US Citizenship General DiscussionCitation for Public Urination

At least they didn't get you for public indecency. Anyone see that movie "terrible bosses" or something like that where the guy is a life-long sex offender registry person because he peed (at night) across the street from a school?

If you don't have any luck with the local federal court house try the FBI or US Marshall's Office.

Since it was on Federal property try the local FEDERAL courthouse. If they don't have it they can either order it for you or direct you as to how to get it.

US Citizenship General DiscussionTook Oath but Citizenship denied

Legally she must get Citizenship. Nope, no one is entitled to just receive citizenship, they must meet the requirements.

Even if her father honestly believed what he was doing was correct and proper according to US law he is still liable if fraud is discovered. He didn't commit the fraud, this is why he is not in jail. But he obtained benefits by fraud (sounds like) and thus he is not entitled to those benefits.

Has he heard anything about his green card being revoked? If it was obtained through a fraudulent L-1 visa this would be the next logical step.

He needs a really good attorney....quick.

US Citizenship General DiscussionTook Oath but Citizenship denied

You need an attorney. In an nutshell since her dad's citizenship was denied and she was a derivative of him it was proper to deny hers also. Just as if an LPR by marriage is denied citizenship (for whatever reason) any derivative children of the LPR are also denied citizenship.

US Citizenship General DiscussionDeported for an Agravated felony but we think he is a US Citizen? What to do next?

Just FYI we all make mistakes, just some of us get caught. All of us do stupid things, some just have more serious consequences than others. Don't judge unless you are willing to walk in their shoes.

Problem I see is he never claimed his citizenship prior to turning 18. Not that I know much about this.

They want to know your residence......where you were when you went to sleep that night. They ask for information about any trips of 24 hours or more so certainly your time in India would meet the need to list it.

US Citizenship General DiscussionDid USCIS lost my application? (Urgent)

It would help if we knew what sort of package you are talking about. You posted in the US citizenship forum, your profile says ROC pending, but the Tx lockbox is for fiancé visas.

So what are you applying for?

US Citizenship General DiscussionI'm a US citizen. My wife received her greencard. How long do I have to wait to apply for her US passport?

Your spouse has a conditional green card. You will file to remove conditions 90 days (and not one day sooner) prior to its expiration date. She will receive a 10 year green card. She is eligible to apply for citizenship based upon her marriage to you 90 days prior to the three year anniversary of her "LPR since date".

belinda63FemaleIran2014-06-09 09:23:00

Must be three years from the date  LPR since xxxx on your green card.

Or she can just wait and file after 5 years of being an LPR.

US Citizenship General DiscussionCan I request US Citizenship? Particular case

Correct Jimmy. He has to gain citizenship on his own as you outlined. No passing on of the citizenship by virtue of being his child.

US Citizenship General DiscussionCan I request US Citizenship? Particular case

Your father can't pass on citizenship to you at birth because he was not a citizen then. He could not pass on citizenship to you when he became a citizen because you were not in the US as an LPR. Since you are over 18 you cannot gain citizenship from him anymore.

You won't become a US citizen until you apply and are approved. You never have to become a US citizen if you don't want to.

Three years from the date of "resident since". So two years on the conditional and one on the new one, sort of. Actually you can file up to 90 days prior to the three years.

US Citizenship General DiscussionHow to enter country for naturalization under 319(b) after having been abroad for more than 6 months?

Usually a government contractor is treated the same as a military person. They are there for US government business on US government soil, so to speak. As to the list, more so just the person being familiar with the companies that do government contracts and knowing who they are. I would think his travel orders would suffice.

belinda63FemaleIran2014-10-07 13:24:00
US Citizenship General DiscussionHow to enter country for naturalization under 319(b) after having been abroad for more than 6 months?

Your spouse should have some proof of his contract as a government contractor or should be able to obtain it. Maybe just an ID type card that you can copy. CPB might give you some grief if they are unaware of the company but a lot of them know (or maybe have a list) which companies do government contract work.

Caryh.....as a US government contractor on a US government contract overseas they are treated the same as active duty military...considered on US soil while doing work for the contractor.

thanks again everyone.

It was the same with me. A congresswoman petitioned the transfer on our behalf, and we got the same reason.

oh well.... for Montreal I'll wait I guess...

Well, Vancouver declined our request for transfer. They advised that their workload did not permit them to take any extra cases.

We are now in the process of contacting Montreal.

Any suggestions on what else we can do, that may help us push through a transfer?

Thanks again everyone for your replies.

My fiance and I emailed the Vancouver Consulate last week, requesting they consider transferring our case. We still have not heard anything from them. Should we have contacted Montreal instead, and ask them to transfer our case to Vancouver?

We were under the impression that Vancouver was the one who had to approve the transfer, but I have seen other posts where people have said they emailed Montreal, and Montreal initiated the transfer. Does anyone have any further info?

Hi all,

I am in the process of applying for a transfer of my K1 visa from Montreal to Vancouver. I realize that they are "cracking" down, according to other discussions, though other than this word of advice, it appears that most people are successful in getting their paperwork transferred. I understand that a valid address in BC is warranted, as well as a valid reason why we would like the transfer.

For those of you who have applied for a transfer, were any of you denied? If so, was an explanation provided?

haha, I would like an idea of how optimistic I can be

CanadaWhen do I complete the medical?
Thanks Tinker. I haven't even recieved packet 3 yet (hopefully coming this week sometime), and i was going to go ahead and book the medical, but I had read something on here that said it could be troublesome to do the medical too early. So I was just curious as to when Montreal will ask for the medical to be complete. If it's not till after I recieve packet 4, then I know I will have plenty of time to update my immunizations.

CanadaWhen do I complete the medical?
Hi folks,

Can you someone please let me know when the medical is completed if I'm having my interview in Montreal?

Does it happen between recieving Packet 3 and 4? Or does it happen between recieving Packet 4 and my interview?

I know I know that I need to get a timeline on here. I only have access to the internet at work, so it's hard to be sneaky around my boss and find time to fill in the timeline. I promise, I'm working on it! :)

Thanks Lance, you are always very helpful in responding to my inquiries. You should call yourself a consultant and charge for your services ;)

Just one more thing, I thought that there is a form that I recieve in Packet 4 that I am required to take to the medical with me. If this is the case, how can I see the doctor now? Or am I misinformed about the medical form in packet 4?

CanadaJust recieved Packet 3 - very confused
Hi everyone,

I just recieved Packet 3 from Montreal and I have a few questions, as I'm sure everyone does when they recieve their packet.

1) Can I complete forms DS-156K and DS-230 online, or do I need to use the forms that were included in my packet? If I can complete them online, where can I find them?

2) The checklist says to arrange for a medical appointment. How can I arrange for this when I don't know when my interview is going to be? I thought the medical takes place after recieving packet 4. Can I just check this off and deal with it when I get packet 4?

3) If I get my 5 passport photo's done now, will I just have to get them done again when it is time for my interview, considering that the interview wait time is over 5 months right now?

Any help anyone can provide is much appreciated!

Thank you!

Misty

And EI is Employment Insurance I think. There is a lot of info on it, but I can't seem to make sense of what I find. From what I gather, you can apply for EI, but I don't know through who... Canada, US... it's all above me.

Hi folks,

One can very easily spend days and days reading through all the info on this website, and still not know what they are supposed to do.

So, in an effort to get all the info available in one spot, I am soliciting our VJ experts to let us new comers know where we can find the important info/discussions surrounding preparing for a move to the States.

These can includes links to pages within or outside of VJ, and cover topics such as....

- What happens to my taxes when I move?

- What do I do with my Canadian loans?

- What is EI?

- Do I have to revoke my Canadian citizenship to become an American citizen?

I am not looiking for answers to these questions, but rather links to forums or websites that will provide others with the info they need to prepare for their immigration.

Thank you to all who can help!

I think the "ties" has to do with people applying for student and work visa's. It doesn't apply to those seeking permanent residency in the States.

PLEASE NOTE: All visa applicants are required to submit electronically-completed DS-156 visa application forms. Hand-written forms will no longer be accepted. If you appear for your interview with a hand-written DS-156 application form you will be turned away. You will have to make a new appointment if you still would like to apply for a U.S. visa. You must complete the electronic form on-line at http://evisaforms.state.gov in either French or English, print out the entire form including the third (barcode) page, and bring it with you to the interview. Please also pay special attention to the list of supporting documents that you will be required to bring with you to your interview.

Do they really request this during the interview? There is no way I can get a lot of this stuff.

Records of employment
Old pay stubs
Old lease agreements/home ownerships

Hello,

I am starting to complete Form DS-230, and I am completing the area that requires employment history. Since my memory of dates is fuzzy (I know I'm going to be off by a month or two for some of them), will the consulate require proof of my actual employment history? Such as pay stubs or tax reciepts, to confirm my work dates?

Thanks!
