case to be processed then continue to recommend people who don't qualify file for expedites. But don't complain when it takes years instead of months to obtain a visa for your family member

 

OP, pregnancy is not grounds for an expedite. If you can prove she was affected by the typhoon then I think they are still expediting cases for that. The problem is so many people from the Philippines have used this route that it is taking months to get an appointment.

If you are showing in the system you application was received. His failure to receive the NOA-1 (receipt) has no affect on your processing. Just sit back and wait....this is a long process with lots of waiting. Seems K-1s are moving fairly fast but it has only been two months since he filed. Give it another two or three months before you begin to worry.

DO NOT file another application. This will just confuse the system.
