Can she afford to support him and her three children while he waits for approval as he cannot legally work until he has his EAD or green card? Does she meet the qualifications of the affidavit of support or does she have a co-sponsor who does. For her it would be a family of five, that would be an income of $33,763 per year. Do they have the money to pay for AOS, about $1800 for the filing and medical?

There may be some questions as to how and why the first passport was off by 11 years. Some people "pay" to have the wrong information placed on a document in an attempt to gain some benefit. The purpose of the K-1 visa is to marry and adjust status within the US. It is illegal to use the VWP to enter the US with the intent to immigrate. If you leave after the marriage and return on the VWP then adjust status, if you are even permitted into the US, there will be intent written all over your paperwork (not literally). There is a chance your AOS would be denied, with the VWP there is no ability to appeal the decision, you would have to leave the country, never be eligible to use the VWP to enter the US again, and would have to file for a CR-1 to return to the US.
In hindsight, you should have come to the US on the VWP, married, returned home for the blessings, then filed for the CR-1.

The quick and dirty answer is the number of persons being supported is the person filing the taxes plus the number of dependents listed on the taxes plus the intending immigrant. So if dad files taxes jointly with the wife, claiming the child as a dependent, the number would be four to determine the income needed. Dad+wife+child+intending immigrant.

As far as I can see you don't need this letter. She broke no law, has no ban on her, so why the lengthy letter?
As to the content of the letter itself, too long, too detailed, too many assumptions. CPO determined she had immigrant intent due to the circumstances. This is their job, to assume immigrant intent until proven otherwise. Someone coming into the country with a large amount of personal items for a 90 or less day visit would raise suspicions. Having been marked for immigrant intent once would lead them to suspect the same again. The burden of proof is upon the visitor to prove they do not have an immigrant intent.
But again, why the letter?

There is not switching. You would be cancelling the K-1 and applying for the CR-1. Back to the end of the line to wait all over. Most likely your fiance will have Administrative Processing based upon his country of origin, so there is not really any "fast" in your case.

You can pay for and receive a work permit without filing for AOS but it will expire with the expiration of the I-94 she receives when she enters, about 90 days after arrival. Since it takes about 60-90 days to receive the EAD it is essentially useless. If you don't file for AOS she will be out of status when the I-94 expires and she will begin accruing time towards a ban. Also she will be subject to detention and deportation since she will be out of status. If she remains in the US for more than 365 days out of status she will receive a 10 year ban from returning to the US when she leaves. You could petition her in the future to return to the US with a spousal visa petition but if she has a ban she has not served out you would have to file a hardship waiver and there is little chance it would be granted since you were both living in the Philippines together.

You probably need to re-think your plan.

Make sure you declare it, no tax is due to bring it in. You may get pulled into secondary for carrying that much cash. Make sure it is on your person or in your carry-on. I know this sounds stupid but some people don't like to carry that much cash and put it in their checked baggage. Good for my hubby he didn't, as they lost both his bags.

I still think from the story that the US officials thought she was in Mexico illegally and attempting to enter the US illegally. It is not uncommon for persons to obtain a visa to Mexico, since it is much easier than obtaining a US visa, then entering the US illegally or for them to go to Mexico illegally and then attempt to cross into the US. There may also have been a bit of a communication gap, such as them perhaps asking something like "you have a visa? (meaning for Mexico) and her saying "No" (meaning for the US).
Nevertheless, you can't file the waiver until the visa is denied. This doesn't mean you can't have the package ready to send as soon as the consular officer says denied but you are eligible to file the I-601 waiver.

But the issue is (aside from his question about a waiver) how can the US officials detain someone who has not entered the US and has a visa to be legally in Mexico. The simply went to border control, on the Mexican side, to ask if she could get a day visa. Why not just tell her no and send her back to the hotel? Why all the drama, detention, and confusion about shipping her in handcuffs into the US so they could send her back to Russia at our expense when she was legal in Mexico and had a return ticket?
And yes stupidity happens. In Germany we had a 2nd LT. who was almost arrested because he caught a train to Austria not knowing he needed his passport, made it fine into Austria, but returning to Germany, where he was stationed, was almost denied entry and detained although he had a legal right to be in Germany by virtue of his military orders.

Grant n Karleen - That link doesn't work for me. When I went to the Guides section, it shows me the instructions from the USCIS website. I have that. It says on there about entering 'N/A' or 'None' in any sections that won't apply. I entered it in everywhere that was blank and wanted to see if I was being excessive.

It also doesn't say anything specifically about what whether I would enter anything in the box in question 10. I know I send in a copy of my birth certificate, but I'm not sure if I enter anything in that box.

Hi everybody!

I'm Holly, a US citizen from Kentucky, and my fiancé is Simon. He's from the UK. We just got engaged on 2/22 and now we're figuring out the whole process for the K1 visa and getting together documentation for the I-129F. Neither of us know anybody that has gone through this, so I feel stressed. He's back in England now too, so we're trying to figure everything out seperately then discuss it after I get off work and before he goes to bed (darn 5 hour time difference) AND while I'm taking care of my 7 year old son.

Soooo I guess I'm trying to figure out if maybe there is a specific forum for my phase of the process and/or people that have been through it that can help?

I'm not sure if I need to get an attorney or not. Both of us are fairly intelligent people, so he thinks it's not necessary. I don't know if there are any good reasons to use one.

It just seems like it takes so long and I would like to speed it up in any way.

I heard that of he just came here and we got married (can you even do this?!?) that the USCIS can deny perms at residence due to malicious intent or something ( as in..he comes with a tourist visa knowing we'd be getting married). I don't want to do anything the wrong way and risk our future.

I also asked if he could come here while we're waiting and I called the USCIS customer service and they basically said no.

Also, some form related specific questions....
1) Do you really have to have every box completed? I read somewhere that you should enter 'N/A' in any box that doesn't apply.
2) On question 10 of my info (USC was granted through..), I have birth in US selected. Do I need to complete anything in the box below that?
3) Its 2/28 and the form expires tomorrow. Should I scrap this and wait for a new version? Has this happened to anyone before? Does a new version post straight away?
4) Do I need to send in any other forms with this? He doesn't have any kids ( so not bringing any lol). I'm not referring to the evidence, but actual forms from the USCIS.
5) When will he need to send anything anywhere? I've seem some things that said now and others that say nothing until he bring stuff with him to the interview.

Obviously any help would be appreciated!!!!

Actually, only thing I see here that might slow you down is changing your address if the house sells. Don't forget to change your address with USCIS as soon as you move, and put in a forwarding order too, just in case.

Agree that Gary would have the answer, most likely. Alla is off to Donetsk I think, so the party at Gary's should be over in a few days. I do think that getting the permission sooner rather than later would be good. If the dad decides the answer is no later, there could be all kinds of problems as your SO tries to deal with it. What name appears in her passport? That would be the name they match to, I think.

You will have no cert number if you were born in the US, unless I am reading this wrong. Check out the example forms in the blue bar above this thread.

Hello all. First off, let me just say that this site is wonderful!
I have never done anything like this in my life, so I am totally new at this. I have posted some threads over on the Russia-Ukraine Forum. But they recommended I come here for some additional advice...

My Future wife currently resides in Ukraine (She is amazing!) I am filling out the I-129F Form as well as the G-325A Form.
From what I learned so far, I have to send this I-129F Petition to my closest US NCICS.
My question(s) are:
1. What do I need to include with this form?
2. Does she send one to her local U.S. Embassy in Ukraine?
3. Does the G-325A form go with this first form?

OK - hoping to not make a big mess like when I misread Tom's post earlier. Here is the link to the I-129 checklist I-129 checklist. You send the package to USCIS, and she will have a separate batch of stuff when your file eventually gets to Kiev. You will get notices from USCIS along the way, but the first step is to get your visa application package together. Well, you might want to propose first - your call :lol: . The G-325 is a part of the package, you will need one for you, and one for her.

Sorry to be a contrarian, but I think folks sometimes go a little crazy-retentive with the advice and prep. I sent the entire package with one big clip, check on top. No cover letter. A dozen or so pics in hard copy. Everything worked fine.

Try to relax a little. The visa you are chasing now is different than a tourist visa, especially for some one his age. If I remember your earlier posts, you had tougher stuff to work through than this at home. Best of luck to you!

It looks like the procedural stuff has all been dealt with here already (several times). Although I met my wife here in the US, plenty of our friends and acquaintances met the way the OP apparently did. I hear stories from the USCs all the time about people from Eastern Europe having second thoughts at some point, and backing away from the commitment. When confronted with the reality of leaving everything and every one you know behind permanently, I think it is completely natural to have second thoughts. I traveled to Ukraine several times, courted, met the ENTIRE family in her home city, and even had a sitdown with her father and uncle. Leaving to permanently live here was still a tough decision for her.

This stuff happens, sometimes you can work out her butterflies, sometimes not. I would say that if she says delay the petition - waste no time going back to Ukraine and spend more time, if the OP thinks it is worth saving. Probably some one close to his SO is telling her some version of "You're doing what? You barely know this guy!!". If the comment is coming from a family member it could change her mind by itself. My two cents.

My fiancee (the beneficiary) currently works but her job is very hard and she doesn't get home until like 9 pm every night. I would like for her to quit, but I wanted to find out how this would affect our visa. I am the USC and I currently make barely enough to meet the financial requirements (around 19,000 a year). I have my mother and/or father as cosponsors so as far as I know that's not a problem. But perhaps the consular will determine that we are a risk for becoming a public charge and look at whether the beneficiary has a job as a way to determine if she can contribute to our family? She has two degrees and working here in the U.S. will be no problem, but I'm not sure how they judge these sorts of things. So my question is if she quits her job, could that negatively impact our chances of getting our visa approved?

Her job in Ukraine really won't effect your petition at all, nor will her education. USCIS just needs to determine that some one has the income to support her - so she doesn't arrive and go on some aid program.

So anyways, here we are, she has an interview set for June 27th; but I am extremely doubtful the outcome could be good. Since the letter was back in July of last year, too much time may have passed and they may refuse it because of that. They may also refuse it because I have not been with her in person in a little over 2 years; and was recently reading about the process and it was mentioned you have to have met in person within 2 years, though I don't know if that is 2 years from the interview at the embassy, or two years for initial filing. Anyone have any advise on my situation? I don't think I could handle a flight over there in my condition, I would be ready to jump out of the plane... Should I hire a lawyer's firm that can maybe meet with Nataliya in Sumy or Kiev to go over paperwork and see if we can supply anything more that might help, or what else should I do?... Any advice or good-referrals for attorneys welcomed. thanks!


No need for an attorney at this point. The instructions for the I-129F include the following:

2. You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

Read the guides and do some research to save yourself a big (and largely wasted) attorney fee up front. You can always hire one later if the process is in fact screwed up. It looks like you met the requirement to me.

The State Dept. says the following about the petition:

Your petition is valid for four months, but may be extended by the Embassy if a visa cannot be issued during that period and the intention to marry still exists. (See Frequently Asked Questions)

It would be great if I could connect with someone who had an "unofficial” wedding ceremony in Ukraine after their fiancée has her visa in hand. Surely, it has been done before.


OK - now that the fire spitting has slowed down, I have something to share. I know two couples who have married in Eastern Europe (one in Ukraine and one in Russia) in church before using the K-1 to marry in America. They both did what you describe above, and waited until the visa was approved - thus mitigating the risk. Good advice about not carrying lots of wedding pics around at POE, but if you have the ceremony after the visa, and the ceremony is not legal in the home country of the beneficiary, it seems that the risk is minimal. Also, no one will likely ask, but you should both be prepared to answer "no" if any one here wants to know if you are married.
