There was another set of posts on this recently. I looked but couldn't find the thread. I believe the final result was that Pshbrk weighed in saying that you can track some shipments, but there is no truly reliable way to know when your file will arrive. Apparently the date NVC says they shipped has no relation to the date DHL has necessarily.

Thank you for your response, the question now is whether they will email or mail the bills. We're praying we will get the invoices by email, It's much faster!
Edited to answer:I only emailed the information on my choice of agent (To Sue) as I saw on one of the guides on Visajourney. I did it yesterday and got a response today.


Happy to hear you got a response, and I am sorry I don't understand the process you are going through better. It seems to me that theoretically you could appoint anybody your agent (although your SO makes more sense). Good thing Darnell was around with some knowledge. :star:

I am not very familiar with the expedite process, but from your timeline, it looks like they are expecting the AOS forms and fees - through the agent you appointed. It looks like the IV bill should be on the way to your agent.

Take a look at the flow chart here NVC flow chart You should be on the right side of the chart, based on your post.

Because you are acting through an agent, you may not receive the bill or notice of same. Check with the agent, or call NVC about the IV bill if you are at that point. I am not sure who will have information for you, but I might start there. Members that have gone this route, please correct me if necessary.

Edited to ask, did you email the 3032, or just information on your choice of agent? If you did not send the form, that could be the hold up.

When the I-485 was denied the EAD and AP became invalid. These documents are based on the I-485 so when that is denied everything else is cancelled.

You will need to resubmit the entire packages for the I-130 and I-485 and if his medical is more than one year old he will need a new one. You will have to apply for EAD and AP as the old ones are no longer valid. Since the I-485 was denied he has been in overstay status since his I-94 or VWP expired. If he has been in the US for more than 180 days since he was supposed to leave he will have a ban and I would suggest not trying to use the AP.

He is going to need proof he makes that much Since he hasn't even started the job yet you will need to wait until he has at least several months of pay stubs to prove his income. He will also need a letter from his employer stating how much he makes, how long he has worked there, and that it is a permanent job. Even then it may not fly since he just started the job. Do you have anyone else you can ask?

In reality Indyial32 most states in the US have an "employment at will" statue which means either the employer or employee can fire/quit at any time for any reason. She just started this job so she is not covered by the FMLA. Many jobs in the US have a probationary period where if you miss work for any reason you lose the job.

ok, whoa, maybe my old man is old fashioned or maybe he just does not want me to come to iran. I know he said his father won't even allow his married children to kiss in the house because it is rude......maybe all I said is just the way he was raised and not the "law" in his country. After reading of women having acid thrown in their faces for wearing too much makeup, I don't want to chance it.

The answer to the question is how long are you willing to wait and how important is getting married right away to you? Only you can answer these questions.

Remember the new fees for AOS include the bundled package now. It is EAD, AOS, and advance parole all included in the one $1,000 (about) package. So unless you really want to leave the US right after arriving or want to start working as soon as possible, it should not really make a difference.

I understand completely. I would love to visit my fiance in Iran but there would be no point as we could go nowhere together without and escort, although I have thought of using his nieces. The rules are very strict, we could not visit together in a hotel room, could not ride travel together, could not even touch in public.

Sadly, you must decide between the fiance visa and the spouse visa. We chose the K-1 because it was supposed to be quicker ane we can always go to his sister's home in Sweden if it takes too long to reunite again.

If you plan to spend a lot of time in Iran or make a lot of visits while you are waiting, I suggest you go ahead and get married and file the 130/K-3. If you are like us and can't afford to visit in Iran, or have alternative places (Turkey is good) to meet, go with the K-1 because it is faster.

Finding fillable I-forms is difficult at times; however, I get most of mine from this website: Fillable forms

They have every immigration form I've ever needed. Not always perfect but they work fine.

I would be extremely careful when using the forms from here to make sure the forms are the current version. The first one I opened was outdated.

And where I (and many others) answer people's questions, is a forum for those getting married (foreign spouses is just one small part of it) and strictly non-professional and I also stress that when I answer them. I just want to help them out with the simplest questions, and they do call USCIS and local embassy, and their spouses call too, but they get very conflicting information.

Reading the stories here, I sometimes feel immigration attorneys aren't always up-to-date themselves... :rolleyes:

It's because people here have been through the things themeselves and are familiar with the concepts and how things work, that VJ rules :D

Apparently I'm a lil thick-headed, because I didn't find an answer there... The embassy told you could apply for a "non-immigrant" visa to stay with your spouse, but apparently that only meant the Visa Waiver (in our case) or tourist visa, as Reba pointed out? There is no other way to reside with your spouse then?

I read earlier in the guides that if you file for I-156K (sorry, not sure the numbers were right) together with I-130, you'd be able to stay with that, as non-immigrant visa. But is that only AFTER the I-130 interview anyway?

And I apologise for asking things to be simplified, but I'm sort of giving advice to people who are marrying their American sweethearts, and I would like to be clear with the facts they present me with, or questions they ask. I refer them all to this site, but not sure how many actually come here.

First of all, I used Search to look for topics about this issue, but didn't find any that would answer this specific question. So I apologise if I missed the thread with this question :blush:

We decided to take another route (I-129F) for a visa, but would it have been quicker to get married, apply for I-130 and non-immigrant visa, than just I-129F or I-130? (Ugh...not a clear question, sorry)

Take 2:
If you get married, and file I-130 and non-immigrant visa I-156...?, are you able to recide in the USA with your spouse before the final interview at your local embassy? Is it a lot quicker than waiting for the whole I-130 process to go through and for getting a K-3 visa?

(with the desire to be together with your spouse as soon as you can)

Would the same have applied to I-129F?

I hope this made sense, but I can't really explain it any better..lol

I am unsure whether you meant that your husband would stay permanently when he returns tomorrow, so have covered both scenarios:-

Your husband cannot enter the US as a visitor if the intention is to stay permanently (this is visa fraud).

If he is entering the US to visit and intends to return to Canada without overstaying his allowed visiting period, then he is allowed to visit at any point of the process (for either K3 or CR1). However, he should bring strong ties to Canada each time he visits incase he is asked by the border officers to prove his intentions to leave. The border is within it's rights to refuse entry to the US if it believes he is intending to stay permanently. It is your husbands responsibility to supply enough evidence to prove otherwise.

thank you... yes that is what we want to do... just visit for now (and get the papers filed together). We plan on doing a lot of back and forth from US and Canada. He's an interpreter and there is not that much need in the Southern US for that! (french)... He has all the papers that tie him to Canada with him... hopefully that will be enough.

I'll be glad when he is here safely... it's really stressful esp. to him. We are both so surprised on how complicated it can be for 2 adults to be together if they are not from the same country!

He does not have to come back for you to file for CR1 or K3.  File the petitions when you have all the documents and proofs in order to the appropriate service center.  He can try to come back and forth while the petitions are pending as he has in the past....  just be honest in answering questions at the border.  Have proofs of ties to Canada as it may be needed.  He may not be allowed to enter, that is always a risk if they think he is not going to leave.


He has already got the ticket to come here and I miss him!! I want him to come here to be with me for a few weeks at least... I want to file this stuff together.

We don't have anything filed yet... what does he say to the border agent? "We are going to start the immigration process and to visit?"

i saw your dates on the tracking list in the africa forum...can't believe they are scheduling interview so far out!!!! We are still waiting for NOA2, and i see others here filing after us already been approved! Its such a crazy system..and the embassys are all different! Did your husband pick up his packets, or wait till they mailed it? Heard u can get a quicker interview date if u pick up the packets, but others have said interview is already set in system when case is transmitted!

I agree that the system is crazy. My husband picked up his packets on December 27th. I have no idea how they set the interview dates, but it is quite a ways out . . . I have not visited the African Forum. . . maybe I should .. . LOL. I hope you get your NOA2 very soon!

We were approved in Nov. but our interview date is not until March 10, 2008. There are others who were approved after us who have their dates earlier. I think it depends on the embassy, etc. Take care and may you get your interview date soon!

I hope by this time, they guys that were in my group have all now made it to their separate embassies and have their interview dates in hand. Good luck everyone! Will give another update when the resume our case and also when we receive our approval.

I'm so glad it was what you thought and not a complete surprise. Now that you have sent the requested information, I pray they approve your petitions soon. We still don't have an interview date. Our petition was sent to the embassy from NVC on Dec 12th. My husband will go to the embassy tomorrow to pick up his packets and hopefully the interview date. He was sent home last Friday, as were all the others who showed up, because they were told they did not come on time. He was there at 6:30 a.m. They told him to be there tomorrow at 7:00 a.m. and he told them he will be there at 6:30 a.m. like he was on Friday. I pray that things go better and he gets what he went for. Hang in there, Deb. It's all going to work out!
