It is a violation of the VJ TOS to: Make comments in a Post either direct or implied toward another member that are purposely designed to upset, antagonize, make fun of, belittle, or otherwise instigate an argument that takes away from the personal enjoyment of the Service by other users.

I have removed a post that clearly violates this rule, and all posts that quoted it. Thanks to all the members who reported it.

We just called USCIS a couple of days ago. We sent ROC paperwork to Vermont May 14, and they received it May 20. The rep told us they were working on May 2, and I thought I would share that.

On a related note, Vika delayed her biometric appointment into July because she was in Ukraine visiting her parents/grandparents. The rep said this shouldn't delay anything.


We received the approval letter in the mail today, dated February 1. No interview required apparently.

Now it makes a lot more sense, all i saw originally was the arriving on K-1 and working without authorization ( which could lead to arrest if a workplace raid happened)

Since she had her greencard she is/was authorized to work. So no problem. If you might, might be referring to not paying taxes since she received a 1099 an not a w-2 this would be addressed when she files her taxes dependent on how much she made and how much she owes total (or both of you as I always recommend running the figures both join and filing separate).

Obviously from your statement they didn't make a "mistake" by working prior to receiving employment authorization, they knew they were not authorized to work since they were "working off the books" or so they thought.

As to the consequences? Depends if USCIS finds out and what they choose to do about it. I see from your timeline that your wife has been in country about one year yet you have not filed/completed the AOS process? Did she report her "under the table" work on the AOS application?

I don't mean to judge anyone, and you are not the only one who has done something like this, but after all the time and money spent to get the person here why do people knowingly do illegal things that may result in denial of the green card or deportation?

Seriously, maybe a copy of the old green card which shows you as female, driver's license, maybe a bill for a pap smear or mammogram? Do you have a copy of your application that you could copy and send with your proof to show it was their error?

For me it would not be a big deal, obviously I am female and I don't need a government ID to prove my sex.

If you have the time go with the transcripts, it saves you a lot of headache if one of the W-2's falls out or the clerk is lazy and doesn't want to go through all the papers.

You need to file a change of address form to notify USCIS of your new address. Actually by law you are required to do this. Being a resident of a particular state does not change the fact that you are still a resident of the US.

Unemployment is an "insurance" paid by the employers not a means-tested benefit so you are more than entitled to receive it is you meet the requirements. Most states have a website with more information and where you can also apply for benefits online.

Yes there are requirements regarding how long you have worked and the conditions of your employment ending.

I think the best thing is to time it so it happens just prior to filing for the removal of conditions, file with along with the certified Order changing the name, then follow with the SS card and DL? or do it before?

He can if he qualifies. Unemployment is an insurance fund that is paid into by each employer thus it is not considered a means tested benefit but rather something that is earned, sort of (please no annoying opinions on this). The problem will be his qualifying since he is a conditional resident (less than two years here) and has been unemployed for a year this means he has worked very little.

Pax, questionable if she overstayed the tourist visa, kinda thinking she did, but the green card expired March 2009 and she didn't leave the US until summer 2010.

The big issue now, since it has been determined the green card route is closed, is what ban she has incurred. It sounds like she overstayed a tourist visa, married, failed to remove conditions on her green card, stayed another year after it expired, then left the US. Looking probably at a 10 year ban and, as Bob said, she was probably deported due to failing to remove conditions. With this history the chances of obtaining any visa to the US, other than immediate family, are zilch to none.

Sounds like your green card was expired prior to you leaving the US yes? If so there is no way you can obtain a returning resident visa as you had to be a resident when you left to qualify.

Permanent resident aliens who are unable to return to the United States within the travel validity period of the Alien Registration Receipt Card, or the Reentry Permit, may apply to the nearest U.S. consular office for a special immigrant Returning Resident (SB-1) visa. To qualify for such status aliens must show:

That they were lawful permanent residents when they departed the United States;
That when they departed they intended to return to the United States and have maintained this intent;
That they are returning from a temporary visit abroad and, if the stay was protracted, that it was caused by reasons beyond their control and for which they were not responsible; and
That they are eligible for the immigrant visa in all other respects.

Possibly I can explain this by giving an example. If you are male and found in a known house of prostitution when it is raided you might be arrested and charged. Later they may realize there is not enough evidence to convict you so they dismiss the charges. You were not convicted in a court of law but USCIS may determine that a person who was in this situation is not of "good moral character" and deny your application.

You need to file a 1040X to amend the incorrect tax return. I would take it back to the person who did it, point out the error and ask them to file amended return with you as married (you were married that tax year correct?). What filing status did your spouse use?

Hubby did his name change prior to removing conditions. He obtained a court order (simple process) filed ROC with the new name (copy of court order enclosed with application) Now that he has the new green card he just changed his social security card, driver's license, and is working on his credit card name changes. Not a difficult process, just a lot of paperwork contacting everyone.

If you wait until you do ROC you can have the name changed with the application. I'm not sure if being married would require a court order to do it, but if it does it should not cost much. Hubby got the form off the internet, filed it at the courthouse (no court appearance required), got a couple of certified copies and mailed one in with his ROC paperwork with the ROC in his new name. After he received his new green card he changed his name on everything else.

Finally some news. After hiring an attorney and responding to the RFE he received in the mail today.......ta dah.....you have been approved and will receive your new green card within 60 days.

Just an update, hubby hired an attorney today to help with the RFE and to prepare/go with us to the interview if we have one. He gave us some good advise and a list of things to obtain. Hopefully we will have it mailed back in a few weeks, we have until the end of April to respond. And the good news is he only charge $600 for everything, including going to the interview, if we have one, with us.

Good news: Our case has been touched.

Bad news: We got an RFE for more evidence of a bonafide marriage. Guess we are going to have to scrounge up some affidavits since we never really co-mingled our finances (after my last marriage I refuse to do this). And send copies of our tax returns.

At least we all know VSC is alive and working again.

Yep, we did ROC without a joint account. I wrote a letter and included a copy of the civil judgement a creditor had against me. I just explained that I didn't want to risk his money being taken for a debt I had prior to us meeting.

Hello,

I'm sure this question has been answered before, but I don't seem to be having much luck with the search feature.

I am getting ready to submit the I-751, and I'm compiling evidence right now. How important is it to supply two Affidavits from people who can attest to our relationship? We feel we have enough documentary proof of our relationship, but the affidavit thing seems very confusing.

Did anyone else leave this out of their application submission?
