That said, to the OP you will need lots and lots of evidence of your relationship. I suggest when you go to visit you take lots of pictures with his family, neighbors, and friends. Keep all the receipts of things you do together. Make sure you have a way to keep chat logs/phone records to show a history of the relationship. Getting married at the first meeting could be a red flag but if you have a long history of a relationship you should be ok.

Hang in there, as you know things are in an upheaval right now. It is common for a male from a Muslim/Middle Eastern country to have AP though yours seems to be going a bit long. If it has been more than 6 months try contacting your local congressman and have them make an inquiry. NOTE: They cannot speed up the processing but they can at least make sure the file isn't just sitting somewhere forgotten. And it provides some comfort to you knowing your case is being worked on.

You are on the hook for the next 10 years or so unless she meets one of the requirements otherwise such as obtaining citizenship, losing her residency status, accumulating 40 work credits (10 years) etc. Her obtaining her 10 year green card or another term is filing for removal of conditions does not relieve you of your obligations under the I-864.

Just curious what is the current status of you and the woman?

I don't know what state you live in or what the laws there are but usually a child born of a marriage is considered the husband's child unless proven otherwise. At the least you will have to have DNA test to prove it is not yours. Again annulment laws vary from state to state so you would need to check with an attorney.

This is a huge mess and I feel very sorry for you. It would be interesting (just from curiosity) to hear what she has to say about this.

Time to consult with a family law attorney is all I can advise.

They normally do not do AP, background check version, until they believe the relationship is real. It would be a waste of money otherwise. If you are referring to AP to verify the relationship, information on the application, possible issues from past visa application, etc, this is totally different.
AP can take any amount of time they wish and no one can speed up the process. It is likely they may conduct a second interview if they have questions about something that may have shown up during the background checks such as were you in such and such a country during this time period. If the process takes more than one year (god forbid) from the time of the original interview they are required to conduct a second interview as the application for the visa is expired.

If you are in background check AP and have never been associated with terrorist, do not have outstanding warrants in any country, nor been arrested/convicted of something serious, then most likely you will obtain your visa.

To file to adjust status while inside the US would be for persons who came on the K-1 visa (fiance coming with intent and permission to marry and AOS), someone who came here without the intent to marry, found the love of their life, and couldn't bare to leave, persons with certain work visas, etc.

To turn things around a bit, what would be the point of the I-130 if anyone could just fly here and file for a green card without having to wait for the I-130 to be processed?

If you have a mind to try it, read the adjustment of status guide at the top, I still recommend you just wait it out and do it the right way.

Can you say immigration fraud? Entering on the VWP or a visitor's visa with the intent to immigrate is fraud punishable by anything from no action to a life-time ban from the US. Since you have already filed the I-130 and have shown immigrant intent you might have problems even being permitted to enter the US. If you do you might be pulled into secondary inspection and questioned about your intent. If you answer that you are just visiting and then you file to adjust status, that is a material misrepresentation. If you tell the truth, that you came to get married and stay, you will be on the next flight back home.

Best to just wait a few more months and finish the process the right way.

You can marry her in Mexico, ask in the Mexico forum for the procedures, and file a petition for a CR-1. Or you can file now a petition for a K-1 and marry if she obtains the visa and after she arrives in the US. The advantage to the CR-1 is she will receive the green card shortly after arrival and thus can start work. She should also receive a stamp in her passport that works as a temporary green card so she could leave the country as soon as the passport is stamped. With the K-1 you would have to file for AOS to obtain her green card after you marry in the US and she would have to wait about three months after filing to obtain paperwork allowing her to re-enter the US if she leaves.
The I-864 is a contract between you and the US government that if she receives any means-tested benefits the government can sue the sponsor to regain the money. This contract is valid until she works 40 quarters, obtains US citizenship, or loses her green card or dies.
As to any other financial responsibilities that would be decided by a Court during the divorce proceedings.

The guide for the CR-1 visa posted at the top of this site under guides takes you step by step through the process and tells you everything you need. You wife HAS to have a passport when she goes for her interview otherwise there is nothing to put the visa in. She has to have the medical prior to being issued the visa, this is a legal requirement, she must have the interview, you must make above the poverty guidelines or have a co-sponsor (accepted in Manila for married applicants but not usually fiances).
Please begin by reading the guide on this site which contains links to the forms you need. When you have a specific question someone will be happy to help you but no one will do the process for you without pay (unless you are very lucky). If you are still not sure what to do after reading the guide, hire an attorney to complete the process for you.

One thing to be prepared for is they may require DNA testing to prove the child is yours prior to issuing the US CRBA, If the child is issued a US passport, for the purposes of your relative/co-sponsor the child will not be counted as an immigrant since it is a US citizen.

If the petition is approved and you pass the interview you will be issued a visa to enter the US. The baby would be a USC so it would be eligible for benefits, although not a great way to start a new life and marriage. Gramps needs to read the contract (never sign anything without reading it) and understand that if she receives any means tested benefits they could come after you first and him if they can't get the money from you. Even if things do not work out and you divorce it does not negate the contract.

Pregnancy is not a reason for an expedite. You can get on a plane at any time and return to the US to give birth. There are social programs to provide insurance for pregnant women who can't afford health care. Are you aware the US has one of the highest rates of infant mortality of any of the developed nations?
While some males from T countries are lucky to have a short AP, it is very likely your spouse will have to endure this. Expedites will not speed up the AP process.
While I hope things work out for you I suggest you begin looking at the process not being completed prior to giving birth.

Or even worse at the POE they pulled my record and made some very snide comments about it in front of my fiance. He was aware of my history but sometimes it sounds worse than it is (terrorist threatening for saying I was going to hit someone). You should be ok.

You need to remember that the petitioner is required to show continuing income sufficient to meet the guidelines.
