You need to do a Freedom of Information Act request on your file to find out exactly why you were denied. Unless there were indications at the interview as to what the problem was we would just be shooting in the dark trying to advice you. Filing a motion to reopen would be useless without knowing why it was denied. How would you argue there was a mistake made if you don't know what they based the decision on?

Re-filing the I-130 won't do any good until you know why it was denied or at least until you gather a LOT more evidence of your relationship. If nothing has changed why should the consular officer change his decision?

I would suggest a consult with an immigration attorney to get some direction on what to do.

     You are putting the cart way before the horse. Before you even think about the interview he needs to file the I-130 and associated documents and evidence (see the guides above). He needs to establish a domicile in the US. You have to show proof he is living or intends to live in the US prior to the interview time. In his case since he has not lived there in a very long time a copy of a lease, a home mortgage, or a letter from friends/family saying the two of you will be living there will be a start. He needs to open a US bank account and probably get a US driver's license.

     It will take about one year after filing the I-130 before you go for the interview so don't worry about that part too much yet. Better to worry about getting prepared for the interview and everything you will need for it.

Domicile and income or an additional sponsor. That is why he most likely will have to move to the US and file for you later.

 

There is a lot of proof required to show he intends to live in the US. A good start would be seeing if he could live with his cousin while he establishes himself. Your husband will need a US address he is living at and other proof such as a driver's license, voter registration, bank accounts in the US, etc. to prove he intends to live there. He will also have to provide proof he makes at least 125% of the poverty level for his household size. If it is just two of you that would be around $20,000 per year (it must be US income) or that he has assets of about $60.000.  His cousin can be a joint sponsor for him if the cousin meets the 125% poverty level for his household size plus you.

He will probably need to travel to the US to obtain a residence and employment. He will need to prove you have a place to live in the US and the income to support you when you arrive. Read the requirements for a spousal visa and see what he will need to do. Highly unlikely you will travel together unless he has good friends or some relatives living in the US already.

When she passes through customs they will stamp her visa. It will become a temporary green card....good for one year...that will serve until the real green card comes in the mail. It works just like a green card. Her visa will not be good as soon as she comes as a visa is only for entering the US, it will be converted, via the stamp, to a temporary green card.

Will you be physically with your wife at any time during or after the marriage? Immigration law is very clear that you must be legally married and have consummated the marriage. This means you must have had sex with the person after the marriage took place. If you marry but are not physically with the person after the marriage you are not considered married in the eyes of US immigration and cannot apply for a spousal visa.

You dying won't help him get a visa. You returning to the US, establishing a domicile, and obtainig the needed sponsor for the affidavit of support will help him get the visa. Either you aren't as sick as you say or you don't care about yourself or your spouse.

When did you file the I-130 and what papers have you received in regards to the I-130?

     You need to stop worrying about your spouse's visa and start worrying about your health. Waiting for him to get a visa to the US could have very bad consequences for you. You don't need your spouse, there are hospices and social workers who can arrange for the assistance you need while undergoing treatment.

     Since you are more worried about getting your spouse a visa than you are about your health I have a few questions.

  • Do you have proof of a domicile in the US or proof of an intent to establish a domicile in the US?
  • Do you have the financial means to meet the requirements of the affidavit of support or do you have a US citizen or LPR living in the US who meets the requirements and will co-sponsor?

     Without these things your expedite is the least of your worries.

If he is in Algeria waiting for a visa to come to the US you should have followed the guide for the I-130. No I-485 was needed since that is to adjust status if he is inside the US. You need to wait about six months or so for the I-130 to be processed then it will be sent to NVC. At that point you will provide your income information.

Please, please read the guides as to what to do and what is next.

If you read the instructions for the I-130 you will find a lot of things are required other than just the one form. Following the VJ guides will allow you to prepare and plan ahead for all steps in the process. Remember procedures and fees do change so check the USCIS site prior to sending anything off to make sure you have the most up-to-date forms and fees information.

Currently spouse visas are taking about 15 months.

I've seen posted here before that the NVC updates the automated information on Tuesday and Saturday. I'm not sure if that is acurate or not. Even when my information was updated it did not report the correct information. If you feel that the information is wrong or you do not receive an update within 10-14 business days call by all means. They will help you the best they can with the information they have. I was told by a NVS rep that the best times to call are between 10:00a.m. -11:30a.m., 6:00p.m. - 6:45p.m., and late evening. My experiances with the reps at the NVC have been very good.

work with congressman in your area. Write him/her a letter explaining your situation & frustation. You can find your congressman via www.house.gov via your zip code. It's really worth a shot. Good luck


From what I understand USCIS will not consider your case outside of processing unless...
For example...they are processing 9/11/07 and and your case date is 8/10/07.

I'm pretty sure it's option A. I worked with my Congressmans office for 2 1/2 months before I finally made it out of there.

Hello All,

I just got off the phone with another really nice rep at the NVC. She told me that our letters where done today, the case should leave for the embassy tomorrow, and my husbands interview date is Oct. 22nd. London is moving right along!! kicking.gif kicking.gif

I kept telling myself to wait until tomorrow to call because that would be a week from the approval & I'm glad that I didn't!! I also verified that they had my husbands new address since he moved about 6 weeks ago. The update was sent via email just as instructed. They still had the old address on file. blink.gif Since I called tonight and they just did the letters today she took the new address to update the the letter. If you've sent in an address change...lesson learned here...call them and verify that they have it. wacko.gif

I AM SO EXCITED!! I want to call my husband so bad but it is 2:15am there. I'll just have to hold it in until he calls to wake me in the morning. whistling.gif

My husbands experiance:

To ease the minds of those following... Finding Knightsbridge Doctors was pretty easy. I pre-booked my train through Raileasy (and saved a fortune!) and rode into Euston. Out of Euston, I turned right onto Euston Rd for Knightsbridge and literally just followed the main road. I had used AA Routefinder to gauge the distance to the Docs from Euston and it had stated 0.3 miles, which I figured was walkable in just a few minutes. Just the same, I wanted to find it first and THEN relax and enjoy a coffee! It's a good job I did...I walked for probably 35 minutes but found it quite easily. As I said, right out of the station and follow the main road until you spot some construction on the opposite side of the road. Cross over and go up Marylebone High St and just keep walking. Eventually, this merges into Thayer St. Bentinck St is just there on the left, you can't miss it. The docs is on the right, hiding in some flats behind a brown varnished door. You'll have to use the Door Buzzer thingy to get buzzed in. The main thing I found on this journey was that I walked quite a distance down Euston Rd, when all of the maps i've seen don't make it look that far!! Oh, and the Docs close for lunch between 1 and 2, but Coffee Republic does a mean Caramel Cappuchino! Into the Docs and the first thing they wanted was my passport, the completed medical questionnaire, my vaccination records, and one regular UK passport size picture (the sites say the US visa type, but this was not the case). I then took a seat (very comfy leather type) and waited for maybe 20 minutes while they processed my paperwork. I got my passport back and had to fill in another questionnaire almost identical to the one I had just given them. The only question I could find that seemed different was something along the lines of "Have you ever caused a death?". Fortunately, this is my year off from killing so I added "no" and then signed the HIV test disclaimer and handed it all back. Almost as soon as I sat down, I was called through for a painless and very quick chest X-ray. Then back to the waiting room. A couple of minutes later and I was in another room going through my vaccination history. Despite my best efforts and the advice of my own GP, I still needed to get an MMR shot, so I took it like a man and returned, with a free cotton ball, to the waiting room. Finally, I was called by a Doc into an examination room. She asked a few questions about my medical history that I had already written onto two questionnaires, then got me to remove my shoes and socks. I warned her about the walk from Euston but she insisted, so I took them off for a weigh in and measurement session. Then she showed me to a couch and asked me to get undressed and lie down. I wasn't THAT tired from the walk, but I did as I was told and she returned to check my ears, nose and throat and then prodded about to check my chest, stomach and 'manparts'. Then she stole some blood from me, took my blood pressure and then asked me to get dressed again. Once dressed, I had an eye test (I wear glasses for distance and she checked and got me to put them on). Finally, we sat and went through the paperwork, counter signed everything, and that was it. I left the room, and was directed to the desk to pay the fee for the exam and the MMR. The girl there said that the results would be sent to the Consulate in a few days and basically "no news is good news"...they would only call if there was a problem. An hour and a half from start to finish. And that was it. All in all, apart from the fee, fairly painless. Every single person in the place was helpful and friendly and I left feeling pretty good about the whole experience. All that was left was a phone call to my Wife, a leisurely walk back to the Station, and a pint in the Station Bar. Mr Branson's trains were running perfectly and I was home in time for tea. No complaints and, unless you're a mass murderer who can't lie, definitely nothing to worry about! Best fo Luck to all!
