The two of you had sex while he was married to someone else which resulted in a child being born. He was denied an immigrant visa (to the US?) once already and now you want to file for him to come to the US to marry you.  Is all this correct and if not please correct it.

The first step is to read the guide for the K-1 visa. You must have met in person within two years of filing for it. If you have further questions come back and ask after you have read the guide.

A few things to know. The time for the K-1 to be processed cannot be guessed. It might take 5 months, it might take one year. Thus the warning "Do not make any plans until you have the visa in your hand".

If you marry while the K-1 is processing you will have to start all over with the CR-1. The K-1 is for a fiancé to marry in the US, not for a spouse. The K-1 cannot be converted to another type of visa. If you marry the K-1 is not applicable to you and you will lose all the time and money invested.

You can marry anytime you want but doing so will result in the K-1 process becoming meaningless since it is for a fiancé to come marry in the US. There is no "transferring" of cases. If you marry you start all over from square one with filing a petition for a spousal visa.

Another thing to keep in mind, I kind of mentioned this earlier but I want to make sure you understand fully. The child is not entitled to US citizenship. If you somehow succeed in obtaining it he can lose his citizenship (which he was not entitled to) at any time and be deported from the US. This can happen when he is five years old or fifty years old. He is not and never will be entitled to US citizenship by virtue of being born to a US citizen (since he wasn't). Better to be honest now than to have to explain to him in the future why he is being sent back to live in a country he never really knew because mom and dad lied on his paperwork.

This could go two ways. 1. You have the birth certificate corrected which will take time and money. I believe in the Philippines since the birth father is not on the certificate the mother has sole custody and does not need permission to take the child out of the country. 2. Apply for a CRBA knowing you both will be filing false documents and hope they do not request a DNA test. If, at any point in the future, they find out you lied to obtain USC for the child all three of you could be in really big legal trouble. My recommendation is to have the birth certificate corrected.

You apply for the tourist visa just as you normally would. You are a citizen of your country and all requirements for a tourist visa for your country apply even after you obtain your green card. The only difference I have found is it is usually easier to obtain a tourist visa when you have your US green card as your chances for overstaying your tourist visa are diminished.

She will need a court order to change her first name, usually easy to obtain. Check with the circuit court office or even online. If she obtains the court order prior to filing for AOS she can send in a certified copy of the order with her paperwork and filling all the paperwork out with her new first and last name (marriage certificate is the legal name change document for last name only) she can obtain her green card in her new names.

If she obtains the legal name change after submitting the AOS paperwork she will have to file for a replacement green card and pay the fee.

Time for an attorney. Usually a conviction of possession of a small amount of marijuana is waiverable but a conviction of possession of cocaine is not. Wouldn't hurt to do a consult with an attorney. The fact that he knowingly lied to obtain ESTA and the conviction is recent will not help at all.

ok cool...so what i will do now is make copies of the forms and put them with the others...i may send extra just in case he mess up..as well as the support form and documents..i request for my 2009, 2010, 2011 tax transcript and receive those. I have my pay stubs so now i will wait for the approval letter to get the letter from my employers...

That is similar to what I did. I downloaded all the forms I could and sent them, then found she could get them online in her native language and provided the link.

I think the answer is yes, based on the form itself. Look at the affidavit here. Question #1, d or e appears to allow a lawful resident to fill out the affidavit. No guarantee of success though. Facts and circumstances tend to dictate in each case.

Actually for a k-1 visa holder you can get your social security card any time before your I-94 expires even if you are married. It does not matter what state you live in you can get it before your I-94 expires. Just not all people who work at the social security office know all the rules.


Actually, we tried to get a SSN after we were married, but before Vika's K-1 expired. If your I-94 is within two weeks of expiration, they will make you wait until your GC is approved, or until your Employment Authorization (EAD)is sent.

We used Vika's EAD, and she got a SSN, but the card said "for employment only" on it. This was a condition we had to have removed after her GC came. It works the same way if you get a SSN before you get married (and K-1 holders are entitled). You just go back and notify Social Security that you are married, and your name has changed. It may take a few extra days for them to find your married name and do all the checks.

If the USC does an intent letter in English, and the beneficiary shows up for the interview and doesn't speak English, do you think the Consular Officer will have questions as to the beneficiary's understanding of intent? In Ukraine, there would have been questions unless there was a translation matching and signed.

The I-129f instructions state that any document submitted to USCIS containing foreign language shall be accompanied by a certified translation. And you ask anything else. For what? The passport pictures are not part of the letter of intent.

Without knowing all that you sent the first time, I would say comply exactly with the instructions. It looks like you are a K-1 filer. My only other suggestion is to make an infopass appointment with a field office if you are close to one and ask what else they suggest you provide. Good Luck.

yeah thanks once again. i read somewhere i think here on VJ that, the CO determines who is likely to be burden on the US government and so in some cases they may not even look at the affidavit of support. basically the person was saying the 125% poverty line is just a guideline they may or may not use. if the beneficiary has his/her college education from the US, does it make the whole affidavit thing easier since the beneficiary is more likely to get a job while in the US easily compared to those without US education? also if the beneficiary is currently working for an American company from his/her home country remotely and is paid in US$ (makes over the 125% poverty line) into a US bank account, does this make the whole affidavit thing easy. so may questions. our situation is a bit interesting :huh:


I don't think the source of education is at all relevant to the process, but the income is. If your income is paid to you in the US, you should be filing tax returns right? If so then it sounds like you are good to go. Resident aliens and citizens paid by foreign corporations are required to file a tax return here. The other country will also require it. Which country gets the taxes (or most of them), and which gets the credit depends on the filers citizenship I think.

this trust fund thing is really killing me. technically we shouldn't have this problems, because the trust fund is a reasonable amount which can easily take care us (both of us) for a long time even if we are living lavishly or a super affluence life style. but i feel like the CO might not understand how it works and just say - go find a so-sponsor. it will be nice to find someone who has used a trust fund for his/her affidavit of support to explain what exactly he/she did and the questions that were asked during the interview.

You are right that a CO may not understand trust documents. If the trust is as healthy as you say, you shouldn't need a co-sponsor though. If you include a statement from a trustee that has a simple road map of the potential income it should get you past the CO. Just make sure it is some one the CO can contact if they want to verify.
