A relative has nothing to do with a person receiving a tourist visa. The person wanting the tourist visa must apply for themselves and show strong ties to the home country to prove they will not remain in the US. An person applying for a tourist visa is considered to have immigrant intent and it is up to the applicant to prove they will not remain in the US.
The relative can write a letter stating they will be providing a place to stay for the tourist, etc. but it has little to no affect on whether the visa is granted.

If everything is normal she can have a home birth no problem. I had three births, all in the hospital and the best one was with a midwife only. Things were calmer and less rushed. She was more understanding of what I was going through. This was in Germany, the other two births were in the US where I felt like I was ignored during the labor. Again if everything is normal she would probably be a lot more comfortable giving birth at home......this is just my opinion.

Immigration is about love, not about living as a rich person. At 125% of the poverty level the petitioner has shown they can support the intending immigrant. When the immigrant arrives and receives the proper paperwork they will probably start working too adding to the income of the family. If all you are worried about is money, suggest you look to another country. In the US by the time you pay for housing, food, gas, and health insurance there is little left over except for the 1% of the US population that holds most of the wealth.

If you really push it, Arrive in US, get married, walk the certificate to the clerk and obtain certified copies the same day (not available everywhere), mail completed AOS packet with marriage certificate that day. Wait 60-90 days and have EAD. Apply for the social security number somewhere after one week of arrival but prior to 2 weeks prior to I-94 expiring. And don't forget the driver's license (area specific).

Yes, you should be ok and have no ban. You will just file for the spousal visa....register your marriage there in the Philippines. You might want to have your husband consider filing the I-130 now as it is taking about 10-12 months for approval. Surely one year will be enough time back home.

You were in the US legally until the I-94 expired. Sounds like that was Dec 2, 2013. Since you did not file to adjust status everyday after that date you were here out of status. Even though you married within the 90 days that does nothing for you unless you file to adjust status. So if you stay in the US for 180 days past Dec. 2, 2013 you will have a three year ban from re-entering the US. That means if you wish to return to the US before the three year ban is finished (it starts the day you leave the US) you would need an I-601 waiver to obtain a visa.

You won't be asked to show anything. You might have a ban from re-entering depending on the exact times. If you stayed 180 days or more past the I-94 date you will have a  three year ban and will need a waiver for the spousal visa. Sounds like you will make it right under the 180 day overstay time.

     If you do choose to DNA testing make absolutely sure you absolutely do not obtain just a maternity test as this only proves you share DNA with the child which will mean nothing as you also share DNA with your sister. A maternity test WILL NOT establish that you are the mother of the child and not her sister. The lab will have to do special testing to determine the difference between sister and child.

Problem is:

Mom carries 100% DNA from parents (50% from her mom and 50% dad from her dad)

Sister can have anywhere from 0% to 100% same DNA as sister

Daughter has exactly 50% DNA from mom.

Only way to tell if it is daughter and not sister is if only 50% of the DNA matched mom, not more, not less. Even then I don't know of a lab that would 99.9% certify it as daughter not sister.

Why not test it for the unknown (fathers) DNA you ask? What about grandma and the milkman scenario?

Guys I am telling you DNA won't work in this case. That's why it wasn't requested. All DNA will show is that she is related to the child, not the relationship as far as being her child or being her sister. It takes very specific DNA test to determine sibling vs child relationships. It won't hurt anything but the pocketbook to do it but it may or may not be accepted.

Will try to find a site to explain it better but it would require testing of a lot of people and very specific testing (read very expensive) for DNA to prove the child is her biological child and not her sister or half-sister (assume grandma might of had an affair).

     Namour you took the words out of my mouth. It would be difficult for a standard DNA test to determine if the person is your sister or your daughter. The only other thing I can think of is to obtain all the court documents and recording of the court proceedings, have them translated, and submit them.

     You have no proof of the pregnancy and birth other than the word of someone. Did you give birth in a hospital or at home? If it was at the hospital can you obtain those medical records. Maybe records of a pre-natal or post-natal visit.

     I hate to say this but in a country where bribes and fraud are common the US isn't going to just take someone's word for it, they want some kind of solid proof.

   Anyways, not really sure where you are going with this. She is under deportation proceedings. You could present your proof to the prosecutor if you are worried about her winning her case.

    As to wanting an annulment you would need to speak to a family attorney. The laws and burdens of proof vary from state to state. I really doubt your angle of her still being married under Philippine law is going to amount to anything as she was divorced and free to marry under US law which is where she married. That would be like saying if I were religiously married under Muslim religious rules to my spouse but got a US divorce we would still be married in all the Muslim countries. While it may matter in those countries the US doesn't give a bean about their laws. The fraud would be the way to go but then would it really have affected your desire to marry her if you had know prior? She lied to you and you were hurt by it, understandable. But was there anything she hid from you that you can say "If I had know this I never would have married her"?

     First you have to establish paternity. This is usually done by going to the local child support office and filing some forms. They might find him and if they do he will be court ordered to have a paternity test. If it is determined he is the father there will be a hearing where he will be ordered to pay child support. At that point he could file in family court for visitation and/or custody. He is almost guaranteed to receive visitation unless you can prove he is a murderer. If he files for custody you could have a several years long court battle. In family court you either represent yourself or pay for an attorney. If he decides to fight for custody you could be looking at thousands of dollars to fight to keep your child.

   He can file for a paternity test with the child support office without your permission. Again if it is shown he is the father he could file for visitation/custody.

So you could:

  1. Leave things as they are

  2. File for child support and hope he wants nothing to do with the child

  3. Obtain child support and him receive visitation

  4. Obtain child support and spend thousands fighting him for custody.

 

Please note that some fathers decide it is cheaper to fight for and obtain custody than pay child support. If he gains custody you will pay him child support.

To better answer your question we would need to know what the source of income is. If it is employment then that has been answered. If he has significant savings he will need to prove it. If he has a trust or other source of income he will need to provide proof of it. Usually the Philippines wants to see income (from working) and will rarely accept a co-sponsor for the K-1 although with him being a student they might.
