Looking at this through the eyes of immigration:

1. Major age difference in a country where it is culturally not accepted.
2. Short relationship time.
3 Low income on the part of the petitioner (could give the idea there is money being exchanged for a green card).


I am not judging anyone, I am just trying to show how the interviewer will view it. There are people on this board who petitioned for fiance/spouses from Morocco and had very legitimate relationships and were denied visas. It is a high fraud country.

I you don't have them, you don't have them and explain this when you send in the packet or have the interview. But honey, expect a wait on the visa. Being from Iraq is not so good, I understand he was probably (I am kind of guessing here) displaced by the war and I understand this, that country is torn up right now. But why, oh why did he have to go to Syria (a big T country).

Anyways, again not to scare you, you should expect AP (for background checks) and some of the things they MAY check is banking records to see if he has provided support to terrorist or terrorist affiliated groups and also certain jobs/training require additional background checks.

There are several persons on this board with spouses from Iraq, some of who were displaced, and you may want to check in the MENA regional board for support and more specific information.

Let me add that I filed for the petition before they started doing checks on the USC. Due to my less than perfect background I am glad for this since I don't think it would have been approved otherwise (I have a felony and a lot of misdemeanor convictions). As to his AP he has a very common name, is from Iran, and had the misfortune to travel in Europe in 2001. I waited until he had been in AP for a year before I contacted my congressman and they were very helpful (senator was not). Just hang in there and try to keep updated on what is going on but it is not referred to as the "black hole" for nothing.

I have kept up with your case and know you are very frustrated but at this point all an attorney can do is request updates on your case. If it is in background checks (either for yourself or your SO) there is nothing an attorney can do to speed up the process. Attorney's can really only help if there is something tricky (red flags) about your case which I have not really seen. You made it through the RFE quite well, I think a lot of people are impressed with this, and now you are just stuck.

You would probably be better off contacting your congressman and requesting they make an inquiry. I know it is very hard waiting while your case is in the black hole but there is not much anyone can do. We were in AP for 17 months and I thought I would lose my mind.

I am guessing she is filing for them as unmarried children over 21 of an LPR. If so this would place here children in the 2B category for a visa. For the Philippines the current wait for a visa in the 2B category is about 12 years.

My guess, and someone with more knowledge of this please help me out, is that the petition has been approved and will be sent to storage until a visa number becomes available and then you will be notified and the process for the visa will continue.

First the K-1 is for your fiance to come to the US, marry here, and live here. She would need to remain in the US for several months to file for AOS, do biometrics, her interview, and received AP. If she just comes, marries, and leaves, then another visa (CR-1) would be required for her to enter the US again. So, if you want to process a K-1, pay all the fees, and wait all the time just so you can marry in the US then leave that is a choice but a rather long and expensive one.

Then for her to enter Australia, since she is still on an Iranian passport, she will have the same visa requirements as if she were not married to you.

To work in Australia one requires the proper visa for you and/or her. Just as, for example, a German, cannot come to the US as a tourist and work, neither can you or her do this in Australia.

That made me giggle. I love America, I really do... but they are a bit... self centered. I've been asked if we celebrate Christmas in Canada, why thanksgiving is on a different day and, although it's never been honestly asked, I KNOW that some of them are dying to ask me if we live in Igloos.

I have not had any negative, racist comments so far, maybe because I am white, so it's harder for them to figure out that I'm not from there, but the accent (French Canadian) definatly makes me stand out. I don't care, I love it. It's not so big an accent that they can't understand me, most of them tell me it's lovely, or sexy, depending on who is doing the compliment.

As for frowning down on everything. I would add a correction. My husband's family is very loving and takes care of its own. They are old fashion, but I know that they wouldn't "cast us out" simply because they don't agree with something we're doing (luckily, I get along with them and it's never come to that). However, I would say that America, as a whole, is very judgmental... and pushy. For a country built on freedom and the right to happiness, they are very interested in telling you what they think your happiness should be and how you should acquire it . The key is to ignore it. Do your own thing. Live your own life. Because at the end of the day, you have to be able to live with what you do and say.

ohhh no... my case was stuck at NVC for 41 days.... sounds like the NVC has such a backlog that they dont have room to store them all.... It maybe because the service centers have ramped up production.. my approval took about 140 days vs. the 60 days it seems to be taking now...Im sorry to hear that for you guys....

well first...take a deep breath... realize this is a long process... nothing happens overnight... and even when it seems to be speeding up it probably isnt... and when you have questions just ask they are alot of very knowledgable people here that can and will answer your questions... sometimes it might take a day or three... and sometimes you might even have to go and "BUMP" your thread to get a little attention....

But to answer you 1st question... for the K1 visa there is only 1 interview... for the benificiary... BUT.. depending on the consulate the petitioner might be well advised to attend that interview... so you will have to research your embassy to see if this is the case for you!

My fiancee' has just arrived in the states and we did get our visa with out an attorney and mostly made it thru the process with Info learned from this site!

The best advice I can give is to go to the guides and READ.. then when you find details that are still unclear or unresolved by the guides then post specific questions... And keep in mind that there are things in the process that are consulate specific... i.e. procedures in Manila may be different that in japan or vietnam.. so also read up on your consulate!...

It is a confusing process, but I agree with the posts above.

1. I don't think anyone on VJ is an attorney so we can't give you "legal" advice, however there are so many well-versed members here that have common sense and applied knowledge. Remember no-one is going to be as vested in your visa process as you and your significant other.

2. Attorneys are expensive and slow the process from everything I've heard...if you really want this you'll learn to take the time to sit down and focus, re-read all instructions, read your completed forms four times for mistakes and then have someone else read them as well and always make three or four copies of everything....just in case.

hahaha! I so believe it! We'll be applying for the K1 when it's time. We've been friends online for nearly three years and a couple for more than a year now but we still have to have our first face-to-face visit so we're not making any assumptions til that happens. We have a strong suspicion that this is "it" though so we're examining the steps we'll need to take. In the meantime, we're doing exactly what you suggested: enjoying the journey! :)



Congratulations on finding the love of your life and I hope your face-to-face time is amazing and wonderful.

One thing that I found when I first started our journey for the Visa, was a post from Darnell that said (and I'm paraphrasing here) to use your waiting time or down time to explore the next step, research, print forms prior to the NVC (National Visa Center) requesting them from you and have the next packet of information ready for to send out as soon as you get the next notice.

This was soooo helpful to my husband and I and really helped us move fairly quickly through the process. The only RFE (returned form for more information or missing documents) was on our Affadavit of Support because my dependents on the form didn't match the dependents on my prior year tax returns. Although I included my divorce decree (which I assumed would explain the changes), the processing agent didn't take the time to read through the entire file and sent a request for a letter of explanation why they didn't match up. Frustrating...but things like this can happen even if you're 100% prepared.

It sounds like you're already a person who researches and preps ahead of time, so you should have very few issues. Sounds like you're looking at a 129F for fiance to start things off...unless you decide to elope during your first visit LOL. :thumbs:

Get your letters of employment verification and all your original documents together and send them to your fiance. Original paystubs, original birth certificates, original divorce decrees (if necessary) original EVERYTHING. If you found additional evidence, send it....always err on the side of caution.

You'll get everything back after the interview.

Make sure you make at least two copies of EVERYTHING for your records as a back-up here in the US so you have something to compare if your fiance has questions. You might as well send your proof of relationship (phone bills etc.) now, it's a small fortune to ship overseas and yes you will definitely want to use FedEx or DHL so you can insure and track the package.

Hello everyone! I just received my NOA2 and I am happy as a clam! I just have some questions regarding which documents I can send. Can anyone help me? The following was taken from the NOA2 checklist:

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). I have a copy of this but do I also need to take another passport photo?

2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. Are these just the original photos, boarding passes, letters and emails I sent with the I-129F? I have recently found other evidence that I should have included when I first sent the I-129F. Should I include this as well?

3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). Is this exactly what I originally sent with the I-129F except with a current date? Do I also add something along the lines of "I also intend to support my finance financially..."? Does my fiance create another letter as well?

4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and useful information on the Affidavit of Support Form. Alright, so what I will do is complete the form and I will provide a letter from my employers stating my job status with the company and salary. I will also include the past 3 months worth of pay check stubs and the past 3 years of W-2 forms. I just need COPIES of these, right? No originals? Is this enough evidence?

6. A copy of the NOA2 that you received in the mail. Self explanatory.

7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now). Alright, so I do not have to worry about sending this proof until his interview date right?

A few more questions:

When should I send all of these documents to my fiance? When will they all be needed? Should I send using DHL? Do I wait for packet 3?
Should I contact my congresswoman/man and/or senator? If so, when and what should I say to them?

It's not fraud unless it's not a picture of your fiance. My husband scanned his and e-mailed them to me from Pakistan and I printed his out on my computer. They were accepted and we had no problems.

HOWEVER, please check the requirements for document translation and certification of the translated document. I know that some consulates require they be certified.

Hello fellow vj'ers! It was nice of all the people who responded to my hello. My fiance and I were both (at our own homes) looking at VisaJourney today and it really made us happy seeing all of the people who have had such good luck in this process. I will be sending off my I-129f form here very soon. I'm thinking I may send it off by Friday. My question is this.....can someone help me in some of the specifics of the I-129f form? I have an example sitting right in front of me. I got it from this site and another one from ***removed***. This is where my problem is coming though. I have read almost this entire site and the other one I just mentioned! I've been on the USCIS site and have been watching YouTube videos as well. And now after all of that I've gotten so much information in my head that it seems to be overloaded. I'm only asking for help because I'm really ready to do this. Neither me nor my fiance have any experience in something like this so if anybody could help it would be greatly appreciated. However most of the questions I have I have a good guess what the answer is. I just wanted to see if someone could tell me, "this is how I did it"! I promise to help other noobs with any information you can give me and be a steady member of the VJ community. Thanks everybody!


Part A:
On question ten when it says, "My citizenship was acquired through" it has two choices under it, a box asking for a certificate number, a box beside the word parents two questions asking if you have a certificate of citizenship in your name and if yes when and where it was issued.

Where on the birth certificate is your number of certificate? Is it the number on the top right of the document? Should it be a 10 digit number? A seven digit number? And what do I do if all I have is a copy? Also having to do with something else it asks for a copy of the front and back. Mine doesn't have anything on the back besides security document watermarks.

What is the box that just says parents for? Is it asking if you got your citizenship through your parents? I'm guessing that is what it is and that I would leave it blank if "Birth in the U.S." was my answer.

What is a certificate of citizenship? Is it something you would get if you were a citizen but not born in the U.S.?

Part B:
On question 3a it asks for the place of birth for my fiance. It asks for the town of city and then in another, smaller box it asks for State/Country. Do I put in the state or country or both? If I'm supposed to put both which I believe I'm supposed to do what do I do if I can't fit it in the box? It is Tehran/Iran. But the only way it will fit in the box is if I put TehranIran. Will this be acceptable?

On question 9 should I leave it blank of put the word "none" in the box?

For question twelve how do you fill out the boxes for arrival/departure date and date of arrival and date authorized to say expired? If I put in the box above all of that that she is not currently in the U.S. do I just leave it blank? I was thinking that was a "no-no".

On question 15 when they ask for the phone number that she has in Canada do I put it like this? 011 1 555 555 5555? Will they ever call that number? The reason I ask is because my fiances family since finding out what we are wanting to do has been extremely hard on her. They won't let her work so she can't have money to get her own place. They tell her to leave me or they will kick her out in the streets. They call her names and recently her father said that he would actually take her life! We have decided to keep this all under the rug until things start to blow over a bit. If that's even possible. I try to be there for her as much as I can but I don't make a whole lot of money and flying to Toronto takes a big chunk out of my check everytime. It'd be so much easier if I could just go visit all the time....Ugh, the call worries me.

BIG QUESTION!!!!! On question 16 it asks if my fiances native alphabet uses other than Roman letters, write her name and address in the native alphabet. She lives in Canada. She speaks and write English. But she is formerly from Iran and can also speak Farsi. Does she need to sign this in Farsi? Does she write in her current address in Farsi too? If not do we just keep it blank? Geez, I don't expect a lot of repliers to this I know I'm making it too long! I'm sorry.

If you can help me I'd be so greatly appreciative. I promise I will pass this knowledge onto anybody else I ever in my life hear ask. Whoever takes the time to respond to this let me know if you could answer just a couple of the same type of questions for the g-325a. Like I said before I have read so many different websites now and heard so many different supposed truths that I've gotten everything jumbled in my head. I know not to take anything as the exact truth without looking it up but I don't even know where to go now that I've read the whole site and am still a little confused. ok to be a little clearer (because let me tell you i'm just wrapping my head around it for the first time myself) her passport was issued from Iran. So if she is only a permanent resident of Canada what can she do? Will she have to go back to Iran? It is not safe for her to go back to Iran.

K-1 Fiance(e) Visa Process & Procedures!!!!!***ONE QUICK QUESTION***!!!!!
I am currently finishing up all the necessary paperwork to be sent in with my I-129F. I have came across somewhat of a snag however. On her passport her middle and last name have been put together without a space in between. We were told that for every issue that arises like that we should attach a seperate page explaining that we put her name on the G-325a correctly but on the passport it shows the same name just with no space in between her middle and last. If I am to attach an additional page for each thing like that what exactly should i include on that seperate page besides a signature and a date? If you need any further information on this please let me know. This is really the only thing that is holding us up. Any help would be so extremely appreciated that if I had a million dollars I'd give it to you! : ) Hope to hear from you!

My fiancee has moved from Iran to England back to Iran and now to Canada. When she got her passport in Iran they asked her if their was a "space" between the two names in her surname and she said no. Basically if her name was Joan ParkerWilson they instead asked if it should be Parker [space] Wilson. She said there was not supposed to be a space but they put it anyway. So she left Iran and moved to England with her family and had no problems. She moved back to Iran and then to Canada with no problems. She has gotten a permanent residency card, an insurance card, everything she's needed. I just don't know how she should put the name on the G-325a and if she actually should attach another sheet explaining what the differences are. I know this is like a previous question but they are a little different so I posted them seperate. Thanks everybody

i was told that i needed to make a copy of the front and back of my birth certificate. i did so but the back is blank. is that normal? if not should i send in the passport copy instead? what pages do i copy in my passport? is it just the page with my information and picture on it?
