I don't think any one is saying not to get a birth certificate and/or translation of same. You will need it later. We are just saying you won't need it for the initial filing, and why provide extra information? This is the government you are dealing with, after all :lol: If questions come up about place of birth, they will ask for more evidence (unlikely at the initial stages).

The general rule is to include only what you need. As stated above, you will need the certificate later though.

Edited to say except for proof of relationship. Members include a huge amount of data (phone/skype logs, pictures, you name it), mostly without need.

I waited until we were in AP for almost one year prior to contacting my congressman. I don't want to clog the wheels of progress with requests for assistance unless they are needed.

These persons who's response to every problem or delay is "call your congressman" are creating problems. A congressional inquiry must be answered within a certain amount of time and takes time away from the actual processing of visas/petitions.

I would advise that unless there is a serious problem to just be patient and wait.

Almost happened to my hubby. He is from a "t" country, brought more than 10,000 euros with him, and I guess just looked suspicious. They opened the magic brown envelope and looked at all the evidence again, actually read some of the chat logs I had sent as evidence of our relationship, pulled up my criminal history on the computer and per my hubby (then fiance) were laughing about it. They were pretty much a**holes and kept threatening to send him back.
After about five hours they let him through but of course his flight had left so he spent his first night in the good ole USA sleeping in O'Hara airport. I really thought about filing a complaint because it was like the border police were re-adjudicating his case.

Easiest way to handle this. Put a trace on the money order. If it has not yet been cashed place a stop payment on it. It will cost you a fee, for Western Union I think it is about $17. If it has been cashed you will receive a copy of it from the trace request and your case number should be on the back or you will receive a NOA-1 with your case number.
When you have the case number have the petitioner send a notarized statement asking to cancel the case, perhaps mention why, but be brief and sent it delivery confirmation.
Once you receive confirmation the case has been canceled then he is free to file for a K-1, or if you want to marry while this is being resolved, a CR-1. In any case you are looking at 6-8 months in general to receive the visa. No attorney can speed up this process and and neither will you being pregnant. Several persons from countries with lesser health care facilities has requested it and have been denied.
When the baby is born file for a CRBA, not sure what will need to be done for this possibly a DNA test. The baby does not require a visa to enter the US.

The most important question is does he feel two visits is enough? My now husband and I had an eight month relationship via the internet and met once for about one week. He received his visa without any questions regarding it being a legitimate relationship. Most important is the evidence he can document of an ongoing relationship whether it is via internet, letters, or in person and her sincerity and knowledge of him during the interview.

Perhaps you can gain some more specific answers from persons who have dealt with the Mexican embassy on how much proof is required.

Please read the guides first. The fiance visa will take about 6-8 months if there are no problems. After the petition is approved she will have to undergo a medical exam and interview in her country prior to receiving the visa. You will have to show with or without a co-sponsor that you meet the minimum poverty requirements for the visa to be approved. After she arrives you will have to file for AOS for her to obtain her green card and employment authorization.

I think you should spend a little more time studying the guides and understanding the entire process including all the costs involved.

You would need to cancel the K-1.

The big, big, big issue you have is the misrepresentation. You really need to find out what this was as it can result in a LIFE-TIME ban with no waiver available. Since you say with the first K-1 she was given no opportunity to file a waiver I am pretty sure this is what it was. Did she at any time represent herself as a US citizen say for school or work? If so no waiver is available for her and she will not be permitted to obtain ANY visa to the US.

As to the I-130 you must be married prior to filing for the CR-1 visa but again, I would find out exactly why the K-1 was denied or you may just be flushing your money down the toilet.

I assume you divorced your first wife prior to filing the I-129F and that you don't have any other current wives. If so that leave two complicated issues.

1. Being married to two persons at the same time is illegal in the US. It doesn't matter what the reasons are, it is illegal and you committed bigamy. What affect this will have on the immigration process I don't know, it could vary from none to a denial due to a crime of moral turpitude committed by you or a question of the legitimacy of your relationship since you seriously cheated on her during your first marriage and add to this you divorced her so you could remarry her in the US (big question as to why). So this is a big unknown.

2. If you obtained your LPR status and subsequent citizenship by being petitioned as the UNMARRIED son when you were in fact married, you could possibly lose your citizenship and be deported as you committed immigration fraud to obtain your immigrant visa.

Walk very carefully here as you have committed a lot of wrongs that could result in big problems.

Your petition has been approved she still has to have the medical exam and the visa interview. Once she has her K-1 visa she will have (usually) six months to enter the US and then after entry 90 days to get married. As soon as you have the marriage certificate (which in some states it is possible to obtain the same day as the marriage) you can file for AOS. You may file for EAD and AP at the same time as the AOS at no additional cost.

Remember the K-1 visa is a one entry only visa and once she uses it if she leaves the country for any reason prior to obtaining her AP she cannot re-enter as an immigrant (very rare exceptions apply).

At this late date I would say stick with your attorney until the end and if it is denied due to a question of meeting in the past two years requirement being fulfilled then I would consider asking for a refund from the attorney.

Probably the bigger issue, although the embassy may be using the two year requirement as a solid grounds for denial, might be why you have not visited in more than two years. Although technically one meeting of one minute within the last 730.5 days meets the requirements to file it certainly would not show an ongoing relationship. So I think there is a little more to this than just meeting the two year requirement on a technicality.

Yes it is normal for AP cases to be done in Washington as it involves checking one or more databases and possibly pulling the actual files. The CO always has final say in issuance of the visa but they wouldn't be spending the money on AP if they intended to deny you. Now keep in mind that is negative information is obtained then the situation changes.

The people at DOS are next to useless. Refer to the thread I mentioned and you will get lots of help there.

No matter what visa you apply for there will be a wait and there will be a requirement for evidence the immigrant will not become a public charge. If you can use the duplex since it is in the US as assets I am not sure but it would be worth checking out.
There is no legal instant way to have your fiance, spouse, mother, father, etc. obtain an immigrant visa.

If the embassy suspects the relationship is not a true one, not uncommon in Morocco, you will need to provide strong evidence of a real relationship. I would start accumulating as much as you can, for example chat logs if you use an instant messenger, phone records, photos. It would be strongly advised that you meet again in person and take lots of pictures.

I am referring you to the MENA (middle east, north africa) forum in the regional section as there are a number of people who have had problems with immigrant visas in Morocco and they can give you more specific advise. Good Luck.

You can re-file as many times as you want (actually you have to have a waiver after so many but I couldn't advise you about that) and the US govt. will be happy to take your money as many times as you want to send it.

IF you want to file and be successful you need to overcome the reason for the denial on the first case. Just sending them the same information all over again won't get you a different result. I don't know when last you met in person but for a new petition it must have been within two years of the filing of the new petition even if it is for the same person.

I strongly suggest you provide a little more detail on the reason for the case being returned and maybe we can give you some specific information that will assist.

Once you enter the US on the K-1 you cannot leave without AP (as you know). Traveling within the US is perfectly acceptable just make sure none of the trips has a stop somewhere not considered a US state or territory.

AP takes about 3 months after you file for AOS. So it is sort of dependent on when you want to marry and how long it will take to obtain the marriage certificate as to how long it will take to receive AP.

You can use Western Union or any other money place to transfer the funds to the US or you can bring it with you. Anything over $10,000 has to have a customs form or something like that filled out for it whether it is physically brought with you or transferred. Not a big deal, it was designed to prevent money laundering, drug money, and now terrorist money from being sent undetected.

It has been a few years since we went through the process so things may have changed but this is how it was for us.
They never mailed him anything in Iran, he got his interview letter by email. I had him download the forms (from the Ankara website or the USCIS website) and fill them. Then he mailed them to me. I checked them, copied them, etc then I had to UPS them to Ankara (cost about $45). At the time there was one civil surgeon (found on the Anakara website) that you could make appointments over the internet. He went about 2 days early, had the medical, and then the interview. He said he waited like forever for the interview and it lasted all of 5 minutes. There is a hotel there that a lot of Iranians stay at but sorry I don't remember the name. The passport will be returned by delivery service to the hotel you are at, they will not return it to Iran.

Make sure she is aware of the possible consequences of her actions, missed wedding vs lifetime ban to the US, and wish her luck.

1. Without the RFE we can not really advise you as to what to do.
2. Never, ever send additional documents at a later time unless you have an RFE. Thousands and thousands of applications are received yearly and are handled by hundreds of clerks/adjudicators. Can you imagine someone being paid to sort the mail receiving a random package and being expected to search boxes and boxes of files and/or hundreds of offices to try and match this random package with the initial application? It ain't gonna happen.
3. Trying to re-open/appeal the original denial would take more time/cost more money than just refiling the entire package.
4. They will not keep "active" the package of documentation you have already provided. Most likely it will go in a warehouse somewhere or be scanned and destroyed. (Think of the Bush era e-mails)
5. All an attorney can do, if your case is not complicated, is fill in the forms for you, double check everything, and mail it for you. Having an attorney WILL NOT speed up the process and will usually slow it down. Also contacting your congressman will do nothing to speed up the process.
6. It will take about 10-12 months from filing to completion of the process if there are no problems. The wait time just for the petition to be approved is currently around five months, then the beneficiary must submit documents, medical exam, and interview for the visa. This is not a quick process.

So what to do? First wait until you have the RFE and determine why the original application was denied. If it was for lack of documentation/incomplete application this will be simple to address by filing ALL the required forms, signing them in blue ink is recommended, and filing ALL the forms along with your documentation in one envelope. Please see the guides above and follow them closely. Many of us filed for K-1's without attorneys very successfully.

What should be asked is what have you done to overcome the original return of the petition? Without addressing this issue why do you thing the case will be treated any differently the second time it is filed? Morocco is a very difficult consulate to obtain a visa from and you should address the original problem prior to filing another petition.

A K-1 beneficiary can only adjust status in one of two ways; either by marriage to the original petitioner or by having been abused (and able to prove it) and adjusting under the VAWA rules.
