I think it will depend upon the reason for the overstay. Although it is generally true that the 179 days won't result in a ban, if the overstay was caused by, for example, a stay in the klink because of some criminal activity, there is a problem with any kind of visa going forward. The overstay is not the reason for the problem, just the event that allowed state to find it.

The insurance subsidies would not be a means-tested benefit just as receiving the EIC or child tax credit on your taxes don't count against you. This is going to be a big mess as it stands right now as the employers are not required to provide the insurance for another year, which means they won't pay the fines for not providing it, which means some of the money to fund the program won't be available, which means.....wow. For those of you in Kentucky there is a website KYNECT...won't be up and running until October, but it might have more information then.  For me to buy private insurance with a $5,000 deductable will be about $250 a month.

You are not here legally.

Does he really want to take a chance of doing that to his current fiance? Does he love her so little that he is willing to risk her future? It does happen, she could even become a citizen and be stripped of her citizenship if they discover the fraud. That is what it would be.....fraud.

As milli said filing a writ of mandamus can backfire as it only forces them to make a decision, not one guaranteed to be in your favor. The government will not admit someone to the country if there is a question as to their being a "terrorist". You speak of bad PR for taking so long to process visas but think of the bad PR is they admit someone who comes here and kills thousands of people.

I wouldn't think it is a violation. Immigration is not a right. She has no right to bring another person to the US, plenty of people have been denied spousal visas which had nothing to do with disabilities. She has the right to find a co-sponsor. She has the right to move to another country.

Or to flip the issue, I, as a taxpayer, have the right to demand a person not be permitted to immigrate if they are going to require my tax dollars to support themselves. The intending immigrant has a right to a life where the basic necessities such as food, water, and housing are provided.

If she doesn't meet the poverty requirements how will the spouse survive. He will not be eligible for any means-tested benefits such as food stamps, federal subsidized housing, free medical care, etc. How will the spouse eat, where will he live?

There are a lot of people's rights to consider here but remember, immigration is not a right.

From reading your prior post i would advise the following There is no way to speed up the process, no way to force it through, you have to wait. The best you can do is be prepared for each step and make no mistakes.

1. Read the guides at the top of the page for filing the I-130.

2. Repeat #1

3. Gather all the required information.

4. Make a checklist and make sure you have all the information required.

5. Reapeat #1 then #4

6. Mail the petition

7. Wait some months then proceed with the NVC step

8. Give birth (more or less in this time)

9. Have spouse attend visa interview.

10 Spouse arrives in US.

The problem is you left the US after the marriage. Now if you return on the VWP with the intent to immigrate (which is fraud) you may be denied entry to the US or you may have problems explaining how you "suddently and without intent" decided to remain in the US with your wife after you quit your job, sold your home, have all your belongings with you, etc. Think about it...how are you going to answer the question "How long do you intend to visit?" If you lie you risk a lifetime ban for misrepresentation. If you tell the truth they won't let you in. Even if you make it past the gates don't you think it will be a little suspicious when you file to remain?

Your wife needs to file a petition for the CR-1. This is the legal and proper way to do it.

Your plan to immigrate to the US on the VWP is the problem. You cannot enter the US on the VWP or a tourist visa when you have the intent to immigrate. If you could why would there be spousal visas? Your wife needs to file a petition for the CR-1 and you wait in the UK until it is approved and you have your visa.

Yes, I believe the UK allows a person to self-sponsor.

How are you going to prove you had no intent to immigrate when you just posted it on a board read by immigration?

Just to calm some fears, although I can't speak for the embassy people, when I am confronted with someone who is hearing impared I find paper and pen work well. I have been in the customer service industry all my life and have never found anyone insulted or unwilling to use written communication with someone who cannot speak/hear well. Even in communicating with my father-in-law, who speaks not a word of English, we are able to convey general information by gestures.

The process is time consuming. The best advise is to read the guides and read them again. Gather everything and have it ready before it is asked for.

Best thing to do is plan for a K-1 or a CR-1 since chances of a tourist visa are very small. I direct you to the Tourist Visa subforum for stories of people who were denied. Travel to Morocco, spend some quality time with him, gets lots of evidence, either marry and file the CR-1 or file the K-1. Morocco is a very difficult consulate and you will need LOTS of evidence of a relationship and time spent together to obtain an immigrant visa from there.

He can apply for the tourist visa and if denied the only thing lost is the application fee and the time for the interview. It will not affect the filing of a K-1 or CR-1. Even if he is approved you need to be fluid in your plans as he might not get six months when he enters the US. He probably will not get an extension of a tourist visa. The entire visa process requires you to be able to adjust plans due to unforseen problems.

Best bet, given where he is from, is to visit each other several times. That could be in his country, the US, or anywhere else. You are going to need lots of proof of a relationship for him to pass this embassy.

Have you tried to military immigration hotline to see if your deployment would qualify you for an expediate?

Even being married you are going to need a lot of proof of relationship. There have been many married couples who were denied at this embassy. Gather anything and everything you can. Very unlikely he will obtain a tourist visa for the purpose of getting married even if he intends to leave after the marriage. Look at the country he is from, this is difficulty even for low-fraud countries. If he is approved it is very unlikely the visa will be extended. There is no guarantee of him being granted a six-month visit when he enters, that will be decided at the point of entry. That being said, very, very little chance of the visa being extended since this is usually only for real emergencies like death or immeninet death of a close family member.

You can apply for the CR-1 as soon as you have the marriage certificate. it doesn't matter if he is in the US or another country. There is no "advance parole" for a CR-1. When he leaves, he leaves. If he has a multi-entry tourist visa he can come back using that, no guarantee he will be permitted in, but remember he must spend more time outside the US than inside.

The entire process from filing to visa in hand takes about a year. With him being from Morocco plan on administrative processing which will make the time longer.

Depending on where you are deployed to you might be able to get an expediate. Doesn't hurt to try.

Of course you know he can't enter the military until he has his green card which would be upon his entry to the US with his CR-1 visa.
