I can't believe you actually tried to slow down the process. You should have done the interview anyway. There was no guarantee of immediate approval and she wouldn't have had to travel right away anyway. I think you have 6 months after visa approval before she had to travel. Anyway, hope you can get it now that you want it.

during the previous administration I emailed VP Cheney about the visa situation and got no repsonse. A couple of weeks ago I sent a message from the White House site, and have receive no reply to it either. My conlusion is that no one cares and no one wants to help us on this issue. And by the way K-1s aren't always approved faster. From what I've seen, that is mostly if the non usc is female. My fiance and I have been waiting for 2 years...........

With all this paperwork I'm starting to lose my mind....I did call the NVC last night and they are checking into why the AOS payment isn't showing as Paid on my inquiries...the operator told me that it is in Paid status in their system however and that I do not have to wait to send in the I-864 if I have the NVC Invoice letter with barcode.

So are we paying double the fees to end up with one VISA? I am so lost! headbonk.gif wacko.gif


You have two visa processes in motion. The I-130 for a CR1 or IR1 visa and the I-129F for the K3 visa. Decide which one you want, determine which case number applies to it and ignore all correspondence on the other.

No, submission of the I-129F does NOT mean he can simply or freely come here and wait for his visa to come through... If he desires to come here to visit (read VISIT not STAY), he would need to do that under a tourist visa or the VWP. As always, his entry could be denied.


There are a few options that you may want to look at. This is information that an immigration attorney sent me. It may be of some assistance. blink.gif GOOD LUCK!! Of course the first one will not work for you since you are already married. CONGRATS on that!

IMMIGRATION OPTIONS FOR THE FIANCE OF A U.S. CITIZEN
There are three options for the fiancé of an U.S. citizen who wants to immigrate to the United States: 1) K-1 visa, 2) immigrant visa, or 3) K-3 visa.

OPTION 1: K-1 VISA.
The first option is the K-1 visa. This is for a couple who are engaged but not yet married. The first step is to file an application for the K-1 visa. It takes approximately 6 months to obtain the approval. After the approval, the fiancé is scheduled for an interview at the U.S. embassy or consulate in the country where the fiancé lives. After receiving the visa, the fiancé enters the United States in K-1 status. The fiancé must either marry the U.S. citizen or depart the United States within 90 days after his/her arrival in the U.S.
After the fiancé and U.S. citizen marry, the fiancé can then apply for adjustment of status. The fiancé will receive an employment authorization card approximately 90 days after applying for adjustment of status and will receive permanent resident status approximately 6 months after applying.
For this option,
K-1 visa application (Form I-129F)
Adjustment of status (Forms I-485, I-765, i-131 and biometrics fee)
There are filing fees for each of the above.


There is also a visa application fee, which must be paid at the embassy or consulate. There is also a medical examination fee, which must be paid directly to the doctor who performs the medical examination.

The second option is to get married (either in the U.S. or in another country) then apply for an immigrant visa for the spouse. It takes approximately 6 months to obtain approval of the immigrant visa petition. OPTION 3: K-3 Visa
The third option is to get married (either in the U.S. or in another country) then apply for a K-3 visa for the spouse. The first step is to file an I-130 Petition. After receiving the I-130 Petition, the next step is to apply for a K-3 visa for the spouse. The processing time for the K-3 visa petition is usually 3 to 4 months but can be as long as 6 months, depending on the workload at the processing centers. After the K-3 visa petition is approved, the spouse is scheduled for an interview at an U.S. embassy or consulate in the country where the foreign spouse lives. After receiving the K-3 visa, the spouse enters the United States in K-3 status. The spouse can apply for employment authorization after entering the United States and will normally receive employment authorization 90 days after applying for it. After the I-130 Petition is approved, the spouse can then apply for adjustment of status.

Hello everyone. Sorry I have not been on here much but I have been busy with other things. Congratulations to those who have already been approved for visas.

My husband had his interview at the lagos embassy today. He said it was awesome. He was told to pick up his visa on Monday, 3/17/08, at 2 p.m. He will be flying home on Marhc 18th!!! We are very excited. We give all the thanks, honor, and glory to our Lord for making this happen. God bless each of you.

I sent all the documents for my husband's interview on Feb 14th and he picked them up at the DHL office on Feb 19th! Glad they made it there on time .. . the interview is March 10th!

I really don't understand what's going on any more, and the embassy use to answer my questions in the same day (email messages) but now that I am asking them why I haven't receive my packet# 3, and if it is possible to get it through email, no answer at all it's been 3 days and they haven't email me back, and to make matter worse, calling the embassy is just useless, phone rings and no one answer, you call over and over, in may different times, but no way, nobody answers

I am starting to lose it now.. don't know what to do sad.gif



Hello Win. I am so sorry you are going through all this '#######'. Is there any way your wife can go to the embassy and pick up the packets? My husband went and picked his up. It took 3 trips, but he finally got them on 12/27/07. Now, we just have to wait until 3/10/08 for the interview, but at least we have a date. Hang in there and don't give up!

Update: My husband picked up pkt 3 & 4 at the embassy in Lagos on December 27th. We have an interview date: March 10, 2008. crying.gif I can't believe it's going to be that long before the interview! My husband and I are EXTREMELY disappointed, but not devastated. It's in God's hands and we are standing firm in our faith!

Merry Christmas to everyone. Congrats to those who have interview dates and also those who have been approved. My husband went to the embassy today at 6:30 a.m. and waited several hours to pick up pkg and interview date, and they were all told to go home because they were not there on time or something like that. unsure.gif He said that there were at least 10 of them there at 6:30 a.m. today. They were told to come back on Thursday of next week. My husband went there already on Tuesday and was told to come today. Thank God the embassy is not far for him, but for some, it is very far. We were just hoping to know the interview date before Christmas, but such is life. We are confident that things are fine though.

YAYYY...congratulations!!! Well, I also called NVC today but nothing. The person at NVC advised me to call USCIS, so I did (through the RFE Line) and luckily a very nice lady answered the call and she told me that our I-129F was tranferred to NVC on Friday, December 7th.....(and that the case is no longer with USCIS)...yaayyy...so hopefully our I-129F will get there this week.


Thanks! I bet yours was in the same batch as mine. I called NVC on Friday of last week and they had not received mine, but the told me today they received it yesterday. The lady had told me that the mail comes in bulk there so it is very possible that they will put in your information either today or tomorrow! I know it's going to happen very soon for you yes.gif

I called at 1:45 p.m. EST on 11/29/07 and the total call took 7 min. I called on 12/3/07 over and over from 12:56 pm EST - 11:51 p.m. EST and there was no operator each time I called. On 12/7/07, I called at 10:11 a.m. EST and the call only took 8 min. I called today (12/11/07) at 4:32 p.m EST and no operator, but called right back at 4:38 p.m. and the call only took 5 min. NVC is open until midnight EST. You are better off calling 11:30PM EST to get through to an operator. You can call early too, 7:30AM. So their hours are pretty good, but hard to reach an operator at peak times (lunch hour, 8-10 AM EST, etc.).

The bit about the truck being loaded before being sent out from CSC to NVC originated from the March filers. They were at the leading edge of the current slow down both at CSC approvals stage and getting to NVC. After seeing Feb filers fly (relative to themselves) through CSC and on to NVC, they were wondering what was taking so long. First with their approvals, then with getting to NVC. Various March filers (LvivLovers, Kalina, neel06 and others) called USCIS and got through to CSC and got various reasons why they were so long to get to NVC. One consistent response they got was the trailer wasn't full and thus there was no shipment to NVC yet. The story went the truck goes to NVC once full, or once a month if not full. So you might have to wait a month for it to go once its on the truck if you get into an empty truck.

Another thing that they heard was the new I130 and I129F pairing (and sending I130 to NRC and I129F to NVC) resulted in a new staging area being set up to handle this activity, and the newness of it all was taking them some time to get used to, up to an additional month before it got on the truck. How true any of these stories are is unknown. They came from the misinformation line after all. As you can see, some of us April/May got to NVC awful quick (could have just been we made it at the tail end of a mostly full truck too whistling.gif ). But then they slowed again.

Lastly, you can certainly go with your spouse to the interview. I would be careful about helping her answer questions, as in if you cut off her answer to interject, it might look strange to the interviewer as if you have something to hide.

About NVC hours… waw I didn’t know that I was thinking they have a business hours only. But that’s very good I will sure call them toward Monday morning to see, and if my case haven’t made it I will follow up everyday when I come from work.



About the interview, I was wonder if at all they will allow me to get with her to the window/room she will be interviewed on.

Just an FYI. I called the NVC on Monday of last week over and over again and I kept getting a message that an operator was not available and after twice of saying that, they disconnected the call every time. I called all the way up til midnight. Hopefully you will be able to get through this Monday. On Friday, I called and the entire call took only 8 minutes. The lady (her name was Rose) told me that they do send everything by bulk mail and that it could be 2 - 4 weeks. She told me to try back in 2 weeks. They should receive the petition in 2 -4 weeks, but they have up to 90 days! I'm thinking 2 more weeks. . . 90 days??? It's already been 3 weeks since we were approved. I'm cool though, but dang . . . blink.gif She was extremely nice so it made it more difficult for me to think about reaching through the phone and well you know . . . LOL Of course you KNOW I would have done nothing more than wring, I mean hug, her neck. Heee heee.

When I read the directions for what was going to happen next, it said we would get a bill (two actually). I suppose I have read the wrong thing! Hello everyone. Congrats to everyone for making it this far! Urge, will you please add me to your chart when you update. My info is in my signature. I called the NVC today and they have not received our stuff yet. I'm confused about what is going to happen next. I thought the NVC was going to send a bill to me and to my spouse, one for AOS and one for visa processing. The lady at NVC told me that all they do is enter our information into the computer and forward everything on to the embassy. She said we would receive a bill from the embassy. Is that correct? She gave me the number for the consulate in Lagos so I can call with general questions, but I thought I would ask here first. I'm just trying to get this all straight! That is indeed good advice, my wife and I just want to be together - as Im sure we all do. Although AOS once in the States in a pain, we will be together. The benefits of a CR1 are great, but our time together is more precious

just grasping at straws requesting assistance from Congressman and now the Senator and still will never know when that call for the visa will come
he could of been here back in April
soooooooo i think our situation is unique and i think we want to save money by just letting him get the green card there but it has been to difficult
our life is hold
ultimately it took 1 month for CR1 visa petition approval
10 months for CR1 interview...7 weeks AP
5 1/2 months for K3 visa petition approval
8 1/2 months for K3 interview...12 days AP
good luck to you whatever you decide and i am not sure how much help a lawyer really is

If your I-130 was forwarded to the NVC, you can just follow the process with the NVC for your CR1. Here is a link where you can read the proceedures to get through the NVC in 4 to 6 weeks. http://www.visajourn...howtopic=136822 .

I am currently following both paths. But you do not need to do this. You can just ignore the K3 if you want.

Hi there
Ok, so I had our lawyer get all our documentation together in preparation for a Packet 3 from the London embassy (K3). Which he did and forwarded me a copy of the DS 156. I noticed there were a couple of mistakes on there regarding where members of my family live (it asks if any members are in the US and if they are US citizens or not). Well, my wife and father live there as US citizens but he forgot and put a NO for everyone.
Also there are a couple of blank spaces in there that I could easily fill with pen, but I guess it will be information the embassy won't have until I turn up with it at the interview.
My question for our network of suffering applicants is - Should I go ahead and do another online application and send it? It will presumably create another barcode, and I'm worried it will cause confusion.

Hi Everyone
I should be dead chuffed today as I received Packet 3 from the London Embassy!

Unfortunately, I think they have sent me instructions for a K1 or K2 visa. Someone has crossed out the words 'to marry' in the title of the first page (Additional Instructions for obtaining a non - immigrant visa to marry and reside in the United States) and written 'K3' in biro underneath.

The instructions asked me for:
DS 230 Pt1
DS 156
DS 156K
DS 157

All are fine but I did read here somewhere that I do not need to include the DS 156K as that is only for K1 or K2. So I rang the embassy hotline and the guy told me that Packet 3 should be:
DS 230 Pt1
DS 156
Ds 157
DS 2000
IV15 (interview checklist for a K visa
)

Now Im totally confused. The packet obviously didnt contain a DS 2000, nor a checklist to send back.

The embassy hotline man gave me a code to send an email to the embassy and ask for a correct Packet 3. But I think he's wrong. I think I need to include:
DS 230 Pt1
DS 156
DS 157

I dont want to request a new Packet 3 because of the time delay, but also because I think he is wrong, I rang twice and spoke to the same scottish guy, and I don't waant to question his understanding, but .....thats wrong isn't it???

I think I will email the embassy with the code he gave me and ask for clarification. rather than just request a new Packet 3.

Can anyone help? Especially people in the UK who have recently received their Packet 3 and what theyve been asked for!!!!

Happy days! Had my K3 interview this morning at the London Embassy. Needn't have stressed so much about it as it was a piece of cake. They gave me an approval and told me I would have my passport couriered back to me in 3-5 business days.
There were 2 'interviews', the first one, I just handed over a bunch of forms - police certificate, birth cert., marriage cert., I134 + 1 years past tax returns, W2's, and passport photocopy of supporters.
Second interview just asked me 3 or 4 questions about me and my work, didnt even ask about my wife! (she's pissed).
The dude told me i was approved, I paid me courier fee and walked out 2 hours after going in (the interviews are only about 10 minutes each, and they spend most of that time reading the info on your forms)
It really helps if you get an early appointment. Mine was 8 AM and I was seen within 5 mins of getting in the hall.

Chuffed to bits. Hopefully off Stateside on the 30th.

I was in the same situation as you. I had both petitions approved and as the K3 interview came up first I went for that one, the good thing about the CRR1 (as you may know) is that you get the GC sent to you a few weeks after POE, but in my situation, I just wanted to get out here ASAP. It has been a right pain in the rear waiting for EAD - which has only just now been approved (see my timeline). I will have an AOS interview in January, so the good thing is that I have been with my wife since the end of August - the bad side is that I haven't been able to work. It depends on your priorities.
I think you can do both interviews. I have spoken with another member on this forum - I think her screen name is Kylady. Look her up - she and her spouse applied for the K3 but ended up going CR1 route.
