Just wanted to add that a 401(k) or IRA is a pretty liquid investment. Just deduct from the balance your taxes, and a 10% penalty if you haven't reached 59 1/2. I would say go ahead and use the asset if you have it. Good Luck!

My wife would have been thrilled if I had moved to Ukraine. She is OK here now too. I think it is all about who you are with, not where you are. We are married over three years and have a child. Speaking from that perspective, I find it weird that the OP's man puts location first, family after. No judgement at all mind you, but something to think about.

This is my second time petitioning. I broke off my first engagement due to her being unfaithful as it appeared then and what I found out later to be factual. Watch my timeline as I am certain of RFE even though I sent them a letter detailing why I ended my first fiancee visa and relationship. I doubt age has much to do with this. One of my friends married a 32 year old and he is 59. I have seen others 30 years difference and okay. For me I am 22 years older than my current. I am age 46 and she is 24. I did live in the Philippines two different times for more than a year each time with one time being 3 and half years working. That is why I keep going this route lol. I am more Filipino than American the last 10 years.
The only reason I can forsee an age rejection is if the petioner is well into his 60's or older and his fiancee is under 30. I am only speculating that maybe they look at how much time based on aging death does the petitioner have to support his wife to be.

I agree that age difference is not a good indicator of compatability (my wife and I have seventeen years age difference), but I think the OP is asking a procedural question. From what I have read on VJ over the years, it seems like it depends on the embassy, the amount of visa fraud in the beneficiary's country, and the culture of that country. So in a culture where men don't normally marry women that are much older than they are, the CO can make the visa petition an uphill climb.

To the OP - yes it is possible. If I recall correctly you will need a waiver if you file again within two years, assuming this was your first petition. Some one will no doubt correct me if that has changed. Good luck to you.

After a reasonable amount of time for mail delivery, I would suggest you call Madrid again. I worry that you did not get confirmation about the last date that was set, as you posted.

Definitely take control of the scheduling by calling them. Say that you sent the documents and tried to schedule by email - just checking to make sure everything is on track.

I just wanted to add that the Kiev embassy is known to be pretty easy on K visa applicants. Have a look at some of the reviews. You might even find this situation covered. Another suggestion is to have the petitioner/USC attend the interview.

At some point she will have to explain. Questions 11 and 12 in the I-129f ask if she has ever been to the US, and what her status was while here. Her passport number and name are in the database at State somewhere, and if she is not truthful, she could be denied the visa and banned.

There is no problem at all receiving another K visa, provided she left on time before, and had no criminal charges while here. Disclose everything asked in the application and interview.

My preference is to give the government exactly what they ask for, and no more. It keeps the megaminds at USCIS from making a mistake because they have too much information to process.

To stop the K-1 Visa, prepare a letter explaining that you'd like to withdraw/stop the K-1 Visa. It wouldn't hurt to have your signature on the letter notarized. Send / Fax the letter, along with a copy of the NOA2, to the US Embassy in Guangzhou.


Don't forget to copy USCIS to be thorough. The Embassy should send the file back, but you may want to notify USCIS separately as well.

Although I agree that USCIS probably won't move faster because of an inquiry, that really isn't the main reason to ask. Each congressional office has a staffer that specializes in immigration issues, and they USCIS has special liasons to deal with these staffers (and others no doubt). If you have a conversation with the staffer, and your visa application is past due, they can quickly make sure that it is on track, and not lost in transit or on the desk of an adjudicator that is taking leave or something.

I went to my Congressman when we went past the USCIS projected time, and got a prompt response and some email follow up from the staffer who helped us out. She seemed professionally interested in the USCIS meeting the projected time they gave her. I did not ask for a letter or anything, just to have them check on the file.

You cannot apply for a US passport until you obtain citizenship which you will be eligible to apply for roughly three years after you obtain your Legal Permanent Resident Status if you remain married to the same US citizen (this is a basic explanation).

I do believe you can apply to renew your Philippine passport from within the US and am sure someone will be along to explain this.

You can file for AOS as soon as you have a copy of the marriage certificate. When you apply also apply for the advance parole which when received will permit her to travel out of the country and reenter the US while awaiting her green card. It takes about 3 months after filing to receive this.

She will not be eligible to apply for citizenship until she has been an LPR for three years (minus 90 days) based upon still be married to you.

Na, have her check, if she lives in a big town there is an IRS office located there. I live in Louisville, Ky and just drove over to the office and had my tax transcripts in a matter of less than one hour (55 minutes of it was waiting).

There is no charge for the transcript and you should receive it in 10 business days from the time we receive your request.
Tax return transcripts are generally available for the current and past three years."


And I have heard they will fax them to you if you ask.

You have no legal obligation to provide for her, the I-134 is not a legally binding document. Morally I believe from the information given you have done the right thing. You have provided her with an honest assessment of the relationship and indicated you did not wish to continue it. You have provided her with paid transportation, if she chooses to not accept the free ticket from you then she can pay for her own way home.

I would just cut ties with her and move on.

When her I-94 expires she will be out of status. She cannot adjust status in any way except through marriage to you. I would suggest you take steps to have her removed from the residence, with witnesses present, and if she is still in the country after the expiration of the I-94 contact ICE and provide what information you have.

Hobbit hit the nail right on the head. A proxy marriage is legal, I know Texas and a few other states recognize them, but FOR IMMIGRATION PURPOSES a proxy marriage is not recognized unless it has been consummated. Filing for a K-1 is the proper way to do it but expect a lot of trouble along the way. Right a clear letter explaining the situation and provide it along with copies of the proxy marriage paperwork, maybe highlighting the words relevant to proxy.

I have read here of people who were denied fiance visas because the consulate believed they were actually married so anticipate and prepare for this.

The K-1 is a visa, not a permanent residence card. Once you arrive in the US you have 90 days to marry the petitioner. After you are married you file AOS (adjustment of status) to obtain your green card (permanent residence). You can also file at the same time for an EAD (employment authorization) so you can work while your green card is pending. It normally takes about 90 days after filing AOS/EAD to receive the work authorization, not two years.
Once you arrive on the K-1 visa it is void, it is a one use visa. If you leave the US after arriving and prior to obtaining AP (advance parole) which can be filed for with the AOS, you will be considered to have abandoned your application to adjust status. You will have to obtain a new visa to enter the US.

Keep in mind that when you file to adjust status you must show a legitimate relationship with your spouse such as living in the same residence, joint bills, etc. And you cannot adjust status by marriage to anyone other than the person who petitioned you.

It has nothing to do with your relationship and everything to do with checking his background for all sorts of lurid things such as terrorism, links to terrorist, any specialty training, any trips outside his country or even some places within his country.

You can have as many people as you want file a K-1 for you, of course not at the same time :P . There is no life-time limit on it. But do keep in mind that repeated attempts at a K-1 visa might raise questions as to your intent, in other words are you just shopping for a way into the US or is it really love? (not me saying this but might be a question in the interviewer's mind).

A K-1 visa is issued for the purpose of marrying the person who filed the petition. Sorry to say but marriage and subsequent AOS based upon that marriage is the only way for you to legally remain in the US.

She would not be doing AOS based on the K-1, that is done and over. She would be adjusting status based on the concurrent filing of an I-130 and I-485 (after they marry). She is subject to a ban so AP would be useless and until the AOS is accepted she could be deported (but unlikely).
