Good choice - I am definitely happy that I went to the interview. Read my review of same when you get a chance. Aside from any effect it had on the interview itself, Vika was so relieved that I was coming, it was worth it.

We had some stuff in the binders stapled, but at the interview they really didn't want any of it. They took the support information and not much else. So I guess it probably won't matter much. I did see the staff pulling staples out of documents behind the glass, and they didn't look ticked off or anything.

Brian describes a frustration felt by plenty of us here about the difficulty of getting our SOs here legally, when so many just sneak in or arrive under false circumstance. The amnesty proposal (based on the results of the last one) does nothing but encourage the opinion that coming to America by hook or crook and hiding here long enough will completely circumvent the immigration process. Personally, it blows my mind that people really think that the US, unlike every other country in the world, has no right to screen and scrutinize every person who comes here to live.

Just know that as you go through this there is a good chance you will be seperated for a very long time or for the rest of your lives you will have to fight long and hard and in the end you might have to live in mexico if you want to be together.

My friend will have to leave the USA and her child is 5 years old and is a USC the fact is she has to leave but the child does not and if she cant afford to fly him home with her the US will not and she will have to leave him here award of the state.

That is our system and what a system it is. No concern for families for relationships for true love for the very thing that is most important to us as humans.

Sorry for the harsh reality you maybe able to pull this off but like I said its not going to be easy


Seeing a lawyer under these circumstances is adviseable. And no, hospital care w/o a green card does not necessarily mean that Homeland Security knows anything about her. She may still be under the radar, but that will end immediately with the filing of a petition.

Well she is 3 now and can't imagine she will travel without us for at least 10 years or so. So am I correct in saying it is ok she is in moms passport and they will just put daughters visa for the both of them in the one passport. Just want to make sure I do everything correctly. Sorry, forgot to answer that question. Yes, children under 18 can be in her passport. I am sure your daughter will not travel by herself any time soon, but in our case our son was going to travel with me and could not. So imagine, if 3 years from now, your wife wants to go over ahead of you and you and the daughter join her later, say for reasons of the daughters school classes (exactly our situation) then you will not be able to do that. It isn't so much when you think she may travel ALONE but when you think it might be possible she travel without Mom.

You are correct, don't sweat it. And I was thinking of a variant of Gary's situation above, where your daughter might travel with grandparents (Vika has relatives in Russia), or when older as an unaccompanied minor. We don't have kids together yet (and so this will never apply), but it seems to me that carrying the extra passport would be worth it - expense aside. Happy to see you have a solution.

Gary and Alla and payxibka (both posted above) have older kids that they separated out of the wife's passport. Consensus seems to be that separate is better if the child will ever travel back to Ukraine separately (like as an unaccompanied minor to visit grandparents).

Thanks Brad and Vika. Yes this is the document she has that was obtained at Central Registration, or as everone seems to know it as the "marriage building". Everyone so far seems to be in agreement that this is the document to have and that it will be enough to show there is no father to claim parental rights. Still, you have been through the mill there with documents and I am sure you understand that one document seems to affect another and it all fits together in some way, but the KEV-1 form asks for a court decree, so I am wondering if I should check that box and have them look at this document as the court decree, or if I should leave that blank as well as the other references to parental consent and leave them wondering and searching for a document giving permission. Perhaps the interview will be easier than I envision, but I plan for the worst and hope for the best.

Thanks. A word of caution too. If I understood you, you are considering leaving blanks on a form and hoping to make it through the interview without a document showing custody. I would advise against that, and show the form above instead. It seems to me that leaving a required form out is inviting a delay - and in Kiev they tend not to ask too many questions. Consider making another post on this forum and a similar post on the bringing family members to America forum. Use the English name for the form and a brief explanation, just to see if any one else has done it. There are also some long term members here who you could PM, that have spouses from Ukraine that brought kids. Good Luck!

There is a document (named in another recent thread - I will look around), that basically says that the childs name was determined by the mother - as the father cannot be located. Vika says this is done all the time, and is the closest thing to a court order that exists. The document is made around the time the child is born.

As I see it you have some issues... one is that you are probably not going to be able to claim your stepdaughter this year as she is not yet considered a rsident alien for tax purposes as she does not have her greencard nor did she spend more that 50% of the year as a member of your household

Your wife on the other hand can be treated as a resident alien by special exception and therefore you will be able to file a joint return


No doubt, married + SSN = claimable. How old is your daughter? Not sure that is relevant, but you might be able to get her an SSN before you file. The fact that you were married awhile before they got here is relevant, as you probably contributed more than 50% of her support (use the Ukrainian scale for %). That might get you past the living in your household test.

Point is Verde obviously you have never dealt with our justice system or the government in any extensive way. What the law says, what the constitution says, what any legal document says is only good if someone decides to enforce it. And if they don't there is no one to go to have it fixed.

You are stuck in the system and while I agree with you that the law says, the manual says, the constitution says, etc. etc. There is not a thing you can do about it except complain. You cannot get it fixed, you cannot speed it up, you can do nothing but wait.

Feel lucky that your case was expediated as much as it was. I am sorry you are having some problems with your case but so did I. All you can do is wait. If he is in AP no one, and I mean no one can do anything. If he is being given a K-3 instead of a CR-1 (or the other way around) just go with it, at least he will get here. You are so busy creating stress over minor details and losing focus on the main issue, getting him here in the US.

When you deal with the government or the justice system you are at their mercy. Just an example. I was in prison, I was released and had my letter signed by the Warden that I had served out all my time. Two weeks later i was arrested again on the same charges because the prosecutor went to the judge and lied. I spent two more months in jail with my letter stating I had already served my time before I saw a judge and was released. There was not a thing I could to about it, I just had to sit in jail and wait.

Same thing here you are at their mercy. You will just have to wait.

Nothing you do can speed up the process, no one, no attorney, no senator, no congressman, no one can speed up the process. Send emails all you want, call 10 times a day to the embassy and DOS, it will not speed up the process.

Take up knitting, walking, buy a dog, do anything you can to take your mind off of it because at this point all you can do is wait.

If getting married in the Hindu way is a legal marriage (i am not familiar with India marriage laws but I know they are different from here) then you will file for a CR-1 visa (better than a K-3) and she will interview in India.
If this is not a legal marriage then you will file for the K-1 visa and she will interview in India.

She may apply for a visitor's visa at any point she wishes but it will be difficult to obtain.She must prove she intends to return to India with proof such as job, school, home, and other significant ties to India.

Joe i can't really speak for everything you have written but I can point out some flaws. First she cannot legally live with you in the US without permission from the government, ie a visa or green card. She came on a tourist visa and has overstayed her visit so she is now here illegally. For the K-3 visa she must interview in Mexico, this is a visa allowing her to immigrate from Mexico to the US, the proper procedure would have been what you said initially, file for AOS, but I am not really sure if this would have worked either since she committed immigration fraud when she entered the US on a tourist visa with the intent to immigrate.

This is a huge can of worms and I am not really sure what your attorney was advising, I can only assume that he wanted her to return to Mexico and remain there, only visiting on a tourist visa, while her K-3 was pending which is perfectly legal.

How to put the cat back in the bag at this point? I'm not really sure but I do know the longer she stays in the US out of status the greater a bar to re-entry she will incur.

IF your case is outside of processing times, or IF something very unusual is going on with your case THEN contacting your congressman would be appropriate.
It does nothing to speed up your case, in slows down the processing for everyone because that means someone must spend time answering the congressional inquiry rather than processing the papers.

I AGREE it is a beneficial tool if not abused buy please don't contact them hoping to jump to the head of the line.

Raquel.... it isn't VJ to decide their fate right? we only give advice and opinions...
