Hello VisaJourney!

It's been nearly two years since my wife received her permanent residency status. Things have been great! We have enjoyed a lot of great times and have had a chance to save up some money and are now looking to get her into college. It's been so long since I've filed any paperwork like this that I'm wanting to try and start early and really make sure that I do everything correct. Everybody here was so much help through the first bit of the process that I'm hoping I can run into more of the same. Here are the questions that I have:

1. Can you send the I-751 prior to 90 before your two year anniversary or should you wait? She received her permanent residency status on November 15, 2010.

2. I have recently lost my job. I have been looking for another one without much luck. I was considering filing for unemployment but am afraid that it could negatively affect my wifes immigration status. Am I worrying about something I shouldn't or should I avoid getting unemployment?

3. My wife has applied for multiple colleges around the US. If we are accepted into one of these schools we planned on moving out of the state we live in. We live in KY. If we move it will be around May or June. What do we need to do when we move? How will that affect her status? What will do that do to her residency card? How will that affect the I-751?

4. Does everybody have an interview when they apply for their conditions to be removed? What do we do if we plan on moving? What should we do to plan ahead to make sure we have everything set up to where we can have the interview, if necessary, in a location near to us.

We are extremely excited about moving but are a bit worried about any complications it could create in our immigration status. Thanks to everybody who helps us with this and I hope everybody is have great luck with their journey. We love you all!!

Congrats! :) I can imagine the relief.

For what it's worth, letters from USCIS do seem to get lost every now and then. Not sure if thats a problem with them or with the US Postal Service (both, probably). I've had issues like yours during my AOS, very frustrating!

Why USCIS doesn't send important paperwork like GC's and extension letters via a reliable courier service is beyond me. I for one would be happy to pay an extra fee for them to use UPS (for instance).

An update, in case anyone is interested. I received the Biometrics letter dated 5/04/2010. That's a load off the shoulders, now just to make the Infopass appt. to get the extension.

Thank you for your points! I guess I'll just wait for the Biometrics letter next, and at some point make an infopass appt. just so I can go visit my folks this summer. I understand you would need the NOA1 to show the extension to your green card, Biometrics letter deosn't cut it?

I have spoken to USCIS about that because I needed the extension letter for my employer my GC was gonna expire very soon. The representative told me that as soon as they cash your check they assign a number for your NOA extension letter and she also said that they send receipt notices in 10 days from the date they receive the petition. They cashed the check 4 days after they received I-751 and when I open my account I saw the check image with my NOA number and the date but It was a very bad hand write so I couldn't see the actual number. On 03/13 I got the NOA extension letter so very fast for 7 days from the date of sending it. Some people have reported here that they have received biometrics only and their cases go perfectly fine but you can still call them and make sure you receive it on time.


Thank you for calming my nerves! That's an excellent idea, we can ask the bank for a picture of the check. Being a cashiers check tho, I don't know if they have it. (We haven't used checks in my country since the 70s or so, so I don't really know how they work.)Then again, if the writing was illegible anyway...

v333k: Thank you for the reply. It does make me breathe easier, when you said if they cashed the check, they should have the paperwork and keep it too. I'm going to wait for any action from them, maybe they go straight to the biometrics letter. That's what seemed to happen to some ppl from January filers.

If it still drags on, I might make the infopass appt. Especially with the summer trip coming up. I understand that even with a case #, USCIS aren't the most helpful people to call to... I don't think they would bother much.

Update: I logged into my USCIS account online, and noticed that they had touched the Employment Application on 04/18/2010, which means either they have the current application, or were just going through old stuff, wondering why we haven't submitted the ROC yet, and if they should start deportation procedures :blink: (I don't seriously believe I'd be deported for just that :))

Have you checked the April filers thread in this forum to see if you're lagging behind others who filed around the same time as you? That's really the only way to know whether or not you're experiencing something outside the norm.

I tried asking this question in that thread first :) That's what alerted me to it; everyone else seemed to get it in a few days!

This happened to quite a few Vermont filers back in January when we filed. :) It didn't have any bearing on the case at all. Our only problem with it was that the NOA1 is what gives the extension to the green card while the case is processing, so we made an Infopass appointment to get an I-551 stamp so we could travel out of the country without having to worry about an expired green card.


I'm actually filing to Vermont too... And that is also our problem. We're planning on a summer trip, but without the extension, we (I) can't go anywhere.

I'd just want to know that they haven't lost the application or something, but I guess there's no way of making sure of that?

I'll go in and check the Janaury filers thread.

Here's our story short:

We submitted a ROC for myself 04/06/2010. It was certified, so according to the tracking, it was received 04/09/2010. We sent them a cashier's check, which was (I don't know what they do with cashiers checks) but it was taken/cashed/whatever a week or so from then. After that, we've heard nothing, and I'm getting worried.

Could someone please, help me out with info on what we should do next?

a) Does it mean the application is in trouble?
b) Could it have gone to an address they had on file back in AOS days, or do they send it to the address on the current form?
c) I don't have a case#, since we haven't got the NOA1 yet, but is it worth calling USCIS?
d) Should I make an Infopass appointment?

Any help is appreciated!

I can answer this for you, on my part, I just checked the LUD and it showed 07/08/2010. I didn't check it last night when I got the e-mail update. But it's changed today.

You might not have a case number but you have an A number, your alien number on your green card. And that should help them find you if needed.
An infopass appointment can't hurt, especially if you're getting close to having your GC expiring. You do need the extention for work after all.

Ok, Now I'm officially worried.

Our package was delivered and signed for 4/9/2010, the check was cashed maybe a week later, it's 05/04/2010 and I still haven't received my NOA1!!

Thus I don't even have a case# that I could ask for. Could you, please, advise me on what to do next? I've already contacted the local post office, and they say they've checked the mail truck and all, and nothing. I don't really know what to do. Should I make an Info pass appointment? Can I do that without a case#? I know calling USCIS is a total waste.

Any advice is appreciated!

Meanwhile:
1) I continue making out the paperwork and gathering the evidence for the N-400, hopefully am able to file on August 18th, or not too long after that
2) Wait for my son's birth certificate in the mail (have to get that first before I file). How much longer will it take?
3) Wait for confirmation that the USCIS got my AR-11 and I-865 (had to file those, since we are moving). How long does that take?
4) Move into our new house next week...better get packing!
5) Catch up on vj and then get some very-much needed sleep in between feedings and diaper changes....

Your posts really make me laugh not in a bad way.But i 100% know how you feel.A couple months ago i was parasitically checking the USCIS website after transfer now i check maybe 8 times.Its like we are outcasts at USCIS.More like the untouchables and biblical leppers they wont even acknowldge we exist in the process.When i think about it like that i can laugh.I only get really mad when a new poster says i got approved in 60 days thats what boils my blood.I have also cut back on my mailbox stalking because 2 months ago i swore my letter of approval would have been in the mailbox any day.Now its oh someone else got approved in 60 days simply ignore to not make blood pressure go up.It feels good to vent on this website evn if im a broken record.I amnot alone.

I have a family that I have to take care of...I wouldn't give rat's #### if we didn't have kids...

Do you think I don't know what that piece of ###### USCIS manual says or do you think that the our immigration attorney whose sole job is to deal with hundreds of people's eligibility to work in this country do not know what is states. Please...

The point is Conditional residence is a state of limbo...It is worthless...I don't care what USCIS claims conditional residency = garbage. USCIS claims a lot things as well...They claim that the applications are processed in a first come first serve basis....Soon they will start selling Washington bridge to immigrants too...

I was trying to help you out and calm you down, but you jumped back at me man. This is no way to reply back. I know what you as i am going through the situation. A lot of folks here on VJ work in Billion Dollar Companies but they never brag or say about it. It's just the way you deal with your employer matters. I know your company is big and all and have great immigration attorneys, but the reason i mentioned the info was just in case you or your company's attorney didn't know (which unfortunately most of time they don't).

The fact, Removing condition is indeed useless, but we have to obey laws and follow them. So i think we can't anything except wait and complain about it.


my employer did not ask, I did not give them info. simple.





Removing conditions equals an unlimited time in having not a clue what the present or the future holds.I dont care who says having a case pending dont affect your status in the USA it does and thats the truth.So to the people who waited short times please realise that there are other people waiting longer and that the belittling of our situation /USCIS victims does not help.

I am in the same situation here, I aplied to remove my condition in April 2008 and still waiting...BUT there's no reason to panic until your 1-year extension is expired...before that, you have no leverage against USCIS. You had an RFE which you have responded to so maybe you are closer than you think. From what I gather, most peple get approved shortly after their RFE. Have you applied for naturalization?



Another day no mail from USCIS no email update.I dont know why i act shocked blink.gif blink.gif .I really did not want to apply for citizenship but it sems that i may hav to.I did not want to because my Trinidad passport expires soon and wanted to renew it minus becoming a US citizen and having to declare that on the renewal form.Oh well N400 here i come another chapter added to the saga.The saga of USCIS bs, money sucking from immigrants and being ignored.I pray to god that if i file for citizenship it does not drag on for ten months.Because that will make me even more pissed than the I751 wait. I have one question though.Since my green card expired Sept 06 2008 and i submitted I 751 in July.Do i have to get a 1551 stamp in September when my card expired or July as my receipt date.

I guess this is the Case stuck in a black hole thread,for transfer cases and general irregularities.I love when i call the 1800 number and they tell me my case is pending,tell me what i already didnt know.If there were a fairness to approvals it would not anger me as much.But its the 5 week approvals and the 5 month approvals vs ten.Is there some criteria that we do not fall into that's taking so long for us.I mean what can it posibly be,because i know the 7 months at Vermont did nothing ,but is it that with the transfer notice sent that it will actually be 6 months at CSC that we must wait making our wait times 14 months in total.If so thats total Bs.I look at the CSC July 2008 people who are longgggggggg approved and done with USCIS but we must be made to wait indefinitely,oh well.

Understandibly my employer is antsy because we provide services to government agencies and everytime we undertake a project the agency requests our passport, greencard visa copies and every freaking time this stupid approval letter causes headache! Even the freaking students on F-1 optional training are not given hard time! I am fed up with this as well...I am being pulled of from several big jobs with the government and it is hurting me big time!! I am being told that the company is not doing good...economic crisis...bla bla bla...They just don't trust that god damn letter that's the whole reason it is....

I applied on July 12 2008 and I have no patience left...I am sick of this stupidity...I scheduled an infopass and I already told the company immigration lawyer to come to the infopass with me and withdraw the petition to get H1B and EB2 green card.I have a PhD so it should not be a problem..I have two kids to feed I can't afford bullshit...


Welcome to the club guys ten month no repsonse seeing people file din 60 days getting approved.I contacted my Congressman they did an enquiry and NOTHING AS WELL.And i am doing everything possible to not get mad.It had started to sen dmy blood pressure up to the point i had to see a Dr.Yup now i am rationally dealing with the wait by ignoring everyone else who is approved who filed ahead of me.And yes i do hold a grudge against the 60 day approvals vs 10 months ,its like rubbing salt in my wounds.And no i am not interested in being patient 10 months is long enough.I dont want to apply for citizenship either because i am not ready for that.
