Removing Conditions on Residency General DiscussionI need advice helping my ex-wife RFE to remove conditions of GC

I believe is she is divorced you have to file the waiver also. Since that wasn't done they think you are still married and are filing to remove conditions jointly.

Removing Conditions on Residency General DiscussionI-864

She can file for citizenship 5 years after she became a permanent resident. She does not have to file for citizenship ever.

The I-134 is not binding but when your fiance arrives and you fle for AOS you will have to file the I-864 which is legally binding.

He will have biometrics to remove conditions. He will have biometrics if he files for citizenship. Yes, it is required.

Removing Conditions on Residency General DiscussionI-751 denied what can i do

Sounds like a felony but I can't say for sure as I don't know the state. Suggest you pack your bags.

What matters is not what you say but what you can prove. You signed a paper saying you moved out of the marital house three months after the marriage. You have a felony conviction. You have no proof of a bonefide marriage. Your green card expired years ago.

What does your attorney say?

You signed an annulment, got into enough criminal trouble that you were in jail, did not remove conditions in a timely manner. You need an excellent attorney not just a good one. Chances are slim.

Removing Conditions on Residency General DiscussionI-751 Waiver with option 1.e. (Wava) Please Read!

If you apply under VAWA and are approved you get your citizenship as though you were still married to the person. It request a LOT more proof, proof of abuse not just marriage didnt' work, and takes time. Do you have proof you were abused? VAWA is the violence against women act where an immigrant who was abused can obtain a green card. Of course it also means a lot more money for your attorney.

Is obtaining citizen three years after the marriage that important or do you mind waiting until you have had your green card for five years?

belinda63FemaleIran2013-12-22 13:18:00
Removing Conditions on Residency General DiscussionI551 pending for 3 years

What do you mean by temporary green card and official green card? Do you mean conditional (2 year) green card and interview to remove conditions or do you mean stamp in your passport (which is what your post implies) and interview for physical green card? What visa did you enter the US on?

I am confused because you say you got your temporary green card in 2008 and interviewed for your permanent green card in 2013. The temporary card (or stamp) is only good for 2 years.Maybe you meant you went for your interview in 2010? This would make sense if you have been waiting 3 years as your post says.

If you interviewed in 2010 you need to call someone Monday, first thing, or make an info pass to find out why you haven't received your new card. Why have you waited three years to inquire?

Removing Conditions on Residency General DiscussionWhen can a CR-1 spouse file for ROC?

The date of marriage is not relevant to the date to ROC. The date you became an LPR is the deciding factor. You file for ROC after two years of being an LPR (the window to file opens 90 days prior).

Removing Conditions on Residency General Discussioncr 1 visa and visa lottery

Thank you merrytooth I knew this story sounded familiar.

She cannot apply for the diversity lottery. If she files for ROC with the two of you married she will have to provide a lot of proof of marriage. If she cannot provide such proof as a joint lease or deed, joint bank accounts, insurance policies, proof of both of you living at the same address, etc.  the ROC will be denied. There are many people who ROC who receive an RFE for more proof of their marriage. If her ROC is denied her choices are to leave the US or remain here illegally.

If you are found complicit in attempting to help her obtain her 10 year green card.....meaning you lie to or provide false information for her to gain a benefit......this is a crime and you could be prosecuted criminally and fined.

Use the new name, include a certified copy of the court order changing her name, new green card will have the new name.  And of course all the other stuff required.  Hubby did the same thing and by changing it when you remove conditions it saves you some money.

So if you file the I-130 and the I-129f at the same time, unless the I-129f is received and processed before the I-130 it will be closed and the I-130 alone will proceed with processing.

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports25 year age difference....Older women marrying younger men
Hi cougar clubbies!!!

Update on Bella: HUBBY IS HERE IN THE US FINALLY!!!

He arrived in Chicago and went through immigration/customs at O'Hare on the 17th and everything has been fantastic since then. We had a couple of strange looks when we went to the Sears Tower (when the heck did they change the name to Willis-something-or-other) and were waiting in line to ride the elevator up to the top. Interestingly enough...they were from tourists that appeared to be international.... I don't know if it was our age difference, his nationality, his height or the combo-pak--but we both found it amusing.

I am pleased and surprised that we have had no weird looks, comments or derogatory remarks in KY and that so far everyone has appeared accepting, amiable and very friendly toward my hubby.

Interesting to me that people felt more comfortable voicing their opinion while I was alone and waiting for his arrival but now adore him when they meet him--I feel like saying "I FLIPPIN' TOLD YOU I MADE A GOOD CHOICE!!" LOL

Hugs to all and hope everyone is well in Cougarville.

Shirorisu

I hear ya girl! I have been amazed at how people are so mean when they are frightened--and an older woman marrying a foreigner scares the p#$# out of people. I have always been very liberal minded so I was shocked and really devastated when I faced the reactions after landing from my first trip and marriage events in Pakistan. Blew me AWAY!

So yes, let it all out here and we're here to support you. YOU do not have a chip on your shoulder, you're going through a hard immigration process in a society that judges and ridicules. Anyone here posting a negative at my girls can be bop over to a different forum....thank you very much.

Hugs,

Bella

Do you have any idea what it is like posting anything about your relationship in any forum anywhere, especially on one like this where we are supposed to be sticking together and helping each other through this process, and your relationship and the validity of it is always belittled? It's bad enough with US immigration questioning if our relationships are real without everyone on this advice forum chucking in their doubtful thoughts.

Do you realise the irony of saying I have a chip on my shoulder? The fsct you even need to point this out is tellingh, if you saw a person saying they did not think age gap relationships were valid, would you post telling them they have a chip on their shoulder?

I am merely trying to show you how ridiculous or hurtful this type of questioning can be.

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports25 year age difference....Older women marrying younger men
Hi ladies...everyone is welcome on this thread but please keep a couple of things in mind.

1. We (the older wives) are really tired of being bashed by a lot of people for our choices and this is a place for positive posts and thoughts. If you think you have to go on a moral tirade to "school" us in wise spousal choices, keep moving and find a different thread. We get it from family, friends and complete strangers...nothing you say is new or inspired and frankly I find it offensive.
2. I'd be honored to have anyone with a major age difference on here...the more the merrier.
3. Let's never judge another person for the choices they make on this thread. We all take a chance in love when we marry...doesn't matter the age difference, the nationality or whatever "reason" you post. These are all fear based and if you find love, no matter how conventional, embrace it and enjoy it. YES, be careful when you're courting, but also be open-minded, a mentally healthy and stable person will always be wary of red flags and proceed with caution. But consider this: iIf our "American" system of marriage to someone within an "acceptable" age bracket or other socially "acceptable" labels...why is the divorce rate so high?
4. There are actually men out there who are not ruled by sex and objectifying women. So what if we look older than our husbands if it doesn't bother them. Maybe there are people, men & cultures out there that base relationships on communication and support without over-thinking the sex. Marriages should be based on a lot more than just physical attraction. A young beautiful 22 year old can get into a car accident and have paralysis for the rest of her life...if she's married to a shallow shmuck who would find her "gross" afterwards, what are the chances that relationship would last a lifetime? Maybe there are a lot of failed marriages because they're based on the wrong ideas of partnership and what love truly is.
5. In the Islamic world many men are open minded about age differences. I don't know this for a fact, but I personally think it may have something to do with the fact that Muhammed (PBUH) married a woman 20 (or so) years older than him. They don't seem to have the same bias with age than many Americans/Europeans have.

Thanks for keeping the thread alive and let's keep this a place to tell our story without the fear of judgment and reproach.

Im older than my husband and everyone around me is totally fine with it. To be honest, after my first relationship with my childrens father broke up, Ive always seemed to gravitate towards younger men(he was 10 years older). The funny thing is my husband has 2 brothers and they both are with older women(LOL) so it must be something in the blood. Good on all the women who have found love with a younger man. I dont have to spell out to any of you why this relationship can be more fun, fulfilling and interesting than what is considered to be a more "conventional" relationship.
Great thread.

Thanks! I love your story and am glad you're on the thread.....I love that we have a place to get together and talk about our "unconvential" choices in love and life. And honestly, I've really never been happier than with my husband, even though the journey is a long one that requires patience until the visa comes through! :-)

I'm a Puma robbing the craddle :) One day I will turn into a Cougar and continue to rob cradles. So I'm wondering if this will be an issue for me to bring my fiance over if he's like almost 2 years younger than me O_o"? Where do they draw the line? I saw someone's post saying even 5 years is red flag for the woman being older. Personally I think it's unfair.. , why is it such a big issue that woman is older?

Hi Dot, 2 years should really not be an issue at all. In fact, any age difference is not supposed to legally matter, but each country's consulate tends to follow their traditional values in making a judgment.

Good luck with your VISA process and I hope you have a very happy, long marriage!

Yeah, that's what I was thinking, about the cougars. Why is it so culturally acceptable if an American woman of a certain age marries/dates an American Man nearly half of that age? It doesn't seem fair to me. I know I am only 1 yr older than my husband, but my problem is that why does age matter? All those "Cradle Robber" comments and such. Why doesn't anyone care when older men love to ogle younger women. Women get the same sensation from younger men, right? And if you choose to be "exotically inclined" towards darker skinned men, or other nationalities, why is it suddenly all about green cards and visas? Even me being practically the same age as my hubby, my family still had comments like "Why can't you find someone from your own country?" or "He is just using you for a visa" or whatever. they felt the same way about my first husband who was 6 yrs older than me. My mom said "What does a 24 yr old man want with an 18 yr old girl?" well gee mom.... do I have to draw u a picture? Anyhow, we were married 7 yrs and had a kid together. I just have always been attracted to "exotic" men as my friends and family say. My first boyfriend was Lebanese/Egyptian, my ex was Bangladeshi and my current husband is Pakistani. I don't think age should matter no matter what because if it happened in the USA, no one would bat an eyelash anymore. But jsut cuz it takes place overseas, everyone has an opinion. They all wanna know "Why are these men looking for women online anyway?" well, cuz its culturally unacceptable in their countries to be alone or meet up with a woman or to even show outward/obvious interest in one. So, the internet is a safe way for them to get to know someone without overstepping their culture's boundaries. that's what happened to my husband. He said he always knew he didn't want to marry within his own culture because he felt that he wouldn't receive the same kind of love from an arranged marriage as he would if he found one for love. So.. i say good for you ladies for finding the man of your dreams. Anyone who says anything..... is just... plain.... JEALOUS! Ha!.. LoL. Good luck wiht your processes girls. I am still in AP.

~Tara

   Well Said TARA~ You go girl!!! I love that you brought up the cultural issue in Pakistan and many middle eastern countries regarding the ban of dating and the men going online to meet someone. Spot on.

Well, I'm 'only' 11 years older than my husband.... heehee

The funniest thing was when my dad heard I was going for the second time. I guess he thought the first visit was just for curiosity. Anyway, he said "what are you going to do over there, change his diaper or something?" ^_^

My ex was the only one who said anything rude out loud to me.

This isn't about age, but I did have a friend who asked why I couldn't just find a nice American man to marry. I just said "well, you see how that worked out for me the first time" to shut her up - and it worked.

Peace
venusfire

:-)

Yes, my ex freaked out and said some pretty raunchy things to me as well about the age difference. I firmly had to tell him that my relationship is none of his business unless it negatively impacts our children. (Which this doesn't.) And that he had overstepped some serious boundaries with his comments. (then the wicked part of me told him my 21 year old husband was twice the man he was at 44)

My fiancée is nine years older than me, but we have yet to receive our NOA2. We will be going through the embassy in Lima and hopefully our age difference is no problem.

Happy smooth journey to you Carmen, I hope your interview is fantastic. Is it unusual for a nine-year age difference in Peru? Like Pushbrk said earlier, it depends on the country's traditions and standards how the judge the age differences in couples.

Best of luck to you and please keep us posted!

Good morning!

Hey Christi! ...there are "stud-essier" women than me on here

Hopp...WOW, seriously? LOL you don't think some of us women have been destroyed financially in divorce court? It's the new age and everyone get's treated "equally" now. Let's dissolve some of these preconceived notions that are so negative.

And-Sam, it's nice to hear from you as well....and so glad to hear you were welcomed with open arms by your in-laws.

badmash....well I guess any marriage is risky. There are natives who marry natives in any country that use them for money, power, social status. It is a risk we all take and I think (or at least I hope) that some of us more experienced women were careful in our courtships to watch for any red flags or warning signs of this happening with our younger husbands. But like I said, marriage is a risk you take....and you take it because you connect with someone deeply on many levels and fall in love. I hope we all have happy endings as well.
