If you are showing in the system you application was received. His failure to receive the NOA-1 (receipt) has no affect on your processing. Just sit back and wait....this is a long process with lots of waiting. Seems K-1s are moving fairly fast but it has only been two months since he filed. Give it another two or three months before you begin to worry.

DO NOT file another application. This will just confuse the system.

You have several choices.

1. Ignore the RFE and have your petition denied in about 87 days.

2. Respond to the RFE without the proper information and have your petition denied in about 87 days.

3. Withdraw the petition and start over.

(87 days is based upon the standard time given to respond to and RFE, it may be different in this specific case)

 

As you can see, the only way to have the petition approved is by filing a new one. Now if you wish to waste another two or three months before re-filing that is your choice.

     The rules for residency are different when you are US military or a US government contractor working overseas. This is considered as still being on US soil. If she has her green card before she goes to be with you everything will be good for certain.

     What I don't know about is if she would have to wait stateside for her AP before she goes to be with you. Maybe she could stay with friends/relatives until she has her finger prints taken and her AP in hand.

     I am confused by what you mean by a bond. The term as used here is being defined as he will pay a small amount of money to someone or a company and that someone or company will guarantee him for a set amount of money. Like what they do in some states to get out of jail. I have never heard of this being done for the K-1 and the affidavits of support must be by a person, not a company.

     The other use of bond would be a government or municipal type of bond where you purchase the item and it pays yearly interest. This would be an asset which could be used as it could be cashed in if needed. Assets must be at 3X the poverty level requirement.

If you look at the lines prior to line 22 you see it will include your pension/annuity income but it will exclude your business deductions. When you have a business your gross income is not your taxable income. You are permitted to deduct all kinds of things like bad debt, cost of products for resell, depreciation, and all sorts of things. It is not uncommon for a business to have a negative adjusted income for tax purposes.

Proof of time spent together, phone calls, online chats, meetings with the family helps. I believe, without looking at the form, there are two spots to list children. One states to list all children and one states to list children who will accompany or follow-to-join. Read the instructions carefully. You have to list the children, even his, where it says to list all children. Also you need to be clear which process you are following. Are you a fiancé or a spouse. It is different forms and procedures depending on if you are married or just engaged.

How did you cancel the K-1 if it was never filed. Do you mean you just told the USC to not file it and no paperwork was ever submitted?

You do still have in the system, and it will always been in the system, that a spousal visa petition was filed for you.

You can certainly apply for a visitor's visa but you will need strong, strong proof of ties to your home country and you will most likely be asked to explain about the abandoned spousal petition.

Sounds like the CO was right and you are only concerned with coming to the US. Chances of a tourist visa are very low even with ties to your country. The returned spouse petition, divorce, and a cancelled fiancé petition with the ex-husband all sounds like immigration fraud.

Sounds like the CR-1 was denied for lack of proof of a real marriage. It also sounds like the decision was appealed and the denial was confirmed. Then the USC spouse divorced her. Now they want to apply for a K-1. I don't see much hope for success. This looks too much like marriage for immigration purposes.

 

If you wish to pursue this matter you are going to need a lot of evidence of a real relationship.

So you are both divorced. He can file the petition anytime he wants provided the two of you have met face-to-face in the past two years. Approval will be slim to none unless you address the issue(s) as to why the CR-1 was denied. They do have that information on file and it will be consulted in reference to any new petition.

If he has a divorce then you are divorced from him also. So you are not currently married. He will need to provide the divorce papers with the application for the K-1.

You will really need to address why the original CR-1 was denied. If you don't know why have your spouse (I assume this is the US citizen) file a Freedom of Information Act request to find out why it was denied. That issue(s) could be addressed in the new filing. Filing again after a denial, especially since you divorced, will raise a bunch of red flags and you need to be prepared to address them.

     Has your fiancé sent you the I-134? You will need this for the interview. Does he meet the poverty requirements on the I-134, in other words does he have an income of at least $19,662?

     You are aware you cannot work when you arrive in the US? You have to file for AOS and the application for the employment authorization (EAD) is free when filed with or after the AOS filing. So you are looking at several months of you being in the US not working.

     Per the K-1 you and your fiancé agreed to marry within 90 days of his arrival. If you don't he will be out of status. You can have a small wedding, we did the courthouse thing, and later have the big ceremony but you must marry within 90 days of his arrival. If you don't he is out of status and subject to deportation. Also if you marry after the 90 days you have to do a concurrent filing of the I-130/I-485.

     You should try to file for AOS prior to the I-94 expiring, 90 days after arrival, as this will give him status to remain in the US while the paperwork is processing. The cost for AOS is $1070 last time I checked and the application for the work permit (EAD) and advance parole (AP) so he can leave the US and return are free with the AOS filing.

      You may or may not have an interview is you comply with the K-1 requirements, marry in 90 days and file AOS. His green card will be good for two years. Then, 90 days prior to the expiration of the green card you file to remove conditions. You will pay more money and send lots of proof of your on-going relationship. You may or may not have an interview. If approved he receives his 10 year green card.

     After he has been an LPR for 3 years, provided the two of you are still married, he can apply for US citizenship.

You won't file any petition for the children if you are eligible to pass on US citizenship to them. Check the requirements for CRBA and if you meet them file for the CRBA and US passports.

In your situation it would be best to get married and file for the CR-1

They usually do not accept joint sponsors for the K-1, this is why I recommended you marry and file for the CR-1.

If you have assets that are 3X (about $120.000) the poverty level for your household size (4) you can try to use assets but my understanding is this particular embassy does not like to use assets, rather they prefer income.

A Philippine income tax return means nothing. You need three years worth of US tax returns.

His income can only be used if he can prove it will continue from the same source after he immigrates.

Sex does not matter. You are the petitioner, you will be responsible for him not becoming a public charge.

Marriage by proxy won't work and will only complicate things. The will be married but not in the eyes of immigration. For a marriage by proxy to be recognized for US immigration purposes the marriage must have been consummated. They can't do that if they haven't met. Meaning they will be legally married, so they can't do the K-1, but not married for immigration purposes, so they can't do the CR-1.
